The problem of gender equality among lawyers has been a subject of significant research, study and action across the globe. It is well known that despite women's entrance into law school in relatively equal numbers to men over the past few decades, they remain significantly under-represented in positions of leadership and power across sectors of the legal profession. Progress has come to a standstill, making this a particularly critical time to examine the ways we conceptualise the problem and rethink the (...) solutions. The legal profession, as a gatekeeper of equality and as an institution committed to the preservation of rights, should be emblematic of gender equality. Responsibility for addressing the problematic gender dynamics is something that lies with the entire profession and should be framed as a matter of ethics. To date, the conversation on this issue has been relatively insular and this essay argues for an expansion of this conversation to include the entire bar. Toward this end, this essay suggests that there are new ways to think about pathways to gender equality by expanding the boundaries that have defined the problem. First, it has been defined in a way that focuses almost exclusively on those already engaged in the practice of law, often at the highest echelons of practice to the exclusion of other sectors, especially legal education. Second, the existing movement has almost unilaterally focused on the structural impediments within the legal system or the characteristics of law practice itself that exist as roadblocks to women, ignoring significant barriers that are not necessarily unique to women lawyers but impede the progress of women generally. The movement also often fails to extend beyond geographic borders of a particular country, thereby eliminating the potential for a global conversation. In crafting solutions, there has been little acknowledgement of the role of legal education. (shrink)

Ecology and sustainability are current narratives about the behavior of humans toward themselves and the environment. Ecology is defined as a science, and a philosophy of ecology has become a recognized domain of the philosophy of science. For some, sustainability is an accepted, important moral goal. In 2013, a Special Issue of the journal Sustainability dealt with many of the relevant issues. Unfortunately, the economic, ideological, and psychological barriers to ethical behavior and corresponding social action remain great as well as (...) obvious. In this paper, I propose that a new, non-standard and non-propositional logic of real processes, Logic in Reality grounded in physics applies to the science and philosophy of these narratives and helps to explicate them. Given the ecological role of organizations and institutions, reference is often made to organizational or institutional logics as guides to ecological practice. This paper suggests that these logics are either too abstract or too informal to have an impact in a conflictual world. Recognition of the suggested new, transdisciplinary logical dimension of ecological processes may provide credibility and support to new initiatives in ecology and its philosophy. (shrink)

What are we? Are we, for example, souls, organisms, brains, or something else? In this book, Andrew Brenner argues that there are principled obstacles to our discovering the answer to this fundamental metaphysical question. The main competing accounts of personal ontology hold that we are either souls (or composites of soul and body), or we are composite physical objects of some sort, but, as Brenner shows, arguments for either of these options can be parodied and transformed into their (...) opposites. Brenner also examines arguments for and against the existence of the self, offers a detailed discussion of the metaphysics of several afterlife scenarios - resurrection, reincarnation, and mind uploading -- and considers whether agnosticism with respect to personal ontology should lead us to agnosticism with respect to the possibility of life after death. The question raised in this book is why Spinoza s work which comes so close to the modern view of natural science is not prominent in the social sciences. The answer suggested is that this is due to the lingering influence of the Cartesian differentiation between the domain of science, dealing with material bodies in space and time, and the realm of thought to which the mind belongs. Spinoza s rejection of this mind/body dualism was based on his conviction that (...) the human mind was an essential part of the forces which maintain human existence. Since this view fits so well the evolutionary view of life, the book suggests that after Darwin, when this dualism became untenable, it was replaced by a nature versus culture dichotomy. The book examines whether the history of the philosophy of science supports this explanation. The author believes that answering this question is important because of the rising influence of cultural relativism which endangers the very survival of modern science and political stability.". A new demarcation is proposed between Natural Philosophy and non-Natural Philosophy—philosophy tout court—based on whether or not they follow a non-standard logic of real processes. This non-propositional logic, Logic in Reality, is based on the original work of the Franco-Romanian thinker Stéphane Lupasco. Many Natural Philosophies remain bounded by dependence on binary linguistic concepts of logic. I claim that LIR can naturalize—bring into science—part of such philosophies. Against the potential objection that my approach blurs the distinction between science and philosophy, (...) I reply that there is no problem in differentiating experimental physical science and philosophy; any complete distinction between philosophy, including the philosophy of science and the other sciences is invidious. It was historically unnecessary and is unnecessary today. The convergence of science and philosophy, proposed by Wu Kun based on implications of the philosophy of information, supports this position. LIR provides a rigorous basis for giving equivalent ontological value to diversity and identity, what is contradictory, inconsistent, absent, missing or past, unconscious, incomplete, and fuzzy as to their positive counterparts. The naturalized Natural Philosophy resulting from the application of these principles is a candidate for the ‘new synthesis’ called for by the editors. (shrink)

