International Criminal Law and Philosophy is the first anthology to bring together legal and philosophical theorists to examine the normative and conceptual foundations of international criminal law. In particular, through these essays the international group of authors addresses questions of state sovereignty; of groups, rather than individuals, as perpetrators and victims of international crimes; of international criminal law and the promotion of human rights and social justice; and of what comes after international criminal prosecutions, (...) namely, punishment and reconciliation. International criminal law is still an emerging field, and as it continues to develop, the elucidation of clear, consistent theoretical groundings for its practices will be crucial. Nowadays, football goalkeepers play an important role in the team's organization, namely, considering the offensive and defensive processes. The purpose of our investigation focuses on the notational and T-pattern analysis of the offensive and defensive actions of elite young football GKs. The participating GKs presented 8 years of experience in the specific position, were internationally selected for the national team of Portugal, and competed in the national U-17 championship of Portugal. Thirty football matches were observed. The observational sample consisted of (...) defensive actions and offensive actions. Two observational instruments were used to codify the actions: the observation system of defensive technical-tactical actions of GKs and the observation system of offensive technical-tactical actions of GKs. Both instruments underwent a validation process, and inter- and intra-observer reliability was tested. The codification of the actions was performed with the LINCE program, and later the data were exported to Microsoft Excel and THEME 5.0. The notational data were analyzed in SPSS, and T-pattern detection analysis was performed in THEME 5.0. The predominant actions of young observed GKs were fundamentally goal defense and participation in the team's offensive process construction through actions performed with the foot and hand. The analysis of T-patterns allowed to identify T-pattern actions in the defensive actions of goal defense and exit of the goal, as well as related to the defensive set pieces. In the offensive process, the analysis of T-patterns reinforced the participation of the GK in the team's first phase of construction and in the execution of goal kicks and actions that start as a result of the actions of the opponent. The GK's defensive actions are mostly focused on the objective of goal defense and offensive actions with the hands and feet are important for their participation in positional attack construction. Our study contributes to a better knowledge of the GK's actions in the competition and is relevant to be considered by the specific position coaches in the training process organization. (shrink)

The book analyses conflicts between the U.S. and North Korea, sovereignty contestations around islands in the Japanese sea, Pussy Riot in Russia, veterans in Ukraine, and Nagorno-Karabakh.

International law enforcement have noted a rise in the use of the Dark Web to facilitate and commit sexual offenses against children, both prior to and since the start of the COVID-19 pandemic. The study presented here therefore aimed to investigate the characteristics and behaviors of anonymous users of Dark Web platforms who were suspected of engaging in the sexual abuse of children. Naturally-occurring data on 53 anonymous suspects, who were active on the Dark Web and had come (...) to police attention in the United Kingdom (UK), were sampled. Analysis of the data yielded 462 features that could be coded reliably. Analysis of these features provided novel insights into suspects’ characteristics, their motivations for using the Dark Web, the nature of the offending behavior they reported engaging in, their technical and security precautions, sexual interests, and the content of their interactions with one another. Findings are discussed in relation to theoretical and practical implications, as well as directions for future research. (shrink)

This article considers Sartre's relations with the French Communist Party (PCF) in the years immediately following the Liberation when the PCF considered that, of all the prominent French intellectuals, it was Sartre who posed the greatest threat. This article opens by situating the PCF within the French political landscape immediately after the Liberation and addressing its attitudes towards intellectuals. It then examines the main themes of the attacks launched by the PCF, between 1944 and the staging of Les Mains sales (...) ( Dirty Hands ) in 1948, on both Sartre and existentialism and the reasons for these attacks. It concludes by noting the differences between the PCF and Sartre on three specific political issues during this period. (shrink)

The specialised vocabularies of lawyers, ethicists, and political scientists obscure the roots of many real disagreements. In this book, the distinguished American international lawyer Alfred Rubin provides a penetrating account of where these roots lie, and argues powerfully that disagreements which have existed for 3,000 years are unlikely to be resolved soon. Current attempts to make 'war crimes' or 'terrorism' criminal under international law seem doomed to fail for the same reasons that attempts failed in the early nineteenth (...) century to make piracy, war crimes, and the international traffic in slaves criminal under the law of nations. And for the same reasons, Professor Rubin argues, it is unlikely that an international criminal court can be instituted today to enforce ethicists' versions of 'international law'. (shrink)

Research in the discipline of international relations finds that the great democratic powers are less likely to pursue revisionist policies. This investigation challenges this argument by showing that the United States' decision to oust Saddam Hussein's regime in March 2003 was consistent with a modified version of John Mearsheimer's theory of offensive realism, which finds that great powers' motivation is global hegemony. This article is divided into three sections. The first section considers the value of Mearsheimer's theory and reworks (...) it by adding domestic variables to explain why states abandon defensive strategies for offensive ones. The second section shows how pre-9/11 American foreign policy strategy was, for the most part, status quo oriented, and section three explains why and how the Bush administration introduced a revisionist foreign policy strategy after the 9/11 attacks. This investigation concludes by showing how the 2003 Iraq War is the first step in the United States' quest for global hegemony. (shrink)

