This volume marks a phase of accomplishment in the work of the World Phenomenology Institute in unfolding a dialogue between Occidental phenomenology and the Oriental/Chinese classic philosophy. To introduce this collection of research studies, which stem from the pro grams conducted by The World Phenomenology Institute, we need say a few words about our aims and work. This will bring to light the significance of the present volume. The phenomenological philosophy is an unprejudiced study of experience in its entire range: experience being understood as yielding objects. Experi ence, moreover, is approached in a specific way, such a way that it legitima tizes itself naturally in immediate evidence. (...) As such it offers a unique ground for philosophical inquiry. Its basic condition, however, is to legitimize its validity. In this way it allows a dialogue to unfold among various philosophies of different methodologies and persuasions, so that their basic assumptions and conceptions may be investigated in an objective fashion. That is, instead of comparing concepts, we may go below their differences to seek together what they are meant to grasp. We may in this way come to the things them selves, which are the common objective of all philosophy, or what the great Chinese philosopher Wang Yang Ming called "the investigation of things". It is in this spirit that the Institute's programs include a "cross-cultural" dialogue meant to bring about a profound communication among philosophers in their deepest concerns. Rising above artificial cultural confinements, such dialogues bring scholars, thinkers and human beings together toward a truly human community of minds. We present here a fascinating panorama of current medical discussions with their philosophical underpinnings, and queries as they have evolved from the past. The role of Tymieniecka's phenomenology of life is brought forth as the system of philosophical reference.

In Speech Acts, John Searle argues that institutional facts presuppose, for their existence, the existence of certain institutions (understood as systems of constitutive rules). In this paper I extend Searle’s theory of institutional facts arguing that a further level is needed for the investigation of the structure of institutional reality: the level of meta-institutional concepts. The meta-institutional concepts are concepts that go beyond (Greek: metá) the institutions of which they are conditions of (...) possibility. An example of meta-institutional concept is the concept of game. In a culture which does not have the concept of game, we could move the chess-men according to the rules of chess, we could also perform a castling, but it would be impossible to play chess. En este artículo discuto dos tesis que Thomas Pogge deriva de su concepción institucional de los derechos humanos: la tesis de la culpa y la tesis de la violación global. La tesis de la culpa asevera que los ciudadanos que contribuyen a sostener un régimen institucional que viola derechos humanos sin realizar compensaciones en beneficio de las víctimas, se convierten ellos mismos en violadores de derechos humanos. Por su parte, la tesis de la violación global asevera que al imponer regulaciones (...) injustas que tienden a generar pobreza extrema, el régimen internacional actual viola los derechos humanos de los pobres del mundo. Mi intención será probar que ambas tesis son insostenibles ya que se basan en presupuestos errados en materia de responsabilidad. Esto no nos conducirá, sin embargo, a abandonar la concepción institucional de los derechos humanos. Por el contrario, una vez depurada de sus problemas, se trata de una concepción que puede ayudarnos a pensar adecuadamente sobre la responsabilidad por los derechos humanos en un mundo globalizado. Social liberals and liberal nationalists often argue that cosmopolitans neglect the normative importance of state sovereignty and self-determination. This paper counter-argues that, under current global political and socio-economic circumstances, only the establishment of supranational institutions with some (limited, but significant) sovereign powers can allow states to exercise sovereignty, and peoples? self-determination, in a meaningful way. Social liberals have largely neglected this point because they have focused on an unduly narrow, mainly negative, conception of state sovereignty. I contend, instead, that we (...) should more closely consider the positive aspects of sovereignty, understood as the capacity to maintain internal problem-solving capacities and make meaningful discretionary choices on a range of national issues. For ten years, 1971–1981, the Institute onHuman Values in Medicine (IHVM) played a keyrole in the development of Bioethics as afield. We have written this history andanalysis to bring to new generations ofBioethicists information about the developmentof their field within both the humanitiesdisciplines and the health professions. Thepioneers in medical humanities and ethics cametogether with medical professionals in thedecade of the 1960s. By the 1980s Bioethics wasa fully recognized discipline. We show the rolethat IHVM programs played in defining thefield, training (...) faculty and helping schools todevelop programs. We review the beginnings ofthe IHVM in the crucible of social andtechnological change that led to theestablishment of the IHVM's parentorganization, the Society for Health and HumanValues. We then turn to the IHVM programsthrough which Faculty members receivedfellowships to explore new crossovers betweenthe humanities and the health professions. Wehave not only described the Fellows Program asit existed in 1973–1980, but have completed asurvey of the fellows a quarter of a centuryafter they held their fellowships. We describeother IHVM programs designed to facilitate theinitiation and development of new humanitiesprograms, to explore conceptual issues betweenmedicine and five humanities fields, to conductissue driven or educational method conferencesand to advance humanities programs intograduate education through the Directors ofMedical Education. Background: Ethical relationships are important among many participants in healthcare, including the ethical relationship between nurse and employer. One aspect of organizational behavior that can impact ethical culture and moral well-being is institutional betrayal. Research aim: The purpose of this concept analysis is to develop a conceptual understanding of institutional betrayal in nursing by defining the concept and differentiating it from other forms of betrayal. Design: This analysis uses the method developed by Walker and Avant. Research context: Studies (...) were reviewed using health literature databases with no date restrictions. Ethical considerations: Analysis was conducted using established guidelines for ethical research. Findings: Although institutional betrayal is a concept applied in the literature, there was a paucity of studies exploring the concept within nursing. Examples of the concept in the literature include violation of trust between organization and nurse, such as provision of inadequate workplace protections, ineffective or hostile management, and gaslighting of those who experience negative events. Examples of institutional betrayal have become more visible during the COVID-19 pandemic. Discussion: A conceptual definition of institutional betrayal is a deep violation of trust or confidence or violation of moral standards committed by an institution toward a nurse. This definition incorporates experiences and issues suggested by the literature. Outcomes are likely negative, including impacts on nurse psychological and workplace well-being. This concept likely fits within a framework of ethical workplaces and has conceptual relationships with moral distress and moral resilience. Further studies can help qualitatively explore and empirically measure this concept. Conclusion: In the pursuit of improving the ethical culture of healthcare workplaces, this concept can provide meaningful insight into organizational behavior and its consequences. Naming and describing the concept can promote conceptual clarity and equip researchers, nurses, and leaders to identify and mitigate the issue. (shrink)

