This chapter argues that the human perspective is not fully reducible – that is, that something would indeed be lost in the absence of the human perspective. It shows that epistemic subjectivity itself is an irreducible, ineliminable feature of the human standpoint. Subjectivity goes along with substantiality, and to be an epistemic subject is to be a substance with a mind. In E2p13, Spinoza identifies the mind's object with the body, thereby specifying where the multiplicity of epistemic subjects comes from (...) – how, that is, individual epistemic subjects are identified and differentiated. The chapter looks at how the three kinds of knowledge relate to the notions of epistemic subjectivity. These include: imaginative knowledge; reason, or knowledge from common notions; and intuitive knowledge. Imaginative knowledge works straightforwardly on the model of having ideas in the thick sense. Research that is initiated, designed or funded by sponsor agencies based in countries with relatively high social and economic development, and conducted in countries that are relatively less developed, gives rise to many important ethical challenges. Although clinical trials of HIV vaccines began ten years ago in the US and Europe, an increasing number of trials are now being conducted or planned in other countries, including several that are considered “developing” countries. Safeguarding the rights and welfare of individuals participating as (...) research subjects in developing countries is a priority. In September, 1997, the Joint United Nations Programme on HIV/AIDS embarked on a process of international consultation; its purpose was further to define the important ethical issues and to formulate guidance that might facilitate the ethical design and conduct of HIV vaccine trials in international contexts. As Husserl already noticed, artworks themselves have a phenomenological character. This means, however, that to experience artworks as phenomena no “epoché” and no “phenomenological reduction” is necessary. The leading question of my essay is whether, and possibly how, this observation can be methodologically generalized for understanding phenomena. I discuss if, and possibly how, a phenomenological reflection on art allows and even demands a general conception of phenomenology that nevertheless does not confuse artworks with phenomena in general. My intention is to (...) show that and how phenomenality can be clarified with reference to its spatial character. Accordingly, works of architecture that are artworks will play a decisive role in my argument. (shrink)

Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Based on some analogies with quantum networks it is argued that the 'observed' gets 'dressed'as a consequence of (...) the observing. Interface dynamics and system dynamics supplement each other without over- determination. (shrink)

Since the last two decades of the 20th century it has been widely accepted that testimony has to be acknowledged as a source of knowledge. As a side effect, any form of epistemic individualism has been discredited. The article provides some arguments against the dismissive attitude towards epistemic individualism. I distinguish between three forms of epistemic individualism, and I argue that only the most extreme form can be flatly rejected while there are good reasons for maintaining the other two forms (...) of epistemic individualism. I show that weak individualism, according to which individuals are the bearers of knowledge, is concerned with a necessary condition of the instantiation of knowledge. We only accept knowledge claims if there is good reason to believe that they are maintained by at least one individual. My main interest, however, is focused on a discussion of the third more challenging form of epistemic individualism, namely normative epistemic individualism, which claims that priority of one’s own epistemic experiences over the testimony of others. I first swow that such a priority claim can only be understood as a local device, i.e. if a belief based on our own experiences is challenged by other people’s assertations, then we are committed to trust our own experiences more than the words of others. In a second step, the relations between such a restricted version of the individualist priority claim and the ideal of rationality are discussed. (shrink)

The first and greatest commandment according to Jesus, and so the one most central to Christian practice, is the command to love God. We argue that this commandment is best interpreted in aretaic rather than deontic terms. In brief, we argue that there is no obligation to love God. While bad, failure to seek and enjoy a union of love with God is not in violation of any general moral requirement. The core argument is straightforward: relations of intimacy should not (...) be morally imposed upon autonomous beings. We contend that such reasoning applies to human beings’ relationship to God. So, even if our ultimate end is to enjoy communion with God, God has no right that human beings seek a relationship with him. If this is correct, then the command to ‘love God’ is not the sort of moral principle that can be supported by threats of hellfire or other forms of coercion. (shrink)

The paper is a critical discussion of scholarship on the "Critique of Pure Reason" published during the past ten years. The emphasis is on Anglo-American authors. I identify and discuss three main trends in the field: a shift from the general discussion of transcendental arguments to the analysis and evaluation of particular proofs in Kant; a renewed interest in the doctrine of transcendental idealism and the distinction between things in themselves and appearances; and the emergence of an entire body of (...) literature on Kant's philosophy of mind, centered around the idea of a "transcendental psychology." Research in the field of Empirical Ethics (EE) uses a broad variety of empirical methodologies, such as surveys, interviews and observation, developed in disciplines such as sociology, anthropology, and psychology. Whereas these empirical disciplines see themselves as purely descriptive, EE also aims at normative reflection. Currently there is literature about the quality of empirical research in ethics, but little or no reflection on specific methodological aspects that must be considered when conducting interdisciplinary empirical ethics. Furthermore, poor methodology in an EE (...) study results in misleading ethical analyses, evaluations or recommendations. This not only deprives the study of scientific and social value, but also risks ethical misjudgement. (shrink)