Up against capacity‐based approaches to animal ethics, Cora Diamond has put the idea of animals as our fellow creatures. The aim of this article is to explore the implications of this concept for our treatment of fish. Fish have traditionally been placed at the borders or even outside of the moral community, although there is growing evidence that they have perceptual and social capacities comparable to animals that are considered morally significant. Given that a fellow creature's approach is not primarily (...) concerned with capacities, fish may pose a challenge: Can fish be seen as our fellow creatures, and if so, on what grounds? In exploring these questions, we defend Diamond against Jeff McMahan's critique of her account and its implications that the fellow creature‐concept is reducible to either capacities or special relationships and leaves no room for argument‐based moral reform. We suggest that moral attention is key to grasping the moral significance of fish and discuss how scientific research can support such attention. In so doing, we demonstrate how Diamond's approach to animal ethics provides a viable alternative to the dominant animal ethics approaches. Finally, we indicate how this approach can be useful for discussions on industrial fish farming. (shrink)

In this paper, we defend ontological disputes from the charge, with a special focus on disputes over the existence of composite objects. Disputes over the existence of composite objects, we argue, have a number of substantive implications across a variety of topics in metaphysics, science, philosophical theology, philosophy of mind, and ethics. ABSTRACT It used to be said that shame culture waned in early modernity, but there is a growing body of historiography on the vital role that recognition and the opinion of others continued to play. Honour mattered; for some it was the mark and the maker of your true self. While philosophers like Hobbes, Locke, Mandeville, Hume, Smith, and Rousseau disagreed in their evaluations of the phenomenon, they were united in thinking that the great engine of recognition whirred like furious (...) clockwork through human society. When one listens to voices from the margins of power, however, to formerly enslaved black women and men, and white women, one hears a different story – that the machine is broken. I argue that, albeit from incomparable positions, they articulate a theory of misrecognition in the face of systematic power. Sensitive to the entanglements of epistemology and naturalised inequality, they offer a politics of vision that deconstructs the punitive lenses of gender and race which render people invisible and misunderstood, and in so doing they try to write themselves into view. They offer an account of the mysterious intractability of hegemonic ways of seeing that poses a challenge to both the putatively laissez-faire economy of recognition of their enlightened contemporaries, and to the emancipatory teleology of modern recognition theorists. We analyze two problems in mathematics – the first (stated in our title) is extracted from Wittgenstein’s “Philosophy for Mathematicians”; the second (“What set of numbers is non-denumerable?”) is taken from Cantor. We then consider, by way of comparison, a problem in musical aesthetics concerning a Brahms variation on a theme by Haydn. Our aim is to bring out and elucidate the essentially riddle-like character of these problems.