We compare Guala’s unified theory of institutions with that of Searle and Greif. We show that unification can be many things and it may be associated with diverse explanatory goals. We also highlight some of the important shortcomings of Guala’s account: it does not capture all social institutions, its ability to bridge social ontology and game theory is based on a problematic interpretation of the type-token distinction, and its ability to make social ontology useful for social sciences is hindered by (...) Merleau-Ponty’s relation to Husserl has been understood along a spectrum running from outright repudiation to deep appreciation. The aim of this paper is to clarify a significant and heretofore largely neglected unifying thread connecting Husserl and Merleau-Ponty, while also demonstrating its general philosophical import for phenomenological philosophy. On this account, the details of a programmatic philosophical continuity between these two phenomenologists can be structured around the concept of motivation. Merleau-Ponty sees in Husserl’s concept of motivation a necessary and innovative concept (...) that we must formulate in order to properly theorize the anonymous and passive functioning of “operative intentionality.” Motivation is the principle that bridges this domain with the egoic life of consciousness. Merleau-Ponty’s focus on anonymity, bodily habit, and other facets of operative intentionality are thus not a repudiation of Husserl’s analyses of intentionality, but rather a deepening of the notion of consciousness. I conclude by showing how Merleau-Ponty’s early work on motivation lays the conceptual groundwork for his later rethinking of intentionality in terms of institution, and thus mature ontology of the flesh. Some bioethical commentators argue that protection for the institutional conscience of Catholic health care providers should be discarded because the notion is conceptually flawed and conflicts with the demands of medical professionalism. This paper argues in defense of the concept of Catholic institutional conscience. The arguments leveled against the concept of institutional conscience are based on an unsound definition of conscience, assume the validity of a definition of conscience that is amenable to the concept of institutional (...) conscience, and indeed assume the validity of the concept of institutional conscience in order to argue against the conceptual validity of the consciences of Catholic health care institutions. This paper reflects on the idea that social institutions inform the development and justification of principles of justice. First, I situate this question in the context of contemporary debates in political philosophy. Then, I turn to a particular defense of this idea by looking at the conceptual relation established by John Rawls between the concept and the subject of justice. Finally, I look at works by Paul Ricœur in which he discusses Rawls’s theory of justice. Managed care employs two business tools of managed practice that raise important ethical issues: paying physicians in ways that impose conflicts of interest on them; and regulating physicians' clinical judgment, decision making, and behavior. The literature on the clinical ethics of managed care has begun to develop rapidly in the past several years. Professional organizations of physicians have made important contributions to this literature. The statements on ethical issues in managed care of four such organizations are considered here, the American (...) Medical Association, the American College of Physicians, the American College of Obstetricians and Gynecologists, and the American Academy of Pediatrics. Three themes common to these statements are identified and critically assessed: the primacy of meeting the medical needs of each individual patient; disclosure of conflicts of interest in how physicians are paid; and opposition to gag orders. The paper concludes with an argument for a basic concept in the clinical ethics of managed care: physicians and institutions as economically disciplined moral co-fiduciaries of populations of patients. Several logical operators are defined as dual pairs, in different types of logics. Such dual pairs of operators also occur in other algebraic theories, such as mathematical morphology. Based on this observation, this paper proposes to define, at the abstract level of institutions, a pair of abstract dual and logical operators as morphological erosion and dilation. Standard quantifiers and modalities are then derived from these two abstract logical operators. These operators are studied both on sets of states and sets of (...) models. To cope with the lack of explicit set of states in institutions, the proposed abstract logical dual operators are defined in an extension of institutions, the stratified institutions, which take into account the notion of open sentences, whose satisfaction is parametrised by sets of states. A hint on the potential interest of the proposed framework for spatial reasoning is also provided. (shrink)

