This paper explores the proposals of Giorgio Agamben and Roberto Esposito, two of the top representatives of the Italian Thought, around the notion of community and commons. Starting from an analysis of the community based on the munus, the statute of the commons is examined as opposed to the right of property. Next, the discussion around the notion of use of the commons and its difficult reconciliation with the legal apparatus is presented. Finally, the notion of inappropriateness that underpins the (...) This article presents the relationship between the notions of equality and freedom assumed by Castoriadis as necessary conditions for social autonomy project. The chiasmatic figure that Castoriadis establishes between equality and freedom will be approached with the aim of clarifying whether both notions should be addressed jointly or, on the contrary, they can be considered separately for an autonomy project as well. Once exposed the difficulties that appear in the representation that establishes a correspondence between both terms, attention will be (...) directed to the need of the figure of law as a legal element to guarantee the privileges that are granted to the members of the community in the Autonomy project that is equal participation. To conclude, the article will be directed to a silence in the work of Castoriadis; who can be considered a subject in the autonomy project, that is, who should participate in the formation of the new institutions. El artículo se propone examinar las condiciones por las que los derechos humanos no son respetados en su totalidad para todos los seres humanos. En concreto, estudia la relación entre ser sujeto de justicia y la posesión del estatus de ciudadanía y, por otro lado, la relación entre privación de derechos y ausencia de ciudadanía. En este sentido, se exploran algunos de los discursos que han permitido la cesura entre el hombre como sujeto político y el hombre como sustrato biológico. (...) The presence of women in possession cults has frequently been noted. Thus women are usually the priviliged religious participants in Haitian Voo-doo and in the African Bori Hausa. Even allowing for the distinction of whether the role of religious chief is held by a male or a female, it seems women are in the majority in the cases representing almost the totality of those cultists who fall into a trance. In this article we propose to compare the position of women (...) within two possession cults in Brazil. One, Candomblé is of African origin; the other, Umbanda, is a synthesis of African religions, Catholicism, and the spiritism of Allan Kardec. We shall attempt in each case to associate the religious position of women with the social position they exercise in each society. (shrink)

The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

El sistema penitenciario de Ecuador enfrenta una crisis estructural de proporciones preocupantes. Esta investigación se centra en analizar las diversas causas que han precipitado esta situación, con el objetivo de determinar la responsabilidad del Estado ecuatoriano en esta crisis. Se examina específicamente si el Estado cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad tras el cumplimiento de sus penas. Se evidencia una ausencia significativa de programas efectivos de reinserción para las Personas Privadas de (...) Libertad (PPL), lo que directamente contribuye a la crisis carcelaria actúa. El propósito de este estudio es analizar críticamente la situación del sistema penitenciario ecuatoriano, identificando las deficiencias en los programas de rehabilitación y reinserción social ofrecidos a las PPL. Se busca determinar si el Estado es el principal responsable de la crisis carcelaria mediante el análisis de diversas fuentes bibliográficas y la evaluación de su cumplimiento de las obligaciones legales y humanitarias hacia este grupo vulnerable. Se llevó a cabo una investigación cualitativa, donde se analizaron diversas fuentes bibliográficas especializadas para abordar el problema del sistema penitenciario en Ecuador. Se examinaron informes gubernamentales, estudios académicos y documentos legales pertinentes para comprender a fondo las causas subyacentes de la crisis carcelaria. Esta metodología permitió una evaluación exhaustiva de las deficiencias institucionales y la falta de programas de rehabilitación adecuados para las PPL en el país. Los resultados de la investigación revelan una serie de factores que contribuyen a la crisis carcelaria en Ecuador. Entre ellos se destacan el hacinamiento, la sobrepoblación, el debilitamiento institucional, el tráfico de drogas y armas, entre otros. Se evidencia que el Estado no cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad, lo que agrava la situación y hace más miserable la vida de las PPL dentro de los centros de reclusión. Este estudio confirma que el Estado ecuatoriano es el principal responsable de la crisis carcelaria existente en el país. La falta de programas efectivos de rehabilitación y reinserción social para las PPL, junto con otras deficiencias institucionales, ha exacerbado la situación. Es imperativo que el Estado tome medidas urgentes y efectivas para abordar estas deficiencias y garantizar el respeto de los derechos humanos y la dignidad de las personas privadas de libertad en Ecuador. Plato and the Metaphysical Feminine offers a new interpretation of the role of the female and the feminine in Plato's political dialogues--the Republic, Laws, and Timaeus--informed by Deleuze's film theory and Irigaray's psychoanalytic feminism. Irene Han reads Plato against the grain in order to close the gap between the vitalists and Plato, instead of magnifying their differences. Han explores the ambivalence that the vitalist tradition, Irigaray, and Derrida have towards Platonism. The application of Deleuzian and Irigarayan concepts to the (...) ancient texts produces a new reading of Plato, focusing on the centrality and importance of motion, change, sensuality, and becoming to Platonic philosophy and, thereby, reinterprets Platonic philosophy in the direction of Heraclitus rather than Parmenides: as feminist rather than masculinist, and as mimetic. It therefore prioritizes Heraclitean principles of movement and flux over Form, the feminine over masculine, and materiality, feeling, or sensation over abstraction and universal essence. Han's exploration illustrates how, in Plato's thought, the feminine maps itself onto the plane of phenomena--a plane associated with vitalist themes such as motion, tactility, and change (metabolē). Platonic metaphysics is recontextualized by illustrating how Being expresses itself through processes of (feminine) becoming. With this reformulation, the resulting account of Platonic Being destabilizes any purported Platonic dualism. (shrink)

