In this chapter, I bring non-ideal theory to bear on the ethics of immigration. In particular, I explore what the obligations of liberal states would be if they were to attempt to implement migration arrangements that conform to liberal-cosmopolitan principles. I argue that some of the obligations states have are feasibility-insensitive, while some are feasibility-sensitive. I show that such obligations can have as their content both the inclusion and exclusion of prospective immigrants, and that they can be grounded in (...) the requirements of liberal justice, mere capacity to assist, as well as past or foreseeable contribution to harm. The chapter therefore explores the possibility of an international migration regime that takes human rights seriously whilst avoiding the twin pitfalls of strict immigration restrictions and the complete liberalization of immigration. International migration of work force is presently a high amplitude phenomenon. Romanian people have emigrated for work around the world, being engaged both in the physically hardest jobs and in activities that require completion of specialized courses and certification in a particular field. This last category includes social workers who, following schooling and certification and even having a minimal experience in the home country, apply for jobs in the field of social assistance. These recruiters aim to distribute social (...) workers at the workplace of interest, according to certain well-defined criteria. In the present paper we describe international migration of work force, and we illustrate it by adding case studies of life experience of social workers who underwent the process of emigration to the United Kingdom. Throughout the emigration process, these workers experienced certain changes in their life principles, mentality, values, and were marked by professional dilemmas in extreme situations. (shrink)

Using data from the China Education Panel Survey, which was a nationally representative sample of junior high school students, this study examined the association of internal migration with depression among migrant and left-behind children, while exploring the moderating effect of gender difference and the mediating effects of social relationships. The results showed that migrant children had a significantly lower level of depression than left-behind children. Further, the difference in mental health between migrant children and left-behind children was more prominent (...) for boys than girls. The mechanism analyses indicated that compared to left-behind children, internal migration positively predicted parent–child relationships and peer relationships of migrant children, which in turn reduced their depressive symptoms. Although migrant children suffered from a higher level of teacher discrimination than their left-behind counterparts, it had no significant relationship with depression after controlling for children’s social relationships with parents and peers. Our findings suggested that migrating with parents was helpful to reduce children’s depressive symptoms in comparison with being left behind. Therefore, actions should be implemented to reduce the occurrence of involuntary parent–child separation and the prevalence of children’s depressive disorders due to institutional constraints. In addition, necessary treatments are needed to improve the psychological wellbeing of disadvantaged children, especially among left-behind children with mental illness. (shrink)

This study aimed to point out the differences between the religiosity of immigrants and natives and how they hinder or facilitate immigrant social integration into the host society. The study took a multi-national perspective as the basis for analyzing religious views within Europe whereby both the natives and immigrants in European countries are evaluated and explanations for individual groups’ integration trajectories are emphasized. With respect to a thorough scholarly analysis, this study found out that the religiosity of immigrants tends to (...) be high than that of natives in most European countries. It also noted that the initial religiosity of immigrants drops with an increase in the duration of time the individual immigrant stays in the host country. This study makes available knowledge about religious differences in a cross-cultural perspective and strives to help sociologists in outlining the differences in order to help in studying behavior patterns in different cultural settings. This article discusses three major dilemmas embedded in women's labor migration by focusing on undocumented Latina migrants in Israel. The first is that to break the cycle of blocked mobility in their homelands, migrant women must take jobs that they would have never taken in their countries of origin, despite uncertainty about possible economic outcomes. The second dilemma is that the search for economic betterment leads Latina migrants to risk living and working illegally in the host country, forcing them (...) to remain on the margins of society. The third dilemma relates to the role of mothers who, to secure a better future for their children, are forced to leave them behind, thus subverting the traditional definition of motherhood. The absence of an egalitarian notion and the practice of citizenship for non-Jews leave undocumented labor migrants in Israel without prospects for incorporation into the society. (shrink)

In theory, a human rights framework should protect and guarantee the equal provision of care and rights of all people. In practice, however, the universality that underlies human rights is enacted through citizenship rights, which rely on the individual politically ‘belonging’ to a nation-state.

