In many countries, including patients are legally entitled to request copies of their clinical notes. However, this process remains time-consuming and burdensome, and it remains unclear how much of the medical record must be made available. Online access to notes offers a way to overcome these challenges and in around 10 countries worldwide, via secure web-based portals, many patients are now able to read at least some of the narrative reports written by clinicians. However, even in countries that have implemented (...) the practice many clinicians have resisted the idea remaining doubtful of the value of opening notes, and anticipating patients will be confused or anxious by what they read. Against this scepticism, a growing body of qualitative and quantitative research reveals that patients derive multiple benefits from reading their notes. We address the contrasting perceptions of this practice innovation, and claim that the divergent views of patients and clinicians can be explained as a case of epistemic injustice. Using a range of evidence, we argue that patients are vulnerable to epistemic injustice. Nonetheless, we conclude that the marginalisation of patients’ access to their health information exemplifies a form of epistemic exclusion, one with practical and ethical consequences including for patient safety. This qualitative study analysed the agency of eight non-abusing mothers in the Turkish Cypriot Community after disclosure that their child had been sexually abused by someone outside the family. The aim was to discover how, after disclosure, such mothers act to protect their children in the contexts of their family and community. The data were gathered via semi-structured in-depth interviews and analysed using Interpretative Phenomenological Analysis. In the nuclear family context, maternal agency emerged in the form of motherhood skills, including (...) emotionally supporting the abused child, double-checking the child’s safety or limiting the child’s mobility, and controlling the actions of adult sons. In the community context, maternal agency was manifested in efforts to prevent men in the extended family or the abuser’s family from concealing the abuse and to obtain informal support from others such as birth or extended family members. The women were usually successful in hiding their reactions or making decisions in their children’s best interest despite frequently having to cope with the reality of living in a restrictive and patriarchal culture. The results emphasise the need for working with the general public and professionals to change the culture of silence and to improve the social support network for sexually abused children and non-abusing family members, especially mothers. Automated Vehicles (AVs) are designed and programmed to follow traffic rules. However, there is no separate and comprehensive regulatory framework dedicated to AVs. The current Queensland traffic rules were designed for humans. These rules often contain open texture expressions, exceptions, and potential conflicts (conflict arises when exceptions cannot be handled in rules), which makes it hard for AVs to follow. This paper presents an automatic compliance checking framework to assess AVs behaviour against current traffic rules by addressing these issues. Specifically, (...) it proposes a framework to determine which traffic rules and open texture expressions need some additional interpretation. Essentially this enables AVs to have a suitable and executable formalization of the traffic rules. Defeasible Deontic Logic (DDL) is used to formalize traffic rules and reasoning with AV information (behaviour and environment). The representation of rules in DDL helps effectively in handling and resolving exceptions, potential conflicts, and open textures in rules. 40 experiments were conducted on eight realistic traffic scenarios to evaluate the framework. The evaluation was undertaken both quantitatively and qualitatively. The evaluation result shows that the proposed framework is a promising system for checking Automated Vehicle interpretation and compliance with current traffic rules. (shrink)