There are better and worse ways to blame others. Likewise, there are better and worse ways to blame yourself. And though there is an ever-expanding literature on the norms that govern our blaming practices, relatively little attention has been paid to the norms that govern expressions of self-blame. In this essay, I argue that when we blame ourselves, we ought not do so privately. Rather, we should, ceteris paribus, express our self-blame to those we have wronged. I then explore how (...) this norm can contribute to our understanding of the ethics of self-blame as well as the nature of blameworthiness itself. (shrink)

In “The logic of deep disagreements” (Informal Logic, 1985), Robert Fogelin claimed that there is a kind of disagreement – deep disagreement – which is, by its very nature, impervious to rational resolution. He further claimed that these two views are attributable to Wittgenstein. Following an exposition and discussion of that claim, we review and draw some lessons from existing responses in the literature to Fogelin’s claims. In the final two sections (6 and 7) we explore the role reason can, (...) and sometimes does, play in the resolution of deep disagreements. In doing this we discuss a series of cases, mainly drawn from Wittgenstein, which we take to illustrate the resolution of deep disagreements through the use of what we call “rational persuasion.” We conclude that, while the role of argumentation in “normal” versus “deep” disagreements is characteristically different, it plays a crucial role in the resolution of both. Despite an intractable judiciary, there is widespread consensus within the legal academy that jury nullification is compatible with the rule of law. This proposition is most strongly tested by where a jury nullifies simply because it disagrees with the law itself. While some substantive nullifications can comport with the rule of law, most commentatorsjustice,vely undifferentiated view of a morality (even though jurisdictional and vicinage morality can diverge). In doing so, a healthy vision of antityrannical nullifications is presented, but this leaves (...) out many problematic cases. Once these errors are rectified, a more nuanced picture emerges, and it becomes apparent that localism will often disrupt the congruence feature of the rule of law. (shrink)

While democracy is derided for a variety of reasons in Plato’s thought, his most damning critique of that regime type does not involve an observation about democracy qua democracy, but of the transition that it so easily engenders: the decline to tyranny. Regimes are composed of individuals and groups, though, and Plato is anxious to ascribe culpability for the degradation. Two actors are the primary focus of his analysis — the political leaders and the demos. At times he emphasizes the (...) puissance of the demos, but in other passages he suggests it is the leaders who are most authoritative. This paper discusses these apparently contradictory passages, and works towards a reconciliation. It argues that neither is assigned sole culpability, as both work in complex synrgy, and that the underlying cause of the decline—and the motivator behind both actors — is not simply freedom, but greed for material wealth. We explore multi-scale relations in artificial intelligence (AI) use in order to identify difficulties with coordinating relations between users, machine learning (ML) processes, and “sociobuilt contexts”—specifically in terms of their applications to medical technologies and decisions. We begin by analyzing a recent COVID-19 machine learning case study in order to present the difficulty of traversing the detailed causal topography of “sociobuilt contexts.” We propose that the adequate representation of the interactions between social and built processes that occur on many scales (...) ought to drive interdisciplinary approaches for ML modification. Next, we describe ML algorithm development as a process that is partly dependent on methodological stabilization for reliability and partly on coordinating relations. In the coordination between user, ML process, and sociobuilt contexts, we propose that new methods can be explored that promote the inclusion of patients and communities for the purpose of cross-checking portions of the ML process. Finally, we suggest that the advantages of responsible innovation emerge through the iterative entanglement of ethical, methodological, and ontological considerations within the broader conceptual infrastructure of epistemic responsibility. I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