Victory is the ultimate aim in high performance sports; when it comes to team sports, the goal is the key that allows players to achieve that victory. This is the case with futsal which, due to its internal structure as well as the speed in the development of its game, makes the achievement of a goal not an isolated event, but rather more than one goal must be scored to achieve victory. The aim of the present study is to analyze (...) the construction of offensive sequences that have resulted in goal-scoring in the two main European futsal leagues, the Spanish and the Italian, as well as to identify the patterns relating to offensive actions that have ended with a goal being scored. Observational methodology was used to develop the research and an ad hoc observation instrument was developed for this purpose. The data was analyzed using inferential statistics as well as sequential analysis of delays in a diachronic analysis to identify the patterns of offensive actions. The results obtained enable recognition of a league’s idiosyncrasy patterns in goal-scoring in each of the leagues studied. The results obtained will allow experts to have a better understanding of how goals are scored and how to establish more specific training tasks, in both attack and defense. (shrink)

The advertising of controversial products/services and the use of controversial images to "cut through the clutter" in the marketplace appears to be increasing around the world. However, apart from the general ethical issue regarding the deliberate use of controversial/offensive images for public viewing that may offend some people, it is important to determine what makes a controversial advertisement offensive? A questionnaire was distributed to 1014 students across four different countries in the Asia Pacific region to determine what type of products (...) are seen as offensive and the reasons they are offensive. World War II broke out as the result of an alliance between Germany and Soviet Union with the aim to conquer and partition Poland. Having broken off the treaty of friendship and co-operation, Germany attacked the USSR in 1941, forcing the Soviet Union to change sides from that of a German ally to the ally of the anti-German coalition. In 1943, following the German discovery of the graves of Polish officers murdered by Soviet forces in Katyń, Stalin declared that the (...) crime had been committed by the German army and broke off diplomatic relations with the Polish Government-in-Exile in London which had requested that an official investigation be launched by the Red Cross committee in Geneva. Some one hundred German officers were sentenced to death for the Katyń massacre as the result of Stalin’s prosecution trials. 50 years later, the world was rocked by the discovery of a document signed by Stalin ordering the execution of Polish officers in Katyń.In a secret meeting in 1943 in Teheran, President Roosevelt and Stalin agreed on the plan to annex Poland’s eastern territories.The decision to stage an independent fight for independence during the Warsaw Uprising was justified by the inevitable approach of the Red Army, the fear of German reprisal actions for disobeying the order to participate in fortification works, the fear of a spontaneous uprising fuelled by a Soviet radio broadcast in Polish which appealed to the people of Warsaw to put up a fight against the oppressor.Stalin’s decision to withhold the Soviet offensive and ban American and British planes carrying humanitarian aid for Warsaw from landing in Soviet airports contributed to the downfall of the Uprising. The Warsaw Uprising was a cue for the civil outbreaks that followed in Slovakia, Romania, Bulgaria, Paris and Prague. The halt on the Soviet Army’s offensive, which enabled the German forces to eliminate the Polish centre of political command subordinate to the Government-in-Exile in London, limited the European territory that fell subject to Soviet supremacy. The memory of the heroic fight put up by the entire population of Warsaw deterred the Soviet Union’s ambitions to curtail Poland’s sovereignty. (shrink)

Although the use of military force for humanitarian ends seems utterly divorced from the use of such force to combat terrorism, both uses answer to similar descriptions. Both appear to encourage nations that are not necessarily themselves under attack to set aside the reigning conventions of national sovereignty and territorial integrity for the overriding purposes of international law enforcement and protection of vulnerable noncombatants. Both involve offensive rather than purely defensive uses of military force. Both answer to criteria of (...) justification that can be derived more readily from the normative moral principles of the classical just war tradition than from purely descriptive revisions of the 'legalist paradigm' in international relations, because the latter is deeply wedded by precedent to notions of sovereignty, territorial integrity, and a purely defensive use of military force. Most significantly, the justification for both kinds of military action depends essentially upon a notion of 'the international community' that is inchoate and urgently in need of rigorous reformulation. In this paper, I attempt to formulate criteria for the justifiable use of military force for these non-defensive purposes, with attention to the nuances of internationalism that several of the resulting criteria entail. Challenges to the de facto role of the United Nations as the sole authoritative representative of this community, and alternatives to its authority in legitimating the use of military force for purposes of international law enforcement, are considered. States’ capacity for using modern information and communication technology to inflict grave harm on enemies has been amply demonstrated in recent years, with many countries reporting large-scale cyberattacks against their military defense systems, water supply, and other critical infrastructure. Currently, no agreed-upon international rules or norms exist to govern international conflict in cyberspace. Many governments prefer to keep it that way. They argue that difficulties of verifiability and challenges posed by rapid technological change rule out agreement on an (...) international cyber convention. Instead, they prefer to rely on informal cooperation and strategic deterrence to limit direct conflict. In this article, I seek to rebut some of the main objections to seeking an international convention on the use of cyber weapons. While there are significant obstacles to achieving effective arms control in the cyber domain, historical experience from other areas of international arms control suggests that none of these obstacles are insurmountable. Furthermore, while most critics of cyberarms control assume that cyberspace favors offensive strategies, closer inspection reveals the dominance of cyber-defensive strategies. This in turn improves prospects for striking an effective international agreement on cyberarms control. (shrink)