This paper reflects on the continued potency of veillance theories to traverse beyond the taxonomies of surveillance inside liberal democracies. It provides a commentary on the ability of sousveillance to destabilise and disrupt suer/violence by shifting its focus from the centre to the periphery, where Big Data surveillance is tantamount to sur/violence. In these peripheral political spaces, surveillance is not framed by concerns over privacy, democracy and civil society; rather, it is a matter of life and death, a technique of (...) both biopolitical and thanatopolitical power. I argue that the universalist, and universalizing, debates over surveillance cannot be mapped through the anxieties of privileged middle classes as they would neither transcend nor make possible alternative ways of tackling the intersection of surveillance and violence so long as they are couched in the liberal concerns for democracy. I call this phenomenon “liberal luxury,” whereby debates over surveillance have over-emphasised liberal proclivities at the expense of disengaging those peripheral populations most severely affected by sur/violence. İslam felsefesinin tartışmasız en önemli filozoflarından biri olan İbn Sina, dönemindeki yoğun Aristoteles etkisine karşılık, Aristoteles’in sisteminden bağımsız yeni bir zaman sistemi kurmuştur. Şifa isimli kitabında bu sistemi sunan İbn Sina, aynı zamanda hareket, hız, mekansal büyüklük gibi belli kavramların yanında bölünebilir bir büyüklük olan ve zorunlu bir şekilde öncelik ve sonralığa sahip olan bir kapasite olarak tanımladığı imkana dayalı bir zamanın gerçekliği savunusu yapmakla birlikte bu kavramların anlam kazanabilmesi için zaman kavramına ihtiyacımız olduğunu göstermiştir.Zamanın gerçekliği sorusu, güncel felsefenin aktörlerinden (...) de büyük dikkat çekmiştir. Bu isimlerden biri olan J. Ellis McTaggart, hayli tartışmalı olmasının yanısıra etkili de olan “Zamanın Gerçekdışılığı” başlıklı makalesinde zamanın bir illüzyondan ibaret olduğunu tartışmıştır. McTaggart, gerek bu makalede gerekse Varoluşun Doğası isimli kitabında zamanın gerçek olmadığını ve zamana dair verdiğimiz her tanımın döngüsel, çelişkili veya yetersiz olduğunu savunmuştur. McTaggart, bu ispatını zamandaki anların birbirine nispetle iki farklı şekilde sınıflandırılabileceği varsayımı üzerine kurgulamıştır. Buna göre A serisi, zamandaki anları geçmiş, şu an ve gelecek şeklinde konumlandırırken B serisi, öncelik ve sonralık ilişkisi ile konumlandırmaktadır. The objective of the paper is to create a concept of what securing the claim is, based on the positive legislation of Kosovo’s law, comparing its regulation with laws of somewhat similar legislations of neighbouring regions, understanding its implementation in practice, to achieve conclusions and remarks based on law, facts, practice, and the comparative aspect. The Civil Procedure Law in the Republic of Kosovo is regulated with contested, non-contested or enforcement procedure. Securing the claim is an institute expressively regulated by (...) the “Law on Contested Procedure of the Republic of Kosovo” on its XXI Chapter that defines its means and types. Considering securing the claim measures are present in civil law to prevent any possible threat of protected rights until the final verdict is given, this paper tends to achieve a realization of how these measures practically succeed in actual cases, if they meet the criteria set in the law, or if securing the claim proposal is approved by the court, if they unintentionally restrain the respondent from using their rights. Moving forward, how one distinguishes claim security and interim measures from one-another although they describe the main concept, is strictly reviewed under this article, to finally achieve conclusions and remarks based on questions raised as above. This book focuses on the impacts of global and transnational trends in higher education policy in Albania and provides a window into the variable interplay of local and global forces in an under-studied Balkan nation.

