This article examines Martin Luther’s view of Natural theology and natural knowledge of God. Luther research has often taken a negative stance towards a possibility of Natural theology in Luther’s thought. I argue, that one actually finds from Luther’s texts a limited area of the natural knowledge of God. This knowledge pertains to the existence of God as necessary and as Creator, but not to what God is concretely. Luther appears to think that the natural knowledge of God is limited (...) because of the relation between God and the Universe only one side is known by natural capacities. Scholastic Theology built on Aristotelianism errs, according to Luther, when it uses created reality as the paradigm for thinking about God. Direct experiential knowledge of the divinity, given by faith, is required to comprehend the divine being. Luther’s criticism of Natural theology, however, does not appear to rise from a general rejection of metaphysics, but from that Luther follows certain ideas of Medieval Augustinian Platonism, such as a stark ontological differentiation between finite and infinite things, as well as the idea of divine uniting contradictions. Thus the conflict between faith and reason on Luther seems to be explicable at least in part as a conflict between two different ontological systems, which follow different paradigms of rationality. This paper reviews how research on the demarcation problem has developed, starting from Popper’s criterion of falsifiability and ending with recent naturalistically oriented approaches. The main differences between traditional and contemporary approaches to the problem are explicated in terms of six postulates called the traditional assumptions. It is argued that all of the assumptions can be dismissed without giving up on the demarcation problem and that doing so might benefit further discussions on pseudoscience. Four present-day research movements on evaluating the (...) boundaries of science are introduced: (1) philosophy of pseudoscience, (2) social epistemology of dissent, (3) agnotology, and (4) evaluation of expertise. Relaxed realist theories are becoming more common in metanormative theory. They want the advantages of robust forms of realism but without their metaphysical underpinnings. However, it is not always clear how we should understand relaxed realist theories in general. In this paper I clarify and defend relaxed realism. First, I characterise and distinguish relaxed realist theories from robust realist theories. Second, I defend relaxed realism against a challenge from truthmaker theory.

Recent epistemology of modality has seen a growing trend towards metaphysics-first approaches. Contrastingly, this paper offers a more philosophically modest account of justifying modal claims, focusing on the practices of scientific modal inferences. Two ways of making such inferences are identified and analyzed: actualist-manipulationist modality and relative modality. In AM, what is observed to be or not to be the case in actuality or under manipulations, allows us to make modal inferences. AM-based inferences are fallible, but the same holds for (...) practically all empirical inquiry. In RM, modal inferences are evaluated relative to what is kept fixed in a system, like a theory or a model. RM-based inferences are more certain but framework-dependent. While elements from both AM and RM can be found in some existing accounts of modality, it is worth highlighting them in their own right and isolating their features for closer scrutiny. This helps to establish their relevant epistemologies that are free from some strong philosophical assumptions often attached to them in the literature. We close by showing how combining these two routes amounts to a view that accounts for a rich variety of modal inferences in science. (shrink)