This paper describes the matrimonial and reproductive behaviour of Italians who migrated to Belgium after the Second World War. Migrants were either already married, or later became married, to other Italians. Among the children of migrants, men equally chose Italian or Belgian wives but women tended to prefer Italian partners. Italian-Belgian marriages were more frequent among the better educated groups. Family size is smaller among migrants marrying after migration and in heterogamous marriages. Significant differences in birth intervals are found (...) when marriage occurred before or after migration, between generations, and between homogamous and heterogamous marriages. (shrink)

There is an ongoing debate on the migration of doctors, especially psychiatrists, from developing countries. It is argued that these countries, which are already running short of psychiatrists, will further be jeopardised and their health systems will collapse if this migration and subsequent recruitment continue. In this paper the author presents a personal view of the ethics and human rights of this matter. He emphasises the importance of migration of doctors in view of the current situation in (...) developing countries and advises that the Commonwealth Code be followed to address the problem of the shortage of psychiatrists in developing countries and psychiatrists’ basic right to avail themselves of the opportunities in the developed world. This article uses a well-defined setting to suggest an optimistic view about the distributional effects of immigration. Section 2 provides a general picture of the native-immigrant differences in labour force participation, unemployment, and occupational and educational attainment, taking skill levels and years since immigration into account. Section 3 investigates the inequality impact of immigration by summarizing the potential labour market impacts and the wage and employment consequences. Section 4 deals with the potentially slow integration of immigrants into the labour market (...) of the host country, as well as with the role that self-selection and selection through politically set admission rules can play for the performance in the labour market. It also considers cultural or ethnic identity as an independent factor potentially affecting economic success and discusses the consequences for inequality. Section 5 concludes. (shrink)

We are really just at the beginning of analysing the connection between ethics, border management and migration policies. In this framework of the debate, I would like to propose a line of analysis centred, not so much what States do in the area of migration policies but rather theorize about the behaviour toward the demand for entry by people from other States. That is, how the States behave rather than what the States do in migration policies. This (...) analysis implies entering into the field of applied ethics and taking a contextual approach. The construction of an ethical framework for the evaluation of decision-making represents a justified task in the current context of migration policies in Europe, and can contribute to the incipient debate on the Ethics of migration.This article follows five sections. In the first section the debate on the Ethics of Migration especially that concerned with the normative debate on the control of borders is introduced. In the second section, the need for using an applied ethic for analysing migration policies is justified, and, in the third section, an "evaluative ethical framework" is finally proposed. In section four, this framework and the policy-maker's information resources are presented, and in section five, the resulting ethical approaches and orientations that follows are defended. Finally, in the concluding section, the article shows the different applications of the proposed framework, viable in both the area of public policy analysis and for empirical research. (shrink)

