Carl Schmitt's critique of liberalism includes a specific attack on the philosophical coherence of the rule of law as a component of constitutional sovereignty, a view he identifies with the wider liberal tradition. Despite his associations with Nazism it has been taken up recently by post-modern critics of Liberalism. This article analyses Schmitt's claims and then compares them with what representative liberals actually say about the rule of law. The finding is that at least two major thinkers -- Locke and (...) Burke -- show none of the ignorance or naivete with which Schmitt charges the tradition. Concepts such as the exception are recognised and included in their political analyses -- but, unlike Schmitt, not in their prescriptions. (shrink)

Reading Burke’s Vindication of Natural Society as targeting Rousseau insinuates continuity between Burke’s preoccupations in that work and his later opposition to Rousseau as supposedly also based on radical state-of-nature arguments. But neither contextual nor intra-textual evidence supports any Rousseau—Vindication connection, and the putative link implicitly misreads Burke’s preoccupation in the Vindication , the grounds of his critique of Rousseau, and the role Burke ascribes to the latter in the revolution. The real target of the Vindication was Bolingbroke’s application of (...) philosophical rationalism to religion. This kind of argument he only later came to see applied to politics. Burke’s later opposition to Rousseau is based not on the revolutionaries’ (dubious) claim that Rousseau endorsed their radical state-of-nature and natural rights discourse, but on Rousseau’s espousal of a new moral psychology opposed to Christian deontology. This was the ‘revolution in manners’ which made the revolution possible and for which Rousseau provided a philosophical underpinning. (shrink)

The study of social inequality and stratification has long been at the core of sociology and the social sciences. In this article, I argue that certain tendencies have become entrenched in our dominant paradigm that leave many researchers pursuing coarse-grained analyses of how difference relates to inequality. Centrally, despite the importance of categories and categorization for how researchers study social inequality, contemporary theories of categories are poorly integrated into conventional research. I contend that the widespread and often unquestioned use of (...) state categories as categories of analysis reinforces these tendencies. Using research on colorism as an inspiration, I highlight several components of what I call the infracategorical model of inequality, which urges researchers to disaggregate difference by shifting our focus from membership in categories to the cues of categories, membership in subcategories, and perceived typicality. Wittgenstein’s use of the word ‘phenomenology’ to describe his own work in Philosophical Remarks and The Big Typescript has occasioned much puzzlement and confusion. This paper seeks to shed light on what Wittgenstein meant by the word through a close analysis of key passages in those two works. I argue against both the view of Nicholas Gier that Wittgenstein held ‘grammatical’ phenomenological remarks to be synthetic a priori and that expressed by Moritz Schlick that Wittgenstein held grammar to be tautological. (...) I also take issue with the claim by Merrill and Jaakko Hintikka that Tractatus Logico-Philosophicus ought to be regarded as a work of phenomenology. Wittgenstein’s adoption of a variant of Husserlian phenomenology, I argue, lasted no more than a few months, from February to October 1929, during which he conceived of phenomenology as something that sought to establish what one might call ‘analytic a posteriori’ truths through something like the Husserlian method of ‘bracketing’. By the end of 1929, I claim, he had abandoned that in favour of the view expressed in the slogan ‘phenomenology is grammar’, where ‘grammar’ is not confined to the tautological, but is rather intimately linked to Wittgenstein’s notion of ‘the understanding that consists in seeing connections’.
