Must treatment be provided to subjects who acquire HIV during the course of a prevention study? An analysis of ethical foundation, regulation, and recent argumentation provides no basis for the obligation. We outline an alternative approach to the problem based on moral negotiation.

Issues: We present key aspects of our paper, commissioned by UNAIDS in 2005, entitled, “Revisiting the ethics of HIV prevention research in developing countries.” In 2004 and 2005 we witnessed the closure or suspension of three international clinical trials testing tenofovir in the prevention of HIV infection in high risk groups due to the failure to provide free treatment to those who seroconvert during the conduct of the study. We examine critically moral claims for the provision of treatment to those (...) who seroconvert in HIV prevention trials and ask whether it is a matter of moral obligation or moral negotiation?Description: Using the tools of philosophical and regulatory analysis we examine the moral foundations of research ethics, international regulation, and the contemporary literature in search of valid arguments in support of a moral obligation to treat. Arguments supporting the obligation to provide such treatment are found in a wide variety of documents. These claims are variously rooted in the demand to compensate for research-related injury, maximization of research benefit, justice as reciprocity, and justice as equality.Lessons learned: Our analysis reveals that there is as of yet no robust moral argument supporting a moral obligation to provide treatment to participants in HIV prevention trials who seroconvert. We argue that moral negotiation offers distinct advantages over moral obligation. Moral negotiation finds support in the principle of respect for communities that holds researchers responsible to respect communal values, protect and empower social institutions and abide by the decisions of accepted communal authorities.Recommendations: Moral negotiation, rather than moral obligation, reduces the chance of polarization of positions by inviting trial participants, sponsors, researchers and all other involved parties to the table for discussion. Moral negotiation favors middle ground solutions that fit the specific health needs and priorities of the community in question. (shrink)

The more traditional approaches to the history and philosophy of science and technology continue as well, and probably will continue as long as there are skillful practitioners such as Carl Hempel, Ernest Nagel, and th~ir students. Finally, there are still other approaches that address some of the technical problems arising when we try to provide an account of belief and of rational choice. - These include efforts to provide logical frameworks within which we can make sense of these notions. This (...) series will attempt to bring together work from all of these approaches to the history and philosophy of science and technology in the belief that each has something to add to our understanding. The volumes of this series have emerged either from lectures given by authors while they served as honorary visiting professors at the City College of New York or from conferences sponsored by that institution. Cependant, diviser la bioéthique entre le médical et l’environnemental est réducteur. Potter propose au contraire une bioéthique globale s’intéressant aux enjeux situés à leur interface, dont ceux concernant la terre, la vie sauvage, la surpopulation, la consommation, etc. Cet article vise à amorcer un nouveau chantier d’analyse de la pensée de Potter en s’appuyant sur l’héritage de Leopold en biologie. Une synthèse de cette vision potterienne est proposée de manière à considérer son œuvre comme un tout cohérent s’intégrant aux grands débats qui transcendent les XXe et XXIe siècles. Sa vision apparaît comme une sagesse collective et prospective sous la forme d’une science de la survie et d’un code de bioéthique. We live in times where it is possible to control our emotions using biomedical means – for example by taking pills that make us feel better. This chapter discusses one worry about the biomedical enhancement of mood. It is a worry that seems to play an important role in more familiar objections to biomedical enhancement of mood, such as the objection that it would lead to inauthenticity. The worry is that the use of positive mood enhancers will corrupt emotional lives. (...) Ethical questions about the biomedical enhancement of mood are often really questions about our affective reasons. Negative emotions typically feel bad, positive ones typically feel good. Here our hedonic reasons come into direct competition with affective reasons. Those who entirely dismiss affective reasons, or at least think that negative affective reasons are extremely weak, are likely to see little problem with positive mood enhancers. (shrink)

Surveillance programs supporting the management of One Health issues such as antibiotic resistance are complex systems in themselves. Designing ethical surveillance systems is thus a complex task (retroactive and iterative), yet one that is also complicated to implement and evaluate (e.g., sharing, collaboration, and governance). The governance of health surveillance requires attention to ethical concerns about data and knowledge (e.g., performance, trust, accountability, and transparency) and empowerment ethics, also referred to as a form of responsible self-governance. Ethics in reflexive governance (...) operates as a systematic critical-thinking procedure that aims to define its value: What are the “right” criteria to justify how to govern “good” actions for a “better” future? The objective is to lay the foundations for a methodological framework in empirical bioethics, the rudiments of which have been applied to a case study to building reflexive governance in One Health. This ongoing critical thinking process involves “mapping, framing, and shaping” the dynamics of interests and perspectives that could jeopardize a “better” future. This paper proposes to hybridize methods to combine insights from collective deliberation and expert evaluation through a reflexive governance functioning as a community-based action-ethics methodology. The intention is to empower individuals and associations in a dialogue with society, which operation is carried out using a case study approach on data sharing systems. We based our reasoning on a feasibility study conducted in Québec, Canada (2018–2021), envisioning an antibiotic use surveillance program in animal health for 2023. Using the adaptive cycle and governance techniques and perspectives, we synthesize an alternative governance model rooted in the value of empowerment. The framework, depicted as a new “research and design (R&D)” practice, is linking operation and innovation by bridging the gap between Reflexive, Evaluative, and Deliberative reasonings and by intellectualizing the management of democratizing critical thinking locally (collective ethics) by recognizing its context (social ethics). Drawing on the literature in One Health and sustainable development studies, this article describes how a communitarian and pragmatic approach can broaden the vision of feasibility studies to ease collaboration through public-private-academic partnerships. The result is a process that “reassembles” the One Health paradigm under the perspective of global bioethics to create bridges between the person and the ecosystem through pragmatic ethics. (shrink)