The use of student evaluations of teaching (SET) has become a widespread practice in higher education despite inconclusive evidence reported in the literature around its validity. Not surprisingly, the question of the validity of SET continues to be a current debate in higher education, pointing to the need for more research in this area. This paper is a part of a larger scale study, which aims to contribute to broadening the knowledge and understanding of SET validity by analysing the process (...) within the South East European University (SEEU) in North Macedonia in order to determine whether student evaluations are objective and critical. A likert scale questionnaire, containing 9 questions, was designed for the purpose of the analysis. The questionnaire was sent to all students from the five (5) Faculties: Business and Economics, Law, Contemporary Sciences and Technologies, Contemporary Social Sciences and Faculty of Languages, Cultures and Communications, in both campuses, Tetovo and Skopje. Three hundred and thirty three (333) students participated in the survey. Statistical Package for Social Science (SPSS) was used for analysing the results. Findings revealed that the information students received about the reputation, experience and qualifications of the professors had the highest influence on their perceptions, which in turn influenced the evaluations. As an addition, the present paper also compares two methods on a data set of actual SET. For illustrative purposes, only data from one faculty have been analysed. It is shown that the traditional method of considering the average values can misrepresent a teacher’s performance as it can be highly sensitive to any extreme grades, being either very positive or very negative. In doing so, it will provide an insight into the workings of the capitalist system, including its inroads into the shores of human desire – explaining how it robs individuals of their true essence and dehumanizes them. Finally, the article will call for checks and balances vis-à-vis our uncontrollable desires and recommend collective efforts in order to protect the institution of family and bring back commercialized societies from the brink. Autism spectrum disorder can lead to mental disorders such as anxiety, miscommunication, and limited repetitive interest. If the autism spectrum disorder is detected in the early childhood, it will be very beneficial for children to enhance their mental health level. In this study, different machine and deep learning algorithms were applied to classify the severity of autism spectrum disorder. Society Must Be Defended is a collection of Michel Foucault’s courses at the College de France in 1976. In this volume, Foucault discusses the emergence of a new technology of domination called biopower. It is a power that is not “individualizing”, but “massifying”, that is directed at man as a member of a “species”. Biopolitics exerts control over relations between the human races. Yet, some critics claim that Foucault’s biopower does not address colonial societies and problems. This paper argues that (...) Foucault’s theory of biopower could be applied to the postcolonial discourse, too. To trace Foucauldian biopower in postcolonial literature, the authors of this article have focused on E. M. Forster’s A Passage to India. In this paper, the plot and the dialogue of Forster’s novel is studied based on Foucault’s theory of biopower as discussed in his Society Must Be Defended. It is concluded that in Forster’s novel, it can be noticed that the English power, which dominated early twentieth century Indian society, employs biopower to subjugate the Indian population. The English officials control India not merely by means of disciplinary institutions, but by manufacturing norms for an entire race which are explainable in terms of Foucault’s theory of biopower. Bhabha’s theoretical framework in this regard. In this novel, Antoinette emerges as the “Other” who aims to prove herself to the “Centre”. Undergoing extreme sufferings, the heroine wistfully ponders mimicry as an impulse to break out of her mare’s nest and to establish herself within one culture. Indeed, unlike what Bhabha (...) believes mimicry cannot upset the total authority of the “Centre”. Meanwhile, Antoinette used it as a result of her longings for the position of the “Centre” which she is unable to attain because of her hybrid existence. Countering Homi K. Bhabha’s central argument, this essay contends that Antoinette’s mimicry of Englishness fails to fend off the norms of the superior power, but