Objectives—While clinical practice is complicated by many ethical dilemmas, clinicians do not often request ethics consultations. We therefore investigated what triggers clinicians' requests for ethics consultation. Design—Cross-sectional telephone survey.Setting—Internal medicine practices throughout the United States.Participants—Randomly selected physicians practising in internal medicine, oncology and critical care.Main measurements—Socio-demographic characteristics, training in medicine and ethics, and practice characteristics; types of ethical problems that prompt requests for consultation, and factors triggering consultation requests. Results—One hundred and ninety of 344 responding physicians (55%) reported requesting ethics (...) consultations. Physicians most commonly reported requesting ethics consultations for ethical dilemmas related to end-of-life decision making, patient autonomy issues, and conflict. The most common triggers that led to consultation requests were: 1) wanting help resolving a conflict; 2) wanting assistance interacting with a difficult family, patient, or surrogate; 3) wanting help making a decision or planning care, and 4) emotional triggers. Physicians who were ethnically in the minority, practised in communities under 500,000 population, or who were trained in the US were more likely to request consultations prompted by conflict. Conclusions—Conflicts and other emotionally charged concerns trigger consultation requests more commonly than other cognitively based concerns. Ethicists need to be prepared to mediate conflicts and handle sometimes difficult emotional situations when consulting. The data suggest that ethics consultants might serve clinicians well by consulting on a more proactive basis to avoid conflicts and by educating clinicians to develop mediation skills. (shrink)

We live in times where it is possible to control our emotions using biomedical means – for example by taking pills that make us feel better. This chapter discusses one worry about the biomedical enhancement of mood. It is a worry that seems to play an important role in more familiar objections to biomedical enhancement of mood, such as the objection that it would lead to inauthenticity. The worry is that the use of positive mood enhancers will corrupt emotional lives. (...) Ethical questions about the biomedical enhancement of mood are often really questions about our affective reasons. Negative emotions typically feel bad, positive ones typically feel good. Here our hedonic reasons come into direct competition with affective reasons. Those who entirely dismiss affective reasons, or at least think that negative affective reasons are extremely weak, are likely to see little problem with positive mood enhancers. (shrink)

The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.

Clinical Study Agreements can have profound effects both on the protection of human subjects and on the independence of investigators to conduct research with scientific integrity. Sponsors, institutions, and even investigators may fail to give adequate attention to these issues in the negotiation of CSAs. Despite the key role of CSAs in structuring ethically important aspects of research, they remain largely unregulated and unreviewed for adherence to ethical norms. Academic institutions routinely enter into research contracts that fail to meet adequate (...) ethical standards. This is a failing that can have serious consequences.Accordingly, it is necessary that some independent body have the authority both to review research contracts for compliance with norms of subject protection and ethical integrity, and to reject studies that fail to meet ethical standards. Such review should take place prior to the start of research, not later. Because of its expertise and authority, the institutional ethics review board is the appropriate body to undertake such review. Much recent commentary has focused on contractual restrictions on the investigator’s freedom to publish research findings. The Olivieri experience, and that of other investigators, has brought freedom of publication issues into sharp focus. Clinical study agreements also raise a number of other ethical issues relating to human subjects and research integrity, however, including disclosures relating to patient safety, data analysis and reporting, budget, confidentiality, and premature termination of the study. This paper describes the ethical issues at stake in structuring such agreements and suggests ethical standards to guide institutional ethics review. (shrink)