Abstract Do the central aims of epistemology, like those of moral philosophy, require that we designate some important place for those concepts located between the thin-normative and the non-normative? Put another way, does epistemology need "thick" evaluative concepts and with what do they contrast? There are inveterate traditions in analytic epistemology which, having legitimized a certain way of viewing the nature and scope of epistemology's subject matter, give this question a negative verdict; further, they have carried with them a tacit (...) commitment to what we argue to be an epistemic analogue of the reductionistic centralist thesis which Bernard Williams, in our view, successfully repudiates in ethics. In this essay, we challenge the epistemic analogue of the traditional but mistaken thesis. In offering an alternative to it which provides a comfortable home for the epistemic normativity which attends thick evaluative concepts, we align ourselves with what has been recently called the Value Turn in epistemology. From this perspective, we defend that, contrary to tradition, as influenced by centralist assumptions, epistemology does need thick evaluative concepts. Further, the sort of theories that will be able to give thick evaluative concepts an irreducible role in both belief and agent evaluation are adequately social epistemologies. What loosely refer to as second-wave of virtue epistemology is the widespread interest to provide a comfortable home for the role of thick normativity, as it is connected both with epistemic evaluation, and guidance. We recognize that, in breaking from centralism, there is a worry that a resulting anti-centralist theory will be reductionistic in the other direction, making the thick primary. We contend however that second-wave virtue epistemologies take different sources of social and epistemic value into account; they seek the 'right thickness' to ride with conception of epistemology and a field which due in part to virtue theory's resurgence, is today normative, diverse and expansive than was the traditional set of problems from which it emerged. Recent corporate scandals have put company boards in the spotlight. Legislation, codes of conduct, and guidelines have been developed to improve corporate governance. But while many prescriptions for improving corporate governance focus on the structure of boards, Dr. Richard Leblanc's research suggests that there is no direct causal relationship between board structure and corporate performance. Indeed, many recent failed corporations had exemplary board structure. Richard Leblanc discusses how to assess board effectiveness and improve it.

