The chapter deals with the notion of phenomenal realness, which was first systematically explored by Albert Michotte. Phenomenal realness refers to the impression that a perceptual object is perceived to have an autonomous existence in our mind-independent world. Perceptual psychology provides an abundance of phenomena, ranging from amodal completion to picture perception, that indicate that phenomenal realness is an independent perceptual attribute that can be conferred to perceptual objects in different degrees. The chapter outlines a theoretical framework that appears particularly (...) well-suited for dealing with corresponding phenomena. According to this framework, perception can be understood as a triggering of conceptual forms by sensor inputs. It is argued that the attribute of phenomenal realness is based on specific types of internal evaluation functions which deal with the segregation of causes conceived as ‘external’ from those conceived as ‘internal’. These evaluation functions integrate different internal sources of ‘knowledge’ about the potential causes for the activation of conceptual forms and provide markers by which conceptual forms can be tagged as ‘external world objects’. The Norwegian Association for Heredity Research played a key role in the rise of genetics as a research field in Norway. The immediate background of its establishment in 1919 was the need for an organization that could clarify scientific issues regarding eugenics and coordinate Norwegian representation in the organized international eugenics movement. The Association never assumed this role. Instead, Norway was represented in the international eugenics movement by the so-called Norwegian Consultative Eugenics Commission, whose leader, Jon Alfred (...) Mjøen, was dismissed as a pseudo-scientist by Norwegian geneticists. The paper explores the Association’s role in defining and delimiting scientific expert knowledge in the field of genetics and eugenics in Norway. It demonstrates how struggles about academic authority on the national arena were intertwined with struggles about representation and impact in the international eugenics movement and how transnational scientific networks where mobilized to legitimize and delegitimize notions about Nordic race supremacy, racial mixing and the politics of eugenic sterilizations. This chapter first addresses the standard definition of international organizations and the theory of functionalism. Then, it examines why the status of international organization may be deemed attractive. Functionalism appears highly plausible when it suggests why international organizations are set up since, obviously, a single state will be unable to guarantee the accurate delivery of mail abroad or provide for collective security. The chapter also focuses on the European Union, which can be regarded as possessing (...) class='Hi'>international legal personality. The European Communities were all individually granted legal personality, and this was construed as including personality under international law. Functionalism finds its normative justification in the contribution of organizations to the common good, and the Court of Justice of the European Union's (CJEU), in similar spirit, has placed considerable weight on the public nature of the tasks of an international organization, both in SAT Fluggesellschaft and in Vardakas. The International Labor Organization is not an effective force for raising labor standards in the developing world and could become considerably more effective by taking account of two of the most important and interrelated recent theoretical developments in understanding labor standards. First, countries derive no comparative advantage in the global trading system from most very low labor standards. The ILO should therefore concentrate its energies on lifting these, rather than concentrating on labor standards that are a source of (...) comparative advantage, the elimination of which is resisted strongly and effectively. Second, the tools of game theory may be used to identify the collective action problems that prevent countries from lifting their own labor standards, and create a role for a transnational agency that may assist them. The publication collects contributions on Coding as Literacy by computer scientists, mathematicians, philosophers, cultural theorists, and architects. Organization figures centrally in the understanding of biological systems advanced by both new mechanists and proponents of the autonomy framework. The new mechanists focus on how components of mechanisms are organized to produce a phenomenon and emphasize productive continuity between these components. The autonomy framework focuses on how the components of a biological system are organized in such a way that they contribute to the maintenance of the organisms that produce them. In this paper we analyze and compare these (...) two accounts of organization and argue that understanding biological organisms as cohesively integrated systems benefits from insights from both. To bring together the two accounts, we focus on the notions of control and regulation as bridge concepts. We