Los principales patógenos víricos que podemos ad­quirir ingiriendo alimentos contaminados son los norovirus, el virus de la hepatitis A y el virus de la hepatitis E que se propagan principalmente a través de la vía fecal oral. En los últimos años, la incidencia de brotes de transmisión alimentaria causados por estos patógenos ha experimentado un aumento considerable, en parte debido al comercio globalizado y a los cambios en los hábitos de consumo. Las matrices alimentarias que mayor riesgo representan para el (...) consumidor son los moluscos bivalvos, ve­getales de IV gama, frutas tipo baya y platos listos para comer. Actualmente las técnicas moleculares son las más habituales para la detección de estos patógenos en alimentos, aunque toda­vía existen dudas acerca del significado de la presencia de estos genomas víricos en términos de seguridad alimentaria. La infec­tividad de estos patógenos en alimentos viene también determi­nada por su elevada persistencia ambiental y por su resistencia a los tratamientos aplicados para la conservación de los alimentos. The four theistic proofs of Monologion are based on the categories of being per se and being per aliud. This article analyses them through a comparative approach. The categories of per se and per aliud are compared with the categories of substance (ti) and function (yong) as touched on the first chapter of the Rectifying Ignorance (正蒙 Zhengmeng) of Zhang Zai (1020–1077), an exponent of neo-Confucianism. In fact, the two pairs of categories explain the relationship between an absolute, the supreme (...) nature (summum) or the Great Void (太虚 taixu) and the sensible world. Through the comparison, this article highlights the fundamental function of being per aliud in the rational knowledge of the supreme nature that exists per se and provides new insights into the process of derivation of being per aliud from the being per se.Contribution: This article, through the comparison with the Chinese philosophical tradition, intends to offer a new perspective on the understanding of the Anselmian categories of being per se and being per aliud. ​Authors, Factions, and Courts in Angevin England: A Literature of Personal Ambition (12th-13th Century) advances a model for historical study of courtly literature by foregrounding the personal aims, networks, and careers as the impetus for much of the period’s literature. The book takes two authors as case studies – Gerald of Wales and Walter Map – to show how authors not only built their own stories but also used popular narratives and the tools of propaganda to achieve their own, personal (...) goals. The purpose of this study is to overturn the top-down model of political patronage, in which patrons – and particularly royal patrons – set the cultural agenda and dictate literary tastes. Rather, Fabrizio De Falco argues that authors were often representative of many different interests expressed by local groups. To pursue those interests, they targeted specific political factions in the changeable political scenario of Angevin England. Their texts reveal a polycentric view of cultural production and its reception. The study aims to model a heuristic process which is applicable to other courtly texts besides the chosen case-studies. The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

El sistema penitenciario de Ecuador enfrenta una crisis estructural de proporciones preocupantes. Esta investigación se centra en analizar las diversas causas que han precipitado esta situación, con el objetivo de determinar la responsabilidad del Estado ecuatoriano en esta crisis. Se examina específicamente si el Estado cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad tras el cumplimiento de sus penas. Se evidencia una ausencia significativa de programas efectivos de reinserción para las Personas Privadas de (...) Libertad (PPL), lo que directamente contribuye a la crisis carcelaria actúa. El propósito de este estudio es analizar críticamente la situación del sistema penitenciario ecuatoriano, identificando las deficiencias en los programas de rehabilitación y reinserción social ofrecidos a las PPL. Se busca determinar si el Estado es el principal responsable de la crisis carcelaria mediante el análisis de diversas fuentes bibliográficas y la evaluación de su cumplimiento de las obligaciones legales y humanitarias hacia este grupo vulnerable. Se llevó a cabo una investigación cualitativa, donde se analizaron diversas fuentes bibliográficas especializadas para abordar el problema del sistema penitenciario en Ecuador. Se examinaron informes gubernamentales, estudios académicos y documentos legales pertinentes para comprender a fondo las causas subyacentes de la crisis carcelaria. Esta metodología permitió una evaluación exhaustiva de las deficiencias institucionales y la falta de programas de rehabilitación adecuados para las PPL en el país. Los resultados de la investigación revelan una serie de factores que contribuyen a la crisis carcelaria en Ecuador. Entre ellos se destacan el hacinamiento, la sobrepoblación, el debilitamiento institucional, el tráfico de drogas y armas, entre otros. Se evidencia que el Estado no cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad, lo que agrava la situación y hace más miserable la vida de las PPL dentro de los centros de reclusión. Este estudio confirma que el Estado ecuatoriano es el principal responsable de la crisis carcelaria existente en el país. La falta de programas efectivos de rehabilitación y reinserción social para las PPL, junto con otras deficiencias institucionales, ha exacerbado la situación. Es imperativo que el Estado tome medidas urgentes y efectivas para abordar estas deficiencias y garantizar el respeto de los derechos humanos y la dignidad de las personas privadas de libertad en Ecuador. Plato and the Metaphysical Feminine offers a new interpretation of the role of the