This paper examines implicaturist hybrid theories by examining how closely attitude expression by moral utterances fits with the varieties of implicature (conventional, particular conversational, generalized conversational) using five standard criteria for implicature: indeterminacy (§3), reinforceability (§4), non-detachability (§5), cancellability (§6), and calculability (§7). I argue (1) that conventional implicature is a clear non-starter as a model of attitude expression by moral utterances (2) that generalised conversational implicature yields the most plausible implicaturist hybrid but (3) that a non-implicaturist, and non-hybrid, alternative (...) might in fact be superior. The first part of this paper asks why we need, or what would motivate, ameaningful expansion of epistemology. It answers with three critical arguments found in the recent literature, which each purport to move us some distance beyond the preoccupations of ‘post-Gettier era’ analytic epistemology. These three—the ‘epistemic luck,’ ‘epistemic value’ and ‘epistemic reconciliation’ arguments associated with D. Pritchard, J. Kvanvig, and M. Williams, respectively—each carry this implication of needed expansion by functioning as forceful ‘internal critiques’ of the tradition. The (...) second part of the paper asks what specific directions an expanded field of epistemology should take. While this is taken as an open question for debate, the expansion suggested here remains continuous with the analytic tradition, while also underlining the centrality of the acquired or ‘reflective’ intellectual virtues in meeting the burdens of the three arguments. Responsibilism, as here understood, is not a philosophical thesis so much as an orientation of commitment to clearing away philosophical assumptions that systematically obstruct recognition of the importance of empirically-informed research programs into the reflective virtues. But inasmuch as Camus saw his work in the trope of journey, his complex set of ideas about justice are to be discerned in the narrative structure of his texts. This is particularly so in his last work, (...) the incomplete autobiographical The First Man.1 In the novel, Camus has his protagonist and fictional self Jacques Cormery seek the sources of his orientation to questions of love and justice by attempting to reconstruct the brief life of a father he never knew. It is in the life reconstructed, chiefly through the recollected memories of those who knew the man that Jacques comes to understand his own responses to questions of love and justice. A necessary by-product of the process is that through his questioning, Jacques recreates a community of which he is a product but, until the journey is undertaken, he has never been a part. His journey is, thus, one of self-discovery and inextricably ties justice to community formation. Camus's last novel, I will argue, suggests the importance of memory and narrative to the fundamental questions of political theory, particularly, questions regarding community-formation and the role and nature of justice.IContemporary reflections on the nature of politics take narrative encounters with reality seriously. The significance of narrative to political theory is, I think, tied to the Augustinian recognition that, temporally speaking, we live forward but learn backwards. It is through reconstructing [End Page 140] our experiences as individuals that we learn about who we are and how we got here. Recent political theory has come to recognize that this epistemological structure works at both the individual and the communal level. Michael Walzer, for example, has suggested that a community's culture is the story its members tell so as to make sense of the different pieces of their social life and justice is the doctrine that distinguishes the pieces.2 But distinguishing the pieces can mean and has meant blocking or restricting our access to that reconstruction. While a time-honored political practice, the impulse to control the contents of the narrative by deeming it unworthy or too dangerous to speak became a self-conscious political practice and a particularly dangerous phenomenon in the last century. Controlling the contents of narrative means control in past, present, and future tense. Memory can become a site of resistance because narrative depends on memory for its points of reference. What gets narrated gets remembered. Most often, what does not get narrated either gets lost or must find another way.Narrative and memory have always been political resources, Joshua Foa Dienstag suggests in his important work on memory and narrative in political theory, but the self-conscious control of them is dangerous.3 At the end of a century wherein we perpetrated much we might be tempted to forget, it is increasingly evident that we must remember before we can speak of justice, that is, our stories must be told and heard before we can reconstitute (or re-member) a functional conception of political community. It is in these terms that I want to talk about narrative and its relationship to political community and justice. But what is silenced is as important as what is articulated. Dienstag, who reads political theory as narrative, suggests that, practically speaking, what we have learned is that memory unarticulated is even more dangerous than memory manipulated. Memory unarticulated either festers and becomes a flashpoint for turmoil or is articulated by an interest for its own ends and becomes a tool of control if not oppression. In either case, memory is bastardized to the ends of power politics and distinguishing between authentic and inauthentic experiences becomes the province of politicians. Leaving these distinctions to politicians, I want to suggest, is risky business. When memory represents the absence of a set of experiences rather than their presence, we are confronted by the end of a community rather than its beginning.All cultures, Walzer suggests, have an interest in... In The Humanist Spirit of Daoism, Chen Guying presents a concise overview of his understanding of the meaning and significance of Daoist philosophy. Chen is a leading contemporary Chinese thinker and spokesperson for a new Daoist approach to existential and socio-political issues. He was born in mainland China in 1935, but after having resettled to Taiwan, he received his education there and was a student activist in the 1960s. He became famous in the Chinese-speaking world with his writings on Nietzsche, (...) Laozi and Zhuangzi. At present he is a Professor at Peking University. This volume collects representative essays from the past 25 years which not only outline Chen's interpretation of Daoism as a deeply humanist way of thinking and living, but also show how he employs this philosophy in a critique of totalitarianism and neo-imperialism. So-called theories of well-being (prudential value, welfare) are under-represented in discussions of well-being. I do four things in this article to redress this. First, I develop a new taxonomy of theories of well-being, one that divides theories in a more subtle and illuminating way. Second, I use this taxonomy to undermine some misconceptions that have made people reluctant to hold objective-list theories. Third, I provide a new objective-list theory and show that it captures a powerful motivation for the main competitor (...) theory of well-being (the desire-fulfilment theory). Fourth, I try to defuse the worry that objective-list theories are problematically arbitrary and show how the theory can and should be developed. (shrink)

Protective measurements illustrate how Yakir Aharonov's fundamental insights into quantum theory yield new experimental paradigms that allow us to test quantum mechanics in ways that were not possible before. As for quantum theory itself, protective measurements demonstrate that a quantum state describes a single system, not only an ensemble of systems, and reveal a rich ontology in the quantum state of a single system. We discuss in what sense protective measurements anticipate the theorem of Pusey, Barrett, and Rudolph (PBR), stating (...) that, if quantum predictions are correct, then two distinct quantum states cannot represent the same physical reality. There are indications that simple reaction time might have slowed in Western countries, based on both cohort- and multi-study comparisons. A possible limitation of the latter method in particular is measurement error stemming from methods variance, which results from the fact that instruments and experimental conditions change over time and between studies. We therefore set out to measure the simple auditory reaction time (SRT) of 7,081 individuals (2,997 males and 4,084 females) born in Sweden 1959-1985 (subjects were aged between 27 (...) and 54 years at time of measurement). Depending on cut-offs and adjustment for ageing related slowing on SRT, the data suggest that SRT has increased between 3 and 16 ms in the 27 birth years covered in the present sample. The slowing is unlikely to be explained by attrition, as evaluated by comparing the general intelligence × birth-year interactions and standard deviations for both male participants and dropouts, utilizing military conscript cognitive ability data. The present result is consistent with previous studies employing alternative methods, and may result from several synergistic factors, such as possible recent micro-evolutionary trends favouring lower g in Sweden and the effects of industrially produced neurotoxic substances on peripheral nerve conduction velocity.