partakes in celebrating the very ideals that Bhabah’s theory is trying to keep at bay. ]]>. When there is a close tie between a narrative fiction and political issues then critics may deem it as “committed fiction”. Political fiction is at the crossroads of political science and the art of fiction. And more often than not, novelists are involved with politics but not all of them are dubbed as or even (...) consider themselves to be political novelists. In this article I attempt to investigate political fiction as a distinct genre produced consciously by a range of novelists and critics. The authors discussed in this paper demonstrate dissimilar perspectives on freedom and democracy. Also, regarding political fiction and the responsibility of author, we will see how divergent is the attitudes of critics such as George Orwell, Allen Robbe-Grillet, Juan Goytisolo, Mario Vargas Llosa and Isabel Allende. Faith development theory has evolved as a prominent theoretical perspective during the past three decades to explain different ways of relating to religious beliefs and worldviews. Recent revisions of the theory have elaborated on these characteristic ways as religious styles namely the fundamentalist, mutual, individuative-systemic, and dialogical. The present study developed an Urdu version of its principal measure, i.e., Faith Development Interview, to analyze twelve cases of Muslims of various religious affiliations within Islam in Pakistan. Four case studies representative of (...) each faith style are presented in detail. The cases are compared to analyze Islamic faith in terms of faith development theory and to understand fundamentalism in a Muslim context. The findings support faith development theory as a comprehensive paradigm to address the varieties of faith orientations in Islam. Implications for future research with larger samples in highly religious and collectivistic cultures are discussed. (shrink)

Corporate social responsibility remains a topic of interest for both theory and practice due to its multifaceted avenues and potential for growth. We have chosen embedded CSR and peripheral CSR measures to evaluate how these activities affect the employee turnover intentions via a mediation mechanism of organizational citizenship behavior. In doing so, this study addresses important stakeholder concerns and provides meaningful managerial contributions for the employers to encourage more employee participation toward sustainable corporate performance. This study incorporates four hypotheses that (...) are tested in a structural equation modeling framework by employing Warp-PLS software. Data were collected from 297 employees working in firms that are renowned for their CSR initiatives. We found support for our key hypotheses leading to strong theoretical contributions to the stakeholder theory. We have addressed the main issues of stakeholders’ response to the CSR tradeoffs and have tried to develop a deeper understanding of managers in initiating peripheral and embedded CSR activities for their firms. The concept of Industry 4.0 refers to the Fourth Industrial Revolution, which started in the 18th century with the First Industrial Revolution in England and is accepted as the last stage of industrial revolutions reached today. Industry 4.0 is expected to influence all sectors in the economy, especially the industry sector, the emergence of new professions based on cyber physical systems and artificial intelligence (smart machines), the need for labor to decrease considerably and a qualified workforce to remain in the (...) market. Along with the Industry 4.0 process, the change and transformation that will occur in the structure and functioning of the professions will have major impacts both in the individual, social and economic fields. In the present case; career planning and career choice issues, which are already difficult due to educational system troubles, adverse environmental conditions, the level of economic and technological development of the country, etc. will become more complicated for individuals with Industry 4.0 process. In this study, it is aimed to investigate the career selection and the possible effects of change and transformation in professions. In the study in which literature review and editing methods were used; conditions affecting the development and emergence of Industry 4.0 were examined first. Next; career concepts and career choice issues were analyzed. In the last part; in the context of career phases, research and editing has been carried out to determine the effects of Industry 4.0 on career development in children, youth and adults. According to the research data in the study; in the industry 4.0 process, it was determined that some of the existing professions will disappear due to technological development, whereas new occupations that are not currently available will emerge, and the professions that will continue to exist will also change. As a result of all these data, industry 4.0 process is expected to significantly affect professions, career choice and career development. (shrink)

