Subsequently we will identify the proponents’ incoherencies between the considered judgments and norms and values they are committed to and conclude that as long as these incoherencies are in place, forced caesareans are morally impermissible. Spatial developments contribute to climate change through greenhouse gas emissions and disordered land use. At the same time, climate change impacts have spatial implications, influencing the land uses and settlements development, and damaging habitats, ecosystems, infrastructure and other assets. Considering its regulatory character and multi-sectorial approach, spatial planning is gaining an increasingly important role in climate change management. As such, it could be better utilized in increasing climate resiliency and achieving decarbonization targets in Kosovo as well. While Kosovo is prone (...) to natural hazards such as floods, landslides, droughts, and wildfires, the future climate change could further impact the economy, infrastructure, buildings, energy, health and wellbeing of its communities. Assuming that climate change considerations are not sufficiently integrated in spatial planning policies at the national level in Kosovo, this research assesses the extent that the Law on Spatial Planning and the Spatial Plan of Kosovo (also referred as the Spatial Planning Strategy) address those considerations. Upon the identified gaps, this research provides recommendations for better climate change management, risk reduction and resiliency building. Considering that the Spatial Plan of Kosovo has expired, and the Kosovo’s institutions are currently reviewing and considering the updating of the Law on Spatial Planning, the findings of this research could better inform and orient climate change mainstreaming in spatial planning at the central level. Understanding attitudes towards the environment is important because they often determine behaviour that either increases or decreases environmental quality. In this article we investigate the environmental worldview of the young people from Kosovo. The New Revised Environmental Paradigm Scale or New Ecological Paradigm Scale, known as NEP Scale (Dunlap et al., 2000) was used. The study involved 330 young people age 18-20. 150 young people are from secondary schools, and other (180) are from some different faculties at the State University (...) in Mitrovica. The mean score for the full NEP scale in this study was 3.48, which indicates a low endorsement of the NEP among the sample of Kosovo young people. The averages of the sub-dimensions varied between 3.08 (“Limits to growth”) and 3.73 (“Eco-crisis”). Like as others non-industrialized societies, young people from Kosovo tend to believe in the profound connection between humanity and nature, or there are no clear differences between pro-NEP and pro-DSP views. This study confirms the thesis that environmental worldviews differ across cultures. The mean value of the NEP Scale can be feasibly associated with various variables concerning general environmental attitudes. In order to discover the factors that create a pro-ecological orientation of young people in this country, additional researches are needed. (shrink)

Poor pregnancy outcomes and inequalities in these outcomes remain a major challenge, even in prosperous societies that have high-quality health care and public health policy in place. In this article, we propose that justice demands the improvement of what we call the ‘health agency’ of parents-to-be as part of a response to these poor outcomes. We take health agency to have three aspects: the capacity to form health-goals one has reason to value, the control one perceives to have over achieving (...) those health-goals and the freedom one has to achieve those health-goals. We will moreover argue that this demand of justice can be best based on a perfectionist rather than neutralist method of justification. Subsequently, we will argue that perfectionist policy may be paternalistic but not wrongfully paternalistic. This leads us to conclude that perfectionism should be adopted to inform and justify public health policy that is aimed at improving health agency in general and counteracting poor pregnancy outcomes and inequalities in perinatal health outcomes in particular. There is an increasing interest in the possibility of using nudges to promote people's health. Following the advances in developmental biology and epigenetics, it is clear that one's health is not always the result of one's own choices. In the period surrounding pregnancy, maternal choice behaviour has a significant influence on perinatal morbidity and mortality as well as the development of chronic diseases later in life. One's health is thus a matter of one's own as well as one's maternal choices. (...) Therefore, self-regarding and other-regarding nudges should be considered as viable strategies to promote health. In this article, we introduce the concept of other-regarding nudges. We use the harm principle and the principle of beneficence to justify these other-regarding nudges. We conclude by stressing the importance of a fair assessment of expectations towards the nudgee, when determining whether a nudge is aimed at preventing harm or promoting a good. (shrink)

