In this paper, I discuss and analyze three instances of exchange and interaction between Russian (incl. Soviet) and (West) European philosophical culture: the correspondence between Merab Mamardašvili and Louis Althusser, Jacques Derrida’s visit to Moscow in 1990, and a joint Russian–German publication by Nikolaj Plotnikov and Alexander Haardt. The focus is on the implicit mutual perception of philosophical cultures and on the ‘micro-politics’ of discourse that is at stake in their interaction. Also, it is shown how different contexts—labelled ‘philosophical culture’, (...) though not in any deterministic sense—are at work in the mutual perception between individual thinkers. Even if philosophical thinking tends to transcend the parameters of ‘glocal’ situations, this involves a job that needs to be done, individually and collectively, by the philosophers involved. Consequently, this dimension has to be taken into account when analysing such instances of encounter. (shrink)

In this paper I convey a recurring problem and possible solution that arose during my doctoral research on the topic of cross-cultural Holocaust curriculum development for Latvian schools. Specifically, as I devised the methodology for my research, I experienced a number of frustrations concerning the issue of transferability and the limitations of both reader generalizability and grounded theory. Ultimately, I found a more appropriate goal for the external applicability of this and other highly contextual research studies in the form of (...) "grounded understandings," which are tentative apprehensions of the importance or significance of phenomena and conceptualizations that hold meaning and explanatory power, but are only embryonic in their potential to generate theory. Our folk epistemology says that if someone knows that P and tells you that P, then, given the absence of defeaters, if you believe what they tell you, you will come to know that P as well. A speaker's knowledge that P is then, for the most part, enough for a hearer to come to know that P. But there are counterexamples to this principle: testimonial knowledge does not always transfer from the speaker to the hearer. Why should that (...) be so? Because testimonial knowledge arises through the flow of information--from conclusive grounds--from the speaker through the speaker's assertion to the hearer's state of comprehension as of the speaker's assertion. A speaker's belief can be based on conclusive grounds, but the speaker's assertion may fail to provide conclusive grounds to the hearer. Then the hearer won't acquire knowledge, even from a knowledgeable speaker. Knowledge from testimony then works more like knowledge through perception. But wait, you say, that can't be so because testimony involves free will but perception does not. The essay ends with a broadly Hume inspired reply to this objection. (shrink)

Does the notion of ground, as it has recently been employed by metaphysicians, point to a single unified phenomenon? Jonathan Schaffer holds that the phenomenon of grounding exhibits the unity characteristic of a single genus. In defense of this hypothesis, Schaffer proposes to take seriously the analogy between causation and grounding. More specifically, Schaffer argues that both grounding and causation are best approached through a single formalism, viz., that utilized by structural equation models of causation. In this (...) paper, I present several concerns which suggest that the structural equation model does not transfer as smoothly from the case of causation to the case of grounding as Schaffer would have us believe. If it can in fact be shown that significant differences surface in how the formalism in question applies to the two types of phenomena in question, Schaffer’s attempt at establishing an analogy between grounding and causation has thereby been weakened and, as a result, the application of the Unity Hypothesis to the case of grounding once again stands in need of justification. The theory of transference and the centrality of transference interpretation have been hallmarks of psychoanalysis since its inception. But the time has come to subject traditional theory and practice to careful, critical scrutiny in the light of contemporary science. So holds Joseph Schachter, whose _Transference: Shibboleth or Albatross?_ undertakes this timely and thought-provoking task. After identifying the weaknesses and inconsistencies in Freud's original premises about transference, Schachter demonstrates how contemporary developmental research across a variety of domains effectively overturns any theory (...) that posits a linear deterministic relationship between early childhood and adult psychic functioning, including the adult patient's treatment behavior toward the analyst. No less trenchantly, he shows how contemporary chaos theory complements developmental research by making the very endeavor of historical reconstruction - of backward prediction - suspect on logical grounds. Nor, Schacter continues, does the clinical evidence normally adduced in support of transference theory provide the firm bedrock of data that most analysts suppose to exist. What one finds, he holds, are endlessly reiterated claims of identifying determining historical antecedents sustained only by descriptions of current behaviors through a gloss of theory. Less a polemic than a call to order, _Transference: Shibboleth or Albatross?_ is cogently argued and straightforwardly written. It is destined to be a thorn in the side of analysts who resist change and a spur to those who seek to bring analytic theory into closer alignment with contemporary science in the interest of improves treatment efficacy. Imāmiyya holds that the theory of imāmate must rely on scriptural evidence and designation and that the Imām, the successor to Muḥammad, is in charge of all political and religious issues. The authority of the Imām includes some religious and social duties such as executing the legal punishments, collecting almsgiving, sustaining social order and declaring holy war. The fulfillment of these duties requires actual leadership of the Imām or his deputy. With the beginning of the great occultation in 329/941, there (...) was an uncertainty among the Imāmiyya followers about who would uphold these responsibilities. In this period, Shīʿī ʿulamā began to undertake the duties of the Imām in order to overcome this uncertainty and to avoid the possible schism. In the beginning, this delegation of authority was limited to the religious sphere; but, later, its scope gradually became wider. This process of delegation of power, which covers a long process, needs to be examined in its various periods. In this study, this subject will be considered with special reference to the scholars of the fifth century of hijra (hijrī). An effort is made in this article to reveal how the issues of the Imām’s powers are discussed in the context of the problem of expanding