This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

In this new publication, Cristina Cormos professionally addresses a sensitive issue, complex and difficult in the same time, and ambitiously manages to give us a picture of international migration viewed through identity change. Starting from the hypothesis that "migration is a change that simultaneously occurs in both physical and socio-cultural realms, which implies not only movement from one community to another, but also the disintegration of structural bonds in the departure area, paralleled by a cultural assimilation of (...) the destination environment", the author analyzes identity changes of the emigrants throughout the entire migration process, the factors underlying these changes, as well as the consequences and implications of these factors in the return migration. The issues addressed within this book also cover the changes occurred in the family and community of origin as a result of the absence of one of its members and of the manifestation of identity changes respectively. In this article, we introduce the project developed in this special issue: a search for principles of ‘real-world’ justice in international migration that can offer practical guidance on real political problems of migration governance. We begin by highlighting two sources of divergence between the principal topics of theoretical controversy within literatures on migration justice and the animating sources of political controversy within real national and international publics. These arise first in the framing of the problems (...) on which normative theory is purported to offer guidance, and second in the character of the normative reasons that are invoked as grounds for settling the controversies. In response to these divergences, we propose that the development of action-guiding normative theories of international migration can be supported with resources from broadly ‘realist’ approaches to political theory. We outline three key dimensions in which the ‘real-world’ theoretical approaches developed in this collection of papers connect up with important themes in the wider theoretical literature on political ‘realism’: first, a problem-centred methodological strategy; second, a focus on the value of political legitimacy; and third, a commitment to reconciling systematic engagement with real political problems and circumstances with a critical normative orientation towards political problems. This chapter focuses on the implications of economically self‐interested behavior by voters and lobbyists, rather than important issues of irredentism, demagoguery, and security. It also focuses on the political problems of liberalizing migration between poor and wealthy states. Economists often support temporary migration in order to guard against potential adverse effects of brain drain. International organizations can serve to engage in surveillance, communication, and adjudication in order to enforce rules. Responsibility for international economic migration could (...) be assigned to an existing organization or to a new organization. The chapter addresses the possible features of a new international organization addressing migration. It also describes the present migration‐related functions of the International Organization for Migration (IOM), International Labor Organization (ILO), and World Trade Organization (WTO). The ILO has broad experience in a variety of labor and migration issues, and its tripartite structure facilitates negotiations that involve the concerns of industry and labor. (shrink)

Increasing globalization of the nursing workforce and the desire for migrants to realize their full potential in their host country is an important public policy and management issue. Several studies have examined the challenges migrant nurses face as they seek licensure and access to international work. However, fewer studies examine the barriers and challenges internationally educated nurses (IEN) experience transitioning into the workforces after they achieve initial registration in their adopted country. In this article, the authors report findings from (...) an empirically grounded study that examines the experience of IENs who entered Ontario’s workforce between 2003 and 2005. We found that migrant nurses unanimously described nursing as ‘different’ from that in their country of origin. Specifically, IENs reported differences in the expectations of professional nursing practice and the role of patients and families in decision‐making. In addition, problems with English language fluency cause work‐related stress and cognitive fatigue. Finally, the experience of being the outsider is a reality for many IENs. This study provides important insights as policy and management decision‐makers balance the tension between increasing the IEN workforce and the delivery of safe patient care. (shrink)

This paper aims to show that fairness in trade calls for relaxing existing WTO rules to include a greater liberalisation of labour migration. After having addressed several objections to global egalitarianism, it will argue, first, that the world’s rich and the world’s poor participate in a same multilateral trading system whose point is primarily to reduce trade barriers, and hence to establish global economic competitions, in order to raise their standards of living; second, that these competitions are subject to (...) requirements of formal and substantive fairness; and, third, that the substantive fairness of the competitions that are taking place in the field of trade in goods is likely to require a greater liberalisation of labour migration, especially low-skilled labour from developing countries. Forced population migration is not a modern phenomenon. It is often an integral part of totalitarian policies and has been used repeatedly to ensure the survival of political regimes or achieve specific political ambitions. Violent migration is present practically throughout history when considering the time scope and everywhere, practically in all continents of the world, with a specter of variations depending on the context imposed by the political circumstances, we can encounter it under different names. These variations have (...) also reflections in the terminology used, among others, they are also indicators that speak of the different methods applied in order to achieve particular policies. Individuals, families, or even whole peoples are forced to migrate violently, abandon their homes and leave behind them all their lives, including the material goods created up to that moment. Seen from a normal retrospective, forced migration represents the culmination of a regime’s goals to dominate the territory without hindrance from any possible resistance. This fact has brought so many tragedies to humanity, and even worse, it has often ended with “legitimization” by international treaties or has even been the product of inter-state agreements. Forced population migration has clearly brought to the surface the evil purpose and has revealed territorial ambitions. (shrink)

