My aim in this paper is to explore the appeal of contemporary television serial drama. I argue that there are four main aspects of serials that inspire viewers’ interest and long-term commitment: serials’ overall aesthetics, its narrative complexity, strong emotional pull and serious mimetic aspect. I analyse each of these and I show how each stimulates our more general interests and emotional dispositions, primarily those related to aesthetic reward, intellectual challenge, moral clarity and entertainment. My analysis shows how these four (...) elements unite and how their union inspires and maintains viewers’ long-term commitment to the show. In the process, I explore viewers’ emotional engagement with the characters, suggesting it is of secondary importance for their long-term commitment to the show. This commitment, I argue, is motivated by viewers’ sense of care for the work developed in response to its repeated providing of pleasurable stimuli. (shrink)

The second Yearbook of the Central East European Forum of Young Legal, Political and Social Theorists aims at reassessing some major legacies of jurisprudence and political philosophy, thereby celebrating one hundred years from the publication of the first important theoretical account of Hans Kelsen - Hauptprobleme der Staatsrechtslehre; the fifty-years anniversary of one of the most important contemporary books in legal theory - Herbert Hart's The Concept of Law; as well as the forty-years heritage of the most influential 20th century (...) account of justice - John Rawls's A Theory of Justice. On this occasion fourteen scholars from Eastern and Central Europe gave their accounts and interpretations of jurisprudential and political philosophical problems that persist or emerge anew in contemporary debates. My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art's impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art's impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

This article lies at the intersection of two problems: the one concerning the potential of fictional works to inform us about our social reality and foster our understanding of its various aspects, and the one concerning their potential to engage with philosophical issues. I bring these two together by analyzing the hit television series Law and Order: Special Victims Unit. According to my interpretation, the series is informative about our social world, and it raises philosophical concerns about it. This makes (...) it well-equipped to fulfill the educative function attributed to mass art by Noël Carroll, and to stand out as an example of what he calls popular philosophy. To support this interpretation, I rely on contemporary views regarding the nature of our engagements with fictional narratives. I then explore how philosophical concerns are generated and I elaborate on the role they have in deepening one’s understanding of one’s social circumstances. I further show how the series provides innovative and independent philosophical knowledge by means specific to the medium of generic serialized fiction. The central part of my argument is an analysis of the narrative strategies which enable the informative and philosophical aspects of the series to generate the series’ educative function. (shrink)

In order to show the validity of here proposed conception of social ontology and its advantages over descriptive theories of social reality, which in the analysis of the socio-ontological status of human rights find only legally understood normativity as present in social reality, we will first lay out Searle’s interpretation of human rights. In the second step, we will introduce the methodical approach and basic concepts of our socio-ontological position, and explain the structure of the relationship between justice, law, morality, (...) social institutions and collective intentionality. At the end we will show how our theory of social ontology is better than Searle’s legal positivism in examining the ontological status of human rights. At the end, we show in what ways such a theory of social ontology more intuitively and with wider arguments explains the ontological status of institution of human rights than Searle’s legal positivism. Die vorliegende Arbeit berücksichtigt die Philosophie und Poetik der Geschichte und der Sprache a priori im poetischen und literarischen Werk von Peter Handke, in seinem poetologischen Essay Ich bin ein Bewohner des Elfenbeinturms und seinem Drama Die Fahrt im Einbaum oder das Stück zum Film vom Krieg, und zwar im Ausgang von der kantianischen Idee der Apriorität der Geschichte. Die Geschichte a priori ist, laut Kant, möglich, „wenn der Wahrsager die Begebenheiten selber macht und veranstaltet, die er zum voraus verkündigt“. (...) Die identische Idee vom Subjekt, das vor der Geschichte besteht, finden wir auch im poetischen Werk von Peter Handke, sowohl in seinen poetologischen Schriften, als auch in seinem dichterischen Werk. Das Ziel der Arbeit ist, durch eine immanente, phänomenologisch-hermeneutische Deutung der Werke des Philosophen und des Schriftstellers die unumstrittene enge Beziehung zwischen ihren geschichtsphilosophischen, bzw. – poetologischen Ideen aufzuweisen und einen allgemeinen philosophisch-dichterischen Rahmen für die Erklärung aller Geschichtsphilosophien ohne Ausnahmen zu geben. In this paper I follow Ted Nannicelli in the project of establishing boundaries of television works. I focus on serialized television works pertaining to a particular genre and I set out to provide an account of their identity. My claim is that external identity of such works is determined by their specific genre-affiliation, given the way in which generic norms determine the content of the series, namely, its characteristic storylines and regular set of characters. From the internal perspective, a series’ (...) identity is determined by the particular way in which it implements abstract generic norms. I describe the process of such implementation as creation of series-specific formulaic patterns, and I analyze different layers of works where such patterns are evident. My central claim is that series-specific formulaic patterns create a coherent set of norms which, through repeated instantiation in the series’ episodes, become associated with that particular series. The function of this set is to establish the series’ boundaries, and to maintain its identity when different modifications to the patterns are made. (shrink)