Formulating sound and acceptable embryo research policy remains challenging especially in a pluralistic world. This challenge has acquired a new dimension of complexity with the advent of so-called embryo models, which are derived from stem cells. In this article, we present a normative strategy to facilitate the process of sound policy-making in the field of human embryology. This strategy involves seeking neutral agreements on higher level theories and doctrines as well as seeking agreements on the level of concrete policy proposals. (...) By going high and low, the plurality of reasonable moral and epistemic convictions of stakeholders involved in the domain of human embryology is respected while the process of policy-making in this area is improved. This article examines the ethical validity of using viability as the cutoff point for abortion in the Netherlands, in view of potential changes to the Dutch perinatal care guideline. According to the Dutch Penal Code, abortion is permitted until viability: the point at which a fetus can survive outside the womb with technological assistance. Since the law was enacted in 1984, viability has been set at 24 weeks gestational age. Currently, in the Netherlands, the treatment limit for extreme prematurity is (...) also set at 24 weeks. The potential revision of the guideline could lower this threshold. Such a change could have implications for abortion in the Netherlands. We critically evaluate the use of viability within the Dutch context and offer recommendations for modifying the legal framework concerning abortion. We conclude that relying on any interpretation of viability is morally problematic for abortion regulation, as it is too indeterminate a concept to establish a threshold in a morally relevant way. Many governments in the world have created e-government initiatives including developed and developing countries. In order to better understand e-government evolution, different maturity models have been developed by many authors. In this paper the most cited e-government maturity models are analyzed using the meta-synthesis approach. As a result, five stages of e-government maturity are identified. The comparative results show the supported stages by each e-government initiative as important elements in the decision making process. This paper is attempting to show that (...) although there are many models for measuring e-government maturity, they all converge on one common model. The contribution of this paper is in simplifying work for researchers when choosing the right maturity model. (shrink)

Muhammad al-Shahrastani, the famous Muslim theologian of the 12th century and author of the Book of Religious and Philosophical Sects, was greatly influenced by Ismaili teachings. In this work al-Shahrastani refutes the metaphysics of Ibn Sina (Avicenna) from an Ismaili point of view.

The Ismāilī/Bātinī movement was criticized by early Ahl al-Sunnah kalam schools on different matters, one of which is the angel belief that is also related to other principles of faith. However, the issue of angels was not a direct subject of criticism; instead, it was mostly discussed in connection with related matters such as prophethood and the afterlife. On that note, the Ismāilī/Bātinī teaching, due to their views on prophethood and the afterlife, was accused of denying angels by some Ash‘arī (...) mutakallims. While Hanafī-Māturīdī kalam scholars found faults with the same points, they did not make such an accusation. Moreover, pointing out as the source of the opinions above to philosophers increased the merit of these criticisms. In the present study, after alluding to the claims and the accusations of the parties concerned, the matter of angels will be discussed in relation to prophethood and the afterlife from the viewpoint of the Ismāilī/Bātinī teaching. While doing so, their own works will be consulted. Subsequently, the criticisms of Ahl al-Sunnah will be compared with the views of the Ismāilī/Bātinī doctrine concerning the issue of angels. Also, the significance and value of different viewpoints put forward by the related schools of thought will be presented in terms of the consequences of those views. (shrink)

The Ismaili is one of the sub-sects of Shiite sect which in addition to being involved in some specific events in the history of different regions in the world of Islam from India to Iran and North Africa has been able to form governments. The record of Ismaili’s presence in Azerbaijan goes back to the third century A.H and the ruling period of Mosafer and Sajian in the fourth century A.H that continued to Seljuqs and Ilkhanids periods. Upon (...) Mongol attacks the center of Immamat moved to Azerbaijan, during 8 and 9th century A.H and this coincided with the Nezari Ismaili’s internal evaluations in Iran. The level of Ismaili sect’s presence in and its contribution to Azerbaijan between 4th and 10th century A.H is assessed here through a descriptive-analytic method and library studies. (shrink)

The exact sectarian affiliation of Shahrastānī has long been a matter of serious debate. Was he possibly an adherent of the Ismaili cause? Considerable recent scholarship purports to establish a connection. The evidence consists of some off-handed remarks by his own contemporaries; what he himself has to say about the Ismailis in his Kitāb al-Milal wa-l-niḥal; and finally, a set of doctrines or analytical categories he uses in his later writings that were later adopted by Nizari Ismailis. However, an (...) impartial look at the evidence does not support the claim that Shahrastānī was himself in any significant way an Ismaili. (shrink)