or narrowing the authority of the scholars who played significant roles in systemization of Uṣūlī (rationalist) thought in the period after Shaykh al-Mufīd.Summary: In the issues of Imām/Caliphate which led to political division among Muslims after the Prophet Muḥammad, Imāmī Shīʿa opines that the Imāmate theory relies on scriptural evidence and designation. According to this theory, apart from scriptural evidence and designation, personal qualities such as immaculacy, knowledge, bravery, and vantage are found in Ali, Ḥasan, Ḥusayn and nine people from the lineage of Ḥusayn. The Imām as a successor to the Prophet Muḥammad is a person who has both religious and political power which includes implementation of punishments, collecting alms, ensuring justice, declaring holy war. For the Imāmī Shīʿa, there is a need for imām or his deputy who has absolute power to fulfill these duties.Imāmī Shīʿa, who held that the disappeared twelfth Imām would return back to restore justice in the world, had to confront various problems in finding solutions to some issues related to the existence of Imām himself, as well as theological issues during the period of great occultation. Particularly, the period of great occultation (329/941), in which the link with the Imām was severed completely, the Shīʿī community were uncertain on how to fulfill the responsibilities of the Imām probably due to the lack of religious sources. Shaykh al-Mufīd draws attention to the issue of khums (a one-fifth share of the spoils of war and of other specified forms of income). In this period of uncertainty, the Shiite scholars came into prominence in order to fill the gap and to prevent the social disorder. Referring to a tawqī‘ (rescript) from the Twelfth Imām, they claimed that they would take responsibility for the Twelfth Imām on his behalf. In the beginning, the delegation of the power was limited to the religious sphere. It was gradually extended to other spheres by the contribution of some scholars. It reached the largest dimension with the implementation of “wilāyat al-faqīh” theory.From that period until our times, the era when Sharīf al-Murtaḍā and his disciples lived can be considered as the beginning of this period. In the fifth century when Sharīf al-Murtaḍā and his disciples lived the delegation of power was limited to the religious sphere. In this article, how the scholars who played a role in the systematization of Uṣūlī thought dealt with the issue of the limits of the authority of Imām and how they defined the role of the Imāmī jurists (faqīh) will be examined.Sharīf al-Murtaḍā and his disciples were sometimes cautious on the issue of the delegation of the power of Imām. They, however, pointed out the role of the faqīh in the occultation period in order to overcome the uncertainty. As a matter of fact, Shaykh al-Ṭūsī and al-Qādī Ibn al-Barrāj made significant contributions to the issues of collection and distribution of khums. However, Sallār al-Daylamī’s contribution to the subject is more crucial. He considered khums as the grace of God and believed that it can be allocated by taking into account the share of the Imām. They put forward the views that explained in details the role of the faqīh in the collection and distribution of alms. Even Ibn al-Barrāj opined that in the absence of Imām and his deputy alms are to be allocated to the Faqihs on the ground that they know better how to distribute it. Therefore, in the absence of Imām and his deputy, by suggesting that faqīh must be in charge of collecting and distributing alms, they proposed a remedy in an early period.On the issue of leading the Friday prayer (ṣalāt al-jum‘a), which is one of the social duties of Imām, Sharīf al-Murtaḍā and his disciples considered the presence of the Imām or his deputy as a condition for a valid Friday prayer. In addition to this condition, Al-Ḥalabī, also added that a person who meets the necessary conditions can be also considered in leading Friday prayer. This addition by Ḥalabī was an important contribution to the solution of the problems encountered during the period of great occultation on both Friday prayer and delegation of Imām religious and political authorities to faqīh. On the other hand, Sallār, another disciple of Sharīf al-Murtaḍā, opposed the idea of the faqīh leading the Friday prayer in the absence of the Imām even when the necessary conditions are met. It can be said that this approach of Sallār led to the opinion of some Imāmis which considered Friday prayer unlawful in the absence of Imām. In the occultation period, Sharīf al-Murtaḍā and his disciples showed a cautious attitude about the implementation of the punishments. They argued that only Imām could implement the punishments. However, the major step was taken by Shaykh Ṭūsī on the issue of who implements the punishments in the occultation period. He argued that the Imām’s designated the faqihs to implement the punishments. In addition to this subject, Shiite scholars discussed the issue of whether a Shiite officer under the reigning rule in the occultation period implemented the punishments. On this issue, Sharīf al-Murtaḍā compiled a treaty untitled Mas’ala fi’l-‘amal ma‘a’al-sulṭan. For him, the main criteria are whether such person has necessary responsibilities and qualifications. Sharīf al-Murtaḍā and his disciples also continued their master’s conciliatory attitude. In the final analysis, the contribution of Sharīf al-Murtaḍā and his disciples on the issue of who will undertake the duties and responsibilities of the Imām is crucial in the systematization of the idea of transferal of the power of the Imām to faqīh including political one. In fact, Sharīf al-Murtaḍā’s advice to take part in the existing administrations has been considered a way out for the scholars who want to establish relations with the authorities in the later periods. In a series of papers, Don Fallis points out that although mathematicians are generally unwilling to accept merely probabilistic proofs, they do accept proofs that are incomplete, long and complicated, or partly carried out by computers. He argues that there are no epistemic grounds on which probabilistic proofs can be rejected while these other proofs are accepted. I defend the practice by presenting a property I call ‘transferability’, which probabilistic proofs lack and acceptable proofs have. While we endorse Heidegger’s effort to reclaim Kant’s Critique of Pure Reason as a work concerned with the possibility of metaphysics, we hold, first, that his reading is less original than is often assumed and, second, that it unduly marginalizes the critical impetus of Kant’s philosophy. This article seeks to shed new light on Kant and the Problem of Metaphysics and related texts by relating Heidegger’s interpretation of Kant to, on the one hand, the epistemological approach represented by Cohen’s Kant’s (...) Theory of Experience and, on the other, the metaphysical readings put forward by