It is a virtue of virtue theory approaches to argumentation that they integrate many of the different factors that make arguments good arguments. The insights of virtue argumentation are brought to bear on a variety of versions of the requirement that good arguments must have good premises, concluding that a sincerity condition serves better than truth or assertability conditions, despite apparently counterintuitive consequences for arguments involving heterogeneous coalitions.

This book provides a concise overview, with excellent historical and systematic coverage, of the problems of the philosophy of language in the analytic tradition. Howard Callaway explains and explores the relation of language to the philosophy of mind and culture, to the theory of knowledge, and to ontology. He places the question of linguistic meaning at the center of his investigations. The teachings of authors who have become classics in the field, including Frege, Russell, Carnap, Quine, Davidson, and Putnam are (...) critically analyzed. The past few decades of moral psychology research have yielded empirical anomalies for rationalist theories of moral judgments. An increasing number of psychologists and philosophers argue that these anomalies are explained well by sentimentalism, the thesis that the presence of an emotion is necessary for the formation of a sincere moral judgment. The present review reveals that while emotions and moral judgments indeed often co-occur, there is scant evidence that emotions directly cause or constitute moral judgments. Research on disgust, anger, (...) sympathy, and guilt indicates that people only reliably experience emotions when judging conduct that is relevant to the welfare of the self and valued others. Moreover, many recent studies have either failed to replicate or exposed crucial confounds in the most cited evidence in support of sentimentalism. Moral psychologists should jettison sentimentalism, and focus instead on how considerations of harm and welfare—the core concepts of rationalist theories— interact with empirical beliefs to shape moral judgments. This note discusses critically a point in a d m walker's paper "the ideal of sincerity" ("mind", October 1978). Walker claims that desires are insincere if corrupted by incompatible desires. This view accounts for some cases, But not for all. It is argued, In the note, That superficial, Factitious, 'got up' desires are judged insincere as such because not 'natural' to a man. This is implied by the claim of andre gide's which walker misinterprets. The issue of natural desires in (...) contrast to artificial desires introduces the question of 'authenticity', Which is looked at in connection with lionel trilling's "sincerity and authenticity". In this paper, I examine an account of instrumental reasoning recently put forth by John Broome. His key suggestion is that anyone who engages in reasoning about his intentions also believes that he will do what he intends to do and that combined with a belief about necessary means this creates rational pressure towards believing that one will take the necessary means. I argue that Broome’s model has three significant problems; his key premise is false—the sincere expression of an intention (...) does not entail the belief that one will successfully execute that intention; his account yields a model of instrumental reasoning that is uncomfortably reflective; he seems unable to explain the rational pressure towards taking necessary means that arises directly from having an end and an instrumental belief. All three problems, I argue, are a consequence of Broome’s inadequate position on what it is to intend to do something. (shrink)

Clinicians' work depends on sincere and complete disclosures from their patients; they honour this candidness by confidentially safeguarding the information received. Breaching confidentiality causes harms that are not commensurable with the possible benefits gained. Limitations or exceptions put on confidentiality would destroy it, for the confider would become suspicious and un-co-operative, the confidant would become untrustworthy and the whole climate of the clinical encounter would suffer irreversible erosion. Excusing breaches of confidence on grounds of superior moral values introduces arbitrariness and (...) ethical unreliability into the medical context. Physicians who breach the agreement of confidentiality are being unfair, thus opening the way for, and becoming vulnerable to, the morally obtuse conduct of others. Confidentiality should not be seen as the cosy but dispensable atmosphere of clinical settings; rather, it constitutes a guarantee of fairness in medical actions. Possible perils that might accrue to society are no greater than those accepted when granting inviolable custody of information to priests, lawyers and bankers. To jeopardize the integrity of confidential medical relationships is too high a price to pay for the hypothetical benefits this might bring to the prevailing social order. (shrink)

