The volume gathers eleven studies on the intellectual exchanges during the Middle Ages among the three cultures which existed side by side in the same geographical area, i.e. the vast space from the British Isles to the Sahara Desert, and from the Douro Valley to the Hindu Kush. These three cultures – who may not be reduced to their confession or ethnicity – are historically related to each other in many respects, both material (trade, wars, marriages) and immaterial (the interdependence (...) among their religious narratives and their philosophical speculations). The studies herein presented focus on some peculiar examples of the transcultural interactions among exponents of the Arabic, Hebrew and Latin philosophical and theological traditions. While we do not want to downplay the fundamental role of the religious contexts, our focus on the linguistic denominations of these cultures aims at drawing attention to the conceptual medium, or rather media, which underlined and shaped the interactions and interplays among these traditions – interplays that were characterized by the contact of these three languages being used by people of different religious beliefs in their quest for knowledge: Spanish Jews writing in Arabic, Jews collaborating in the translation of Arabic texts into Latin through the vernacular, Western Muslims whose writings were read mainly by Jews and Christians in Hebrew and Latin. PREFACE. THE Author of this very practical treatise on Scotch Loch - Fishing desires clearly that it may be of use to all who had it. He does not pretend to have written anything new, but to have attempted to put what he has to say in as readable a form as possible. Everything in the way of the history and habits of fish has been studiously avoided, and technicalities have been used as sparingly as possible. The writing of (...) this book has afforded him pleasure in his leisure moments, and that pleasure would be much increased if he knew that the perusal of it would create any bond of sympathy between himself and the angling community in general. This section is interleaved with blank shects for the readers notes. The Author need hardly say that any suggestions addressed to the case of the publishers, will meet with consideration in a future edition. We do not pretend to write or enlarge upon a new subject. Much has been said and written-and well said and written too on the art of fishing but loch-fishing has been rather looked upon as a second-rate performance, and to dispel this idea is one of the objects for which this present treatise has been written. Far be it from us to say anything against fishing, lawfully practised in any form but many pent up in our large towns will bear us out when me say that, on the whole, a days loch-fishing is the most convenient. One great matter is, that the loch-fisher is depend- ent on nothing but enough wind to curl the water, -and on a large loch it is very seldom that a dead calm prevails all day, -and can make his arrangements for a day, weeks beforehand whereas the stream- fisher is dependent for a good take on the state of the water and however pleasant and easy it may be for one living near the banks of a good trout stream or river, it is quite another matter to arrange for a days river-fishing, if one is looking forward to a holiday at a date some weeks ahead. Providence may favour the expectant angler with a good day, and the water in order but experience has taught most of us that the good days are in the minority, and that, as is the case with our rapid running streams, -such as many of our northern streams are, -the water is either too large or too small, unless, as previously remarked, you live near at hand, and can catch it at its best. A common belief in regard to loch-fishing is, that the tyro and the experienced angler have nearly the same chance in fishing, -the one from the stern and the other from the bow of the same boat. Of all the absurd beliefs as to loch-fishing, this is one of the most absurd. Try it. Give the tyro either end of the boat he likes give him a cast of ally flies he may fancy, or even a cast similar to those which a crack may be using and if he catches one for every three the other has, he may consider himself very lucky. Of course there are lochs where the fish are not abundant, and a beginner may come across as many as an older fisher but we speak of lochs where there are fish to be caught, and where each has a fair chance. Again, it is said that the boatman has as much to do with catching trout in a loch as the angler. Well, we dont deny that. In an untried loch it is necessary to have the guidance of a good boatman but the same argument holds good as to stream-fishing... (shrink)

Thus it would not be the content or meaning of a written Torah that Jeremiah would attack; rather it would be the Deuteronomic “claim to final and exclusive authority by means of writing” . Jeremiah’s problem is political rather than theological. He knows that writing is more powerful than prophecy and that he will not be able to withstand it—and he knows that the Deuteronomists know no less. As Blenkinsopp says, “Deuteronomy produced a situation in which prophecy could not continue (...) to exist without undergoing profound transformations” —that is, without ceasing to be “free prophecy,” or prophecy unbound by any text, including its own. “It might be considered misleading or flippant to say that for [Deuteronomy], as for rabbinic orthodoxy, the only good prophet is a dead prophet. But in point of fact the Deuteronomic scribes, despite their evident debt to and respect for the prophets, contributed decisively to the eclipse of the kind of historically oriented prophecy represented by Jeremiah and the emergence in due course of quite different forms of scribal prophecy” .It is at this point that we reach a sort of outer limit of biblical criticism—a