Heimsoeth, Wundt and others in the 1920s. On this basis, we argue that Heidegger’s interpretation of Kant remains indebted to the methodological distinction between ground and grounded that informed Cohen’s reading and was transferred to the problem of metaphysics by Wundt. Psychoanalysis provides a complex discursive matrix for making sense of, or unraveling the existing sense of, textual material in social research. However, the relationship between psychoanalytic work in the clinic and psychoanalytic social research poses a series of questions for those working in each domain. The relationship opened up new fields of enquiry, of empirical and theoretical research, but it also now gives rise to empirical and theoretical problems. This paper is concerned with the elaboration of clinical concepts in the (...) emerging field of psychosocial research, with a particular focus on the use of transference. The paper distinguishes 3 versions of transference in the psychoanalytic tradition, drawing attention to the importance of an “intersubjective” conception of transference in psychosocial research as an alternative to “attachment” models that appeal to mainstream empiricist approaches to psychological inquiry. The third version of transference elaborated in Lacanian psychoanalysis, one concerned with signification, is used to ground an analysis of the clinic as specific space in which the phenomenon manifests itself. Analysis of the clinic as “transferential space” enables us to conceptualize the place of psychoanalysis in the clinic and to question the extrapolation of transference to social research. Recent developments in studies of sperm‐mediated gene transfer (SMGT) now provide solid ground for the notion that sperm cells can act as vectors for exogenous genetic sequences. A substantive body of evidence indicates that SMGT is potentially useable in animal transgenesis, but also suggests that the final fate of the exogenous sequences transferred by sperm is not always predictable. The analysis of SMGT‐derived offspring has shown the existence of integrated foreign sequences in some cases, while in others stable modifications (...) of the genome are difficult to detect. The appearance of SMGT‐derived modified offspring on the one hand and, on the other hand, the rarity of actual modification of the genome, suggest inheritance as extrachromosomal structures. Several specific factors have been identified that mediate distinct steps in SMGT. Among those, a prominent role is played by an endogenous reverse transcriptase of retrotransposon origin. Mature spermatozoa are naturally protected against the intrusion of foreign nucleic acid molecules; however, particular environmental conditions, such as those occurring during human assisted reproduction, can abolish this protection. The possibility that sperm cells under these conditions carry genetic sequences affecting the integrity or identity of the host genome should be critically considered. These considerations further suggest the possibility that SMGT events may occasionally take place in nature, with profound implications for evolutionary processes. We are reminded of relevant stories, tales, or symbols from long-term memory when facing a novel problem our daily lives. Visual cues are 1 tool known to facilitate reminding. In 2 experiments, Chinese students, who had experienced a folk tale many years ago during childhood, were asked to solve an analogous problem. We tested the hypothesis that a visual cue can help bridge the gap between a novel problem and a source analogy experienced in the distant past. Different types of (...) cues proved to have distinct influences on components of analogical problem solving. This research suggests that analogical representational features of a story or problem can be stored in long-term memory and can be activated by visual cues. The implications of these findings for theories that point to perceptual or grounded, rather than decontextualized structures in knowledge representation are discussed. (shrink)

It is not necessary to have a keen ear in order to find out that the steps we take towards the future sound hollow. But it is necessary to have concentrated hearing if one wishes to find out which type of vacuity resonates with our progress. There are several types of vacuity, and ours must be compared to others, if the aim (...) is to understand it. The incomparable is incomprehensible. If we affirm that our situation is incomparable, we give up the effort to grasp it. The comparison that imposes itself is to the vacuity of the Baroque. There are innumerable traces in the present that evoke the Baroque. We bear the mark of the same somber rationalism (logics, informatics, cybernetics), and of the same magic and fanatic irrationalism (mass media, phantastic ideologies). But there is a decisive difference. Humanity advanced over a stage during the Baroque. All of its gestures, even the most sincere, were marked by theatricality. The vacuity that resonated under its feet was of the void under the stage. Baroque man represented. 1 For example he represented faith in waging religious wars. Baroque vacuity was the consequence of a medieval loss of faith in dogmas . Our vacuity is different. We do not represent anything. Our world is not a stage. We are not actors, and if we act, it is not to represent a drama, but to divert the audience's attention and our own from the subjects that really matter. We act like criminals that try to hide their tracks. We pretend. Our progress is a farce. The vacuity under our feet is not Baroque. We have not lost our faith in dogmas: we have lost faith in ourselves . We are as counter-reformists as was the Baroque (we want to cover up the recent revolution with warm cloths), but for different reasons. Although comparable with the Baroque, in certain aspects, our situation is in fact incomparable to any other. That is because an incomparable, unheard of, never before seen event happened recently, which emptied the ground we tread. Auschwitz . Other posterior events; Hiroshima, the Gulags, are nothing but variations of the first. Therefore every attempt to grasp the present leads to the following questions: how was Auschwitz possible? How can we live after this? Such questions relate not only to the ones directly or indirectly responsible, and not only to those who were directly or indirectly hit by it: they relate to everyone who takes part in our culture. Because what is so incomparable, unheard of, never before seen and therefore incomprehensible in Auschwitz, is that it was there that Western culture revealed one of its inherent virtualities. Auschwitz is a characteristic realization of our culture. It is neither the product of a particular Western ideology, nor of specific “advanced” industrial techniques. It springs directly from the depths of culture and of its concepts and values. The possibility to realize Auschwitzes is implicit within our