Objective Having failed to achieve adequate influenza vaccination rates among employees through voluntary programmes, healthcare organisations have adopted mandatory ones. Some programmes permit religious exemptions, but little is known about who requests religious objections or why. Methods Content analysis of applications for religious exemptions from influenza vaccination at a free-standing children’s hospital in Cincinnati, Ohio, USA during the 2014–2015 influenza season. Results Twelve of 15 260 employees submitted applications requesting religious exemptions. Requestors included both clinical and non-clinical employees. All requestors (...) voluntarily identified their religious affiliation, and most were Christian. Content analysis identified six categories of reasons used to justify an exemption: risks/benefits, ethical/political, lack of direct patient contact, providence, purity and sanctity of life. Individuals articulated reasons in 1–5 categories. The most frequently cited category was purity; the vaccine and/or its mode of administration were impure, or receiving the vaccine would make the individual impure. Two individuals asserted that the vaccine contained cells derived from aborted human fetuses. Individuals also volunteered information supporting the sincerity of their beliefs including distress over previous vaccination and examples of behaviour consistent with their specific objection or their general religious commitment. All requests were approved. Conclusions Less than 0.1% of employees requested religious exemptions. Partnering with religious leaders and carefully correcting erroneous information may help address requestors’ concerns. (shrink)

The meaning of human existence is sought in the awareness of the same, incomprehensible divine presence in man and in the other. Background: While employers are increasingly considering and implementing COVID-19 vaccination requirements, little is known about the reasons offered by employees seeking religious exemptions.Methods: We conducted a mixed methods analysis of all the requests for religious exemptions submitted during the initial implementation of a COVID-19 vaccination requirement at a single academic medical center in the United States.Results: Five hundred sixty-five (3.4%) employees requested religious exemptions. At least 305 (54.0%) requesters had job titles suggesting that they had direct patient contact. Four hundred (...) ninety-nine (88.3%) of requesters self-identified as Christian, of whom 120 (21.2%) identified as Roman Catholic. Requesters offered 0 to 8 (mean 2.7) categories of reasons for their request. The most frequently stated reasons pertained to the use of fetal cell lines in vaccine development and manufacturing (382, 67.6%), interest in maintaining purity (221, 39.1%), or belief in divine healing (172, 30.4%). Some requesters also volunteered evidence of the sincerity of their beliefs including examples of their religious practices (116, 20.5%), other practices (66, 11.7%), and emotional states (32, 5.7%). One hundred fifty-two applications (26.9%) contained text copied without attribution, primarily from sample religious exemption request letters available on the Internet.Conclusions: Most requesters focused on the use of fetal cell lines in the development or manufacturing of the vaccines as the justification for their request. The development of vaccines that are not reliant on fetal cell lines may increase vaccination rates. Understanding reasons for religious exemption requests may inform vaccine education and vaccination policies. (shrink)

The first issue of Business Ethics Quarterly was launched in 1991. At that time there were few general principles that could serve as guidelines for global business. However, since 1991 a plethora of such principles have been developed to serve as guidelines and evaluative mechanisms for global corporate responsibilities. But operationalizing these principles in practice has been a challenge for most transnational corporations and even for smaller, more local enterprises. This is because, in some cases, the principles ask too much (...) of companies. In other cases, the principles are ambiguous. And in still other cases,the principles, written by and large from a Western, rights-based perspective, cannot be operationalized in some cultural or religious settings. In this paper I will outline a series of dilemmas multinational enterprises face in the global market place, even when they sincerely sign on to one or another set of principles. These problems are not insurmountable, but in the imperfect world of commerce, require that our expectations of corporate responsibilities be satisficing rather than absolutist. (shrink)