The Qur’an has told the stories of many prophets and past tribes in order to convey the message it wants to give to its addressee. The Qur’an has narrated the stories that were narrated in the Bible in accordance with its purpose, by correcting the distorted points and without going into the details reported in the ‘Kutub-i al-Qadim’. One of the stories told in both the Qur’an and the Bible is Dawoud (David) and the plaintiffs. In this study, the story (...) of Dawoud and the plaintiffs deals with the evaluation of the story of Davud and the plaintiffs and the opinions expressed in the interpretation of the story in the context of Mushkil al-Quran al-Karim. From the earliest times to the present day, commentators have adopted different interpretations of the story of Dawoud and the plaintiffs. Some commentators, taking into account the literal meaning of the verses, interpret the verses based on the fact that the case described in the story is real. On the other hand, some interpret the parable based on the assumption that the case event expresses a representative expression, not a genuine event. The commentators who adopt this understanding are also divided into two as those who interpret the tale over the narrated narrations and those who interpret the tale over wording. The main reason why commentators adopt different interpretations of the tale is that the narrations about the background of the tale, primarily from the Bible, whether to be accepted or not. It is stated that the different opinions expressed in the article by the commentators, whom we have included in the classification, with the fear that they will harm the authority of prophethood, are difficult for the understanding of the story. In this article, different works that emerged according to the interpretation style of the commentators will be resolved in the context of the interpretations made by the same commentators. (shrink)

The positive role of religion in reducing prejudice has remained a neglected theme in Psychology of religion, concerning itself mostly with prejudice and fundamentalism. Recently, noting the absence of a positive antithesis to prejudice and fundamentalism, faith development theory presents xenosophia as going beyond mere tolerance to a creative engagement with other religious faiths to develop new insights and broaden one’s own worldview. The current research undertakes a study of Muslim faith contents to get insights into how these beliefs shape (...) construction of self in relation to other faith communities. Conducting inductive thematic analysis of faith development interviews from 12 Muslim participants from three major religious affiliations in Pakistan in an earlier research, the research analyzes a range of xenological patterns from xenophobia to xenosophia with associated potentials for inter-faith dialogue. Focusing on residents of a country with a dense Muslim population, the study carries implications for religious socialization and religious education in a globalized world. (shrink)

We examined the updating of decisions made during visuo-motor processing when two sequentially presented stimuli, Prime1 and Prime2, primed discriminative responses to a following probe. In Experiment 1, the visibility of the two primes was suppressed or left intact by varying the stimulus onset asynchrony of the stimuli immediately following them. In Experiment 2, the visibility of Prime2 was suppressed or left intact by varying its spatial separation from the following probe. We found that Prime2 dominated the effects of Prime1; (...) that Prime2’s updating was stronger when the Prime2–probe SOA was 200 as compared to 53 ms; and that Prime2’s updating was weaker when the Prime2–probe spatial separation was 58 as compared to 0 minarc. We conclude that these effects are due to an interaction of spatial attention and the state of processing of Prime2. (shrink)