ZusammenfassungIm gesundheitspolitischen Kontext werden die internationale Rekrutierung und Migration von Ärztinnen, Ärzten und Personal in Gesundheitsfachberufen seit langem diskutiert. Diese Studie untersucht die thematischen Schwerpunkte dieser Debatten um ethische Aspekte der internationalen Rekrutierung in der Public Health Literatur mit Peer Review. Unser Artikel diskutiert, welche Implikationen für gesundheitspolitische Maßnahmen bezogen auf gesundheitliche Ungleichheiten diese fachspezifischen akademischen Diskussionen aufwerfen. Wir erstellten eine qualitative Übersichtsarbeit basierend auf Literaturrecherchen zu fachspezifischen internationalen Studien mit Schwerpunkt auf theoriebasierten und qualitativen Forschungsdesigns in den Datenbanken (...) PubMed und Web of Science. In die Analyse einbezogene Artikel wurden mit der Critical Appraisal Skills Program Checkliste für qualitative Forschung bewertet und anhand eines thematischen Inhaltsanalyseverfahrens auf gemeinsame Muster untersucht und kodiert. 17 Artikel wurden in die Analyse einbezogen. Diese Artikel befassten sich mehrheitlich entweder mit Pflegeberufen oder mit Ärztinnen bzw. Ärzten, und wurden verfasst aus Perspektiven des globalen Nordens. Die thematische Inhaltsanalyse ergab, dass ethische Aspekte generell zusammen mit einer allgemeinen Übersicht über Gesundheitssysteme und Ungleichheiten zwischen Ländern genannt wurden und Migration zwischen Ländern stärker im Fokus stand als Migration innerhalb einzelner Landesgrenzen. Vorgeschlagene Lösungsansätze in der Public Health Literatur sind meist ökonomischer Natur und stellen globale Finanzausgleiche zwischen Ländern oder nationale Verbesserung von Arbeitsbedingungen zur Diskussion. Möglichkeiten der Evaluation solcher Lösungen werden selten vertieft. Insgesamt fokussiert diese fachspezifische Diskussion mehrheitlich auf einen systemischen Ansatz und problematisiert die Migration von Personal in Gesundheitsfachberufen sowie von Ärztinnen und Ärzten. Unsere Ergebnisse deuten darauf hin, dass die akademische Forschung im gesundheitswissenschaftlichen und medizinischen Feld derzeit nur Vorschläge für politische Maßnahmen formuliert, die nicht grundsätzlich die globale Ordnung der Gesundheitssysteme in Frage stellen. Die Diskussion scheint daher geeignet zu sein, ein Bewusstsein für Benachteiligungen zu schaffen, ohne diese radikal beseitigen zu wollen. Eine vertiefte Auseinandersetzung mit Aspekten von Gender, Ethnizität und übergeordneten intersektionalen Bedingungen sowie Auswirkungen für und von internationaler Rekrutierung und Migration könnte die Diskussion schärfen. Histories of economic development during the Cold War do not typically consider connections to race science and eugenics. By contrast, this article historicizes the debates sparked by the International Labor Organization’s Puno–Tambopata project in Peru and demonstrates how Cold War development practice shared common epistemological terrain with racial and eugenic thought from the Andes. The International Labor Organization project’s goal of resettling indigenous groups from the Peruvian highlands to lower-lying tropical climates sparked heated debates about the biological specificity (...) of Andean highlanders’ physiques and ability to survive in the tropics. Such concerns betrayed the antitypological consensus expressed in the United Nations Educational, Scientific and Cultural Organization Race Statements and defended by one of the main proponents of the resettlement project, the Swiss–American anthropologist Alfred Métraux. The concern with Andean racial types was central to the research agenda of the acclaimed Peruvian physiologist Carlos Monge, who endorsed modernization projects that did not entail moving highlanders outside of their traditional climate. The debates sparked by the Puno–Tambopata project demonstrate how Cold War development discourse grappled with racial and eugenic thought from Latin America and the Global South and thereby produced projects of indigenous “improvement.”. Brock argues that states’ rights of border control should be understood to be conditional on states’ protecting human rights internally as well as on states’ appropriately contributing to the human rights conditions of migrants internationally. I discuss these requirements in turn. I first argue that Brock needs further to specify how internal human rights failures affect the legitimacy of states’ border control rights. I then outline some considerations that I believe would strengthen Brock’s proposal for better international cooperation on (...) migrants’ human rights. (shrink)