threshold that scholars, with their foundations in literary criticism, their analytical attitude toward texts, and their theological concerns, are not inclined to cross. In any case, it is no accident that the political meaning of the conflict of prophecy and canon has received its most serious attention not from a biblical scholar but from a radical historian, Ellis Rivkin. In The Shaping of Jewish History, a brilliant and tendentious book, Rivkin proposes to treat the question of canon-formation and the promulgation of canonical texts of the Scriptures, not according to literary criteria but according to power criteria. For Rivkin, the production of the Hebrew Scriptures “was not primarily the work of scribes, scholars, or editors who sought out neglected traditions about wilderness experience, but of a class struggling to gain power.”23 23. The traditions about isrāʾīliyyāt that were seen almost in all the types of Islamic sciences appeared in the sources of tafsīr from early periods. These traditions that were generally used to explain the Qurʾān were seen problem and critisized by some exegetical specialists. Even though corresponding to a relative later period in the classical era, an approach was tried to put forward in view of the traditions about isrāʾīliyyāt. This methodological concern for isrāʾīliyyāt in classical period has increased and been (...) influential for many researchers from east and west to work on this issue in modern times. There has been reached to important results about the issues of the definition of isrāʾīliyyāt, the source of it, its spread in Islamic sciences, its aim of usage, the progress of these positive-negative attitudes against these traditions in historical process. But it is important to discuss some evaluations and analysis again that put forward in this process when different cases about the issue are taken into consideration. According to this, a series of problem, such as how the isrāʾīliyyāt can be defined in tafsīr, when the criticism of isrāʾīliyyāt started, whether Biqāʿī was the first exegete who made reference to Bible or not will be discussed considering relevant resources in this article.Summary: Since the early periods, isrā’īliyyāt narratives were used as a source of information in tafsīrs. These narratives, which are transmitted in various tafsīrs of the Qur’ān, one of the main sources of Islamic religion, have also taken the methodological interests of some exegete since the early periods. This interest continued in the modern period, and both Western and Eastern researchers made research on isrā’īliyyāt. Some of the findings, analyses, and claims available in researches on this subject will be reexamined in this article. The first of these is the problem of the definition of isrā’īliyyāt. In contemporary research, inclusive definitions are made for isrā’īliyyāt, seen in all sources. These definitions do not allow for a refined description of isrā’īliyyāt which is handled in terms of different intentions in the sources of each different field and which varies in terms of the issues it covers, leading to the underestimation of some of its aspects in relevant fields. In the definitions, it is stated that isrā’īliyyāt is mostly learned from the Ahl al-Kitāb, (the People of the Book) it became widespread along with Islām and it included narratives about caliphs, dynasties, and Mahdī, as well. Another issue is to be emphasized that they are fictive or mythological. In classical tafsīrs, isrā’īliyyāt is observed to be related mainly with the history of the Ahl al-Kitāb or with the subjects they know about. In the modern era, the narratives about the ancestors of the Arabs have been identified as isrā’īliyyāt. If some of the isrā’īliyyāt narratives are related to the history of Arabs, then their resource should be the historical-cultural memory of Arabs. However, as almost all Qur’ānic stories were somewhat known before the revelation period and relations with the Ahl al-Kitāb dated back to times long before the Islamic period, the claim that these narratives became widespread along with Islām should be revised. It is also problematic to emphasize the legendary nature of some of the isrā’īliyyāt and to make that as a reason to reject all. Such emphasis also leads to the underestimation of the functions of narratives in tafsīrs. In isrā’īliyyāt, tafsīr was used for i) interpreting the ambiguous words in the stories, ii) to bring evidence to the Ahl al-Kitāb, and ii) tarhīb-targhīb (encouragement-warning). These narratives can be used as a source in tafsīr unless they are explicitly falsified by the data of fields such as history, history of religions and archaeology as well as the Qur’ān and the true Sunnah. The first criticisms of isrā’īliyyāt are claimed to belong to exegete like Ibn al-‘Arabī (d. 543/148) or Ibn ‘Aṭīyah (d. 541/1147). However, criticism of isrā’īliyyāt is also observed in the tafsīrs of earlier exegete, such as al-Māturīdī (d. 333/944), al-Māwardī (d. 450/1058) or al-Ṭūsī (d. 460/1067). They do not necessarily have to use the term isrā’īliyyāt explicitly in their criticism like the later ones. If the narratives they criticize and the reasons for their criticism are the same as those of the later exegete, it will be necessary to date the criticism of isrā’īliyyāt back to the 4th Century of the Hegira. The understanding that "the expression in the story is sufficient, it is unnecessary to deal with the ambiguities; instead, it is necessary to deal with the lesson and wisdom in the story" is one of the criteria that Muḥammad ‘Abduh (d. 1905), who is deemed to be the pioneer of the strict criticism of isrā’īliyyāt in the modern period, took as basis in this criticism, is valid for the exegete of the classical period, as well. Although exegete, such as al-Ṭabarī (d. 310/923), al-Māturīdī, al-Rāzī (d. 606/1210), and Abū Ḥayyān (d. 