culture from the very start: the Western “project” already harbored it, although as a remote possibility. Auschwitz lies within the initial program of the West, which progressively realizes all of its virtualities as history unfolds. That is why the question that Auschwitz poses before us is not: how did it happen? It serves no purpose to “explain” Auschwitz. The fundamental question is: how was it possible? Because what is being questioned is not the extermination camp, but the West. Thus one other question: how to live within a culture henceforth unmasked? Everything that happened afterwards resonates with such a question, with such vacuity. Every economic, social, political, technical, scientific, artistic, philosophic event is corroded by such an undigested question. The distance that separates us from the event does not mitigate the abyss, it erodes it even deeper. Because the distance progressively dissolves the aura of the horror that envelops the event, and it progressively opens up a vision of the scene. It progressively reveals that there all of our categories, all of our “models”, suffered an irreparable shipwreck. Auschwitz was a revolutionary event, in the sense that it overthrew our culture. Insofar as we seek ways to cover up such revolution with trips to the moon or with genetic manipulations, we are counter-revolutionaries: we are inverting the course of history in order to cover up the past. The unspoken in Auschwitz is not the mass murder, it is not the crime . It is the ultimate reification of people into amorphous objects, into ashes. The Western tendency towards objectification was finally realized and it was done so in the shape of an apparatus . The SS were functionaries of an extermination apparatus, and their victims functioned in function of their own annihilation. The extermination camp's program, once it started functioning, developed in an automatic fashion, autonomous from the decisions of the initial programmers, even if, as it effectively did, it contributed to the defeat of the programmers. The SS and the Jews functioned one in function of the other like cogwheels. The models for such functionality were provided by the highest of Western values: the SS behaved like “heroes” and the Jews like “martyrs”. This is an apparatus that functions at a borderline situation: objective even beyond death. What has just been said is intolerable. We cannot accept it and so we mobilize arguments against it. Good arguments. The SS behaved like criminals: they removed the gold teeth from the cadavers. The Jews behaved like victims: they rose up in the Warsaw ghetto. Such arguments are true, but they do not reach the nucleus, the “ eidos ” of the phenomenon: they do not grasp it. Although there was “normal” behavior: (theft, murder, revolt, heroism), there was also “abnormal” behavior: functionality during a borderline situation. And this is what counts. There, for the first time in the history of humanity, an apparatus was put into operation that was programmed with the most advanced techniques available, which realized the objectification of man, together with the functional collaboration of man. The previous horrors committed by Western society against other societies and against itself (and there are many) were crimes . They were violations of Western models of behavior: anti-Christian, anti-human, irrational. So that it is possible to condemn them and continue to be Western, even if the horror is so colossal, such as the enslavement of Africans. However, it is not possible to condemn Auschwitz and continue to adhere consciously to the West. Auschwitz is not a violation of Western models of behavior, it is, on the contrary, the result of the application of such models. Our culture allowed its mystifying mask to fall and must be rejected in toto if we admit that the purpose of every culture is to allow for the convivial existence of men that recognize each other mutually as subjects. However: it is not possible to reject one's own culture. It is the ground we tread . Those who seek to reject their own culture (as Nietzsche did in rejecting Judeo-Christianity), fall victim to madness. Those who reject their culture's models, are incapable of grasping the world in which they live. Cultural models are traps to catch the world. Those who seek to substitute their own models for other's (for example by shouting “Hare Krishna”) will find that such exotic models have already been caught by the very models to be substituted. There is no exit: we are condemned to use our models and to serve such models, even after they have been unmasked, if we wish to continue living. The only alternative would be to commit suicide. That is: we must continue our economic, political, scientific, artistic, philosophic activities despite Auschwitz. We must continue progressing despite everything . That is why there are those who recommend that we should seek to forget what happened, that we should repress the event. They sustain that enough has already been said and written about the subject and that it is time to “overcome” it. But such an ostrich strategy reveals itself disastrous. Because the result is that Auschwitz transfers itself from Poland of the 1940s to the post-industrial society of the future. What characterizes the extermination camp is precisely that it is not an event that can be “overcome”, because it is the first realization of an inherent virtuality within the Western project, which will repeat itself in other formats unless we become totally conscious of it. The advantage (if this is an appropriate term) that Auschwitz offers us, is to give us a concrete example of the West’s tendency towards the apparatus. For the first time in our history it is possible for us to experience concretely the utopia inherent in our culture. For the first time in our history we have the experience that utopia, no matter in what form, towards which we progress, is the extermination camp. Everywhere we can observe, as of now, the emergence of variations on the theme “Auschwitz”. Everywhere apparatus spring, just like mushrooms after a Nazi rain, from the ground that has become rotten. Certainly: such new apparatus are not externally similar to the Nazi extermination camps. Their labels are different, as are the ideologies that pretend to inspire them. Even the apparatus that admittedly envision extermination, such as the Gulags, the ones of a future nuclear war, or the ones that functioned in Vietnam, claim to be different from Auschwitz. Others claim to be “friends of mankind”, such as the scientific, technical and administrative apparatus. But such labels and such ideologies are deceptive and serve only to cover up the essence of apparatus. They are all just like Auschwitz, black boxes that function with complex inner-workings in order to realize a program. They all function according to an inertia that is inherent to them and such functionality escapes , from a certain