female and the feminine in Plato's political dialogues--the Republic, Laws, and Timaeus--informed by Deleuze's film theory and Irigaray's psychoanalytic feminism. Irene Han reads Plato against the grain in order to close the gap between the vitalists and Plato, instead of magnifying their differences. Han explores the ambivalence that the vitalist tradition, Irigaray, and Derrida have towards Platonism. The application of Deleuzian and Irigarayan concepts to the (...) ancient texts produces a new reading of Plato, focusing on the centrality and importance of motion, change, sensuality, and becoming to Platonic philosophy and, thereby, reinterprets Platonic philosophy in the direction of Heraclitus rather than Parmenides: as feminist rather than masculinist, and as mimetic. It therefore prioritizes Heraclitean principles of movement and flux over Form, the feminine over masculine, and materiality, feeling, or sensation over abstraction and universal essence. Han's exploration illustrates how, in Plato's thought, the feminine maps itself onto the plane of phenomena--a plane associated with vitalist themes such as motion, tactility, and change (metabolē). Platonic metaphysics is recontextualized by illustrating how Being expresses itself through processes of (feminine) becoming. With this reformulation, the resulting account of Platonic Being destabilizes any purported Platonic dualism. (shrink)

For a few decades now, debates around the effects of 'new public measures' in education have pointed to how the emphasis on increased accountability and high stakes testing has led to some worrying phenomena, thus changing teachers' practices and roles. These include narrowing of the curriculum, gaming and teaching to the test. This chapter discusses these kinds of knowledge and abilities as fundamentally depending on our understanding of the role of teachers within an educational system and in relation to educational (...) aims. The particular standpoint from which it tackles these issues revolves around asking whether the notion of autonomy is significant to teachers' roles and activities, and hence bears on our conception of teaching expertise. The chapter argues that the notion of autonomy is problematic: it conflates rather different psychological, phenomenological and normative elements. The discussion in the chapter culminates in an analysis of current policy arrangements in England. (shrink)

By putting existential phenomenology into conversation with virtue ethics, this book offers a new interpretation of human flourishing. It rejects characterizations of flourishing as either a private subjective state or an objective worldly status, arguing that flourishing is rather a successfully negotiated self-world fit – a condition involving both the essential dependence of the self upon the world and others, and the lived normative responsiveness of the agent striving to be in the world well. A central argument of the book (...) is that there is an irreducible normative plurality arising from the different practical perspectives we can adopt – the first, second, and third-person stances – all of which make different kinds of normative claim that we understand ourselves as having reason to meet. Flourishing is human excellence within each of these normative domains achieved in such a way that success in one domain does not compromise success in another. Existential Flourishing provides a correspondingly transformed interpretation of the virtues as solutions to various existential problems we face in responding to these normative domains. Ethical conflicts are arising as a result of the growing complexity of clinical care, coupled with technological advances. Most studies that have developed instruments for measuring ethical conflict base their measures on the variables ‘frequency’ and ‘degree of conflict’. In our view, however, these variables are insufficient for explaining the root of ethical conflicts. Consequently, the present study formulates a conceptual model that also includes the variable ‘exposure to conflict’, as well as considering six ‘types of ethical conflict’. An instrument (...) was then designed to measure the ethical conflicts experienced by nurses who work with critical care patients. Critical thinking is a complex, dynamic process formed by attitudes and strategic skills, with the aim of achieving a specific goal or objective. The attitudes, including the critical thinking attitudes, constitute an important part of the idea of good care, of the good professional. It could be said that they become a virtue of the nursing profession. In this context, the ethics of virtue is a theoretical framework that becomes essential for analyse the critical thinking concept in nursing care and (...) nursing science. Because the ethics of virtue consider how cultivating virtues are necessary to understand and justify the decisions and guide the actions. Based on selective analysis of the descriptive and empirical literature that addresses conceptual review of critical thinking, we conducted an analysis of this topic in the settings of clinical practice, training and research from the virtue ethical framework. Following JBI critical appraisal checklist for text and opinion papers, we argue the need for critical thinking as an essential element for true excellence in care and that it should be encouraged among professionals. The importance of developing critical thinking skills in education is well substantiated; however, greater efforts are required to implement educational strategies directed at developing critical thinking in students and professionals undergoing training, along with measures that demonstrate their success. Lastly, we show that critical thinking constitutes a fundamental component in the research process, and can improve research competencies in nursing. We conclude that future research and actions must