In this paper, I will look at the relationship between Weitz’s claim that art is an “open” concept and Dickie’s institutional theory of art, in its most recent form. Dickie’s theory has been extensively discussed, and often criticized, in the literature on aesthetics, yet it has rarely been observed – to my knowledge at least – that the fact that his theory actually incorporates, at least to some extent, Weitz’s claim about the “openness” of the concept of art, precisely (...) accounts for what I take to be the main flaws in the theory. In what follows I present arguments for that claim, looking briefly at the position of both authors with respect to the concept of art, then showing how they relate to each other, and what implications this has for Dickie’s institutional theory, and more generally for the traditional project of characterising art. At the turn of the Millennium, the issue of education, especially higher education, its role in state formation and impact on the life of society acquired particular relevance and became a subject of research of not only teachers and historians but also economists, political analysts, psychologists, social scientists and, above all, philosophers (which gave rise to a variety of models and trends in the philosophy of education). In the meantime, there is some lack of fundamental integrative studies into comprehensive educational-managerial (...) and socio-historical, socio-economic and state-political experiences of some developed countries in the implementation of these philosophical and educational paradigms, trends, models and reforming/modernization concepts of higher education and science, to be examined with consideration for similar challenges faced by education and science in Ukraine. Nearly every developed country has wide experience in building up a system of higher education. Results of reviewing such experience may contribute to the development and enrichment of the domestic educational system, afford an opportunity to avoid repeating mistakes and offer new approaches to solving a range of problems in this field. Based on the above, we also believe that it is impossible to pretend to develop a strategy for educational and scientific modernization reforms that deal with challenges of educational and scientific institution of society in management of scientific and educational space (which applies to both a social component of the philosophy of education and the field of educational management) without analyzing the existing models, schools, trends and their classification in the modern philosophy of education. The article traces the origin and development of the concept of social skills in first and foremost American academic discourse. As soon as the concept of social skills was coined, the concern for people lacking such skills started and has been on the increase ever since. After the analysis of the academic history of the concept follows an examination of the implementation of a range of assessment instruments and training programmes related to social skills in contemporary Danish welfare institutions. The (...) analysis forwarded in the article thus demonstrates how an intellectual idea may develop and travel - and on its journey connect to pre-existing cultural logics and societal concerns. The idea of social skills has through its development been made uncontroversial – everybody wants to be skilful. The concept does, however, convey an individualistic view on social life and imposes a reflexivity over own performance on the participants. Further, its normative character contributes to a problematization of those who are perceived to lack these skills. (shrink)

Half a century after Michael Polanyi conceptualised ‘the tacit component’ in personal knowing, management studies has reinvented ‘tacit knowledge’—albeit in ways that squander the advantages of Polanyi’s insights and ignore his faith in ‘spiritual reality’. While tacit knowing challenged the absurdities of sheer objectivity, expressed in a ‘perfect language’, it fused rational knowing, based on personal experience, with mystical speculation about an un-experienced ‘external reality’. Faith alone saved Polanyi’s model from solipsism. But Ernst von Glasersfeld’s radical constructivism provides scope to (...) rethink personal tacit knowing with regard to ‘other people’ and the intersubjectively viable construction of ‘experiential reality’. By separating tacit knowing from Polanyi’s metaphysical realism and drawing on Benedict Anderson’s concept of ‘imagined communities’, it is possible to conceptualise ‘imagined institutions’ as the tacit dimension of power that shapes human interaction. Whereas Douglass North claimed institutions could be reduced to rules, imagined institutions are known in ways we cannot tell. (shrink)