Tienen razón Francisco Lara y Olga Campos en afirmar en la introducción de su libro que “un mérito importante de este libro es que, de manera muy divulgativa, pretende dar respuestas filosóficas al debate sobre nuestra relación con los animales al aplicar ideas bási- cas a cuestiones prácticas como si debemos ser o no vegetarianos, si hay que experimentar con animales o hasta qué punto son justifica- bles las corridas de toros” (p. 15). Y efectivamente, de una manera muy clara, (...) el libro no sólo pretende, sino que en efecto da respuestas a cuestiones centrales sobre nuestra relación con los animales, en particular a la cuestión acerca de cuál es su estatus o su valor moral y, por ende, sobre si tenemos obligaciones morales hacia ellos. Su tesis es que los animales sí tienen un estatus moral independiente de los intereses humanos, que tienen derechos y que es nuestra obligación moral respetarlos. For a few decades now, debates around the effects of 'new public measures' in education have pointed to how the emphasis on increased accountability and high stakes testing has led to some worrying phenomena, thus changing teachers' practices and roles. These include narrowing of the curriculum, gaming and teaching to the test. This chapter discusses these kinds of knowledge and abilities as fundamentally depending on our understanding of the role of teachers within an educational system and in relation to educational (...) aims. The particular standpoint from which it tackles these issues revolves around asking whether the notion of autonomy is significant to teachers' roles and activities, and hence bears on our conception of teaching expertise. The chapter argues that the notion of autonomy is problematic: it conflates rather different psychological, phenomenological and normative elements. The discussion in the chapter culminates in an analysis of current policy arrangements in England. (shrink)

El súbito consenso que se ha producido en nuestros días alrededor de la importancia de la noción democracia no se ha acompañado de una reflexión filosófica sobre su sentido moderno. La obra filosófica de Claude Lefort ha contribuido a llenar este vacío teórico. Para Lefort, el sentido de la democracia moderna no puede revelarse, como ha supuesto la ciencia política, a través de la descripción del funcionamiento de sus instituciones, sino puede estudiarse mediante la exploración de su dimensión simbólica. En (...) efecto, la fundación y el destino de la democracia son inseparables de la indeterminación de sus fundamentos y de la infigurabilidad del poder, de la ley y del saber. Origen y destino que bien pueden ser rastreados a la luz del contraste entre la sociedad democrática y la sociedad totalitaria. El presente ensayo se ocupa de contrastar la dimensión simbólica de ambas formas de sociedad. According to Lefort, the sense of modern democracy cannot be disclosed, as political science has assumed, just by describing the operation of its institutions. Rather, it may be studied by exploring its symbolic dimension. In fact, democracy’s origin and fate are inseparable from the indeterminacy of its foundation and the non-figurable nature of power, law and knowledge. Such an origin and fate may indeed be tracked in light of the contrast between the democratic society and the totalitarian one. En este trabajo realizamos una revisión historiográfica sobre la fabricación de anatomías artificiales que fueron ampliamente demandadas como herramientas didácticas en la enseñanza de la naturaleza, entre finales del siglo XVIII y principios del XX. Se analizan los contextos educativos y sociales que favorecieron la amplia difusión de este tipo de artefactos en el comercio de la cultura científica, y se describen las técnicas de manufactura. Se concluye que estos artefactos, fruto del ingenio humano, son fuentes materiales de extraordinario valor (...) para comprender la construcción y evolución de la ciencia, los avances en los recursos pedagógicos y las innovaciones tecnológicas. By putting existential phenomenology into conversation with virtue ethics, this book offers a new interpretation of human flourishing. It rejects characterizations of flourishing as either a private subjective state or an objective worldly status, arguing that flourishing is rather a successfully negotiated self-world fit – a condition involving both the essential dependence of the self upon the world and others, and the lived normative responsiveness of the agent striving to be in the world well. A central argument of the book (...) is that there is an irreducible normative plurality arising from the different practical perspectives we can adopt – the first, second, and third-person stances – all of which make different kinds of normative claim that we understand ourselves as having reason to meet. Flourishing is human excellence within each of these normative domains achieved in such a way that success in one domain does not compromise success in another. Existential Flourishing provides a correspondingly transformed interpretation of the virtues as solutions to various existential problems we face in responding to these normative domains. The book also addresses traditional problems in virtue ethics and analyzes the structure of four virtues in detail: justice, patience, modesty, and courage. (shrink)