A leading psychologist at the Menninger Foundation analyzes the current cultural situation where deep unbelief alienates itself from classical belief. He recognizes that unbelief is not just a simple negation of belief but is itself pluralistic, and the varieties of unbelief have now become the attitudes of masses of modern men. The author makes extensive use of recent philosophical reflection. He is also well aware of how social policy may tend to replace what had once been religious goals and institutions, (...) and how secular institutions may become the vehicle of sacred values. Both belief and unbelief are understood as aspects of man’s pursuit of happiness, although the classical philosophical considerations of this happiness principle are never debated. The psychological foundations of the book lie in psychoanalytic object relations theory suggesting an isomorphism between personal relations and the relations between the self and reality. Overbeliefs, [[sic]] whether secular or religious, are analyzed as a function of such object relations. With this in mind the author treats, for both believers and unbelievers, problems of dependency and autonomy, mystery, options, Providence, and fantasy and reality. The analysis and suggestions will be helpful to the lay audience but will not seem especially new to trained philosophers. Strangely enough, the author himself seems to remain in the position between belief and unbelief. He understands each side sufficiently well so as not to reveal decision for either but offers instead a strong philosophically supported plea for tolerance. It is even stranger, in a book concentrating upon the alienation from belief, that so much analysis is given to the nature, content, and psychology of belief. Unfortunately, what one misses the most is what is most needed and desired in a more secular culture; a profound and penetrating analysis of the psychology or psychologies of the unbeliever. Just how the sincere secular man’s psychological character operates to affirm unbelief, involving the psychological analysis of his character so that we may understand his attitude toward anxiety, despair, suicide, hope, self-respect, concern and care, the psychology of tolerance, mortality and death, meaning and meaninglessness surely deserve the same depth and care of analysis that hundreds of years in the psychology of belief has offered, but this, one does not find. One can only hope that out of his extensive clinical experience the author will further reveal the deep ambiguities and psychological character of the sincere unbeliever and his internal struggle with the good, the true, and the beautiful. In such an analysis the profound struggle of unbelief with any classical theories of man’s natural inclination towards belief, clarifying precisely what is being denied, and how one negates it and lives with this negation psychologically, would form a fascinating adventure into the psychological processes of contemporary secular man.—H.A.D. That is why the practice of science interests philosophers who are concerned to say how such knowledge (...) and understanding, such capacity for prediction and control, can be acquired. It challenges them to show why scientific practice should deliver these cognitive goods. Some who decline the challenge, or fail to meet it, may deny that it does deliver the goods; but their conscious practice, of preferring aircraft to broomsticks for flight and telephones to telepathy for communication, belies the sincerity of their denials. The example of a political leader who has to decide whether he would allow the torture of a suspect in order to get information about a ticking bomb has become notorious in ethical discussions concerning the tension between moral principles and political necessity. The relation between these notions must be made as clear as possible before a sincere moral evaluation of ticking bomb situations can be given. The first section of this article considers whether the concept of political obligation is (...) different from moral and legal obligations or whether it is a special kind of moral obligation. In the second section, the idea that the dirty hands problem confronts us with the ambiguities of moral life is rejected because it would imply an untenable moral paradox. The thesis that is developed is, namely, if there is such a thing as political necessity, it must be some form of moral obligation. The third section analyses the concept of political necessity and concludes that it cannot overrule basic moral principles and that the international legal prohibition of torture must be considered to be a categorical imperative. In the last section, these ideas concerning political and moral necessity are brought in against the defence of torture, which should be tolerated in the ‘War on Terror’. There it will be argued that the use of the ticking bomb argument not only supports a highly hypocrite political practice but is also deceptive as a moral and political argument. (shrink)