The early period Ismaili jurist Al-Qādî al-Nu'mān appears as an important figure in the formation of Ismaili jurisprudence. There is very little information about Kadı Nu'mân's family, childhood, education and intellectual environment. His full name is Abû Hanîfah Nu'man b. Muhammad b. Mansûr al-Qādî at-Tamîmî Al Qayrawānî. He was born around 290/903 (late 3rd (9th) century) into an educated family in Qayravan in North Africa. There are different opinions about the sect he belonged to when he was growing (...) up. On the other hand, it is difficult to say for certain whether Nu’mān received education in the Ismaili sect due to the understanding of taqiyya in the madhhab. However, it is understood from the basic jurisprudence texts Nu’mān wrote that he most likely did not receive a Sunni education. Historians refer to him as 'Qadi Nu’mān or Abu Hanifah al-Shi'i' in order not to confuse him with the imam of the Hanafi school. Qādî Nu’mān served at different levels of the Fatimid State. Around 313/925, he entered the service of the first Fatimid caliph, Mahdi (r. 909-934 CE/297-322 AH), as a copyist and secretary. During the reigns of the third caliph Mansur and the fourth Fatimid caliph Mu’izz (d. 365/975), Qādî Nu’mān first served as a judge in Tripoli and then in Mansouriya, the Fatimid capital. After the Fatimids conquered Egypt and the center of government was moved to Cairo, Qādî Nu’mān was appointed by the fourth caliph Mu’izz as the head of the appellate courts (maẓālim). Qadi Numans career was at the peak in the period of Caliph Muiz. Qādî Nu’mān worked as a judge in the Fatimid State for about twenty-six years and continued this duty until his death in 363 (973). After the fall of the Fatimid caliphate, there haven’t been any other Fatimid or Ismaili jurists. Qādî Nu’mān is considered by contemporary Ismaili writers as a figure who systematically transformed Ismaili fiqh into an independent sect of fiqh. It can be said that Ismaili fiqh was developed through his works in the Fatimid period. His works continued as the main references in the fiqh studies and after the Fatimid period. With the death of Qādî Nu’mān, the period of ijtihad in Ismaili fiqh and its the establishment phase of Ismaili fiqh came to an end; The sect, in which esoteric interpretations were at the forefront, emerged as a distinctive school of fiqh by discarding ambiguity. Qādî Nu’mān was a very productive writer. He wrote important works related to the field of furu al-fiqh and usûl al-fiqh. Among his works, Ikhtilāf uṣūl al-madhāhib is undoubtedly one of the most important works in the early history of fiqh methodology. The work in question, which was originally written with the aim of rejecting the Sunni fiqh method, discusses the approaches of the Sunni schools of fiqh on ikhtilāf, taqlid, ijma, nazar, qiyas, istihsan, ijtihad and ra’y in a polemical manner. It reveals the differences of the Ismaili method from the Sunni method in terms of the sources on which the fiqh is based, the authority to make ijtihad and the theory of interpretation of the texts. Qādî Nu’mān examined the relationship between reason and revelation in general and the role of religious authority in comprehending and interpreting the texts while criticizing Sunni methods. Ikhtilāf uṣūl al-madhāhib has the characteristics of the works of development period as a form. It is possible to observe the question-answer and dialectic form which can be seen in the works of the development period throughout the work in question. Qādî Nu’mān endeavoured to persuade his opponents with a dialectical and argumentative style. Again, he replied to the Sunnis, who were his interlocutors, with their own proofs. In addition to these, Ikhtilāf uṣūl al-madhāhib has a unique feature in the matter of content. Because it is not very familiar to any Sunni handbook of usûl al-fiqh. It does not mention the hâss, âmm, ijma, qiyas, amir, nahy, alfaz bets, etc. The text is very similar to the Ahbari movement of the Jafari sect for it rejects all forms of ijtihad. It was written at a time when fiqh was not yet stable. Ikhtilāf uṣūl al-madhāhib gives us crucial information about the development of different usûl and fiqh sources in the middle of the fourth century. However, what is interesting here is that the information he gives about Ismaili method and fiqh is very little compared to the one about Sunni method and fiqh. Much of it centered on Sunni thought and its rejection. However, his ultimate goal was to defend the Ismaili doctrine. (shrink)