Abstract Do the central aims of epistemology, like those of moral philosophy, require that we designate some important place for those concepts located between the thin-normative and the non-normative? Put another way, does epistemology need "thick" evaluative concepts and with what do they contrast? There are inveterate traditions in analytic epistemology which, having legitimized a certain way of viewing the nature and scope of epistemology's subject matter, give this question a negative verdict; further, they have carried with them a tacit (...) commitment to what we argue to be an epistemic analogue of the reductionistic centralist thesis which Bernard Williams, in our view, successfully repudiates in ethics. In this essay, we challenge the epistemic analogue of the traditional but mistaken thesis. In offering an alternative to it which provides a comfortable home for the epistemic normativity which attends thick evaluative concepts, we align ourselves with what has been recently called the Value Turn in epistemology. From this perspective, we defend that, contrary to tradition, as influenced by centralist assumptions, epistemology does need thick evaluative concepts. Further, the sort of theories that will be able to give thick evaluative concepts an irreducible role in both belief and agent evaluation are adequately social epistemologies. What loosely refer to as second-wave of virtue epistemology is the widespread interest to provide a comfortable home for the role of thick normativity, as it is connected both with epistemic evaluation, and guidance. We recognize that, in breaking from centralism, there is a worry that a resulting anti-centralist theory will be reductionistic in the other direction, making the thick primary. We contend however that second-wave virtue epistemologies take different sources of social and epistemic value into account; they seek the 'right thickness' to ride with conception of epistemology and a field which due in part to virtue theory's resurgence, is today normative, diverse and expansive than was the traditional set of problems from which it emerged. This paper examines implicaturist hybrid theories by examining how closely attitude expression by moral utterances fits with the varieties of implicature (conventional, particular conversational, generalized conversational) using five standard criteria for implicature: indeterminacy (§3), reinforceability (§4), non-detachability (§5), cancellability (§6), and calculability (§7). I argue (1) that conventional implicature is a clear non-starter as a model of attitude expression by moral utterances (2) that generalised conversational implicature yields the most plausible implicaturist hybrid but (3) that a non-implicaturist, and non-hybrid, alternative (...) might in fact be superior. The first part of this paper asks why we need, or what would motivate, ameaningful expansion of epistemology. It answers with three critical arguments found in the recent literature, which each purport to move us some distance beyond the preoccupations of ‘post-Gettier era’ analytic epistemology. These three—the ‘epistemic luck,’ ‘epistemic value’ and ‘epistemic reconciliation’ arguments associated with D. Pritchard, J. Kvanvig, and M. Williams, respectively—each carry this implication of needed expansion by functioning as forceful ‘internal critiques’ of the tradition. The (...) second part of the paper asks what specific directions an expanded field of epistemology should take. While this is taken as an open question for debate, the expansion suggested here remains continuous with the analytic tradition, while also underlining the centrality of the acquired or ‘reflective’ intellectual virtues in meeting the burdens of the three arguments. Responsibilism, as here understood, is not a philosophical thesis so much as an orientation of commitment to clearing away philosophical assumptions that systematically obstruct recognition of the importance of empirically-informed research programs into the reflective virtues. Les premiers travaux réalisés sur les effets du confinement du printemps 2020 sur les enfants ont établi que ceux qui étaient en résidence alternée l’avaient mieux vécu que les autres. L’objectif de cet article est de comprendre pourquoi. À partir de l’enquête Sapris et plus particulièrement du sous-échantillon des enfants âgés de 8-9 ans des cohortes Elfe et Epipage2, nous comparons les conséquences du confinement sur les enfants selon la structure familiale dans laquelle ils vivaient. Continu dans les familles nucléaires, (...) le temps familial est habituellement beaucoup plus fractionné entre les résidences des parents pour les enfants de familles séparées. Le confinement est venu transformer les expériences habituelles du temps familial pour les enfants, aussi bien dans son organisation que dans sa texture. Il a modifié leur cadre de vie ordinaire, en réorganisant leurs occupations au quotidien et en modifiant leurs relations avec leurs parents. En observant particulièrement les différences apparues entre les résidences alternées qui ont continué et celles qui ont été interrompues, nous montrons que si les mouvements réguliers des enfants ont pu constituer une respiration bienvenue pour les différents acteurs concernés, les alternances interrompues ont ouvert des espaces exceptionnels dans lesquels il a été possible de renouer avec des formes passées de continuité familiale. In The Humanist Spirit of Daoism, Chen Guying presents a concise overview of his understanding of the meaning and significance of Daoist philosophy. Chen is a leading contemporary Chinese thinker and spokesperson for a new Daoist approach to existential and socio-political issues. He was born in mainland China in 1935, but after having resettled to Taiwan, he received his education there and was a student activist in the 1960s. He became famous in the Chinese-speaking world with his writings on Nietzsche, (...) Laozi and Zhuangzi. At present he is a Professor at Peking University. This volume collects representative essays from the past 25 years which not only outline Chen's interpretation of Daoism as a deeply humanist way of thinking and living, but also show how he employs this philosophy in a critique of totalitarianism and neo-imperialism. So-called theories of well-being (prudential value, welfare) are under-represented in discussions of well-being. I do four things in this article to redress this. First, I develop a new taxonomy of theories of well-being, one that divides theories in a more subtle and illuminating way. Second, I use this taxonomy to undermine some misconceptions that have made people reluctant to hold objective-list theories. Third, I provide a new objective-list theory and show that it captures a powerful motivation for the main competitor (...) theory of well-being (the desire-fulfilment theory). Fourth, I try to defuse the worry that objective-list theories are problematically arbitrary and show how the theory can and should be developed. (shrink)