BackgroundGenetic disorders due to kindred marriages are common medical conditions in Iran; however, the legal aspects of abortion remain controversial. This study was undertaken to determine physicians' opinions regarding the termination of pregnancy for three genetic diseases: thalassemia major, hemophilia, and Down's syndrome.MethodsA questionnaire was administered to selected physicians by stratified random sampling to determine the following: age, gender, knowledge about prenatal diagnosis of diseases in high risk pregnancies, agreement with abortion, recommended gestational age for abortion, and, if opposed to (...) abortion, the reason.ResultsOf 323 physicians, who participated in the study, 91.3(295), 40.6(131), and 78.6%(254) were in agreement and 8.7(28), 59.4(192), and 21.4%(69) were opposed to abortion for thalassemia major, hemophilia, and Down's syndrome, respectively. Among 289 physicians opposed to abortion in respect of each of all three conditions, the following reasons were cited: religion, 18; emotional, 10; quality of care, 23; hope to find a new treatment option in the future, 103; miscellaneous reasons, 6; and a combination of these reasons, 129. Among 680 physicians in agreement with abortion in relation to all of the diseases, 4.6%(31) were agreed with abortion in less than 12 weeks gestation, 79.2%(538) in less than 16 weeks gestation, 5.6%(38) in less than 20 weeks gestation, 2.2%(15) in less than 24 weeks gestation, and 8.4%(58) were agreed with beyond the 24 weeks of gestational age.ConclusionThe majority of physicians were in agreement with abortion for thalassemia major and Down's syndrome because of the overall prognosis, but opposed to abortion for hemophilia. The Enlightenment philosophy, particularly the ideas of Thomas Hobbes and his concepts surrounding the State and Society, serves as a philosophical foundation for numerous subsequent discussions in the fields of social and political sciences. Hobbes’ perspective on human nature and his portrayal of the natural state versus civilization are undeniably among the central tenets of modern thought. He characterizes humanity as the ‘wolf-man’ and underscores the necessity of a social contract-based civilized state to ensure security and safeguard collective interests. Hobbes (...) is primarily concerned with peace, and his political framework, rooted in a modern scientific sense, is designed with the explicit goal of establishing and preserving peace. In the natural state, where humanity exists in an uncivilized condition, each individual is self-interested and disconnected, resulting in a landscape fraught with danger and insecurity. However, a glimmer of hope arises from the fact that human awareness of this predicament serves as the very genesis of contemplation and thought directed towards salvation. The cornerstone of security in the natural state is the equality of all individuals within it. According to Hobbes, society does not represent the spontaneous formation of a fundamental condition for collective life but, rather, the conscious regulation of a potentially volatile state perpetually on the brink of conflict. Through surveys, Hobbes asserts that a majority of people within a society willingly delegate their power and authority to an individual or a group, enabling them to consolidate the various wills into a unified collective will through a voting process. This article aims to explore a fundamental shift in ethics as we transition from classical ethics centered around ‘good’ to modern social ethics founded on ‘security’ and ‘stability.’. (shrink)

This paper argues that the proponents of epistemological scientism must take some stand on scientific methodology. The supporters of scientism cannot simply defer to the social organisation of science because the social processes themselves must meet some methodological criteria. Among such criteria is epistemic evaluability, which demands intersubjective access to reasons. We derive twelve theses outlining some implications of epistemic evaluability. Evaluability can support weak and broad variants of epistemological scientism, which state that sciences, broadly construed, are the best sources (...) of knowledge or some other epistemic goods. Since humanities and social sciences produce epistemically evaluable results, narrow types of scientism that take only natural sciences as sources of knowledge require additional argumentation in their support. Strong scientism, which takes sciences as the only source of knowledge, also needs to appeal to some further principles since evaluability is not an all-or-nothing affair. (shrink)

Der Koran als Offenbarung beansprucht nämlich Wahrheit; eine Wahrheit, die aber ästhetisch vermittelt ist. In welcher Relation stehen indes Wahrheit und Schönheit des Korans zueinander? Offenbarung ist stets Vermittlung; doch wie lassen sich Transzendenz und Existenz zusammendenken? Grundlegend also: Worin besteht der Standpunkt der systematisch-islamischen Theologie? This thesis is concerned with a relaxed form of normative realism. Relaxed realists accept the existence of mind-independent normative truths, properties, and facts, but argue that normative truths do not have truthmakers and that normative properties and facts are not metaphysically robust. The thesis develops relaxed realism by responding to various objections and challenges. The first paper argues that relaxed realists can answer questions about normative language without their theory collapsing into one of the familiar theories in the literature or (...) becoming implausible. More specifically, contrary to Michael Ridge (2019), it argues that relaxed realists can embrace an inferentialist account of normative terms without their theory collapsing into naturalism or quasi-realism. The second paper offers an account of normative belief specifically designed for relaxed realists. It argues that relaxed realists can explain normative belief through a functionalist theory of mind. This proposal not only provides relaxed realists with an explicit explanation of normative belief but also distinguishes it from related theories, notably quasi-realist theories. In doing so, it addresses a previously unresolved dilemma raised by Ridge (2019) and Böddeling (2020) concerning the relaxed realist’s view of normative belief. The third paper clarifies and defends relaxed realism. It justifies the claim that normative truths do not have truthmakers by arguing that these truths are true not because of the existence of truthmaking entities but simply because of the way things are normatively. The fourth paper examines the kind of relaxed realist theory that Scanlon (2014) defends within a “domain-centered view” of existence and truth. The article highlights how this view makes relaxed realism more viable by defending it against objections based on substantive domain-independent ideas, such as the idea that all (synthetic) truths must have truthmakers. Additionally, it presents a distinct argument, different from the one presented in the third paper, to justify the claim that normative truths do not have truthmakers. (shrink)