start from a characterization of biological mechanisms in terms of constraints and focus on a specific type of mechanism, control mechanisms, that operate on other mechanisms on the basis of measurements of variables in the system and its environment. Control mechanisms are characterized by their own set of constraints that enable them to sense conditions, convey signals, and effect changes on constraints in the controlled mechanism. They thereby allow living organisms to adapt to internal and external variations and to coordinate their parts in such a manner as to maintain viability. Because living organisms contain a vast number of control mechanisms, a central challenge is to understand how they are themselves organized. With the support of examples from both unicellular and multicellular systems we argue that control mechanisms are organized heterarchically, and we discuss how this type of control architecture can, without invoking top-down and centralized forms of organizations, succeed in coordinating internal activities of organisms. International Law in Context is a pedagogy-forward textbook. It reflects the recent paradigm shift in legal education, which focuses more on what students actually learn rather than the material to which they are exposed. The text aims to prepare the next generation of U.S. lawyers to engage with our interconnected world and to critically evaluate the U.S.'s role within the international legal order. The work is divided into three parts that accomplish these goals. Part One lays a foundation. (...) It covers the various actors within the system, the theories that help explain their behavior, and the principles and sources of law they create. Part Two turns to the fora that define and support the international order, the historical and political contexts that impacted their design, and their efficacy. Part Three is a capstone section that asks students to weave together everything they have learned in Parts One and Two. Students will engage in normative development regarding climate change, including the existing international treaty regime and U.S. implementation options, and the law of war in the modern age. The cornerstone of this book is its organization. The text groups material into conceptual frameworks that promote understanding and retention. For example, rather than consider the various dispute resolution fora in isolation, Part Two asks students to consider them in the context of what types of disputes arise and what legal rules can be employed to resolve them in various international and domestic fora. The institutions also are presented in chronology. In this way, students are encouraged to chart the developmental progression and to make connections and comparisons between various institutions. The use of conceptual frameworks continues within each part. For example, Chapter Six covers the sovereign State as a conflict resolution forum. Under this umbrella, the author discusses (a) State Jurisdiction; (b) The Reception of International Law into the Domestic Sphere; (c) The Qualification as a State Forum or State Litigant (i.e., Recognition of States & Governments); and (d) Protections Afforded Within the Forum: Sovereign, Diplomatic, and Consular Immunity. A typical coursebook might locate this material in four different chapters. The conceptual framework approach, however, allows students to see the big picture and the relationship between concepts. In addition to the frameworks, there are several other innovative pedagogical devices that support student learning. When the journal Minerva was founded in 1962, science and higher educational issues were high on the agenda, lending impetus to the interdisciplinary field of “Science Studies” qua “Science Policy Studies.” As government expenditures for promoting various branches of science increased dramatically on both sides of the East-West Cold War divide, some common issues regarding research management also emerged and with it an interest in closer academic interaction in the areas of history and policy of science. Through a close reading (...) of many early issues of Minerva but also of its later competitor journal Science Studies (now called Social Studies of Science) the paper traces the initial optimism of an academically based Science Studies dialogue across the Cold War divide and the creation in 1971 of the International Commission for Science Policy Studies as a bridging forum, one that Minerva strangely chose to ignore. In this light, attention is drawn to aspects of the often forgotten history of Science Studies in the former Soviet Union and the Eastern European block. Reviewed also are several early discussions that are still relevant today: e.g., regarding differing concepts of Big Science, science and democracy, autonomy in higher education and what conditions are necessary to sustain academic freedom and scientific integrity (some of Edward Shils’ primary concerns). Finally, it is noted how the question of quantitative methods to measure scientific productivity lay at the heart of a “Science of Science” movement of the 1960s has re-emerged in a new form integral to the notion of a “Science of Science Policy.”