Protective measurements illustrate how Yakir Aharonov's fundamental insights into quantum theory yield new experimental paradigms that allow us to test quantum mechanics in ways that were not possible before. As for quantum theory itself, protective measurements demonstrate that a quantum state describes a single system, not only an ensemble of systems, and reveal a rich ontology in the quantum state of a single system. We discuss in what sense protective measurements anticipate the theorem of Pusey, Barrett, and Rudolph (PBR), stating (...) that, if quantum predictions are correct, then two distinct quantum states cannot represent the same physical reality. There are indications that simple reaction time might have slowed in Western countries, based on both cohort- and multi-study comparisons. A possible limitation of the latter method in particular is measurement error stemming from methods variance, which results from the fact that instruments and experimental conditions change over time and between studies. We therefore set out to measure the simple auditory reaction time (SRT) of 7,081 individuals (2,997 males and 4,084 females) born in Sweden 1959-1985 (subjects were aged between 27 (...) and 54 years at time of measurement). Depending on cut-offs and adjustment for ageing related slowing on SRT, the data suggest that SRT has increased between 3 and 16 ms in the 27 birth years covered in the present sample. The slowing is unlikely to be explained by attrition, as evaluated by comparing the general intelligence × birth-year interactions and standard deviations for both male participants and dropouts, utilizing military conscript cognitive ability data. The present result is consistent with previous studies employing alternative methods, and may result from several synergistic factors, such as possible recent micro-evolutionary trends favouring lower g in Sweden and the effects of industrially produced neurotoxic substances on peripheral nerve conduction velocity. This book studies the occurrence (or not) of a case of circular reasoning in Kant's attempt to establish the foundation of knowledge. The response to this question instigates a commentary on the transcendental deduction of the categories, which lie at the heart of the Critique of Pure Reason, in both the 1781 and 1787 editions.

This paper is an attempt to undermine a basic assumption of theories of well-being, one that I call well-being invariabilism. I argue that much of what makes existing theories of well-being inadequate stems from the invariabilist assumption. After distinguishing and explaining well-being invariabilism and well-being variabilism, I show that the most widely-held theories of well-being—hedonism, desire-satisfaction, and pluralist objective-list theories—presuppose invariabilism and that a large class of the objections to them arise because of it. My aim is to show that (...) abandoning invariabilism and adopting variabilism is a sensible first step for those aiming to formulate more plausible theories of well-being. After considering objections to my argument, I explain what a variabilist theory of well-being would be like and show that well-being variabilism need not be any threat to the project of formulating theories of well-being that deliver general principles concerning well-being enhancement. La structure antithétique et paradoxale de son génie l'a conduit à une quête religieuse sans concession à l'égard de la société de son temps. La fonction dualiste de son écriture aboutit à mettre en valeur la béance séparant le fini de la nature (...) humaine de l'infini de la grâce de Dieu. Seule la médiation christique dans l'histoire a pu combler ce vide de l'homme dans l'humilité de la foi. L'aspect novateur de la quête pascalienne expliquerait alors en grande partie le côté inachevé des papiers. Cinq appendices visent à mettre le texte pascalien face aux modes de pensée du XVIIe siècle. La richesse du texte pascalien demeure malgré tout inépuisable. (shrink)

Le Commentaire du Traité de l'âme d'Aristote par Thomas d'Aquin est le cinquième des commentaires fondamentaux des oeuvres d'Aristote traduits en langue française. Avec celui des Physiques, de la Métaphysique, de l'Interprétation et des Analytiques, il fonde l'édifice de la philosophie de Thomas d'Aquin et assure les contreforts de sa théologie. Ce traité se présente comme un vaste essai de définition de l'âme et principalement de l'âme humaine, avec en filigrane, une question lancinante : cette âme est-elle immortelle? Si ce (...) traité est l'un des plus courts d'Aristote, et selon ses propres termes, encore à l'état d'ébauche, il est construit avec une rigueur méthodologique qui en fait une sorte de modèle pour toute réflexion philosophique. Thomas propose une explication reconnue comme des plus limpides, et introduit à un livre encore loué deux millénaires plus tard par Hegel, Marx ou Darwin. Comme le reste de l'oeuvre d'Aristote, il connaît aujourd'hui un regain d'intérêt remarquable et le commentaire de Thomas offre un guide très sûr pour son intelligence. (shrink)

It is commonly claimed that reliance upon moral testimony is problematic in a way not common to reliance upon non-moral testimony. This chapter provides a new explanation of what the problem consists in—one that enjoys advantages over the most widely accepted explanation in the extant literature. The main theses of the chapter are as follows: that many forms of normative deference beyond the moral are problematic, that there is a common explanation of the problem with all of these forms of (...) deference—an explanation that is based on the connection between the relevant judgments and desire-like attitudes, and that this explanation is compatible with moral realism. Evolutionary debunking arguments are arguments that appeal to the evolutionary origins of evaluative beliefs to undermine their justification. This paper aims to clarify the premises and presuppositions of EDAs—a form of argument that is increasingly put to use in normative ethics. I argue that such arguments face serious obstacles. It is often overlooked, for example, that they presuppose the truth of metaethical objectivism. More importantly, even if objectivism is assumed, the use of EDAs in normative ethics is incompatible with a (...) parallel and more sweeping global evolutionary debunking argument that has been discussed in recent metaethics. After examining several ways of responding to this global debunking argument, I end by arguing that even if we could resist it, this would still not rehabilitate the current targeted use of EDAs in normative ethics given that, if EDAs work at all, they will in any case lead to a truly radical revision of our evaluative outlook.