Divine revelation (waḥy), as a Qur'anic and religious concept in exegetical sources, isusually mentioned together with the institution of Prophethood (nubuwwa). Revelation came to itsend with the end of Prophethood. Therefore, although some have evaluated inspiration (ilhām) andtrue dream (ruʾyā sādiqa) within the this context of revelation, according to most of Islamic scholars,it is not permissible to refer to the recevings of the divinely saints as revelation. Revelation, for whichthe holy Qur'an designates three pattern of descension, is discussed also in (...) three categoriesthroughout the history of Islamic intellectual thought. Scholars of tafsir and theologians,philosophers, and mystics, all hold and bolster different views on the nature of revelation. Claims inSufi literature that inspiration can descend to divinely saints -beyond immediate delivery to theheart- through direct or indirect divine communication from behind a veil and through angles can beevaluated as an effort to create a conception of revelation that corresponds to the three modes ofrevelation, adressed in Qur’an, peculiar to prophets. With regard to the issue of continuity of divine revelation, a thorough examination of the Sufiliterature leads to the conclusion that revelation continues to decsend in its verbal form asinspiration but also, according to some Sufi authorities, in its noun forms unaniously considered aspeculiar to the prophets. Therefore, especially since the period of Sufism’s intermingling withphilosophy, the issues of accommdating sainthood (walāya) within the framework of generalprophethood (nubuwwa ʿāmme), the distinction between revelation and inspiration and itscontinuity appear as a very complex, unframed and unlimited field. Caricatures can help to understand the perception of a face. The prominent facial feature of a subject can be exaggerated, so the subject can be easily identified by humans. Recently, significant progress has been made to face detection and recognition from images. However, the matching of caricature with photographs is a difficult task. This is due to exaggerated features, representation of modalities, and different styles adopted by artists. This study proposed a cross-domain qualitative feature-based approach to match caricature with a (...) mugshot. The proposed approach uses Haar-like features for the detection of the face and other facial attributes. A point distribution measure is used to locate the exaggerated features. Furthermore, the ratio between different facial features was computed using different vertical and horizontal distances. These ratios were used to calculate the difference vector which is used as input to different machine and deep learning models. In order to attain better performance, stratified k-fold cross-validation with hyperparameter tuning is used. Convolution neural network-based implementation outperformed the machine learning-based models. (shrink)

Therefore, especially since the period of Sufism’s intermingling with philosophy, the issues of accommdating sainthood within the framework of general prophethood, the distinction between revelation and inspiration and its continuity appear as a very complex, unframed and unlimited field. The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action. The interaction between environment and individual personality determines career. Over the past decades, the role of personality traits in explaining entrepreneurship cannot get much attention of researchers. To fill this gap, this study aims to investigate the effect of personality traits on the entrepreneurial intentions along with the mediating role of financial risk taking. Sample size consists of 500 students of business and management of different universities of Pakistan, out of which 466 useable questionnaires were collected and analyzed. The results (...) of the study are consistent with conventional wisdom as explored by past studies. In line with past studies and proposed hypothesis, we found that both extraversion and openness to experience have a positive association with FRT, whereas neuroticism, conscientiousness, and agreeableness have negative association with FRT. The results also revealed that there is positive association between FRT and EI; however, FRT did not mediate the relationship between agreeableness and EI. (shrink)