This article considers what the implications of decertification would be for single-sex services such as domestic and sexual violence support. Some reform options attached to decertification could (re)allocate authority away from the state to organisations or individuals to determine gender criteria. What would the consequences of such re-allocation be in determining eligibility to receive or access services or excluding people on the basis of a characteristic protected under equality law? Engaging with this in the context of domestic and sexual violence (...) support service provision raises a number of questions. Firstly, does the existence of gender-based violence and/or of the effects it produces require a stable category in order to address them? What benefits may emerge from providing single-sex spaces that could not be replicated in other settings? And finally, what criteria of exclusion and inclusion are currently used to determine access to spaces beyond legal gender status? (shrink)

In spite of the importance of point mutations for evolution and human diseases, their natural spectrum of incidence in different species is not known. Here I propose to determine these spectra by comparing consecutive sequence periods in stretches of repetitive DNA. The article presents the analysis of more than 51,000 such point mutations identified by this approach in the genomes of human, chimpanzee, rat, mouse, pufferfish, zebrafish, and sea squirt. I propose to explain the observed spectra by auto‐mutagenic mechanisms of (...) genome variation involving the inter‐conversions of nucleotides, single base‐pair inversions and their combinations. Fichte's System of Ethics, published in 1798, is at once the most accessible presentation of its author's comprehensive philosophical project, The Science of Knowledge or Wissenschaftslehre, and the most important work in moral philosophy written between Kant and Hegel. Fichte's ethics integrates the discussion of our moral duties into the systematic framework of a transcendental theory of the human subject. Its major philosophical themes include the practical nature of self-consciousness, the relation between reason and volition, the essential role of the (...) drives in human willing, the possibility of changing the natural world, the reality of one's own body, the reality of other human beings, and the practical necessity of social relations between human beings. This article compares Kant and Fichte from the double stand- point of identity and difference with regard to two thinkers who were at first united by a master-student relation but who later on drifted apart from each other due to mutual defamation. At the center of the present discussion stands the relationship between spirit of freedom and system’s form which binds Kant and Fichte beyond methodological divergences and doctrinal differ- ences. The critical comparison between Kant and Fichte will be developed (...) in four steps: it will start with the general positioning of Kant within German Idealism, and then move on to Kant’s double critical enterprise of grounding an aprioristic doctrine of principles of nature and freedom; it will later on address the conception championed by Fichte of having pre- sented the “first system of freedom”, and from there it will focus on the manifestations of freedom within Fichte’s philosophical system, with Kant’s position as contrast. A number of fairness issues and principles are developed and discussed from the context of personnel selection. It is noted that not too much attention has been paid to these issues and concerns in the past. A distinction is made between justice and fairness having to do with the procedural components and processes of selection, the nature of the information used to make selection decisions, and the resulting outcomes of the selection process. Hylomorphism is the Aristotelian theory according to which substances are composites of matter and form. If my house is a substance, then its matter would be a collection of bricks and timbers and its form something like a structure that unites those bricks and timbers into a single substance. Contemporary hylomorphists are divided on how to understand forms best, but a prominent group of theorists argue that forms are emergent powers. According to such views, when material components are arranged appropriately, (...) a novel substance emerges with the power to impose unity on its components through time. I argue that these accounts of form fall prey to a bootstrapping problem, and so, suffer from issues of redundancy, given plausible assumptions about inherence. In their place, I suggest an ontologically minimalist conception of forms as collective manifestations of the powers of matter. (shrink)

Hylomorphism is the Aristotelian theory according to which substances are composed of matter and form. If a house is a substance, then its matter would be a collection of bricks and timbers and its form something like the structure of those bricks and timbers. It is widely agreed that matter bears a mereological relationship to substance; the bricks and timbers are parts of the house. But with form things are more controversial. Is the structure of the bricks and timbers best (...) conceived as a part of the house, or is it related to the house in some non-mereological fashion? Kathrin Koslicki argues that substances have formal parts, that forms are best conceived as bearing a mereological relation to substances. This paper shows that her argument fails, given the traditional and plausible distinction between substances and accidental unities. I close with a brief suggestion for a non-mereological construal of forms. (shrink)

British equality law protections for sex and gender reassignment have grown fraught as activists tussle over legal and social categories of gender, gender transitioning, and sex. This article considers the future of gender-related equality protections in relation to ‘decertification’—an imagined reform that would detach sex and gender from legal personhood. One criticism of decertification is that de-formalising gender membership would undermine equality law protections. This article explores how gender-based equality law could operate in conditions of decertification, drawing on legal thoughtways (...) developed for two other protected characteristics in equality law—religion and belief, and disability—to explore the legal responses and imaginaries that these two grounds make available. Religious equality law focuses on beliefs, communities, and practices, deemed to be stable, multivarious, and subject to deep personal commitment. Disability equality law focuses on embodied disadvantage, approached as social, relational, and fluctuating. While these two equality frameworks have considerable limitations, they offer legal thoughtways for gender oriented to both its hierarchies and its expression, including as disavowal. (shrink)