Sulla base di una straordinaria analisi dei problemi deontologici riconducibili alla crisi della professione medica, Ivan Cavicchi e un gruppo di lavoro multidisciplinare – promosso e organizzato dall’Ordine dei Medici Chirurghi e Odontoiatri della Provincia Autonoma di Trento, in collaborazione con il programma FBK per la salute della Fondazione Bruno Kessler e il gruppo di Biodiritto del l’Università di Trento – hanno rielaborato le basi concettuali della tradizionale deontologia medica per mettere in condizione gli Ordini dei Medici di riformare (...) il proprio codice deontologico. Si tratta di una vera e propria «rivoluzione» destinata a modificare nei prossimi anni la deontologia nel nostro Paese, a influenzare la redazione dei futuri codici di tutte le professioni medico-sanitarie, ma soprattutto a cambiare radicalmente i rapporti tra medici e cittadini, tra professione e società, tra medicina ed economia. Assumendo il malato come «archè», la proposta di rielaborazione cambia postulati, presupposti, linguaggi, concetti, soluzioni e obiettivi, affrontando problematiche usualmente ignorate dalla deontologia convenzionale. Lo scopo di fondo è definire una nuova figura di medico capace di recuperare il rapporto fiduciario con i malati e con la società e di farsi carico dei problemi di sostenibilità economica che ormai da anni gravano su tutti i sistemi di tutela sanitaria. We tend to associate Henry David Thoreau with the renunciation of material possessions, projecting onto him our fantasies of a life lived beyond the modern obsession with "things." But Thoreau's practical philosophy held a special place for tools, artworks, Native American artifacts, and a variety of natural phenomena. In Mindprints, Ivan Gaskell focuses on the material items that were important to Thoreau, using them to reveal Thoreau's unique and profound aesthetics of everyday life and the environment. "Mindprint" was Thoreau's (...) term for a material object that has captured the presence of its maker and first user. Thoreau applied the term to ancient stone artifacts and other objects in an effort to capture something of the relationship between material items and humans. For Thoreau, these relationships contribute to the creation of "worlds." By looking at Thoreau's engagement with material worlds through his writings and his practical philosophical experiment at Walden Pond--but also, importantly, via his work as a designer of improved pencils, as a house builder, as a land surveyor, and as a collector--Gaskell reveals the aesthetics at the heart of Thoreau's thinking. In this article, I defend the cognitive value of certain generic television series. Unlike media and television scholars, who have been appreciative of the informative capacity of television fiction, philosophers have been less willing to acknowledge the way in which these works contribute to our understanding of our social reality. My aim here is to provide one such account, grounded in aesthetic cognitivism, that is, the view that fiction is a source of knowledge. Focusing on crime and courtroom dramas, I (...) start by offering some examples of the cognitive benefits available in some of these series and I argue that the more beneficial cases establish superior mimetic relations with reality, enhancing their capacity to present ethically challenging issues. I then examine whether the fictional dimension of these works presents an obstacle to their informative potential and I conclude that it does not. A central aspect of my account is the claim that the degree of cognitive benefit depends on the underlying narrative strategy of the series. Specifically, there are clues in any given show, including the treatment of ongoing characters, which signal the extent to which it can be taken as mimetically reliable and thus, cognitively valuable. I complete my account by addressing anti-cognitivists’ arguments which call to doubt the informative aspect of television series and their capacity to address ethical concerns. (shrink)