point, the control of their initial programmers. In a final analysis such apparatuses function, all of them, towards the annihilation of all their functionaries, including their programmers. Exactly because they objectify and dehumanize man. Thus Western culture reveals itself as a project that seeks to transform itself into an apparatus. What characterizes the West is its capacity for an objectifying transcendence. Such transcendence allows for the transformation of all phenomena, including the human phenomenon, into an object of knowledge and manipulation. The space for such transcendence opened up thanks to Judeo-Christianity and resulted, in the course of our history, in science, technique and recently, in Auschwitz. The ultimate objectification of the Jews into ashes is the ultimate victory of the spirit of the West. It is social technique taken to the extreme. Certainly: the transformation of men into ashes is primitive, incipient social technique that progressively refines itself. It will be followed by less brutal objectifications, such as the robotization of society. But it does not matter which form it will assume: it will always be an objectifying manipulation of mankind. Although the apparatus of the immediate future are not necessarily incineration ovens, all will be, and not only the nuclear ones, apparatus for the annihilation of man. The Western program contains several virtualities, not only apparatus. Numerous virtualities have not yet been realized. In this sense the “history of the West” has not ended yet, the Western game continues. But all not-yet realized virtualities are infected by apparatus. That is why it has become currently impossible to engage ourselves in the “ progress of culture .” As it would be to engage ourselves in our own annihilation. We have lost our faith in our culture, in the ground we tread. That is: we have lost faith in ourselves. It is this hollow vibration that follows our steps towards the future. What remains is for us to analyze the event “Auschwitz” in all its details in order to discover the fundamental project that realized itself there for the first time, so that we may nurture the hope to project ourselves out of that project. Out of the history of the West. This is the “post- historical” climate in which we are condemned to live from hereon. NOTES 1. The lesson is familiar. Kripke’s arguments in favor of a posteriori necessary truths annul the idea that conceivability is a guide to metaphysical possibility because determining that which is a priori is a separate issue from determining that which is necessary. Modal rationalists do not completely agree with this conclusion. Following recent work on two-dimensional semantics, David Chalmers suggests that two distinct semantic values can be assigned to a statement, depending on whether we consider possible worlds as counterfactual or counteractual. (...) The idea is that counterfactual possibilities yield familiar Kripkean intuitions, but that counteractuals fulfill the desired link between a priori conceivability and metaphysical possibility. In this paper, I discuss a problem for modalrationalism that arises through the use of material conditionals, or conditionals in the indicative mood. I then turn to Chalmers’ response, and suggest reasons why it is inadequate. I turn to another response from Chalmers, and suggest that, whilst it solves the fi rst issue, it is incapable of grounding modal rationalism. In conclusion I will suggest a way in which a tempered version of modal rationalism can be salvaged. (shrink)

For a few years now, the publishing market, which has been attempting - under the heading of ‘European history’ - to construct a shared past for a present that we now have in common, has been mushrooming. This communal experience is indisputably gaining ground (though more slowly and controversially than some well-known optimists hoped): it is promoted by freedom of movement within the European (...) Union, by the effect of tourism, which some time ago ceased being reserved only for the elite, by the availability everywhere of products that, a few years back, typically represented a certain type of national styles of consumption, and finally by the unifying influence of the media. To the extent that closer relations between the inhabitants of the ‘old world’ run in parallel with the attempt to create institutions to regulate these common goods, and to protect against movements of people from other areas with their own sets of values, a combination of powerful ingredients is in place that leads one to anticipate a strengthening of ‘European’ identity. It is well known in research into identity that history plays an important part in its construction. And indeed historians from European countries have set themselves the task of jointly putting together a school textbook in which presentations that might otherwise focus on national character and be likely to offend neighbours will be harmonized. Others are looking at ways of celebrating memory (places of memory) that are intended to stimulate European rather than national memory. In addition, German and French historians met a while ago, in the little place of Genshagen near Berlin, with the intention of identifying events that would be suitable for European celebrations, in that they would not be connected with events that one of the participants might be ashamed of, or refer directly to a victory of one over another. But to anyone who studies the history of the two neighbours separated only by the Rhine, it quickly becomes clear that there is not a lot of space left in the calendar for activities that would found a common tradition. In this paper I examine whether the Humean denial of necessary connections between wholly distinct contingent existents poses problems for a theory of tropes. In section one I consider the substance-attribute theory of tropes. I distinguish first between three versions of the non-transferability of a trope from the substratum in which it inheres and then between two versions of the denial of necessary connections. I show that the most plausible combination of these views is consistent. In section two I consider (...) an objection to the bundle theory using the Humean doctrine that is advanced by Armstrong, and argue that it is unconvincing. In section three I return to the version of non-transferability that would cause obvious trouble for a substance-attribute theory, and less obvious trouble for a bundle theory. I argue that there is independent reason to reject this principle since, given a perdurantist metaphysic, it does not in fact secure what appeared to be its only benefit: namely that it allows tropes to act as truthmakers. I conclude that there is no objection to trope theory per se on the grounds that it brings commitment to necessary connections. (shrink)