BackgroundBesides physical complications, COVID-19 is associated with psychological issues such as fear and anxiety. High resilience in nurses enables them to adopt positive coping mechanisms and successfully operate in the stressful environment of COVID-19 wards. The present study aimed to evaluate the correlation between COVID-19 fear and anxiety with resilience in the emergency nurses of the hospital affiliated with Kurdistan University of Medical Sciences (west of Iran) in 2021.Materials and methodsThis cross-sectional study was conducted on 295 emergency nurses of selected (...) hospitals in Kurdistan province, Iran, in 2021. Data were collected using a demographic questionnaire, Fear of COVID-19 Scale (FCV-19S), Corona Disease Anxiety Scale (CDAS), and Connor-Davidson Resilience Scale (CD-RISC). Data analysis was performed in R software version 3.6.3.ResultsThe mean scores of resilience, COVID-19 fear, and COVID-19 anxiety were 55.07 ± 19.82 (ranging from 0 to 100), 20 ± 7.37 (ranging from 7 to 35) and 36.48 ± 13.21 (ranging from 18 to 54) respectively. There was a negative and significant correlation between resilience with COVID-19 fear (r = −0.449, p = 0.001), COVID-19 anxiety (r = 0.458, p = 0.001). A significant correlation was observed between COVID-19 fear and anxiety, which indicated that if the other demographic variables remained unchanged, a one-unit increase in COVID-19 fear and anxiety decreased the mean resilience score by −0.66 (P = 0.008) and −0.34 (P = 0.015), respectively.ConclusionCOVID-19 fear and anxiety were significantly correlated. Therefore, providing training courses for promoting resilience could reduce the fear and anxiety of nurses during the COVID-19 pandemic. (shrink)

Yleensä Wienin piirin loogista empirismiä kannattaneet filosofit mielletään antirealisteiksi. Tässä artikkelissa kuitenkin argumentoidaan, että piirin johtohahmo Moritz Schlick oli eräänlainen realisti myös nykystandardien valossa. Näin ollen – niin yllättävältä kuin se kuulostaakin – positivismi ja realismi ovat yhteensovitettavissa. Schlick tosin erotti kannattamansa empiirisen realismin jyrkästi metafyysisestä realismista, jota hän piti merkityksettömänä. Schlickin realismin esittelyn lisäksi artikkelissa tarkastellaan yleisellä tasolla hänen epistemologiaansa, kielifilosofiaansa ja metafysiikan kritiikkiään. Tekstissä pohditaan myös Schlickin suosiman realismin asemaa ja relevanssia nykyisessä realismikeskustelussa.

To counter a general belief that all the paradoxes stem from a kind of circularity (or involve some self--reference, or use a diagonal argument) Stephen Yablo designed a paradox in 1993 that seemingly avoided self--reference. We turn Yablo's paradox, the most challenging paradox in the recent years, into a genuine mathematical theorem in Linear Temporal Logic (LTL). Indeed, Yablo's paradox comes in several varieties; and he showed in 2004 that there are other versions that are equally paradoxical. Formalizing these versions (...) of Yablo's paradox, we prove some theorems in LTL. This is the first time that Yablo's paradox(es) become new(ly discovered) theorems in mathematics and logic. Tech companies have eagerly utilised mindfulness techniques in order to increase both creativity and productivity among their managers and employees. However, while a growing number of studies within fields of clinical psychology and psychiatry suggest that mindfulness provides myriad health benefits, such literature does not critically evaluate the societal and affective influences of mindfulness and other wellness practices on working bodies. By focusing on discourses related to mindfulness training, this paper explores the conception of ‘being present’. Drawing on the phenomenology (...) of the body, affect theory, and critical mindfulness studies, we develop a new theoretical framework for analysing mindfulness as a somatic and social force in technology-driven business contexts. Using research material drawn from the online advertising of mindfulness programmes for managers, this paper describes ‘presence’ as a new labour concept associated with the cultivated performance skill of the managerial body in the era of late capitalism. We conclude that mindfulness training – transforming the somatic into an affective investment – has transformed Buddhist meditation into capital that can be bought and consumed. (shrink)

