Networks for the exchange and/or sharing of genetic data are developing in many countries. We focus here on the situations in the US and France. We highlight some recent and remarkable differences between these two countries concerning the mode of access to, and the storage and use of genetic data, particularly as concerns two-sided markets and dynamic consent or dynamic electronic informed consent. This brief overview suggests that, even though the organization and function of these two-sided markets remain open to (...) criticism, dynamic e-IC should be more widely used, especially in France, if only to determine its real effectiveness. The practice and development of modern medicine requires large amounts of data, particularly in the domain of cancer. The future of personalized medicine lies neither with “genomic medicine” nor with “precision medicine”, but with “data medicine”. The establishment of this DM has required far-reaching changes, to establish four essential elements connecting patients and doctors: biobanks, databases, bioinformatic platforms and genomic platforms. The “transformation” of scientific research areas, such as genetics, bioinformatics and biostatistics, into clinical specialties has generated a new vision (...) of care. Molecular tumor boards are one response to these changes and are now providing better access to next-generation sequencing and new cancer treatments to patients with inoperable or metastatic cancers, and those for whom the usual treatment has failed. However, MTB face a crucial ethical challenge: maintaining and improving the trust of patients, clinicians, researchers and industry in academic medical centers supported by private or public funding rather than providing genetic data directly to private companies. We believe that, in this era of DM, appropriate modern digital communication networks will be required to maintain this trust and to improve the organization and effectiveness of the system. There is, therefore, a need to reconsider the form and content of informed consent documents at all academic medical centers and to introduce dynamic and electronic informed consent. (shrink)

Woraus zu folgern wäre, daß unser Intellekt im engeren Sinn des Worts dazu bestimmt sei, die vollkommene Verwebung unseres Körpers (...) in seine Umgebung zu sichern, die Beziehungen der äußeren Dinge aufeinander vorzustellen, kurz: dazu, die Materie zu denken. SummaryMethodological questions are discussed from a point of view which the author calls open transcendentalism. In the first paragraphs the importance of normative practices is stressed and the application of the method to philosophical problems concerning ontology, analyticity and necessity is illustrated. Against Quine's holism a truely pluralistic view is defended according to which various logical or linguistic systems may be used with regard to the needs in different human activities.In the second part, arguments in favor of a instrumentalistic conception (...) of logic are advanced. Several objections against possible‐worlds‐semantics and proposals for an adequate treatment of counterfactuals suggest that contexts must be taken into account and that a distinction must be made between a descriptive and a fictional use of languages. Accordingly, fictitious entities have to be introduced in the ontology. A notion of counterpart is developped which, in contrast to D. Lewis'one, creates no difficulties with regard to identity.RésuméL'auteur traite de quelques questions de méthode d'un point de vue qu'il nomme transcen‐dantalisme ouvert. Oeffentliche und private Diskussionen von zwei meiner früheren Arbeiten1 haben gezeigt, dass die Ansichten über Quines Einstellung zur Ontologie und zu der sog. substitutionellen Quantifikationstheorie z. T. merklich divergieren. Da eine kritische Auseinandersetzung mit einem Autor vorgängig ein sachgerechtes Verständnis erfordert, wird vielleicht der folgende Versuch, seine diesbezüglichen Auffassungen anhand von Textbelegen syste‐matisch zusammenzustellen, nicht nutzlos sein 2.