A number of philosophers, including Kant, Kripke, Boghossian, Gibbard and Brandom, can be read as endorsing the view that concepts are normative. I distinguish two versions of that view: a strong, non-naturalistic version which identifies concepts with norms or rules (Kant, Kripke), and a weaker version, compatible with naturalism, on which the normativity of concepts amounts only to their application’s being governed by norms or rules (Boghossian, Gibbard, Brandom). I consider a problem for the strong version: grasp of a rule (...) seems to require grasp of the concepts which constitute the content of that rule, so how can we explain concept acquisition without falling into regress? I offer a Kantian response, on which grasp of a rule does not require antecedent grasp of concepts, but still involves the recognition of normativity in one’s rule-governed behavior. In this review we describe theintent and general features of Le mixte and try to place it in the larger context of Duhem'sprogram for energetics. The long essay (Essay3) opposing Marcellin Berthelot'sthermochemistry is singled out for detailedcommentary, since it gives Duhem's reasons forendorsing Josiah Willard Gibbs's chemicalstatics. We argue that a chemical mechanics ofa Gibbsian sort, defended in (...) Le mixte and otheressays in this volume, was the inspiration for,and basis of, Duhem's energetics. Needham'swelcome translations help an English-languageaudience to better understand the basiccontours of Duhem's important, if ultimatelymisguided, project. This new translation is an extremely welcome addition to the continuing Cambridge Edition of Kant’s works. English-speaking readers of the third Critique have long been hampered by the lack of an adequate translation of this important and difficult work. James Creed Meredith’s much-reprinted translation has charm and elegance, but it is often too loose to be useful for scholarly purposes. Moreover it does not include the first version of Kant’s introduction, the so-called “First Introduction,” which is now recognized as indispensable (...) for an understanding of the work. Werner Pluhar’s more recent translation, which does include the First Introduction, is highly accurate when it confines itself to rendering Kant’s German. However, it is often more of a reconstruction than a translation, containing so many interpretative interpolations that it is often difficult to separate out Kant’s original text from the translator’s contributions. Paul Guyer and Eric Matthews have provided a translation that compares to or exceeds Pluhar’s in its literal approach to the German, but that confines all interpretative material to footnotes and endnotes, so that the text itself, with all its unclarities and ambiguities, lies open to view. In addition, Guyer, as editor of the volume, has provided a great deal of valuable supplementary material. This includes an introduction with an outline of the work and details of the history of its composition and publication, and a wealth of endnotes offering clarifications of the text, background information, and, most strikingly, many references to related passages in Kant’s voluminous writings, particularly in connection with Kant’s earlier writings related to aesthetics. The edition also records differences among the first three editions of the work, and—of particular interest—erasures from and additions to Kant’s manuscript of the First Introduction. Although the introduction and endnotes reflect interpretative views that are sometimes disputable, this supplementary material makes the present edition into a valuable resource even for those able to read the text in German. Imagination comes with varying degrees of sensory accompaniment. Sometimes imagining is phenomenologically lean (cognitive imagining); at other times, imagining involves or requires sensory presentation such as mental imagery (sensory imagining). Philosophers debate whether contradictions can obtain in fiction and whether cognitive imagining is robust enough to explain our engagement with fiction. In this paper, I defend the Principle of Poetic License by arguing for the Permissive View of fictional truth: we can have fictions in which a contradiction is true, everything (...) is true, or nothing is true. I show that imagination-based worries about impossible, unlimited, and empty fictions can be shown to be about sensory imagination and that sensory imagination isn’t necessary for fictional truth. This article examines the inherently ethical nature of resource allocation in policing. Decision-makers must make trade-offs between values such as efficiency vs. equity, individual vs. collective benefit, and adopt principles of distribution which allocate limited resources fairly. While resource allocation in healthcare has been the subject of extensive discussion in both practitioner and academic literature, ethical resource allocation in policing has received almost no attention. We first consider whether approaches used in healthcare settings would be suitable for policing. Whilst there (...) are some high-level similarities in the relevant ethical considerations and processes—such as aiming for efficient and equitable resource deployment—there are also fundamental differences between the two settings, which we argue necessitate a different approach. These differences include: (1) greater diversity and incommensurability of the benefits of policing, (2) more frequent non-linearity in returns on policing investment, (3) greater “ethical divisibility” (permissible scaling down) of programs in policing, (4) a requirement to assess “need” for policing resources at the collective (rather than individual) level, and (5) clearer primacy of equity considerations in policing. Having drawn out the implications of these differences, we sketch some tentative proposals for ethical resource allocation in policing. (shrink)