This book traces the interactions between Ismaili intellectual thought and the philosophies of other Islamic groups to shed light on the complex and interwoven nature of Islamic civilisation.Based (...) on a broad range of primary sources from the early medieval to the late nineteenth century, the book brings together different disciplines within Islamic Studies to cover polemical and doctrinal literature, law, mysticism, rituals and philosophy. The main Ismaili groups, such as the Fatimids, Nizaris and Tayyibis, are represented, as well as lesser known traditions such as that associated with the mountain region of Badakhshan in Central Asia. Religious syncretism, particularly in the Indian subcontinent and in Yemen, is considered alongside cultural interactions as reflected in the circulation of books in Fatimid markets, and various literary and mythical traditions, some still little explored. The Persian philosopher Ibn Sina (d. 1037), known in Europe as Avicenna, was arguably the greatest master of Aristotelian thought in the Muslim world. The symbolical 'Poem on the Soul' (Qasidat al-nafs), which portrays all earthly human souls as in temporary exile from heaven, is traditionally attributed to Avicenna, and was received with enthusiasm by its commentators. A highly significant commentary on the Qasida was written by?Ali b. Muhammad b. al-Walid (d. 1215 CE), a major early representative of the Tayyibi (...) Ismaili tradition, which emerged and flourished in medieval Yemen. In his view, the poem encapsulated Tayyibi beliefs, whose doctrines bear striking parallels with late antique Gnosticism. Avicenna's Allegory on the Soul presents the first edition of the Arabic text of Ibn al-Walid's commentary, 'The Useful Epistle' (al-Risala al-mufida), alongside an English translation and extended introduction. It offers invaluable insight into the intricacies of Muslim thought and a deeper understanding of Avicenna's substantial intellectual legacy. (shrink)

Medieval Islamic philosophers were occupied with questions of cosmology, predestination and salvation and human responsibility for actions. For Ismailis, the related notions of religious leadership, namely the imamate, and the eschatological role of the prophets and imams were equally central. These were also a matter of doctrinal controversy within the so-called Iranian school of Ismaili philosophical theology. Hamid al-Din al-Kirmani (d. after 411/1020) was one of the most important theologians in the Fatimid period, who rose to prominence during the (...) reign of the imam-caliph al-Hakim bi-Amr Allah (r. 386/996–411/1021). He is renowned for blending the Neoplatonic philosophical heritage with Ismaili religious tradition. This book provides an analysis of al-Kirmani’s thought and sheds new light on the many layers of allusion which characterise his writings. Through a translation and analytical commentary of the eighth chapter of al-Kirmani’s Kitab al-Riyad (Book of Meadows), which is devoted to the subject of divine preordination and human redemption, Maria De Cillis shows readers first-hand his theologically distinctive interpretation of qada’ and qadar (divine decree and destiny). Here, al-Kirmani attempts to harmonise the views of earlier renowned Ismaili missionaries, Abu Hatim Ahmad b. Hamdan al-Razi (d. 322/934), Muhammad b. Ahmad al-Nasafi (d. 331/942) and Abu Ya'qub Ishaq b. Ahmad al-Sijistani (d. c. 361/971). De Cillis skilfully guides the reader through al-Kirmani’s metaphysical and esoteric correspondences, offering new insights into Shi’i/Ismaili philosophical thought which will be of great interest to those in the field of Shi’i studies and, more broadly, to scholars of medieval philosophy. The main purpose of this article is to discuss what the Ismāilīs, unlike other Muslims, say about the fall of Adam to earth or the reason why man is on earth. In this study in close relation to the subject the hierarchy of existence and the concepts of hadd/hudûd and tawhid that emerge in this context are principally emphasized, for in Ismāilism the emergence of worlds and all kinds of existence occur according to a certain hierarchy. This hierarchy is also (...) seen as the criterion for determining the divine limits to be obeyed. In this context, a crucial term of hadd or hudûd in its plural form refers to the degrees of all beings, ordered from simple to complex, in their divine station. Parallel to this teaching, the fault Adam committed in eternity is regarded as a kind of crossing the line, for he did not show the required devotion to those who are superior to him. In this context, another important concept dealt with in the article in connection with the subject is tawhid, the Oneness of God, for it should not be forgotten that the Prime Intellect invites the entire Realm of Creation to accept the Oneness of the Creator. The most important rule of responding to this invitation is that creatures in both worlds are to recognize and obey those who are superior to them in order to wake to the principle of tawhid and thus attain perfection. It is emphasized in the article that two forms of explanation, one of which can be considered representative and the other philosophical, come to the fore in Ismāilī classical sources on the subject of Adam's fall to earth. In representative narratives the reason for Adam's being on earth is explained as regaining the position he lost due to the fault he committed in the eternal world. This fault was committed by the spiritual Adam, who represents the whole humanity, not the physical one, and actually symbolizes the defectiveness of Nafs (psyche). The story of Adam's exit from Paradise, which takes place in the Qur’ān, is also interpreted in accordance with this narrative, whereas in more compatible explanations with the philosophy of Neoplatonism, the development of Nafs (psyche) is at the core. Nafs is incomplete because it emerges into the realm of existence after the Intellect. Due to this, the reason orlde creation of the material orld is to make Nafs better with knowledge and wisdom and to ensure its ultimate development. In this case, Nafs realizes itself through Adam, who is its supreme representative on earth. The reason why cosmos initially starts its movement is basically this imperfection of Nafs. Hereby, in both elucidations in the article, it is stated that the emphasis is on the faultiness of nafs. In other words, Nafs or Adam, its earthly form, experiences a loss of station and falls into timely existence due to a deficiency caused by distance from God. For this reason, in order for Nafs to mature or for Adam to regain his original station, the material world must exist and a seven-stage process must be experienced. (shrink)

