This paper explores the meaning of the word “felony” in thirteenth and fourteenth century England, i.e., during the first two centuries of the English criminal trial jury. To compile a working definition of felony, the paper presents examples of the language of felony drawn from literary and religious sources, in addition to considering the word’s more formulaic appearance in legal records. The paper then analyzes cases ending in acquittal or pardon, highlighting the factors that might take a criminal case out (...) of the realm of felony. It suggests that the very definition of felony and felonious behavior—and thus the essence of criminal responsibility—may be bound up with the idea of mens rea during this period. The paper aims to uncover broader societal understandings of the nature of guilt and innocence, and to highlight connections and disconnections between the formal criminal law of felony, with its heavy emphasis on capital punishment, and popular and ecclesiastical understandings of culpability. This paper is concerned with what I believe is the epistemological mission of Kant’s doctrine of taste. The third Critique inherits two problems from the first. The evident one is that the categorial constitution of nature must be complemented with the notion of purposiveness. The less evident one is that the transcendental theory of experience needs a common sense in order to secure a common objectivity. The judgment of taste, conceived of by Kant as a ‘cognition in general’ not restricted (...) to either the particular subject or the particular object, offers a solution. It turns out to be a judgment that cannot be made without assuming the purposiveness of nature and the uniformity of the cognizing subjects. (shrink)

János Erdelyi: The Individual and the Ideal Individuality and ideality are the two principles according to which aesthetes yesterday and today interpret art. But individuality must have priority because the systems of ideality, established for instance by Winckelmann and Schiller, produce nothing but lifeless, abstract and uniform figures who represent a concept or the genus. Individuality, on the contrary, is an analogon to nature where everything has its end and sense in itself, and everything must be judged by itself. This (...) is the difference between the figures and works of Shakespeare and those of the idealizing authors. Individuality, however, does not simply mean the imitation of nature; rather it means a well-balanced synthesis of the material and the spiritual in something characteristic. This renders the objection of ugliness invalid, too, because it only pertains to the sensual perception, that is the beginning of perception. Those identifying the beautiful with the ideal are also at risk of insisting on objects which in the course of time lose their novelty and power. The study by the Hungarian aesthete and literary critic János Erdélyi, written in 1847, is an important attempt to enforce the principle ‘life as it is’ in the philosophy of art. (shrink)

This article follows the formulation of a new Palestinian attitude toward the Holocaust memory. It presents it as a bold challenge to past Palestinian perceptions of and attitudes toward the Holocaust memory. This novel Palestinian stance connects the Holocaust memory to the memory of the Nakbah, the Palestinian catastrophe of 1948. It is part of a critical deconstruction of the manipulation of collective memory in the service of nationalism. The authors of this article respond by providing their own deconstruction of (...) the memory's manipulation on both the Israeli and the Palestinian side of the divide. This additional analysis is meant to contribute to a dialogue that would enable us to explore further the dialectical relationship between the Holocaust and Nakbah memory in the Arab-Israeli conflict. This is not a mere academic exercise. Like others who had already participated in this dialogue, the authors believe firmly that such an exposure is a precondition for the elimination of the violence, direct or symbolic, from Israeli-Palestinian coexistence. Words and phrases must be interpreted within the proper cultural and contemporary political and historical context. In particular, the language of politics is distinguished by the use of specific terms and phrases which often allude to other associated meanings. This means that caution must be exercised when interpreting the terms used not only within the context of the other language, but often also within its own linguistic context. The translator or commentator has to be familiar with the language code used (...) in the given environment and within the cultural biases of that particular society so that meanings are not lost and the often crucial connotations are not misinterpreted. Political rhetoric often employs words and language in a manipulative yet frequently subtle manner. This paper analyzes examples of shifts in language code by looking at a number of cases in Japan and their cultural construction where loss of integrity and backstage practices are at stake. Ilan Pappe, one of the New Historians in Israel, answers Amaya et Bacha’s questions concerning the disciplinary proceedings initiated against him by the administration of the University of Haifa. Pappe argues that the measures taken against him were the result of his critique of Israeli academia for its lack of independence, as well as of his scholarly work on the « Nakba » and, in particular, the ethnic cleansing of the Palestinian village of Tantura at the founding of the state (...) of Israel. In an academic milieu characterized by conformism and cowardice, the work of the New Historians is less and less tolerated by the Israeli authorities. (shrink)

This paper focuses on a specific aspect of a Japanese rite of passage called Shichigosan. Although its origins go back to premodern Japan, its contemporary pattern truly reflects the modern living conditions of the Japanese. Today the ritual is one of the most popular family celebrations. Commercialization has significantly influenced the pattern of celebration in the postwar period and as a result, consumption practices have become inherent parts of the ritual. The paper examines this development from a historical perspective. Furthermore, (...) it discusses the process through which consumption practices contribute to the event’s significance, not diminishing but rather enhancing its importance in the observers’ eyes. Conspicuous consumption thus becomes a creative two-directional process, one which is sustained by families’ aspirations and desires, and one which is informed by forces emanating from the commercial sector and from the media. The Origin of the ‘Paardekraal Vow’ Contrary to common belief that the ‘1880 Vow' was taken at Paardekraal, on the restoration of the Republic on 13 December 1880, the writer has documentary proof that this ‘Vow’ was in existence almost two years before that date. An agreement is said to have been signed by a number of the Boers at Wonderfontein, where they had gathered between 10 and 13 January 1879 to claim the restoration of the Republic. Both these minutes (...) and the Transvaal press ignored this agreement as it was feared that they would lead to premature armed resistance. The Paardekraal Festival Commission became aware of the agreement in 1945 and adopted it as the ‘Vow of 1880' in their 1946 programme. (shrink)

The practice of prenatal diagnosis has brought with it the utilization of pregnancy termination as a preventive approach. In this paper the genetic/teratologic, fetal and maternal indications for termination of pregnancy used in Hungary are described, as well as the legal requirements and the proposed mode of termination at the different stages of gestation. The author is the director of the largest prenatal genetic counseling service in Hungary. Proofs have been given that the light-cone approximation can be analyzed in terms of the extended quantum-mechanical description of the space-time measurements by the complex numbers. It is then proved that the so established description is able to support both the asymptotical scale-invariant cross sections and the threshold behavior of the high-energy production processes.

Proofs have been given that the underlying background of the scale-breaking contributions of the Pauli-Jordan functions and of the Feynman propagators is the existence of an energy dependent dispersion of the canonical scale dimension, respectively. The energy dependence of these dispersions can be established by taking into account the existence of the time dispersion, too. For the interacting fields the above functions are subject to the scale invariance restoration around the underlying proper-time dispersions, in so far as the short space-like (...) space-time region is considered. By focusing on the works and intellectual network of the Timurid historian Sharaf al Dīn ʻAlī Yazdī (d.1454), this book presents a holistic view of intellectual life in fifteenth century Iran. İlker Evrim Binbaş argues that the intellectuals in this period formed informal networks which transcended political and linguistic boundaries, and spanned an area from the western fringes of the Ottoman State to bustling late medieval metropolises such as Cairo, Shiraz, and Samarkand. The network included an Ottoman revolutionary, a Mamluk (...) prophet, and a Timurid occultist, as well as physicians, astronomers, devotees of the secret sciences, and those political figures who believed that the network was a force to be taken seriously. Also discussing the formation of an early modern Islamicate republic of letters, this book offers fresh insights on the study of intellectual history beyond the limitations imposed by nationalist methodologies, established genres, and recognized literary traditions.