This article provides a new argument and a new value-theoretical ground for person-centered care and shared decision making that ascribes to it the role of enabling rational choice in situations involving clinical choice. Rather than referring to good health outcomes and/or ethical grounds such as patient autonomy, it argues that a plausible justification and ground for person-centered care and shared decision making is preservation of rationality in the face of comparative non-determinacy in clinical settings. Often, no alternative treatment will be (...) better than or equal to every other alternative. In the face of such comparative non-determinacy, Ruth Chang has argued that we can make rational decisions by invoking reasons that are created through acts of willing. This article transfers this view to clinical decision making and argues that shared decision making provides a solution to non-determinacy problems in clinical settings. This view of the role of shared decision making provides a new understanding of its nature, and it also allows us to better understand when caregivers should engage in shared decision making and when they should not. In this paper, we seek to explain the power of perspective taking in narrative discourse by turning to research on the oral foundations of storytelling in human communication and language. We argue that narratives function through a central process of alignment between the viewpoints of narrator, hearer/reader, and character and develop an analytical framework that is capable of generating general claims about the processes and outcomes of narrative discourse while flexibly accounting for the great linguistic variability both across and within (...) stories. The central propositions of this viewpoint alignment framework are that the distance between the viewpoints of participants in the narrative construal – narrator, character, reader – is dynamic and regulated by linguistic choices as well as contextual factors. Fundamentally, viewpoint alignment is grounded in oral narrative interaction and, from this conversation, transferred to the written narrative situation, varying between demonstration and invasion of the narrative subjects and guiding readers’ route of processing the narrative (experientialversusreflective). Our claim is that variations in viewpoint alignment are functional to the communicative context and intended outcomes of narratives. This is illustrated with the analysis of a corporate journalistic narrative that comprises both interactional and non-interactional aspects of storytelling. The concept of viewpoint alignment further explains the oral fundaments of narrative discourse in conversational storytelling and poses new questions on the relation between the dynamic processing of stories on the one hand and their static outcomes on the other. Giulia Cavaliere and César Palacios-González argue that lesbian couples should have access to human nuclear genome transfer so that both members of the couple can have a genetic link to the child they intend to parent. Their argument is grounded in an appeal to reproductive freedom. In this Response, I address a number of concerns with their argument. These concerns relate to nomenclature, treating like cases alike, genetic-relatedness and the limits of reproductive rights. On this last point, I insist (...) that we should not mistake ‘wants’ for ‘needs’ or ‘rights’. I maintain that there is no right to biological parenthood, there is no compelling need for human nuclear genome transfer to satisfy a so-called need for genetically-related children, and we ought not to pander to an acquired desire for genetic filiation. This article begins by exploring a lost topic in the philosophy of science:the properties of the relations evidence confirming h confirmsh'' and, more generally, evidence confirming each ofh1, h2, ..., hm confirms at least one of h1, h2,ldots;, hn''.The Bayesian understanding of confirmation as positive evidential relevanceis employed throughout. The resulting formal system is, to say the least, oddlybehaved. Some aspects of this odd behaviour the system has in common withsome of the non-classical logics developed in the twentieth century. Oneaspect (...) – its ``parasitism'''' on classical logic – it does not, and it is this featurethat makes the system an interesting focus for discussion of questions in thephilosophy of logic. We gain some purchase on an answer to a recently prominentquestion, namely, what is a logical system? More exactly, we ask whether satisfaction of formal constraints is sufficient for a relation to be considered a (logical) consequence relation. The question whether confirmation transfer yields a logical system is answered in the negative, despite confirmation transfer having the standard properties of a consequence relation, on the grounds that validity of sequents in the system is not determined by the meanings of the connectives that occur in formulas. Developing the system in a different direction, we find it bears on the project of ``proof-theoretic semantics'''': conferring meaning on connectives by means of introduction (and possibly elimination) rules is not an autonomous activity, rather it presupposes a prior, non-formal,notion of consequence. The foundation (waqf), which is a charity institution that was able to find an application area since the emergence of Islam, has developed over time in Islamic societies and has become a common institution. In the Ottoman Empire, these institutions had incorporated different services into its structure. This expansion has also led to the establishment of many different types and purposes of foundations such as charities; family, animal care, hospice, foodbank and educational institutions and mosques. Types of foundations in which (...) the incomes of the foundation were shared in different ways were also developed in this period. Family foundations are one of the types of foundations established for the purpose to share of income. Family foundations, which are characterized by many different names such as “zürri” (familial), “ehli” (domestic) and “evlatlık” (filial), have been criticized legally for various reasons in the last period of the Ottoman Empire and the Republic period, and their legitimacy has been questioned. This questioning of legitimacy, which started especially with orientalist studies, was also written among Turkish historians and lawyers, and attempts were made to base the claims that family foundations are illegitimate. In time, these criticisms came out of the family foundations and became legally questioning the entire Islamic foundation system. Investigating the justification of these criticisms, which have been popular since the end of the 19th century, is of particular importance for the development of today's foundation system. Because as a result of these criticisms, the foundations, which are one of the most effective institutions that provide social cohesion and that Islam has created and developed, have lost their importance over time and