Hicrî birinci yüzyılın sonu ile ikinci yüzyılın ortalarında yaşamış bulunan Ca‘fer-i Sâdık ve Ebû Hanîfe, akran iki âlimdir. Kûfe’de yetişen ve Ehl-i sünnet mezheplerinden birinin imamı olan Ebû Hanîfe’nin, Medine’de yetişen ve İsnâaşeriyye’nin altıncı imamı kabul edilen Ca‘fer ile bir araya geldiği ve onun talebesi olduğu hem sünnî hem Şiî kaynaklarda rivayet edilmektedir. Mukaddem kaynaklarda Ebû Hanîfe’nin Ca‘fer-i Sâdık’ın öğrencisi olduğu yönündeki ifadelerin, muahhar kaynaklarda abartılı bir şekilde yorumlandığı görülmüştür. Bu çalışmada Ebû Hanîfe ile Ca‘fer-i Sâdık arasındaki hoca-talebe ilişkisi netleştirilmeye (...) çalışılmıştır. Bu sebeple öncelikle kısaca her iki imamın hayatı ele alınarak onların ilmî birikimi tespit edilmiştir. Akabinde Ebû Hanîfe ile Ca‘fer’in ne zaman ve ne kadar süre birlikte oldukları, Ebû Hanîfe’nin Ehl-i beyt’e yönelik tutumunun Ca‘fer’den ilim almasında ne gibi bir etkisinin bulunduğu ve çeşitli ilim dallarında Ebû Hanîfe- Ca‘fer ilişkisi tespit edilmeye çalışılmıştır. Makalenin konusu Ebû Hanîfe örneğinden hareketle İslam düşüncesinde yargı-siyaset ilişkisi-dir. Ebû Hanîfe’nin yaşadığı döneme kadar karizmanın dini ve siyasi kültürde gelişimine paralel olarak yargı-siyaset ilişkileri bağlamında İslam düşüncesinde bazı formlar çoktan ortaya çık-mıştı. Burada amaç İslam’ın henüz ikinci asrında yargı-siyaset ilişkilerini Ebû Hanîfe üzerinden anlamaya çalışmak ve dolaylı olarak da meselenin bugüne yansıyan yönlerine ışık tutmaktır. Bu yüzden farklı sosyolojik düzlemlerde inşa edilmiş Şiî, Haricî, Sünnî öteki formlar çalışma dışında tutulmuştur. Araştırma Ebû Hanîfe’nin; doktrini oluşturan Kur’an, sünnet ve sahabe uygulamaları (...) ile kendi dönemindeki dini, siyasi, sosyal ve kültürel şartlar arasında nasıl bir okuma yaptığını sorunsallaştırmıştır. Çalışmada Ebû Hanîfe’nin yargı-siyaset ilişkisi bağlamın-da ortaya çıkardığı genel anlama biçiminin, işaret edilen dini ve tarihi şartlarla kendi dini top-lumsallaşma çevresindeki diyalektik bir ilişkide şekillendiği varsayılmıştır. Dolaylı gözlem yöntemi ile elde edilen veriler bir tekil olay incelemesi bağlamında fenomenolojik bir çözüm-lemeye tabi tutulmuştur. Konu bugüne kadar ilahiyat bağlamında olduğu gibi din bilimi alanın-da da dikkat çekici görülmemiştir. Makale İslam düşüncesinde yargı-siyaset ilişkisinin farklı desenleri arasında Ebû Hanîfe modelini tartışması bağlamında bir değere sahip görülebilir. Çalışmada; temel hak ve özgürlüklerin korunması noktasında sivil ve barışçıl bir muhalefetin yeterli olmadığı, iktidarın kişisel hakları tanımaktan daha çok kişisel ödevler ve mutlak itaat talebi ile siyaset yaptığı bir ortamda Ebû Hanîfe’nin soruna ahlaki bir saikle yaklaştığı ve bu bağlamda bir çözüm önerisi getirdiği görülmüştür. Ebû Hanîfe gerek otorite ve karizması ge-rekse ekonomik statüsü ve kültürel birikiminden aldığı güç ile yaşadığı dönemde üst düzey siyasal ve hukuki bir katılım gerçekleştirmiştir. Yasama erkinin özgür bir üyesi olarak Ebû Hanîfe temel haklar bağlamında hayatı boyunca hep iktidarlarla karşı karşıya gelmiş ve bu mücadele içinde iken de öldürülmüştür. Müslüman bir ailede doğmasına rağmen dönemin politik tavrı nedeniyle daha doğumuyla birlikte iktidar tarafından öteki olarak görülmüş ve ömrü boyunca bu statü ile yaşamak zorunda kalmıştır. Başlangıçta kendi ailesi içinde toplum-sallaşırken deneyimlediği mevalilik duygusu, Ebû Hanîfe’de özellikle hocasının ölümünden sonra iktidarlara karşı toplumsal bir hak arayışına dönüşmüştür. Esasen kendi özelinde bir hak arayışı olmaksızın iktidarların yasa ile sorunlu politik tavırları karşısında dini, hukuki ve top-lumsal bir tavır içinde yürüttüğü bu mücadelesi Ehl-i Beyt’i ve diğer bütün toplumsal grup ve kategorileri içine alan bir genişlikte ilerlemiştir. Ebû Hanife’nin yargı- siyaset ilişkisine dair bu yaklaşımı teorik ve pratik olarak tamamen sistematik bir çerçevede şekillenmiştir. İslam hu-kukunun dayandığı bilgi gövdeleri kapsamında o, çok kapsayıcı ve dinamik bir tarzda din ve şeriat kavramsallaştırması yapmıştır. Buna göre Ebû Hanîfe dine temel hakların dayandığı temel yasa anlamı yüklerken şeriata ise kendisinin bu dini alana veya başka bir ifadeyle yasaya göre düzenlendiği neshe açık, değişken bir alan anlamı vermiştir. Bu tevhit eksenli hiyerarşi içinde siyaset, yasaya karşı kesin sorumluluğu olan dünyevi bir alan görülmüştür. Ebû Hanîfe’nin İslam’ın ilk dönemini bir hukuk devleti nosyonu içinde değerlendirdiğinde kuşku yoktur. Buna mukabil, genel yargı-siyaset ilişkisine yaklaşımından anlaşıldığına göre yaşadığı dönemi, iktidarlar tarafından hukukun araçsallaştırıldığı bir dönem olarak görmüştür. Kurmuş olduğu akademi onun yargı-siyaset ilişkisine bakışının önemli bir pratiğidir. Bu akademiden yetişen ve daha sonra resmi ve gayri resmi olarak yasamanın bir üyesi olan öğrencilerine tav-siyeleri ve mektupları, onun bir yargı elemanı olarak siyaset kurumuna yaklaşımının sübjektif değil; bir düzen ihtiyacının ortaya çıkardığı objektif bir tavır olduğunu göstermiştir. Ebû Hanîfe teorik yaklaşımını pratik bir eylem alanı ile birleştirmek suretiyle yargı-siyaset ilişkisine bakışı konusunda oldukça net bir fotoğrafa sahiptir. (shrink)