Hunt I THE CHAIN OF EVENTS NARRATED in Herman Melville's Billy Budd, Sailor (An Inside Narrative)—how Billy is falsely accused of plotting mutiny by his Master-at-Arms, John Claggart, how Billy accidentally kills Claggart and, finally, is executed at the urging of the Captain of the Ship, Edward Fairfax Vere, despite Vere's personal conviction that (...) Billy does not deserve to be killed—is simple enough. The text itself, nonetheless, is troublesomely complex. It is a very difficult work to interpret with both honesty and confidence. Melville unflinchingly represents to us the moral horror of what Captain Vere does to Billy, and yet he also depicts Vere himself with a respect that borders on admiration. The attentive reader experiences a painful cognitive dissonance that can only be soothed by a coherent interpretation, and perhaps by a bit of philosophy.Given the way in which the text of Billy Budd emerged—it was assembled by scholars, long after Melville's death, from a confusing collection of manuscript pages he had left behind when he died—it may well be an unfinished work. It is possible that ill health and death overtook Melville before he had a chance to iron out the inconsistencies that inevitably arise as a book is written, and it is therefore also possible that some of our sense of dissonance is produced by this brute fact. 1 Whether or not this is the case, this book is, according to the view I will present here, at least very close to being coherent. The point of view it represents is actually quite appropriate to an unfinished work, and little damaged by textual indeterminateness. Billy Budd is about the inescapably dilemmatic nature of certain choices. It alleges the impossibility of resolving them in any comfortable way. Melville beckons us to [End Page 273] look through the window of Billy Budd into an abyss of undecidability, and perhaps a text that contains some chaos within itself will better serve as such a window than one that does not.The best way to begin trying to understand how we should take this work is to begin at its very beginning. The very beginning of a story is of course its title, and the title of this story, or more exactly its subtitle, tells quite literally what sort of story it is. It is an "inside" narrative. Of course, this immediately raises the question of what an inside narrative is. Inside what? Are we supposed to contrast it with an outside narrative? And what sort of story would that be?Melville does not leave us entirely without an answer to this question. Billy Budd does contain another story, one that contrasts so sharply with the main narrative that it might well be described as its opposite: it is virtually an inverted version of the book's plot. In an "authorized weekly publication" quoted at some length at the end of the book, the events of Melville's tale are briefly recounted. In this version of the story, apparently the only officially sanctioned one, Billy Budd is depicted as the ringleader of a genuine mutiny, who "vindictively stabbed" Claggart for exposing him. Claggart is motivated only by a "strong patriotic impulse" and Billy Budd by "extreme depravity."This account, Melville tells, us was written "for the most part" sincerely enough, "though the medium, partly rumor, through which the facts must have reached the writer served to deflect and in part falsify them" (1432.27-30). 2 It could be called an "outside" narrative in virtue of the fact that its author was not there and consequently was not in a position to know what actually happened. The most direct way to give literal meaning to the "inside" status of Melville's main narrative is simply to observe that it gives a view from inside the ship, from inside the Bellipotent. The music of Christoph Willibald von Gluck was a revolution for Paris operagoers when his work premiered there in 1774. In a setting known for its restive and often rowdy spectators, Alceste, Iphigénie en Aulide, and Orpheé et Eurydice seized audiences with unprecedented force. They shed silent tears or sobbed openly, and some cried out in sympathy with the sufferers onstage. “Oh Mama! This is too painful!” three girls called out as Charon led Alcestis to the underworld, and a boy (...) pleaded with his father to take him home. A woman who watched the same performance described falling on her knees in her opera-box as the march of the priests of Apollo began, staying in this position “suppliant and with my hands clasped until the end of the piece.”Gluck's streamlined musical language was one reason for these emotional responses. He and his librettist Ranieri de’ Calzabigi simplified the conventions by eliminating extraneous subplots, abandoning the repetitive da capo form, and replacing trills and runs with simpler melodies meant to convey passion. Another reason was the widespread culture of sentimentalism, which equated virtue with sincerity and judged tears to be the natural sign of an open heart. Painters depicted tender and tumultuous family scenes, and friends pledged trembling vows of fidelity. Listeners were also readers, and many described similar tearful responses when they read the