Chacun parle couramment d’art ou de pensée moderne, de techniques modernes, d’amour moderne, etc. Malgré l’usage et les abus, le mot n’a pas perdu son prestige. Il sert dans la publicité, dans les propagandes et dans l’expression de tout ce qui est ou paraît nouveau. Mais que signifie-t-il exactement? Ambigu, ce mot révèle à l’analyse deux sens et recouvre deux réalités : tantôt il désigne une exaltation plus ou moins factice et soumise à la mode, tantôt il indique un certain (...) nombre de problèmes et de possibilités (ou d’impossibilités). La première acceptation peut se nommer « modernisme », la seconde « modernit頻. Le modernisme est un phénomène sociologique : l’acte d’une conscience sociale qui peut avoir ses lois. La modernité est une motion liée à une critique naissante et à une problématique définissable. Les douze préludes que contient ce volume s’efforcent de distinguer modernisme et modernité, pour saisir leurs rapports dialectiques. Ils cherchent à préciser les contours de la notion de « modernit頻, en formulant les questions qu’elle pose ou plutôt qu’elle enveloppe. Penser l'homme et la folie : dans ce recueil d'études où s'est condensée, au fil des dernières années, sa réflexion, Henri Maldiney se propose de penser ensemble l'énigme de l'humanité et l'énigme de la " catastrophe " qui survient à certains d'entre nous. Double décentrement de la pensée, qui la met à la fois hors de l'anthropologie, fût-elle philosophique, et de son envers dans les théories psycho-pathologiques. Double décentrement où s'éprouvent donc au mieux la tradition philosophique - et en (...) particulier celle qui est issue de Heidegger - et la tradition de la Daseinsanalyse et de la Schicksalsanalyse, telle qu'elle est représentée par Binswanger, Straus, Minkiwski, Von Weizsäcker et Szondi. Dans une démarche authentiquement phénoménologique, où il s'agit de retourner à la " chose même " de l'humain et de la folie, de penser en va-et-vient de l'énigme à penser à ce qui en a été dit, Henri Maldiney dégage, par sa conception toute nouvelle de la transpossibilité et de la transpassibilité, une " compréhension " globale du phénomène humain qui le rend moins intraitable que par le passé. Le " séisme " de la folie, montre-t-il, vient d'un énigmatique court-circuit de la transpossibilité et de la transpassibilité, qui est seul propre à les mettre véritablement en relief comme la dimension profonde et cachée de notre expérience : celle de l' "événement " ou de l'émergence du nouveau, de la surprise de l'inattendu. La transpassiblité est une " possibilité " qui nous excède, en ce qu'elle fonde toute possibilité pour nous d'exister, parce qu'elle est en deçà de tout projet, transpossiblité de l'accueil - et de l'accueil transpassible -, y compris de l'accueil par nous-mêmes, de nous-mêmes. HENRI BERGSON (1859-1941), philosophe français, professeur au Collège de France de 1900 jusqu´à 1921, récompensé avec le prix Nobel de littérature en 1928. Ses oeuvres majeures, écrites avec un style parfaitement accessible au lecteur non spécialisé, sont : « Essai sur les données immédiates de la conscience » (1889), « Matière et mémoire » (1896), « L´évolution créatrice » (1907) et « Les deux sources de la morale et de la religion » (1932). Dans ces études, Bergson élabore une (...) vision philosophique en opposition au matérialisme et positivisme scientifique. Concentrant sa recherche sur les intuitions individuelles, il prône la notion d´élan vital, lequel dirige le procès évolutif vers des états d´organisation de plus en plus complexes, et de là vient l´intérêt de donner prééminence à tout ce qui est spirituel et ouvertement créatif, sur tout ce qui est formel, fixé, fermé. Dans « Le rire : essai sur la signification du comique » (1900), il trouve que le comique est soulevé des que nous percevons dans les actions humaines les automatismes, répétitions ou dysfonctionnements qui contrastent avec l´essentielle spontanéité de la vie réelle. Facelifts, tummy tucks and breast enlargements are no longer the privilege of the rich and the famous. Any woman can have all these and many more cosmetic surgical treatments, and an increasing number of women do. Are they having cosmetic surgery because they are duped by a male-dominated beauty system, or do they genuinely choose these operations themselves? Feminists give diametrically opposed answers to this question. At the heart of the controversy, or so I claim in this article, lies a (...) conceptual problem about free choice; therefore, the only thing that can settle it is a conceptual analysis of “freedom”. After having briefly outlined the views of both sides of the debate, I offer such an analysis. (shrink)

C. I. Lewis’s distinction between the given and the concept is often exposed as the key element of his treatment of the problem of intentionality in that the given and the concept would be necessary and sufficient conditions for objective purport. Such an account nonetheless offers a truncated picture of Lewis’s treatment of the problem of intentionality. The best way to appreciate this verdict is to state the predicament this account is confronted with: If the distinction between the given and (...) the concept apparently leads to a version of the same problem it was designed to address, how could it be the key element contributing to answering the problem of intentionality? Indeed, according to Lewis, the given and the concept are mutually independent so that prima facie nothing guarantees that concepts are applicable to the given. The difficulty is what Lewis calls “the problem of the a priori”: how to guarantee that our concepts can be imposed upon a content of experience which is independent and not yet given? This is a version of the problem that Kant’s Transcendental Deduction addresses: How can categories, as subjective conditions of experience, be objectively valid? A natural question is then: How does Lewis address the problem of the a priori? The main purpose of this essay is then to investigate how C. I. Lewis’s addresses the problem of the a priori and to contribute to restoring an appropriate understanding of Lewis’s conceptual pragmatism. (shrink)

This article addresses the question of the mechanisms of the emergence of structure and meaning in the biological and physical sciences. It proceeds from an examination of the concept of intentionality and proposes a model of intentional behavior on the basis of results of computer simulations of structural and functional self-organization. Current attempts to endow intuitive aspects of meaningful complexity with operational content are analyzed and the metaphor of DNA as a computer program (the `genetic program') is critically examined in (...) relation to an alternative metaphor of DNA as data. It is argued that relatively simple networks of boolean automata can classify and recognize patterns of binary strings on the basis of non-programmed, self-generated criteria, but lack a capacity for self-observation and interpretation. To overcome this problem it is necessary to clarify the relationships between the goals and underlying mechanisms of a process and between a system and its environment. It will be shown that memory devices that record the histories of interactions are essential for models of conscious and unconscious intentional behavior and that the possibility of infinitely sophisticated - and therefore unprogrammable - machines cannot be avoided. It will be argued that the notion of infinite sophistication allows the ideas of self-organization and physical determinism to be reconciled. These models will be used to suggest how the voluntary aspect of decision-making in general can emerge out of functional self-organizing processes. The conclusion will introduce the notion of `underdetermination' of theories, which imposes an intrinsic limitation on models of complex natural systems - a limitation that, at the same time, may be precisely what makes possible mutual understanding and intersubjectivity.