. Histories of economic development during the Cold War do not typically consider connections to race science and eugenics. By contrast, this article historicizes the debates sparked by the International Labor Organization’s Puno–Tambopata project in Peru and demonstrates how Cold War development practice shared common epistemological terrain with racial and eugenic thought from the Andes. The International Labor Organization project’s goal of resettling indigenous groups from the Peruvian highlands to lower-lying tropical climates sparked heated debates about the (...) biological specificity of Andean highlanders’ physiques and ability to survive in the tropics. Such concerns betrayed the antitypological consensus expressed in the United Nations Educational, Scientific and Cultural Organization Race Statements and defended by one of the main proponents of the resettlement project, the Swiss–American anthropologist Alfred Métraux. The concern with Andean racial types was central to the research agenda of the acclaimed Peruvian physiologist Carlos Monge, who endorsed modernization projects that did not entail moving highlanders outside of their traditional climate. The debates sparked by the Puno–Tambopata project demonstrate how Cold War development discourse grappled with racial and eugenic thought from Latin America and the Global South and thereby produced projects of indigenous “improvement.”. Global supply chains (GSCs) present the International Labour Organization (ILO) with a challenge that goes to the heart of its founding mandate and structure, one built on the prominence of nation states and national representatives of employers and workers. In February 2020, discussions in the ILO on the rise of GSCs reached deadlock. To fully understand why the ILO has been unable to address decent work deficits in GSCs greater attention needs to be paid to contestation, power and (...) legitimacy in the deliberation of labour governance. Drawing on the concept of agonistic pluralism we examine the evolution of the ILO’s attempt to establish a new labour standard on GSCs under three empirical phases between 2002 and 2020. We argue that shifting power asymmetries between the tripartite constituents of governments, employers and workers, increased counter-hegemonic contestation, and intensified questioning of the deliberative legitimacy of the adversaries, explain the dissensual relations at the ILO. This article contributes to the literature on labour standards in GSCs in demonstrating how and why contestation underpins the evolution of labour governance over time. (shrink)

The World Trade Organization (WTO) is a multilateral trade organization that, at least partially, governs trade relations between its member states. The WTO (2011a) proclaims that its “overriding objective is to help trade flow smoothly, freely, fairly and predictably.” The WTO is a “treaty-based” organization – it has been constituted through an agreed, legally binding treaty made up of more than 30 articles, along with additional commitments by some members in specific areas. At present, 153 states are (...) members of the WTO, which collectively make up over 97 percent of all trade worldwide (WTO 2011b). Together, the WTO treaty specifies the rights and obligations of its member states. To become a member of the WTO, a state must treat the agreement as a “single undertaking.” Members cannot choose à la carte which agreements – for example, regarding tariffs, or trade in services or intellectual property – they want to accede to and which they do not. Instead, they must take on the obligations of the agreement in toto. The WTO is one of the most consequential governance institutions in the world, a lodestar of political debate about globalization (see globalization), attracting increased interest from moral and political philosophers in recent years (James 2006; Moellendorf 2005; Risse 2007; Brock 2009). Our think tank tasked by the Dutch Health Council, consisting of Radboud University Nijmegen Honours Academy students with various backgrounds, investigated the implications of Deep Brain Stimulation for psychiatric patients. During this investigation, a number of methodological, ethical and societal difficulties were identified. We consider these difficulties to be a reflection of a still fragmented field of research that can be overcome with improved organization and communication. To this effect, we suggest that it would be useful to found a (...) centralized DBS organization. Such an organization makes it possible to 1) set up and maintain a repository, 2) facilitate DBS studies with a larger sample size, 3) improve communication amongst researchers, clinicians and ethical committees, and 4) improve communication between DBS experts and the public at large. Recent work on complex adaptive systems in the natural sciences, and the growing relational turn in the social sciences both reject the "systems theories" of earlier generations. This book builds on these entities to advance a relational processual approach to the comparative study of historical and contemporary international systems.