Su temática es muy variada e incluye cuestiones como el amor divino, la cosmología, la meditación, la práctica ritual, la escatología y el comportamiento ético. La palabra ‘ginān’ deriva en última instancia de la raíz sánscrita ‘ŷñāna’ y está relacionada etimológicamente con la palabra griega ‘γνῶσις’, o ‘gnôsis’, que tiene derivados en muchas lenguas. Varios estudiosos han señalado el doble significado del término ‘ginān’ entre los ismailíes, ya (...) que se refiere tanto a su literatura sagrada como a la gnosis. Este estudio exhaustivo explora el significado y el uso de la palabra ‘ginān’ en la propia tradición ginān. In this work the Persian and English texts are edited and published together for the first time. This is Tusi’s major Ismaili work and the most important primary source on Ismaili doctrines during the Alamut period.

Al-Ghazali is arguably one of the most influential thinkers in the history of Islam, and his writings have received greater scholarly attention in the West than those of any other Muslim scholar. This study explores an important dimension of his thought that has not yet been fully examined, namely, his polemical engagement with the Ismailis of the Fatimid and early Alamut periods. Published in association with The Institute of Ismaili Studies.

The writings of al-Ghazālī give the distinct impression that he was highly concerned with the threat the Ismailis and their doctrines posed. By his own admission, he wrote six separate treatises to refute and condemn them, most importantly his Faḍāʾiḥ al-bāṭiniyya, which he composed in the year 488h in the months prior to his renunciation of government service and departure from Baghdad. His attack focused on the doctrine known as taʿlīm, with its insistence on the unrivaled absolute authority of a (...) single infallible Imam. He had in mind the Alamut teaching by Ḥasan-i Ṣabbāḥ of a doctrine then widely advocated in the Abbasid–Seljuk East. Significantly, there is no sign of this term used in this manner in the western Fatimid domains either earlier or later. However, our knowledge of events in the career of Ḥasan and of his teachings come from much later sources and are in part legendary at best. Although the doctrine of taʿlīm was certainly implicit in Ismaili works long before, in this particular work al-Ghazālī directed his attentions squarely against a new teaching he encountered personally in his own time and place. But we know it otherwise primarily from accounts recorded much later, in particular al-Shahrastānī’s al-Milal wa-l-niḥal. (shrink)