In God Emperor of Dune, Leto II explains to Moneo why people destroyed thinking machines in the Butlerian Jihad: "Humans had set those machines to usurp our sense of beauty, our necessary selfdom out of which we make living judgments." The Orange Catholic Bible (OCB), the key religious text in the Dune universe, forbids the creation of machines that imitate human thinking: "Thou shalt not make a machine in the likeness of a man's mind." The OCB focuses on human mental (...) abilities – especially computation, reason, and logic – that have a status that machines should not emulate. In Frank Herbert's universe, divine imitation and creation are presented in conflicting ways: on the one hand, they are strictly prohibited, on the other, they are aspirations for key characters. Hydrogen fuel cells are likely to begin replacing conventional internal combustion engines as a power generation method for transportation applications in the near future. A life cycle analysis of a hydrogen fuel cell was performed to examine the major environmental impacts of such an engine in comparison with an internal combustion engine. To quantify the emissions, material consumption and energy consumption were identified by carrying out mass and energy balances, respectively. Wherever possible, a “well-to-wheel” approach was adopted to identify all (...) the processes involved. The size of the hydrogen fuel cell engine selected was 60 kW, which would power a small automobile weighing around 800 kg. This report briefly describes the materials and processes involved in assembling such an engine, with their respective environmental impacts. Different technologies to build a hydrogen economy also are discussed because hydrogen is an integral part of most fuel cell engines. The main conclusion is that if an environmentally sustainable system of hydrogen production is found, the use of hydrogen and, in turn, hydrogen fuel cell cars would be highly beneficial. Thus, the theoretical potential of fuel cells is great for environmental benefits, but practical applications might prove otherwise. (shrink)

Filosofian piirissä on viime aikoina käyty intensiivistä keskustelua metafysiikan naturalisoinnista ja tieteellisen metafysiikan mahdollisuudesta. Yksi tämän keskustelun keskeisistä teoksista on James Ladymanin ja Don Rossin (sekä osin John Collierin ja David Spurrettin) kirjoittama Every Thing Must Go (2007). Tässä kirjassa Ladyman ja Ross puolustavat, omien sanojensa mukaan, neopositivistista skientismiä. Heidän ohjelmansa on skientistinen, koska Ladymanin ja Rossin mukaan tiede on ainoa tapa tutkia todellisuutta objektiivisesti. Neopositivismi ilmenee puolestaan siinä, että heidän ohjelmansa tukeutuu eräänlaiseen verifikaatioperiaatteeseen. Ladymanin ja Rossin verifikaatioperiaate ei kuitenkaan (...) perustu, toisin kuin aiempien positivistien vastaava, kielelliseen merkitykseen tai suoriin havaintoihin vaan tiedeyhteisöön. Tiedeyhteisö päättää, mitkä kysymykset ja teoriat ovat tutkimisen arvoisia. Ladyman ja Ross esittelevät kirjassaan kaksi metafyysistä ohjelmaa: negatiivisen ja positiivisen. Toisaalta he pyrkivät kritisoimaan analyyttistä metafysiikkaa, jota he pitävät liiaksi irtautuneena nykytieteestä, ja toisaalta antamaan oman naturalistisen metafysiikkansa. Pyrimme tässä artikkelissa osoittamaan, että Ladymanin ja Rossin positiivinen ohjelma on jännitteessä, tai jopa ristiriidassa, heidän negatiivisen ohjelmansa kanssa. Tämä näkyy Ladymanin ja Rossin sitoutumisesta modaalirealismiin ja siinä, miten he yrittävät oikeuttaa sitoumuksensa. Jännitteen vuoksi Ladymanin ja Rossin on luovuttava joko modaalirealismista tai metafysiikalle antamistaan tiukoista vaatimuksista. (shrink)

Respect for human dignity is a basic and crucial component of nursing care. Illness with restricted physical ability and being confined to bed can compromise the dignity of patients. The views of adolescents regarding dignity in care have not previously been researched. This article details a descriptive-analytic study in which survey data was collected from all nurses and compared with a convenience sample of 180 hospitalized adolescents in two hospitals in Iran. The data was analyzed with SPSS software. A significant (...) difference between nurses and hospitalized ill adolescents’ perceptions was identified in relation to: understanding the importance of privacy (p < 0.001); observance of privacy (p < 0.001); importance of interaction between nurses and patients (p = 0.019); and the observance of interaction between nurses and patients (p < 0.001). Attention to adolescents’ views about dignity can help nurses to improve quality of care for this group. (shrink)