The debate on the Prophet’s parents’ (abawayn al-Rasūl) religious status and their position in the hereafter goes back to several narrations from the Prophet himself. This subject, which can principally be considered part of the problem of the religious status of ahl al-fatrah, seems to be raised by the Shīʿah as an issue of creed in line with their understanding of imamate. Abū Ḥanīfah’s (d. 150/767) statement in his al-Fiqh al-akbar that “Prophet’s parents passed away on kufr/jāhiliyyah” is seen as (...) a Sunnī reaction to this earlier position and led to a new area of discussion shaping the approach of several scholars to the issue. The earliest treatises dedicated to this issue are attributed to al-Ghazzālī (d. 505/1111) and Abū Bakr Ibn al-ʿArabī (d. 543/1148), but these works did not survive to this day. The earliest examples available today are the six epistles that al-Suyūṭī (d. 911/1505) penned. Literature on the Prophet’s parents flourished during the Ottoman times after the introduction of al-Fiqh al-akbar to the Ottoman scholarship. Starting with the first examples that belong to Ibrāhīm al-Ḥalabī (d. 956/1549), Ibn al-Khaṭīb al-Amāsī (d. 940/1534), and Kamālpashazādah (d. 940/1534), the treatises in question were mostly written in Arabic in the Ottoman scholarly milieu. Consequently, it seems that Rawḍat al-ṣafā fī wāliday al-Muṣṭafá is the first treatise dedicated to the issue in Ottoman Turkish. In the library catalogue records, some bio-bibliographical sources, and consequently in some modern studies on the issue of abawayn al-Rasūl, Rawḍat al-ṣafā wrongly attributed to a certain Wajdī Aḥmad Efendī (in Turkish: Vecdî Ahmed Efendi). This is probably due to the author’s presentation of himself in the introduction as just “Wajdī,” without making further description. Besides the data in Bursalı Meḥmed Ṭāhir’s Osmanlı Müʾellifleri, no more information could be provided about the identity of Wajdī Aḥmad Efendī who is shown as the author of the treatise. Intra-textual signs such as the author’s words about the reason and process of writing the work, the way he handled the subject and the evidence he put forward indicate that the treatise belongs to Nūḥ ibn Muṣṭafá al-Qūnawī (d. 1070/1660). Indeed, it overlaps with the fact that Nūḥ ibn Muṣṭafá presented himself as Wajdī in many of his other works. Seemingly the fact that Nūḥ ibn Muṣṭafá defends the view that the parents of the Prophet are among the people of salvation (ahl al-najāh), and while doing this, he was mainly based on the view that they were resurrected after death and that their souls are recaptured after they believed in the Prophet, stem from various reasons such as the view that attributed to Abū Ḥanīfah, Nūḥ’s Sufi identity to the extent that he was initiated to the Khalwatiyyah/Gulshaniyyah along with the ever-growing Sufi influences and the consequent idea of nūr-i Muḥammadī in the public sphere, the authority of the narrations attributed to the Prophet, and perception about the Prophet Muḥammed in the public imagination. The sciences of kalam and fiqh, which have a special importance in the history of Islamic thought and science, became prominent with their interactions with other sciences in their formation processes and their contributions to the evolution of religious thought. In the literature, the field representing the linguistic, religious, mental and practical aspects of fiqh has become widespread with the concepts of usūl-i fiqh and fürū-i fiqh, and the part about creed as usūlü'd-dīn or fiqhu'l-akbar. It has drawn our attention (...) that Imam Abū Ḥanīfa and Imam Shāfiʿī's ijtihads, fatwas and thoughts have remained up to date in every century without exception in the vortex of overdoing and understatement in these two disciplines. However, there are some narrations stating that although these imams were interested in kalam, they kept a distance from it. Their, famous students also indicated that they gave them advice in this sense. Therefore, this study has been prepared in order to examine the background of the aforementioned issues. For this purpose, the reasons why two imams preferred the science of fiqh in the main axis of the subject were subjected to a general criticism. Consequently, it has been seen that both imams had similar concerns and their ideas have been overlapping in the face of the creed developments of the period. (shrink)