Human mass migration from place to place is well recorded in history. The ancient patterns of mass migrations could have their origins in natural forces or divine order. Simultaneously, modern recorded history suggests that human mass migrations were triggered by local and regional politics too such as political oppression or imperial invasion. However, a new pattern of mass migration emerged in the 20th century triggered by a complete new force-strategic redrawing of certain regional maps. This strategic redrawing of (...) maps is not locally inspired but imposed from abroad as part of competitive economic and military strategies of a global scale. This article intends to analyse the mass migrations triggered by Iraq-Syria civil wars in the framework of international strategic global competition. The article argues that these mass migrations are artificially caused by the economic and military strategies of international hegemonic powers. Strategic national interest abroad is the underlying objective at the cost of the sufferings of the millions. (shrink)

A distinguishing feature of the Global Compact for Safe, Orderly and Regular Migration is its “whole-of-society” approach, which includes states, but also engages a “broad multi-stakeholder” partnership to address global migration “in all its dimensions”. As one of the stakeholders that participated in the shaping and implementation of this new global normative instrument, we suggest that a spirit of international solidarity can be located in the cooperative and consensual processes and platforms that make up its architecture. Drawing (...) on the English school’s conception of international society, we argue that the GCM has advanced international solidarity in the acceptance by stakeholders of agreed core principles relating to migration governance and in the creation of spaces and platforms for whole-of-society dialogue. It is within these emergent spaces of the GCM that the possibility of concrete and meaningful improvement in the lives of migrants and other people on the move can be made. (shrink)

Puisque le changement social contribue à modifier et influencer le droit, l’objet de cette contribution est de comprendre de quelles manières ce dernier a des incidences sur le processus de formation du droit en prenant pour exemple la règle coutumière prohibitive de la détention arbitraire en droit international des migrations. Le but de cet article est de tenter de percevoir les effets des changements sociaux sur la coutume en prenant un exemple précis, tout en essayant d’émettre l’hypothèse que ce (...) dernier est révélateur de l’impact des changements sociaux sur la formation de la coutume internationale. En apportant dans un premier temps des éclairages utiles concernant le droit international des migrations, il s’agira dans un second temps d’apporter au lecteur des bases de compréhension essentielles sur la coutume internationale. Enfin, la troisième partie sera consacrée à expliciter des hypothèses qui pourraient expliquer d’une part de quelles manières des changements sociaux successifs ont influencé la formation de la règle coutumière de l’interdiction de la détention arbitraire et d’autre part, comprendre les raisons pour lesquelles les États acceptent d’être liés à cette règle. There is a broad consensus on the legitimacy of states to control immigration. However, this belief has recently been questioned, among other reasons, due to the contradiction with current practices in emigration and internal mobility. The principle of symmetry states that any restriction on immigration should also apply to emigration; or that, to the contrary, if there is a right to emigrate, there should be a corresponding right to immigrate. The principle of coherence posits that every reason one might have (...) for moving within a country also counts for moving between countries. This article proposes to extend the coherence principle from external to internal migration, arguing that the same reasons that justify restrictions on mobility across borders justify restrictions on mobility within borders too. Therefore, either freedom of movement is a fundamental right or the right of the political community to control mobility prevails. The interests at stake are in both cases the same, so asymmetry is not warranted. This leads us to an apagogical argument for open borders. (shrink)