there has been a noticeable decrease in established foundations. Previously established foundations were somehow transferred to individual ownership on legal grounds. Based on these reasons, the study aims to determine the truth of these claims and to offer a critical approach to the debates on the legitimacy of family foundations in Islamic law, thus revealing the legal basis of the foundation system in Islam. In terms of nature, family foundations are a type of foundation for the purpose of the foundation. Although its name is described as family, it indicates a foundation that is broader than the concept of family. In this sense, it refers to foundations established first for private individuals and then for one of the general charity classes. Specially designated persons do not have to be among family members. It is referred to by this name as these foundations are mostly established for family members. When the evidence regarding the legitimacy of these foundations is examined, examples from the practices of the Prophet himself can be seen, as well as general verses from the Qur'an that will be included in the scope of these foundations. On the other hand, there are examples of family waqfs in foundations established by almost all of the Companions. The legitimacy of family foundations is challenged within the framework of four main reasons such as violation of the provisions of legacy, avoiding to be confiscated, preventing the fragmentation of property by the heirs and causing the feudal system and it is claimed to be illegitimate. However, the fact that these foundations have existed in Islamic societies since the golden age, including the Ottoman Empire raises a question about the authenticity of the criticisms. When examining the details of the criticisms, it can be easily seen that there is no question of legitimacy in the real sense, only a misinterpretation arising from misunderstanding. As a result, it will be seen that it is not possible to say that the practices of Muslims throughout history are illegitimate. Family waqfs have taken place in history as an institution that does not contradict the general provisions of Islam, on the contrary, by increasing Islamic foundation culture and social solidarity. It is extremely important for these foundations to find a field of application in social and economic terms now. (shrink)

Central to the account of grounded procedures is the premise that mental experiences are grounded in physical actions. We complement this account by incorporating frameworks in cultural psychology and developmental neuroscience, with new predictions. Through the examples of vicarious experiences and demerit transfer, we discuss why, and how, separation and connection may operate somewhat differently across cultures.

Delaware case law has rendered the tender offer obsolete as a method for purchasing a company whose directors oppose the acquisition. A potential acquirer facing target opposition today must run an insurgent director slate, in the expectation that its directors are more likely to sell. The Delaware courts have not justified their preference for elections over markets as the preferred vehicle for implementing changes in control. Informal scholarly analyses ask transaction cost questions, such as whether proxy contests are more costly (...) than takeovers. This article attempts to break new ground by asking whether there are systematic differences in the performance of elections and markets in the corporate context. Recent models of voting processes, we argue, strongly suggest that elections are inferior to markets. Proxy contest elections sometimes can be won by incumbent managements when a transfer of control would be efficient, a conclusion consistent with the sparse data; and the proxy election process aggregates information regarding the sale decision less well than markets do, thereby implying that proxy voters are less well-informed. Theory and data thus suggest, at the least, that the intellectual burden of proof should change: the task now is to justify using elections to transfer control despite their apparent deficiencies. My aim in this paper is to elucidate Leibniz’s account of moral normativity and the relation between motivation and obligation. I argue against the recent interpretation of Christopher Johns, according to which Leibniz’s moral theory is actually a deontological theory, having more in common with Kantian moral theory than with any form of consequentialism. I argue that for Leibniz reason is not itself the source of practical normativity and real obligation; the source of that is rather the agent’s desire for (...) his own happiness or perfection. For Leibniz, reason in its practical role functions instrumentally: the desire for one’s own happiness is the source of practical normativity, and reason functions only to transfer that normativity from the end that it does not determine to the means to those ends that it does determine. In this paper, I argue that, contrary to Robert Stalnaker’s highly influential account of linguistic communication, successful communication does not depend on a common ground between speaker and hearer. The problem for Stalnaker’s account manifests itself in communicative situations that represent both Lingens cases, i.e., cases involving egocentric beliefs, and Frege cases, i.e., cases involving identity confusions. I describe two hypothetical cases that involve successful communication, but in which no common ground of the kind required by Stalnaker’s account is available. (...) I therefore propose an alternative account of communication that is based on epistemic two-dimensionalism. This account maintains that communication requires the transfer of a thought content from speaker to hearer. By holding that this shared content often constitutes common ground, it preserves much of the appeal of Stalnaker’s account. However, my account allows for cases in which the shared thought content does not figure in common ground. (shrink)

Person‐specific evidence was developed as a grounded theory by analyzing 20 selected case descriptions from interventions using the guided self‐determination method with people with various long‐term health conditions. It explains the mechanisms of mobilizing relational capacity by including person‐specific evidence in shared decision‐making. Person‐specific self‐insight was the first step, achieved as individuals completed reflection sheets enabling them to clarify their personal values and identify actions or omissions related to self‐management challenges. This step paved the way for sharing these insights and (...) challenges in a relationship with a supportive health professional, who could then rely on person‐specific evidence instead of assumptions or a narrow disease perspective for shared decision‐making. Trust in the evidence encouraged the supportive health professional to transfer it to the interdisciplinary team. Person‐specific evidence then enhanced the ability of team members to apply general evidence in a meaningful way. The increased openness achieved by individuals through these steps enabled them to eventually share their new self‐insights in daily life with other people, decreasing loneliness they experienced in self‐management. Relational capacity, the core of the theory, is mobilized in both people with long‐term health conditions and healthcare professionals. Further research on person‐specific evidence and relational capacity in healthcare is recommended. (shrink)