Bernard Rollin argues that it is permissible to change an animal's telos through genetic engineering, if it doesn't harm the animal's welfare. Recent attempts to undermine his argument rely either on the claim that diminishing certain capacities always harms an animal's welfare or on the claim that it always violates an animal's integrity. I argue that these fail. However, respect for animal dignity provides a defeasible reason not to engineer an animal in a way that inhibits the development of those (...) functions that a member of its species can normally perform, even if the modification would improve the animal's welfare. For different reasons, Husserl's original, thought-provoking ideas on the philosophy of logic and mathematics have been ignored, misunderstood, even despised, by analytic philosophers and phenomenologists alike, who have been content to barricade themselves behind walls of ideological prejudices. Yet, for several decades, Husserl was almost continuously in close professional and personal contact with those who created, reshaped and revolutionized 20th century philosophy of mathematics, logic, science and language in both the analytic and phenomenological schools, people whom those other makers of (...) 20th century philosophy, Russell, Frege, Wittgenstein and their followers, rarely, if ever, met. Independently of them, Husserl offered alternatives to the well-trodden paths of logicism, nominalism, formalism and intuitionism. He presented a well-articulated, thoroughly argued case for logic as an objective science, but was not philosophically naive to the point of not seeing the role of subjectivity in shaping the sense of the reality facing objective science. Given the preeminent role that philosophy of logic and philosophy of mathematics have played in transforming the way philosophy has been done since Husserl's time, and given the depth of his insights and his obvious expertise in those fields, his ideas need to be integrated into present-day, mainstream philosophy. Here, philosopher Claire Ortiz Hill and mathematician-philosopher Jairo da Silva offer a wealth of interesting insights intended to subvert the many mistaken idees recues about the development of Husserl's thought and reestablish broken ties between it and philosophy now. Se presenta la reflexión sobre el papel de una ética crítica que acompañe los procesos de innovación tecnológica, a partir de los aportes de la filosofía de la tecnología, específicamente las propuestas de Floridi y Verbeek. Se análizará el caso de digitalización de servicios de gobierno, en la ciudad de Medellín, Colombia, centrado en el comportamiento de los usuarios de la plataforma Movilidad en Línea. La tesis principal que se esboza es que con los procesos de digitalización se pretende eliminar (...) la intermediación entre el ciudadano y el acceso al Estado Plataforma. Sin embargo, encontramos que las mediaciones persisten y transitan hacia mediaciones tecnológicas. Esta constatación y la demostración de la agencialidad y moralidad de los artefactos tecnológicos fundamenta la propuesta de una ética critica que acompañe de manera participativa la innovación y transición digital. Recent attempts to explain why modesty should be considered a virtue have failed. A more adequate account is that modesty involves understanding how far one's accomplishments ought to be taken as definitive of one's value. Modest people communicate this self-understanding through behaviour motivated by the desire to ensure that their accomplishments do not cause pain to others. This virtuous mode of self-awareness involves recognizing that one is both defined by social standards of success and irreducible to these assessments. Modest agents (...) do not think themselves ‘better’ than others, but recognize that they rank higher on the particular social standard in question. They thus both avoid causing pain and serve as exemplars of virtuous self-responsibility. (shrink)

The main objective of this study is to identify the socioemotional competencies of adolescents in secondary education who are currently in the first grade of secondary school (school year 2022-2023), which contribute to a better interaction with their peers and environment, in addition to preventing possible risk behaviors. It will be approached from a quantitative approach, with a descriptive scope. The sample consists of 19 students from a private institution, located in the municipality of Guadalupe, Zac. A questionnaire called emociogram (...) was applied through the Habilmind platform, to identify the main characteristics regarding the emotional scale, which in turn is composed of five subscales such as: empathy, assertiveness, interpersonal emotional regulation, teamwork and conflict resolution. The results show us some areas of opportunity that should be emphasized in order to improve the results and thus improve the socioemotional competencies of adolescents. (shrink)