Informed by theories of embodied cognition, in the present study, we designed a novel priming technique to investigate the impact of spatial diversity and script direction on searching through concepts in both English and Persian (i.e., two languages with opposite script directions). First, participants connected a target dot either to one other dot (linear condition) or to multiple other dots (diverse condition) and either from left to right (rightward condition) or from right to left (leftward condition) on a computer touchscreen (...) using their dominant hand's forefinger. Following the spatial prime, they were asked to generate as many words as possible using two‐letter cues (e.g., “lo” → “love,” “lobster”) in 20 s. We hypothesized that greater spatial diversity, and consistency with script direction, should facilitate conceptual search and result in a higher number of word productions. In both languages, word production performance was superior for the diverse prime relative to the linear prime, suggesting that searching through lexical memory is facilitated by spatial diversity. Although some effects were observed for the directionality of the spatial prime, they were not consistent across experiments and did not correlate with script direction. This pattern of results suggests that a spatial prime that promotes diverse paths can improve word retrieval from lexical memory and lends empirical support to the embodied cognition framework, in which spatial relations play a crucial role in the conceptual system. TQM is a comprehensive look which encompasses virtually every aspect of the value chain as well as the human resource and customer satisfaction. Therefore, a great number of companies feel obliged to implement its rules, and procedures. However, the concept is rather complicated and culture-bound, and calls for further research in new settings. (...) The aim of this study is to examine the influences of critical success factors of TQM on customer focus therefore, employees are classified based on their perceptions from critical success factors of total quality management and consequently the level of customer focus is compared between the different classifications. In some cases, Avicenna used the semantical premises in order to deduce some conclusions in his Physics. For instance, he analyzes five derivatives of the word “tabiat” and then in the light of these analyses, he concludes that the natural properties of an object are caused by its essence and are based on it. Here, the major problem is how to justify Avicenna's passage from semantical premises to physical consequents. This paper shows that through analyzing the relation between nature and (...) its derivatives, on one hand, and explicating Avicenna’s definition of the “nature” on the other hand, we can defend the rationality of such a passage. In this article, we try to study Clark Pinnock’s point of view in explaining the methodological foundations of the Open Theism Theory with a descriptive-analytical method so that we can have a fair critique of the strengths and weaknesses of this theory while also understanding it correctly. Pinnock can be considered one of the most important theorists and founders of Open Theism. In his view, Open Theism is one of the theological-philosophical theories that have emerged in the critique of the (...) teachings of traditional Christian theology and consider its claims to be logically and narratively contradictory. Pinnock believes that open theists sanctify God as acknowledged in the Bible and that some of the attributes of God in traditional theology should be revised and modified based on the text of the Bible. They believe that God is the God of the Bible; someone who is truly connected to the world, a relationship that requires the most mobility, not immobility. In this view, God is portrayed as a triune relationship-oriented truth, which seeks romantic relationships with human beings and thereby grants them true freedom. Finally, since open theists believe that theology should be understood by the people of the present age, a better explanation of theology depends on reliance on modern philosophy and its effects. In modern philosophy, method and methodology have become very important. In general, methodology is the knowledge that recognizes “how to go” and the fundamental methodology reveals the hidden principles of each theory and creates the basis for its basic critique. Of course, the purpose of this article is specifically to examine the “basics” of Pinnacle’s method, not his “method.” In fact, the report presented by his method is a platform for examining the basics. From the author’s point of view, most of the mistakes that have been made in traditional theology are also reflected in Open Theism; leading in another way! That is to say, most of the objections that Pinnock made to traditional theologians also apply to him. For example, why is it bad to be influenced by Greek philosophy, but Open Theism’s claims can be influenced by modern philosophy? Do ancient philosophy and modern philosophy have precise and acceptable boundaries at all? On what basis do open theists claim that modern philosophy is more acceptable to modern people than ancient philosophy? Can mere simultaneity justify it? If we take as a basis the claim of open theists – that every thought comes “from somewhere” and that no thought is pristine – the encounter of open theists with the text of the Bible is also done with the presuppositions of modern philosophy, and their pivotal mindset has influenced their understanding of the Bible. How can one be sure that the path taken by theology is more correct than the path taken by its predecessors? Since a better understanding of each theory is gained by reflecting on its foundations, in this article we intend to examine the methodological foundations of Open Theism by looking at the book Most Moved Mover. In general, from Pinnock’s point of view, the method of open theism can be based on the three main bases of the critical study of the interpretation of traditional theologians, return to the Bible and overcoming Hellenism, and attention to modern philosophy, which we will describe and critique. Public health ethics is a subfield of bioethics that focuses on population health. This study aims to conform the principles of biomedical ethics to Islamic values in the context of public health. It culturally helps to optimize health care delivery. The approach is based on the method of immanent critique. The principle of the common good in Islam has a rational justification to draw public interests and ward off harms. The rule of “no harm”, with an emphasis on the preferability (...) of preventing harm to increase benefits, is consistent with the principle of utility, intending to produce a maximum balance of benefit over harm in the context of public health. Thus, on the one hand, the government is obliged to prevent harm and improve public benefits and, on the other hand, as a steward of health and with reference to the article “limitation of the ownership dominance”, it has the right to protect public health with the least justifiable harm. Islam attention to human dignity, individual justice and good will in the rule of goodness implies that Islam, beyond distributive justice, knows that human flourishing and the cultivation of moral virtues are a requisite for the realization of social justice. The present study discusses about the adjustment of the principles of PHE to the principles of the Islamic jurisprudence and, at the same time, it explains why the optimal PH in Muslim societies requires research in order to define accurate indicators of benefit and harm based on the teachings of revelation and reason. The idea of “creatio ex nihilo” entered the arena of natural science with the advent of modern cosmology in the mid-twentieth century. This idea, that is, the creation of the universe out of nothing, seems to be a consequence of the widely accepted Big Bang Theory which implies the temporal finitude of the world. In order to avoid the theological and metaphysical implications of such an idea, some scenarios and scientific models have been proposed. According to one of the scenarios, (...) the creation ex nihilo of the world is a causal physical phenomenon, and, hence, can be explained scientifically by appealing to the laws of nature. In this essay, I aim to discuss and criticize this idea. To fulfill this aim, in the introduction some achievements of modern cosmology will be very briefly introduced. In the next three sections, the notions of existence and nothingness, creation,scientific explanation, and singularity will be explored. It will be shown that what philosophers mean by these notions isradically different fromthe naïve ideas of some scientists. Hence, applying these notions to physical models of the origin of the universe is completely misleading. This work concludes that no scientific explanation appealing to the laws of nature can possibly explainthe creation of the universe out of nothing. (shrink)