745/1344) who had this understanding, gave place to isrā’īliyyāt, these people recognized that "these narratives were not final, binding or necessary”, indeed. The understanding that such expression in the story is sufficient, which is one of the reasons for such awareness in the classical period, seems to have turned into a strict rejection in the modern period. Another issue is the claim that Biqā‘ī (d. 885/1480) was the first exegete to systematically benefit from the Bible in tafsīr in the classical period. However, al-Daylamī (d. 593/1197) before Biqā‘ī, is also observed to have used the Old Testament systematically in tafsīr. He cited the Tanakh in his period in two ways. He either directly quoted from the translation of Tanakh or the Hebrew text written in Arabic letters. Another exegete who used the Tanakh as a source in his tafsīr was al-Ṣafadī (d. 696/1296). He enriched his tafsīr with systematic quotations from the Tanakh. Therefore, the use of the Bible as a source of interpretation in the classical period should not be started with Biqā‘ī. The reason why the pioneer exegete of the classical period did not directly use the Bible is claimed to be the fact that they falsified it and deemed the isrā’īliyyāt narrated from the predecessors to be more reliable. However, it is known that a significant portion of the isrā’īliyyāt, which was orally transferred from the predecessors, is based on written sources, particularly including the apocryphal texts. So just like the Bible, isrā’īliyyāt, which was orally transferred from the predecessors, is problematic in terms of authenticity. This allows us to argue that classical exegete have an inconsistent attitude, indeed. On the other hand, when we take into account the fact that classical exegetes criticize these narratives from time to time and believe that they are not final or binding, the problem of potential inconsistency disappears. Accordingly, they did not deem chain transmission of these narratives from the predecessors by reliable transmitters to be a sufficient reason for their acceptance and adoption for good and all. The Telchines, magical craftsmen and wizards, are best known for their criticism of Callimachus’ poetry in the prologue to the Aetia. The other two appearances of the Telchines are also in programmatic passages in Callimachus’ extant works. In the Hymn to Delos (30–3), the narrator asks an aporetic question about the theme of his song. There, the Telchines are the makers of the trident used to form every island but Delos, highlighting her singular status as uniquely created without force (...) (30–3). In Aet. fr. 75, the Telchines appear in Xenomedes’ history of Ceos. There, Callimachus explicitly names one source for his material, but omits direct citation of equally important sources, namely Pindar and Bacchylides, while still alluding to their songs. This article examines verbal and thematic parallels among these three passages and argues that Callimachus uses the Telchines not only to link the passages but also to comment on his authorial process, his use of sources and his poetic programme. The present volume explores how and why Averroes, a Muslim philosopher and jurist, became one of the most important figures in the history of Jewish philosophy.

The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of (...) law. The reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. This article shows how sixteenth- and seventeenth-century arguments about historical evidence and elite humanist traditions of textual criticism and historical method evolved into the secular political theory of the eighteenth century. It shows how the French crown sponsored scholars who worked on empirical, source-based history as a tool for political prudence, but as this critical historical methodology became public, the crown realized it could be used against its interests, as in the case of the Affaire de Thou. In (...) the mid-seventeenth century, Colbert sought to suppress the old royal humanist historical tradition; however a number of political critics such as Amelot de La Houssaye and Pierre Bayle worked to publicize the tools of historical, political criticism, setting the stage for Enlightenment critics of absolutism such as Durey de Meinières and ultimately Montesquieu and Gibbon. It is important for the materialist historian, in the most rigorous way possible, to differentiate the construction of a historical state of affairs from what one customarily calls its "reconstruction." The "reconstruction" in empathy is one- dimensional. "Construction" presupposes "destruction." Almost fourteen years after the death of Jacques Derrida, the least one can say is that his inheritance is as contested and fraught with rivalries, rejections, and appropriations as at the time of the flowering of Deconstruction in American universities in (...) the seventies and eighties. A halt was observed in 1988-89 after the posthumous revelations about Paul de Man's past in Belgium and Derrida's embattled defense of his friend. Today, in France, one often hears that "Derrida a fait l'Ecole mais n'a pas fait ecole," meaning that Derrida passed the entrance examination of the prestigious Ecole Normale Superieure where he taught for a long time, where he met Paul Celan, Louis Althusser, Michel Foucault and many other luminaries, whereas he never had a real "school" in France-no real institutional backing beyond the various Parisian places at which he taught later, or those that he founded like the College de Philosophie; his following constituted of young philosophers, only a few of whom became university professors in their turn and disseminated his teachings. However, the mechanisms of power within the French university remained closed to Derrida until the end; besides, he wanted to prevent the stereotyped reproduction currently observed from master to disciple.