There are barriers of perception between Sudanese Muslims for whom the sharia is a source of authority and identity and others who see it as an oppressive means of dominating Sudan's minority populations. I make a distinction between process and substance in law, and show that a flawed process has contributed to a perception of international law as an instrument of powerful states, which has obscured its legislative and procedural usefulness to the Sudan as a member of the United (...) Nations. Similarly a distortion of due process in Sudan's sharia has created a substance derived from the legacy of medieval Arabia rather than applied legal methodology. One consequence of this is that Sudan's Civil Wars have been given the attributes of offensive jihad against its diverse non-Muslim populations. I argue that offensive jihad was a legal construction designed to meet the challenges of medieval Arab society, with little basis in the fundamental sources of Islamic law or in contemporary legal methodology. I advocate a return to due process as a partial solution to the impasse between Muslim and non-Muslim identities in the Sudan, and show how international law can be improved by accommodating other legal traditions. This article explores some conceptual issues regarding criminalization at the domestic and international levels. It attempts to explain what it means to say that a particular kind of conduct has been criminalized, and considers how the processes of criminalization differ in domestic and international law. In unpacking these issues, the article takes the examples of rape and sex trafficking in domestic and international legal systems, explores whether these offenses are criminalized more broadly in international criminal (...) law as compared to domestic criminal law, and briefly outlines possible explanations for this disparity. While the simple historical view has pictured the Lysenko controversy as an uninterrupted series of Lysenko's victories-beginning with the 1936 discussion, and culminating in the infamous August 1948 meeting of the Lenin All-Union Academy of Agricultural Sciences, when genetics was officially abolished in the Soviet Union-it was certainly more complex, as recognized by such serious historians as David Joravsky and Mark Adams. As we have seen, the roles the competitors assumed in 1945–47 were the reverse of those they assumed in (...) the 1930s: the geneticists managed to gain the offensive, and Lysenko was forced to defend his position.This episode suggests that the Communist Party leadership probably did not have a special bias against genetics, nor a particular preference toward Lysenko at that time. The actual decisions of the Party apparatus on particular science policies were based upon the current priorities of general foreign and domestic policies, rather than upon an “orthodox Party line” in esoteric scientific questions. It is clear and has been recognized by some historians that the Soviet scientific community was not a passive, monolithic object of the manipulation, control, and repression exercised by the Communist Party leadership; various groups within the Soviet scientific community actively exploited every opportunity provided by the Party's policies to achieve their own objectives.The Lysenko controversy illustrates the profound impact of international events on Soviet science and suggests that its history cannot be understood as a result of exclusively domestic affairs, but should be explicated within a broader framework of interaction between Soviet domestic and international policies and between the Soviet and Western scientific communities. As we have seen, one of the major causes of the geneticists' success in the postwar struggle with Lysenkoists was the shift of Soviet foreign policies toward internationalism stimulated by the wartime alliance between the “Big Three.” This suggests that the so-called “death” of genetics in the Soviet Union in August 1948 was also the result of another dramatic shift in the international situation: the climax of the Cold War confrontation between former allies in the summer of 1948, which marked the final division of postwar Europe and the world into two opposing camps, East and West. Meeting of the Minds records the proceedings of the S.I.E.P.M. conference held in Boston from June 14-16, 1996. The conference participants centred their attention on the relationships between medieval and classical modern philosophy. These relationships have been painted in dramatically different ways by those who have presented overviews of the two eras. Hans Blumenberg, in The Legitimacy of the Modern Age and his subsequent works, discovers the seeds of modernity in the medieval authors themselves. Leo Strauss and his followers see (...) a radical difference between the classical world views of the ancients and medievals and the successive layers of modern thought. These general portraits demand specifics, and the strength of the conference, whose results are contained in this volume, was that it provided many specific examinations of concrete relations between the philosophical positions of celebrated medieval and modern thinkers. Our hope is that this collection of papers will suggest the direction for further cooperative efforts on the interplay of the philosophical views represented by these two eras, and that the issues commonly debated by the medieval and early modern thinkers represented in this volume will give renewed consideration to important philosophical points that have been ignored in more recent debates. Proceedings of the First Conference of the International Society for Hermeneutics and Science.

This book constitutes the thoroughly refereed post-proceedings of the International Conference on Artificial Intelligence and Symbolic Computation, AISC 2000, held in Madrid, Spain in July 2000. The 17 revised full papers presented together with three invited papers were carefully reviewed and revised for inclusion in the book. Among the topics addressed are automated theorem proving, logical reasoning, mathematical modeling of multi-agent systems, expert systems and machine learning, computational mathematics, engineering, and industrial applications.