In this paper I argue that relaxed realism can answer questions about normative language and thought without collapsing into one of the familiar views in the literature or becoming implausible. More specifically, contrary to Michael Ridge, I argue that relaxed realists can use an inferentialist approach to metasemantics without their view collapsing into naturalism or quasi-realism. The inferentialist account that I propose is that the role of normative expressions involves language-entry transitions construed as rational intuitions and language-exit transitions explained in (...) terms of rational agency. I argue that this account fits with relaxed realism and keeps the view distinct from naturalism, quasi-realism, and other familiar views in the literature. (shrink)

There are two possible ways to understand form and substance in legal reasoning. The first refers to the distinction between concepts and their applications, whereas the second concentrates on the difference between authoritative and non-authoritative reasons. These approaches refer to the formalistic and positivistic conceptions of the law, the latter being the author's point of departure. Nevertheless, they are both helpful means of analysis in legal interpretation. Interpretation is divided into formal and substantive justification. They have certain functions and they (...) are utilized in interaction. Authoritative reasons and formal reasoning constitute the necessary point of departure. However, substantive reasons are also necessary in order to justify choices included in interpretation. In addition to formal and substantive reasoning, the role of legal concepts is analysed. This paper deals with the problems involved in the concept of knowledge in the sphere of law. Traditionally, the idea of knowledge has dealt with the presumption of given objects of information. According to this approach, knowing means finding these objects. This is the natural and understandable foundation of metaphysical or philosophical realism. Cognition and cognitive interest are directed outside the sentences by which they are described. This is the point of departure of legal positivism as well. However, it is (...) not possible to see valid law as totally independent of language and concepts. This makes the idea of legal facts as institutional facts vague. From a practical viewpoint, the sentences of judges and legal scholars, when they present valid law, justify rather than describe. Their crucial function is interpretation. Hence, the objectivity of these sentences cannot be based on the presumption of separate objects either. Instead, it has to be based on the principles of acceptable reasoning. Moreover, the author claims that this kind of approach, united with the utilization of human rights and substantial legal principles, leads one to acknowledge objective values. (shrink)