century's bestseller, Rousseau's novel Julie; or, The New Heloise.Everist, a musicologist, takes up the story of Gluck in France in the nineteenth century, when the German composer remained a presence in repertoires. No longer prone to tears, the public was often indifferent and sometimes hostile to his works. Conductors and composers nevertheless persisted in promoting Gluck's music. Between 1828 and 1870, operatic excerpts appeared roughly twice a year in performances of the prestigious Société des Concerts, and the charismatic conductor Jules Pasdeloup regularly programmed his music. Many listeners remained unconvinced. A writer in 1861 described the “sepulchral boredom that reigned the length of all five acts” of Alceste. The periodical Monde dramatique used the same language to characterize Gluck's music: it was “profoundly boring.” After a high point of performances in the middle of Napoleon III's reign, Gluck disappeared from the Paris opera and concert stage for some thirty years.Everist's aim in this slim book is to isolate the “agents” involved in the French reception of Gluck. Traditional reception histories might begin with Gluck and his aims, identifying musical features, particular responses of audiences, critics’ accounts, and perhaps the more elusive temper of the times. Everist focuses instead on less conspicuous networks of impresarios, theater directors, and publishers. In his telling, such agents also include journalists and writers of fiction. The avowed effort is to decenter the artist and his art to emphasize the limited role that composers and librettists play in the performance of an opera. A quoted passage in the book reminds us that without parking attendants, stagehands, and ticket sellers the show could not go on. True enough. Genealogies of Music and Memory therefore provides tables listing Gluck arias in anthologies, particular singers’ performances, works by composers other than Gluck who also drew themes from classical antiquity, and works by other foreign-born composers. A section on “material culture” lists paintings and sculptures of Gluck in Paris theaters and museums.As a “genealogy,” the book is a salutary reminder of the web of amateurs and professionals who discuss, promote, and perform works that others have created. Writers such as E. T. A. Hoffmann, Mme de Staël, and Hippolyte Taine held up Gluck as the embodiment of German music. Hector Berlioz wrote frequently and enthusiastically about Gluck, although he was less keen to program his music. The singers François Delsarte and Pauline Viardot aroused temporary interest in Gluck by regularly including his arias in their recitals. Musical anthologies for the bourgeois household included piano arrangements of his best-known arias. Some nineteenth-century adaptations of his works were scored for the military band.Genealogies of Music and Memory is musicology with very little music. Everist's reliance on networks of actors, agents, publishers, pedagogical practices, and archival environments leads him to assert that “multiple agency is endemic in the story told here.” Unfortunately, it is often unclear just what the story is. Carelessness in writing and editing throughout—including a subject-verb clash in the book's final sentence—has rendered key passages obscure. Everist describes Delsarte's voice as feeble, broken, veiled, and ready to be extinguished twice in the same paragraph, first as a paraphrase and again in a quotation (with a misplaced comma).Decentering artists and their work to elevate others responsible for its reception brings attention to the unseen and often unsung. In the absence of particular performance histories, musical analyses and description, or sustained accounts of shared tastes or critical responses, however, conclusions remain piecemeal. Everist claims to have revealed a “Geertzian web of culture” in his study. A more modest account would describe it as an enumeration of references, revivals, editions, excerpts, and arrangements. A New Philosophy of History for our age of transition from the Christian era to the period of world-unity, combined with a penetrating analysis of our present situation, is offered by Karl Jaspers' Vom Ursprung und Ziel der Geschichte. Jaspers is, however, more post-Hegelian than post-Christian, and in fact anti-Hegelian, but pro-Christian. Rejecting Hegel's dictum that the appearance of Christ is the “axis of world history,” i.e. the aim of the preceding, and the origin of the subsequent, centuries, Jaspers tries (...) to discover the real axis of history empirically at about 500 b.c. Eager to find a common historical origin for East and West, he claims the time from 800 to 200 b.c. as axis-time. He believes that in these centuries, man as we know him to-day, with his religion, art, philosophy, and science, emerged in China, India, Iran, Palestine, and Greece. He further believes that a new axis-time is approaching, and the analysis of the three tendencies leading to