Exploring how modern internationalism emerged as a negotiated process through international conferences, this edited collection studies the spaces and networks through which states, civil society institutions and anti-colonial political networks used these events to realise their visions of the international. Using an interdisciplinary approach, contributors explore the spatial paradox of two fundamental features of modern internationalism. Unnatural States is a radical critique of international theory, in particular, of the assumption of state agency--that states act in the world in their own right. Peter Lomas argues that since the universal states system is inequitable and rigid, and not all states are democracies anyway, this assumption is unreal, and to adopt it means reinforcing an unjust status quo. Looking at the concepts of state, nation, and agency, Lomas sees populations struggling to find an agreed model of the (...) state, owing to inherited material differences; and unsurprisingly, among theorists of the nation, only controversy and a great confusion of terms. Meanwhile, the functional incarnations of the state agent are caricatures: the mandarin state, the lawyer state, the landlord state, the heir-to-history state, and the patriot state. Yet recent developments in international theory (constructivism, scientific realism, postmodernism) sacrifice state agency only at the price of an unhelpful abstraction. The states system is dysfunctional and obsolete, Lomas contends, and international theory must be recast, with morality as central, to inspire and to guide historic change. He focuses in his conclusion on prescriptions for change, led by four moral concerns: human rights, weapons of mass destruction, relations between rich and poor societies, and the environment. "I begin this book," writes Lomas, "with the commonest commonplace of international theory, to expose it as a meaningless cliche. In the masterly hands of Hobbes, it was elaborated into a shock formula for organized society, a reading of history as civilization's failure. Kant sought to rescue morality from Hobbes and create the structures of modernity, but Kant's influence is coming to an end. In the Cold War, politicians disagreeing over another philosopher almost brought the world to an end. Hence the challenges of our time. These are primary and profound. Philosophers have done much to define the modern world. The point of international theory is to change it.". (shrink)

Our aim in this article is to attempt to discuss propagating organization of process, a poorly articulated union of matter, energy, work, constraints and that vexed concept, “information”, which unite in far from equilibrium living physical systems. Our hope is to stimulate discussions by philosophers of biology and biologists to further clarify the concepts we discuss here. We place our discussion in the broad context of a “general biology”, properties that might well be found in life anywhere in the (...) cosmos, freed from the specific examples of terrestrial life after 3.8 billion years of evolution. By placing the discussion in this wider, if still hypothetical, context, we also try to place in context some of the extant discussion of information as intimately related to DNA, RNA and protein transcription and translation processes. While characteristic of current terrestrial life, there are no compelling grounds to suppose the same mechanisms would be involved in any life form able to evolve by heritable variation and natural selection. In turn, this allows us to discuss at least briefly, the focus of much of the philosophy of biology on population genetics, which, of course, assumes DNA, RNA, proteins, and other features of terrestrial life. Presumably, evolution by natural selection—and perhaps self-organization—could occur on many worlds via different causal mechanisms. Here we seek a non-reductionist explanation for the synthesis, accumulation, and propagation of information, work, and constraint, which we hope will provide some insight into both the biotic and abiotic universe, in terms of both molecular self reproduction and the basic work energy cycle where work is the constrained release of energy into a few degrees of freedom. The typical requirement for work itself is to construct those very constraints on the release of energy that then constitute further work. Information creation, we argue, arises in two ways: first information as natural selection assembling the very constraints on the release of energy that then constitutes work and the propagation of organization. Second, information in a more extended sense is “semiotic”, that is about the world or internal state of the organism and requires appropriate response. The idea is to combine ideas from biology, physics, and computer science, to formulate explanatory hypotheses on how information can be captured and rendered in the expected physical manifestation, which can then participate in the propagation of the organization of process in the expected biological work cycles to create the diversity in our observable biosphere. Our conclusions, to date, of this enquiry suggest a foundation which views information as the construction of constraints, which, in their physical manifestation, partially underlie the processes of evolution to dynamically determine the fitness of organisms within the context of a biotic universe. Economists often support temporary migration in order to guard against potential adverse effects of brain drain. International organizations can serve to engage in surveillance, communication, and adjudication in order to enforce rules. The chapter addresses the possible features of a new international organization addressing migration. It also describes the present migration‐related functions of the International Organization for Migration (IOM), International Labor Organization (ILO), and World Trade Organization (WTO). Donald Campbell has long advocated a naturalist epistemology based on a general selection theory, with the scope of knowledge restricted to vicarious adaptive processes. But being a vicariant is problematic because it involves an unexplained epistemic relation. We argue that this relation is to be explicated organizationally in terms of the regulation of behavior and internal state by the vicariant, but that Campbell's selectionist approach can give no satisfactory account of it because it is opaque to organization. We show (...) how organizational constraints and capacities are crucial to understanding both evolution and cognition and conclude with a proposal for an enriched, generalized model of evolutionary epistemology that places high-order regulatory organization at the center. After briefly surveying the mission and principles of the World Trade Organization (WTO), I argue that international trade may be assessed from the perspective of justice, and that the correct account of justice for these purposes is egalitarian in fundamental principle. I then consider the merits of the WTO's basic commitment to liberalized trade in the light of egalitarian considerations. Finally, I discuss the justice of several WTO policies. While noting the complexity of the empirical issues relating to (...) the effects of trade institutions and policies, I conclude that egalitarians have reasons to object to certain of the principles and policies of the WTO.
