Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross-cultural principles of law? In a between-subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross-culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)
Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. Trata-se de um estudo bibliográfico e histórico, com um resgate institucional e conceitual, seguido de uma interpretação (...) das interrelações entre Famílias e Escolas, postas para a promoção do sucesso escolar e cultural das crianças e dos adolescentes. Com efeito, nosso objeto de estudo, a pedagogia do oprimido em Paulo Freire, será analisado numa perspectiva dialógica com o pensamento marxiano, com vistas a encontrar algumas marcas fundamentais da contribuição do filósofo alemão na constituição do ideário crítico freiriano. We first show that a theorem by Cartan that generalizes the Frobenius integrability theorem allows us (given certain conditions) to obtain noncurvature solutions for the differential Bianchi conditions and for higher-degree similar relations. We then prove that there is no algorithmic procedure to determine, for a reasonable restricted algebra of functions on spacetime, whether a given connection form satisfies the preceding conditions. A parallel result gives a version of Gödel's first incompleteness theorem within an (axiomatized) theory of gauge fields.
Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)
Recent literature in experimental philosophy has postulated the existence of the abstract/concrete paradox : the tendency to activate inconsistent intuitions depending on whether a problem to be analyzed is framed in abstract terms or is described as a concrete case. One recent study supports the thesis that this effect influences judicial decision-making, including decision-making by professional judges, in areas such as interpretation of constitutional principles and application of clear-cut rules. Here, following the existing literature in legal theory, we argue that (...) the susceptibility to such an effect might depend on whether decision-makers operate in a legal system characterized by the formalist or particularist approach to legal interpretation, with formalist systems being less susceptible to the effect. To test this hypothesis, we compare the results of experimental studies on ACP run on samples from two countries differing in legal culture: Poland and Brazil. The lack of significant differences between those results suggests that ACP is a robust effect in the legal context. (shrink)
The purpose of this article is to define and restore, in a systematic way, the decisive argumentative axes that allow a degree of internal consistency to the famous expressive interpretation of Spinoza’s philosophy made by Gilles Deleuze. Initially, we will examine how the Deleuzian interpretation of Spinoza portrays a peculiar and unique moment of the relations that Deleuze, during at least three decades, has established with the history of philosophy. Then, we will check which conceptual frameworks – built in a (...) non-hierarchical manner, according to Deleuze – would support the thesis of an intrinsic and practical necessity to the ontological constitutive process in Spinoza’s Ethics under the perspective of a philosophy of difference. Ancorado no versículo paulino omnis potestas a Deo, mas ampliado, sed per homines e, igualmente, nas ideias dos confrades que o antecederam, os quais relacionaram entre si os conceitos proprietas e dominium, com vista a explicar as origens humanas dos mesmos, de um lado, ele rebate tanto a teoria hierocrata quanto a de Marsílio (...) de Pádua, relativas ao tema em exame e, de outro, oferece sua contribuição ao mesmo, mediante a qual, nem o Império nem os Estados estão completamente subordinados à Igreja, nem esta está submissa ao poder terreno, porque, quanto às origens de ambos, a Igreja tem uma procedência divina e os Estados e o Império têm imediatamente uma origem humana e, ainda, porque nas esferas respectivas de atuação, os poderes espiritual e secular independem um do outro. As muitas verdades sobre a infância de nosso tempo, das mais catedráticas às mais “inovadoras”, encontram-se compiladas em livros e artigos dentro e fora de nossas bibliotecas. Grosso modo, elas constroem dois tipos de niilismo. Um niilismo de tipo universalista, que suga a criança para fora da imanência da vida e da histórica e a torna refém de estereótipos universais. Outro niilismo de tipo relativista, que esquece a criança e apenas acusa os estudos da infância como mera invenção. Evitar esses (...) extremos requer uma espécie de arte acrobática de equilibrar-se na possibilidade de um entre. Essa via busca retomar a imanência histórica da criança. Trata-se de uma pesquisa em busca da potencialização da ideia de invenção cuja atitude crítica implicasse não a pergunta pelo governo certo ou pela ausência de governo da infância, mas como não a governar assim, por essas pessoas, em nome destes princípios, em vista de tais objetivos e por meio de tais procedimentos. ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. O presente relato nasce de um projeto pedagógico desenvolvido na Aldeia Tupinikim de Comboios, município de Aracruz- ES, durante a disciplina Projetos de Pesquisa e Prática Pedagógica – PPPP III, no curso de Licenciatura Intercultural Indígena Tupinikim e Guarani, do Programa de Licenciaturas Indígenas – PROLIND, oferecido pela Universidade Federal do Espírito Santo – UFES. O projeto teve como objetivos: Pesquisar com os mais velhos os tipos de trançados, colaborando na reafirmação cultural do nosso povo Tupiniquim; Reconhecer os tipos de (...) trançados Tupiniquim; Confeccionar alguns tipos de trançados; Produzir textos coletivos a partir dos trançados e analisar o processo de letramento a partir de atividades contextualizadas. The main objective of this text is to analyze some of the ambiguities that characterize Augustine of Hippo’s position regarding the so-called pagan culture in general and Greek philosophy in particular. As a matter of fact, the author of Confessions is situated in a mid-term, which I identify by the expression “the paradox of between”, for he does not totally embrace the position of Justin Martyr, who identifies Christian wisdom with Greek philosophy, neither does he claim the other extreme position (...) of Tertullian, who sees an antagonism or an insuperable gap between “Christian wisdom” and “pagan wisdom”, or between faith and reason. In the perspective of this paradox, three major questions will be examined: (a) the relation between philosophy and Christian religion, (b) the problem of the “platonic philosophers”, (c) the concepts of recollection and memory. We comment here one of the most categorical, radical and fundamental concepts of Schopenhauer’s pessimism: the theory of positivity of pain and negativity of pleasure. We present its development in the philosopher’s capital work The World as Will and Representation and defend that it is present in a vital way in his three metaphysics, but is only made explicit in the last (of customs). Finally, we “dialogue” with the problematical issues that G. Simmel and C. O presente trabalho tem por objetivo apontar a práxis como condição pedagógica necessária à educação em Gramsci. Nesse sentido e à luz do referencial gramsciano, busca-se analisar algumas das contradições constitutivas do fazer educativo e ressaltar a práxis na superação dessas contradições, situando a Universidade como lócus privilegiado de construção dessa condição pedagógica.