it, i.e. of socialism, world-unity, and faith, forms one of the most valuable parts of the book. Like Toynbee he believes that a return to a transformed Biblical faith is necessary, if the West is to be saved. Pessimistic about the immediate future, he is optimistic concerning the remote future. History, as the history of single nations, states, or civilizations, is at an end. World History is only just now beginning. This is a book of European importance. It formulates the crucial question, whether Europe has still the spiritual strength to avoid a relapse into its Asiatic background with its despotism, uniformity and loss of personal liberty. In Jaspers' development, it marks a transition from reflecting upon mere possibilities to a consideration of historical reality. His booklet, The Spiritual Situation of our Time concluded with a chapter on “What may become of Man,” but what really did happen to man in the meantime proved that reality is much richer in possibilities than the liveliest imagination could possibly foresee. Does he now actually reach reality, or rather a “possible” History, as the stage on which man reveals himself in all his potentialities, and which moves from one fictitious axis-time to another equally fictitious? Jaspers' Einführung in die Philosophie, most enjoyable and a masterpiece of book-production, is the best introduction to his own philosophy. It emerges here as a possible form of philosophizing in an age of transition; original, sincere, cultivated and stimulating. His method is still the way of reflection, but this now includes meditation and self-examination. Jaspers rightly demands of-a philosopher a thorough knowledge of one special science, an equally penetrating knowledge of at least one great philosopher, and sincerity in his daily conduct and acceptance of responsibility for whatever he is doing. Should he succeed in educating a generation of philosophers on these lines, that would indeed give new hope for the future of European philosophy. Jaspers' Inaugural Lecture, Philosophic und Wissen-schaft, discusses in a clear and competent manner this important problem and clearly exposes the confusion of some contemporary conceptions of science, e.g. in Marxism. His lecture, Unsere Zukunft und Goethe, rejects a Goethe cult, but stresses the new manner in which Goethe could be appreciated by the present generation. All in all, Jaspers represents the best in German tradition, and is now one of the leading European philosophers. (shrink)

Rejecting Hegel's dictum that the appearance of Christ is the “axis of world history,” i.e. the aim of the preceding, and the origin of the subsequent, centuries, Jaspers (...) tries to discover the real axis of history empirically at about 500 b.c. Eager to find a common historical origin for East and West, he claims the time from 800 to 200 b.c. as axis-time . He believes that in these centuries, man as we know him to-day, with his religion, art, philosophy, and science, emerged in China, India, Iran, Palestine, and Greece. He further believes that a new axis-time is approaching, and the analysis of the three tendencies leading to it, i.e. of socialism, world-unity, and faith, forms one of the most valuable parts of the book. Like Toynbee he believes that a return to a transformed Biblical faith is necessary, if the West is to be saved. Pessimistic about the immediate future, he is optimistic concerning the remote future. History, as the history of single nations, states, or civilizations, is at an end. World History is only just now beginning. This is a book of European importance. It formulates the crucial question, whether Europe has still the spiritual strength to avoid a relapse into its Asiatic background with its despotism, uniformity and loss of personal liberty. In Jaspers' development, it marks a transition from reflecting upon mere possibilities to a consideration of historical reality. His booklet, The Spiritual Situation of our Time concluded with a chapter on “What may become of Man,” but what really did happen to man in the meantime proved that reality is much richer in possibilities than the liveliest imagination could possibly foresee. Does he now actually reach reality, or rather a “possible” History, as the stage on which man reveals himself in all his potentialities, and which moves from one fictitious axis-time to another equally fictitious? Jaspers' Einführung in die Philosophie , most enjoyable and a masterpiece of book-production, is the best introduction to his own philosophy. It emerges here as a possible form of philosophizing in an age of transition; original, sincere, cultivated and stimulating. His method is still the way of reflection, but this now includes meditation and self-examination. Jaspers rightly demands of-a philosopher a thorough knowledge of one special science, an equally penetrating knowledge of at least one great philosopher, and sincerity in his daily conduct and acceptance of responsibility for whatever he is doing. Should he succeed in educating a generation of philosophers on these lines, that would indeed give new hope for the future of European philosophy. Jaspers' Inaugural Lecture, Philosophic und Wissen-schaft , discusses in a clear and competent manner this important problem and clearly exposes the confusion of some contemporary conceptions of science, e.g. in Marxism. His lecture, Unsere Zukunft und Goethe , rejects a Goethe cult, but stresses the new manner in which Goethe could be appreciated by the present generation. All in all, Jaspers represents the best in German tradition, and is now one of the leading European philosophers. (shrink)