This paper deals with the concept of practical wisdom and its applications in the field of jurisprudence. The starting point is the Aristotelian idea that a skill to understand and apply law is an embodiment of practical sense. racticality of law has many dimensions. One important dimension is contextuality. Contextuality appears as the situation dependence of interpretation. Hence, the ultimate content of law is context dependent, too. I try to elucidate the essence of practicality of law and its interpretation by (...) examining a precedent of the Finnish Supreme Court (KKO 1997: 87). It is a case involving the distribution of an estate among heirs. The main idea of that decision is that the proper values of inheritance‐shares depend on the utilization values of them and the whole economic situation among heirs. What is just depends on a situation. Taken seriously, the practicality and contextuality of law forces us to adopt an unconventional conception of jurisprudence. First, it is doubtful if one can point to any scientific method at all. Second, according to this conception, legal dogmatics is not a description of law. Rather, it is a skill of argumentation, the skill of taking considered steps from different kinds of arguments to conclusions. The purpose of legal dogmatics is to offer valid and useful arguments to be used in different situations. (shrink)

This research aimed to investigate the status of children-specific metadata elements in theory (existing literature) and practice (metadata standards and children’s digital libraries). Literature reviews as well as two cases, including children’s online national libraries of Iran, and Singapore, are used to identify children-specific metadata elements and their application. The results revealed that descriptive metadata types had been mentioned more than analytical, social, and relational types; the DCMI metadata standard, besides LOM and ALTO metadata standards, can be used to develop (...) an application profile for children’s library catalogs. Two cases showed that they partially cover children-specific metadata elements, and neither has covered relational metadata elements. A deeper analysis of the children-specific metadata elements suggests that children’s catalogs should be semantic and social. The results of this study can be insightful for children’s book catalogers and children’s book publishers (for marketing purposes). (shrink)

The ideas of creatio ex nihilo of the universe and creatio continua of new matter out of nothing entered the arena of natural science with the advent of the Big Bang and the steady-state theories in the mid-twentieth century. Adolf Grünbaum has tried to interpret the steady-state theory in such a way, to show that the continuous formation of new matter out of nothing in this theory can be explained purely physically. In this paper, however, it will be shown that (...) Grünbaum's interpretation encounters at least three problems: not distinguishing between material and efficient causes, inconsistency, and misconceiving the law of density conservation. (shrink)

The realization of dwindling fossil fuel supplies and their adverse environmental impacts has accelerated research and development activities in the domain of renewable energy sources and technologies. Global energy demand is expected to rise during the next few decades, and the majority of today's energy is based on fossil fuels. Alternative energy sources and technologies can play a vital role in lowering or eliminating our reliance on fossil fuels. However, such a transition will require a large investment and will not (...) be reversible. The benefits of hydrogen and other liquid fuels as transportation fuels are not marginal, but the real urgency in greenhouse gas reductions and fossil fuel replacement should not be translated into an energy infrastructure based on unsustainable sources in the long run. It is wise to examine each option thoroughly and objectively now and discard those with little potential so our focus and effort may be placed elsewhere. (shrink)

Studies regarding rural entrepreneurs in developing countries and, specifically, their well-being have not been sufficiently developed in the literature. The present study was an attempt to fill this gap and to examine important antecedents and outcomes associated with entrepreneurial well-being among a sample of 102 Iranian rural entrepreneurs. This research established a theoretical research model that highlighted the relationships among job fit, entrepreneurial passion, well-being, and persistence. The results of structural equation modeling supported the hypothesized model. In particular, the results (...) indicated that higher job fit was associated with higher levels of entrepreneurial well-being through an entrepreneurial passion mechanism. Moreover, the results supported the hypothesized serial mediating effect. In other words, a high level of job fit enhances entrepreneurial persistence through a high level of entrepreneurial passion and well-being. This study provides significant input to policymakers and practitioners in their efforts to promote the antecedents and outcomes of well-being among rural entrepreneurs. (shrink)