We contrast two positions concerning the initial domain of actions that infants interpret as goal-directed. The 'narrow scope' view holds that goal-attribution in 6- and 9-month-olds is restricted to highly familiar actions (such as grasping) (). The cue-based approach of the infant's 'teleological stance' (), however, predicts that if the cues of equifinal variation of action and a salient action effect are present, young infants can attribute goals to a 'wide scope' of entities including unfamiliar human actions and actions of (...) novel objects lacking human features. It is argued that previous failures to show goal-attribution to unfamiliar actions were due to the absence of these cues. We report a modified replication of showing that when a salient action-effect is presented, even young infants can attribute a goal to an unfamiliar manual action. This study together with other recent experiments reviewed support the 'wide scope' approach indicating that if the cues of goal-directedness are present even 6-month-olds attribute goals to unfamiliar actions. Humeanism about laws has been famously accused of the explanatory circularity by David Armstrong and Tim Maudlin, since the Humean laws hold in virtue of their instances and, at the same time, scientifically explain those very instances. Barry Loewer argued that the circularity challenge rests on an equivocation: in his view, once the metaphysical explanation is properly distinguished from the scientific explanation, the circularity vanishes. However, Marc Lange restored the circularity by appealing to his transitivity principle, which connects the two (...) types of explanation. Lange’s transitivity principle has been widely discussed and criticised in the literature. In view of counterexamples, Lange refi ned both the principle, by taking into account the contrastive nature of explanation, and the requirement of prohibition on self-explanation. Recently, Michael Hicks has developed a new strategy for defending Humeanism about laws from the refined circularity challenge, critically appealing to the contrastive nature of both explanations and meta-explanations. In this paper, I address the question of engaged philosophy with an emphasis on aesthetics and the philosophy of art. Referring to some specific problems discussed in these areas – in particular climate change, ecological crisis and immoral art – I demonstrate that philosophy can be engaged in two ways: (i) in its aspiration to question social reality, culture, human experience and the strategies for making sense of and finding value in that experience; (ii) in the aspiration to contribute to (...) the well-being of individuals and society through its contribution to understanding that reality and experience. First, I point to the connection between the philosophical questions and the fundamental intellectual aspirations of human beings as social and cultural beings, but also as autonomous knowers and valuers. Second, I respond to two objections that can be directed against engaged philosophy: (i) one that points to a lack of consensus among philosophical responses (the problem of disagreement), and (ii) one that highlights the irrelevance of philosophical debates to our social practice. With his thesis on the genius who does not know from where their ideas come from and how they create, Kant left an indelible mark on thought concerning art and artistic creation. He insisted that it represents a unique act by natural gift, and thus specific for the domain of art, and specifically not belonging to the domain of science. Although today we know that such a disposition is wrong, many of Kant’s claims are supported in contemporary theories in cognitive (...) science, but also by the artistic practice. In this paper, I will analyse Kant’s theory of beautiful art and artistic creation in the context of contemporary research on creativity and talent and show how much is Kant’s theory on beautiful art and artistic creation rich explanatory, especially for understanding and thinking the artistic creation, artistic reception and artistic practice. This book argues that Nietzsche's Thus Spoke Zarathustra employs circular and cyclical (diurnal and seasonal) symbols to communicate both the life-affirmative and the cosmological aspect of "recurrence" as a unifying idea. It shows that twelve day cycles, which run throughout the book's narrative, and the one full annual cycle, which encompasses the circular and the diurnal images in a continuous cycle of life affirmation, track Zarathustra's ever-changing identity throughout the text. In representing the eternal recurrence, the circular and the cyclical (...) symbols respectively convey the book's central message: Zarathustra comes into being in order to affirm existence as the teacher of eternal recurrence in an endlessly repeating cosmos. The study complements recent findings that Nietzsche's book is on eternal recurrence by establishing the unity among its language, structure, and fundamental conception, which solves the century-old problem of the communication or location of the doctrine within the text. The book is designed for the specialised audience of Nietzsche studies. It would also appeal to both students and professors in various disciplines across humanities and social sciences, as well as to anyone interested in understanding the basic tenets of Thus Spoke Zarathustra. I discuss the role of beauty in physics. Physicists are sometimes described as platonists for their conviction that the fundamental laws are elegant and aesthetic arguments represent an important epistemic tool. After a review of the ideas of Plato and some of the leading figures of modern physics, which suggest that this is indeed the case, I present a list of current aesthetic criteria. I focus on symmetry and unity and demonstrate their increasing relevance in an array of experimentally verified (...) theories. I also deal with an open issue of naturalness as the third criterion. The laws of nature appear increasingly beautiful as we uncover them, and it is important to see if the trend continues in the future. (shrink)

When we talk about creation, we use the progressive and verbs of creation as in ‘Mary is building a house’. The modal account of the progressive says that a sentence such as ‘Mary is building a house’ is true just in case Mary eventually builds a house in all worlds in which her house-building proceeds normally. Recently, the modal account has come under fire from those who claim that it over-generates modal entailments and those who think the progressive should be (...) treated as a predicate of events. By properly situating the modal account within a contemporary semantic framework for natural language modals, I argue that it gives the best semantic treatment of the progressive. (shrink)