Catharine MacKinnon claims that pornography silences women in a way that violates the right to free speech. This claim is, of course, controversial, but if it is correct, then the very free speech reasons for protecting pornography appear also to afford reason to restrict it. For this reason, it has gained considerable attention. The philosophical literature thus far focuses on a type of silencing identified and analyzed by Jennifer Hornsby and Rae Langton (H&L). This article identifies, analyzes, and argues for (...) the importance of a different type of silencing. As we shall see, there are compelling reasons in favor of regarding H&L silencing as a free speech violation and, as I argue here, the same can be said for sincerity silencing. Although additional work needs to be done to show that either one actually is a free speech violation, I demonstrate here that both types of silencing equally warrant this further attention. Moreover, I show that sincerity silencing is a fairly widespread phenomenon; so, therefore, is the harm it constitutes. As a result of these considerations, then, we can safely conclude that sincerity silencing also requires our attention. (shrink)

Sheikh Halid Sufi, as a Sufi poet, addresses human being as the main subject of his sufist dicourse. He is an important figure of our recent history as he primarily adopted the goal of human perfection and revealed a doctrine of humanity in the school of knowledge. In advance of our current century, when human is seen just in physical respect, he lived as a man of heart who handled human being with an integrated approach within the aspects of matter (...) and spirituality, the world and the hereafter, individual and community, body and soul. In this communiqué, I will discuss Sheikh Halid Effendi’s ontology and his point of view on the place of human being in the realm of existence. He seeks human perfection and wishes people to free themselves of shabby desires and regain their disposition. He recommends people to achieve purity in order to reach the rank of being a mirror to God’s reflections. As a Sufi poet, he attaches importance to carrying out the education of divine journey, wrapping up in mystical ethics, having the identity of wisdom and gaining the aesthetics of love so as to reach the perfection. SUMMARY Sheikh Mehmed Halid was born in 1273/1856 in Sivas. He graduated from Ottoman Junior High School. He attended the 1893 War. In 1880, he started his professional career at a state office. Until 1899, he served in several positions, as assistant judge in Erbaa Lower Court, as Prosecuting Deputy Attorney in Sivas, as Prosecuting Judge assistant in Lower Court and head clerk in Darende, as head clerk in Lower Court in Tonus/Altınyayla, and as prosecuting judge in Kuruçay. He died in 1931 and was buried in Sivas Yukarı Tekke Graveyard. Sufism (tasawwuf) is an education for integrity towards maturity, in a way to prufiy the self from evils of nafs (self) and to reach the love of Allah. This spiritual educational journey is called ‘Seyr-u Suluk’. Sheikh Mehmed Halid completed his Seyr u Suluk as a dervish (student) of murshid (mentor) Kastamonulu Ganizade Mehmed Sadık Baba. Sheikh Mehmed Halid wrote three books called Hilafetnāme, Mektubāt, and Divan. He deals with issues of Sufism (mysticism) in these works. Primarily, his works dwells into the matters of morals, worship, good manners (adab), customary practices, ingenuity, existence, and love. Sheikh Mehmed Halid’s sole attempt is to explain the relationship among Allah, man and universe in an understandable way. According to Sheikh Mehmed Halid’s conception of Sufism, existence is unique and that existence is only Allah. The existence of Allah is absolute while the existence of assets is relative. Things do not exist on their own. Universe is like a mirror. What is reflected in the mirror of universe are the shadows of Allah the Omnipotent. The graces of The Divine are reflected in this mirror. All the things that exist in the universe proves the Self of Allah and his properties. Each of the things in the universe are the words of Allah. The existence of the universe is a result of Allah’s mercy. Man is the fruit of the tree of the Universe.Man is both the embodiment and the reflection of Allah. We want to discuss the position of man in