Understanding Institutions proposes a new unified theory of social institutions that combines the best insights of philosophers and social scientists who have written on this topic. Francesco Guala presents a theory that combines the features of three influential views of institutions: as equilibria of strategic games, as regulative rules, and as constitutive rules. -/- Guala explains key institutions like money, private property, and marriage, and develops a much-needed unification of equilibrium- and rules-based approaches. He also critically analyses the theory of “looping effects” and “interactive kinds” defended by Ian Hacking, and asks whether it is possible to draw a demarcation between social and natural science using the criteria of causal and ontological dependence. In this article, I discuss the concepts of social position and social status, the types of social position, as well as the determinedness of social statuses by the given positions in a new approach. In the first, introductory part of the article, I emphasize that the institutional sociological conception of social position in my approach is relatively closest to the structuralist position conception. In the second part, I introduce two different concepts, labelled social position and social status, (...) and briefly review the social determinedness of social status. In the third part, social positions are typified from the point of view of the two components of social position: on the one hand, from that of social power relations and on the other from that of interest relations. I point out that the different social positions promote the realization of interests to different degrees, that is, they make it possible to attain different social statuses. In a related article, I illustrate the concepts and connections in question with a case study carried out on an industrial shop floor. (shrink)

The fundamental importance of theology in the work of Carl Schmitt has been the subject of much recent literature on this controversial figure. However, there has been little consensus on the precise nature of Schmitt's own political theologydecisionisminstitutional thinking,” in order to reveal the theological basis for his understanding of the new regime. I will then argue that Schmitt's institutional approach had in fact always been central to his earlier, better-known writings on law and the state. Schmitt's concept of (...) the institution, which had roots in French legal theory, grounded a political theology that was in the end less a metaphysical approach to the state than one that drew on the concrete example of the legal institutional order of the Catholic Church. Agonistic Democracy explores how theoretical concepts from agonistic democracy can inform institutional design in order to mediate conflict in multicultural, pluralist societies. Drawing on the work of Foucault, Nietzsche, Schmitt, and Arendt, Marie Paxton outlines the importance of their themes of public contestation, contingency and necessary interdependency for contemporary agonistic thinkers. Paxton delineates three distinct approaches to agonistic democracy: David Owen's perfectionist agonism, Mouffe's adversarial agonism, and William Connolly and James Tully's inclusive agonism. Paxton demonstrates how each is (...) fundamental to enabling citizens to cultivate better virtues for themselves and society (Owen), motivating democratic engagement (Mouffe) and enhancing relations of respect and understanding between conflicting citizens (Connolly and Tully). Situated within the context of a deeply polarised post-Trump America and post-Brexit Britain, this book reveals the need to rethink our approach to conflict mediation through democratic institutions. Pulling together insights from experimental research with deliberative democratic innovations, Paxton explores how agonistic theory might be institutionalised further. Through discussing ways in which agonistic institutions might be developed to render democracy more virtuous, more engaging, and more inclusive, Agonistic Democracy provides a unique resource for students of contemporary political theory. Being part of the life of institutions requires a considerable amount of conceptual knowledge. In institutional settings, we must learn the relevant concepts to act meaningfully, and these concepts are internal in a peculiar way, namely, they are strictly relative to the rules of a given institution because they are constituted by those rules. However, institutions do not come out of nothing: They are inscribed in a social setting and this setting determines, at least in a broad (...) sense, what is the nature of the institution. Our social life therefore creates more or less defined contexts for meaningful institutional activities, and these contexts in their own turn involve concepts. In this paper, I address this question by distinguishing between three kinds of concepts relevant for an institution and trying to identify the different relations that these concepts have with constitutive rules. I then proceed to explain how this distinction can improve our understanding of practical reasoning in institutional context. (shrink)

The present volume contains a selection of papers presented at the Fifth Conference on Collective Intentionality held at the University of Helsinki August 31 to September 2, 2006 and two additional contributions. The common aim of the papers is to explore the structure of shared intentional attitudes, and to explain how they underlie the social, cultural and institutional world. The contributions to this volume explore the phenomenology of sharedness, the concept of sharedness, and also various aspects of the structure (...) of collective intentionality in general, and of the intricate relations between sharedness and normativity in particular. Concepts of Sharedness shows how rich and lively the philosophical research focused on the analysis of collective intentionality has become, and will provide further inspiration for future work in this rapidly evolving field.