go further in the search for new evidence and open new horizons, to ensure a positive effect on clinical practice, patient health, student education and the growth of nursing science. Recent attempts to explain why modesty should be considered a virtue have failed. A more adequate account is that modesty involves understanding how far one's accomplishments ought to be taken as definitive of one's value. Modest people communicate this self-understanding through behaviour motivated by the desire to ensure that their accomplishments do not cause pain to others. This virtuous mode of self-awareness involves recognizing that one is both defined by social standards of success and irreducible to these assessments. Modest agents (...) do not think themselves ‘better’ than others, but recognize that they rank higher on the particular social standard in question. With the increased use of Artificial Intelligence (AI) in wildlife conservation, issues around whether AI-based monitoring tools in wildlife conservation comply with standards regarding AI Ethics are on the rise. This review aims to summarise current debates and identify gaps as well as suggest future research by investigating (1) current AI Ethics and AI Ethics issues in wildlife conservation, (2) Initiatives Stakeholders in AI for wildlife conservation should consider integrating AI Ethics in wildlife conservation. We find that the existing literature (...) weakly focuses on AI Ethics and AI Ethics in wildlife conservation while at the same time ignores AI Ethics integration in AI systems for wildlife conservation. This paper formulates an ethically aligned AI system framework and discusses pre-eminent on-demand AI systems in wildlife conservation. The proposed framework uses agile software life cycle methodology to implement guidelines towards the ethical upgrade of any existing AI system or the development of any new ethically aligned AI system. The guidelines enforce, among others, the minimisation of intentional harm and bias, diversity in data collection, design compliance, auditing of all activities in the framework and ease of code inspection. This framework will inform AI developers, users, conservationists, and policymakers on what to consider when integrating AI Ethics into AI-based systems for wildlife conservation. (shrink)

This essay is a critical review of two recent collections, Feminism and Foucault: Reflections on Resistance, edited by Irene Diamond and Lee Quinby and Feminism as Critique: On the Politics of Gender, edited by Seyla Benhabib and Drucilla Cornell. While the collections differ in their manner of addressing the critical sources that have inspired them-the former relying upon a single theorist, the latter attempting to move through some of the philosophical history that constitutes our present theoretical terrain-both attempt to (...) think through and thus revisualize some of the categories of difference which we have inherited. Though the best essays from these collections are celebrated for demonstrating how "feminism as critique" can work to move us toward a clearer and more inclusive feminist theory, questions are raised about what the inattention to race in these volumes suggests about our own role in the construction of power and knowledge, and the erasures that help to secure them both. Research from behavioural sciences shows that people reach decisions in a much less rational and well-considered way than was often assumed. The doctrine of informed consent, which is an important ethical principle and legal requirement in medical practice, is being challenged by these insights into decision-making and real-world choice behaviour. This article discusses the implications of recent insights of research on decision-making behaviour for the informed consent doctrine. It concludes that there is a significant tension between the often non-rational choice (...) behaviour and the traditional theory of informed consent. Responsible ways of dealing with or solving these problems are considered. To this end, patient decisions aids are discussed as suitable interventions to support autonomous decision-making. However, current PDAs demand certain improvements in order to protect and promote autonomous decision-making. Based on a conception of autonomy, we will argue which type of improvements are needed. The concept of sustainability was developed in response to stakeholder demands. One of the key mechanisms for engaging stakeholders is sustainability disclosure, often in the form of a report. Yet, how reporting is used to engage stakeholders is understudied. Using resource dependence and stakeholder theories, we investigate how companies within the same industry address different dependencies on stakeholders for economic, natural environment, and social resources and thus engage stakeholders accordingly. To achieve this objective, we conducted our research using qualitative research (...) methods. Our findings suggest that the resource dependencies on different stakeholders lead to development of different stakeholder relationships and thus appropriate resources within the company to execute engagement strategies that are informing, responding, or involving. Our research explains why diversity exists in sustainability disclosure by studying how it is used to engage stakeholders. We find that five sustainability reporting characteristics are associated with the company’s stakeholder engagement strategy: directness of communication, clarity of stakeholder identity, deliberateness of collecting feedback, broadness of stakeholder inclusiveness, and utilization of stakeholder engagement for learning. Our study develops the literature by providing insight into companies’ choices of stakeholder engagement strategy thus explaining diversity in sustainability reporting based on the characteristics and relationships with specific stakeholders.