between Allah and the universe with Sheikh Halid’s verses. Perceiving plurality in unity and unity in plurality, Sheikh Mehmed Halid attributes the variety of things and existence in the universe to the Divine beauties of Allah. For those who can comprehend, the plurality/ abundance in existing objects in the universe indicates singularity and uniqueness of Allah. According to Sheikh Halid, Allah is independent from and beyond all the entities that exist in the universe. However, Allah, manifests Himself in the things that he creates and the actions he takes through His divine names and properties. According to Sheikh Halid, each object is a reflection of Allah’s divine properties. Every entity in the universe glorifies Allah with all their existence. For Sheikh Halid, Seyr u Suluk is the journey from weakness to perfection, from substance to meaning, and from things to reality. Considering Seyr u Suluk education as distancing one’s self from other beings, reaching purity of heart, disposing of all signs explains these concepts with pilgrimage metaphor. As a response to those who asks him what he meant by seyr u suluk, he says seyr u suluk is servitude and submission to Allah. In order for Seyr u Suluk to be meaningful, a person should enter the way of a murshid-i kāmil (perfect religious mentor), and should have sincerity, purity (being deprived of all sins) and dhikr. According to Sheikh Halid, someone who is not in trouble is not given a remedy. So as to bother is necessary for remedy to be arisen. Nuisances of the universe are also ephemeral as the universe itself. Therefore, it is unnecessary to bother things that are ephemeral. Because remedy is not available without being mature. According to Sheikh Halid, the procedure of gaining advantage from being mature; getting rid of the ego, feeling the love, being pioneer of the mission, being modest, to attain soul pleasure, escaping from fame, leaving the claim, the glory of salvation, proceeding dhikr, reaching the conquests and escaping from friendship of worldly things. According to Sheikh Halid, being mature is not setting about affiliation ceremony. Asceticism cannot be a show and claim authority. Sincerity is needed on the basis of seyr u suluk education. Asceticism which is an effort of making the religion a specific of Allah is to make intimacy with Allah. Sheikh Halid wants his murids who take part in ṭarīqa (sufī path) to decide on the sincerity. Sincerity is said to be the unique factor that makes sense the membership. Seyr u suluk which begins with being membership of mature murshid, which makes sense with proceeding worship and respecting the sincerity arises by teaching manners to soul. Seyr u suluk is trying to reform the soul. Teaching manners to soul is a challenging and significant task. The most important factor that ensure teaching manners to the soul to be achieved is dhikr. Dhikr practice which makes successful the teaching manner to the soul of seyr u suluk training increases the prudence and foresight of dervish. The unique task that murshid expects from his murid during the membership process is to adjust his soul and parlance to the dhikr of Allah. Dhikr of Allah is a product of fondness. According to Sheikh Halid, one who wants to be remembered in heaven should himself learn to remember Allah. Sheikh Halid gives too much importance to disciplining the tariqa where sufi training takes place. A murid should qualify his murshid whom he intimated to. Followers should gain sufficient advantage from the spiritual atmosphere in the dergāh of their murshid. The murid must be at the service of the murshid who trains him and should obey tariqa manners. Salik who achieves seyr u suluk, who maturates the sufi ethics and who gains sincerity through dihkr of Allah tries to achieve the Gnosis. The intent of being a human is to know Allah. The biggest disaster for human is to come upon unawareness. Sheikh Halid who assumes the the Arifs as sultans of walayah makes a comparison between the Arifs and the Zahids and prefers the Arifs. He thinks that the Zahids pay attention to the appearance, cannot reach the basis and cannot go beyond Allahliness show. Sheikh Halid, who encourages the Zahids to avoid comparing themselves with the Arifs, warns the ones who combat with the Arifs and reminds that Allah proclaims warfare to those who has hostility towards those surrendering themselves to Allah. Sheikh Halid lines up the ways of being mature and having wisdom as godly grace, asceticism, love, the mind of leaving, battle with the self, humility, dikhr and being woeful. Salvation process which Marifetullah will guide is to achieve the love of Allah. Love is the way of achieving the reunion. The reality can just be gained through love. However, gaining the divine love requires to be loved. Because, the way of gaining the divine love is to remove everything except Allah from one’s heart. (shrink)

This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share.