This study deals with Dominicus Gundissalinus’s discussion on metaphysics as philosophical discipline. Gundissalinus’s translation and re-elaboration of al-Fārābī’s Iḥṣā’ al-ʿulūm furnish him, in the De scientiis, a specific and detailed procedure for metaphysical analysis articulated in two different stages, an ascending and a descending one. This very same procedure is presented by Gundissalinus also in his De divisione philosophiae, where the increased number of sources –in particular, Avicenna– does not prevent Gundissalinus to quote the entire passage on the methods of (...) metaphysical science from the Iḥṣā’ al-ʿulūm, with some slight changes in his Latin translation. The analytical procedure herein proposed becomes an effective ‘metaphysical programme’ with regards to Gundissalinus’s onto-cosmological writing, the De processione mundi. The comparative analysis of this treatise with the procedure received by al-Fārābī shows Gundissalinus’s effort to follow and apply this metaphysical programme to his own reflection, in a whole different context from al-Fārābī’s and presenting doctrines quite opposed to the theoretical ground on which al-Fārābī’s epistemology is based, like ibn Gabirol’s universal hylomorphism. Nevertheless, thanks to the application of the ‘metaphysical programme’, one can effectively claim that Gundissalinus’s metaphysics is, at least in the author’s intentions, a well-defined metaphysical system. In appendix to this article the three Latin versions of al-Fārābī’s discussion on metaphysics are reported, e.g., Gundissalinus’s quotations in De scientiis and De divisione philosophiae, and Gerard of Cremona’s translation in his De scientiis. This paper aims to deal with the disputes on transferring demonstration between the various sciences in the context of the medicine-geometry relationship. According to Aristotle’s metabasis-prohibition, these two sciences should be located in separate compartments due to the characteristics of their subject-matter. However, a thorough analysis of the critical passage in Aristotle’s Posterior Analytics on circular wounds forces a revision of the boundaries of the interactions between sciences, since subsequently Avicenna, on the grounds of this passage, would widen the area (...) of the transference of demonstration. Furthermore, the fact that Avicenna and Ibn al-Nafīs continued to use geometrical demonstrations in their anatomical investigations shows the need to understand kind-crossing prohibition as a reminder to take into account the present scientific infrastructure and logical rules before proceeding onto a scientific investigation instead of accepting it as a mere nominal doctrine. Therefore, whether kind-crossing was possible or not depended on the extent to which the conclusion derived at the end of the scientific investigation, using a different method after taking into account all these reminders, had contributed to the solution of a particular proposition or the achievement of an approximate truth. Karimov, has headed for refusal of a heritage of a command control system, having started to construction of bases of a democratic legal society with the socially-focused market economy. For achievement of these purposes own model of updating and progress which essential features are the selective approach to (...) experience of the developed countries and the account of specificity and features of centuries-oldevolution of national statehood is involved. In Republic of Uzbekistan process of democratization and modernization of a society became stage-by-stage, with a stress on maintenance of deep understanding of an essence of democracy, in view of sociopolitical traditions and features of national mentality. The heritage of sociopolitical culture of our society has acted original “Means”. By means of which modern values and principles of democracy were brought home to people, their perception and understanding was facilitated. Psychological features of national character, such as tolerance, the aggravated feeling of validity, equality before the law, etc. were especially effectively used. It is known, that the basic directions of democratic transformations and formation of a civil society are defined depending on real needs and opportunities of their realization. We have a precise comprehension of that the major condition of formation of a democratic society is strengthening a role and value in a life of a society of not state and public institutes. In Uzbekistan this process goes by practical realization of the concept “From the strong state - to a strong society”. It is a question of stage-by-stage and gradual reduction of a role of the state structures in the decision of social and economic questions and about transfers of these functions to public organizations. Gradually we go to that participation of the state in economic sphere and a field of activity of managing structures, first of all, a private sector - decreases. In parallel the problem of creation of favorable conditions for realization of publiccontrol on the basis of corresponding motivation - public interests is solved. (shrink)

This paper argues that current pragmatic theories fail to describe common ground in its complexity because they usually retain a communication-as-transfer-between-minds view of language, and disregard the fact that disagreement and egocentrism of speaker-hearers are as fundamental parts of communication as agreement and cooperation. On the other hand, current cognitive research has overestimated the egocentric behavior of the dyads and argued for the dynamic emergent property of common ground while devaluing the overall significance of cooperation in the process of (...) verbal communication. The paper attempts to eliminate this conflict and proposes to combine the two views into an integrated concept of common ground, in which both core common ground and emergent common ground converge to construct a dialectical socio-cultural background for communication.Both cognitive and pragmatic considerations are central to this issue. While attention explains why emergent property unfolds, intention explains why presumed shared knowledge is needed. Based on this, common ground is perceived as an effort to converge the mental representation of shared knowledge present as memory that we can activate, shared knowledge that we can seek, and rapport, as well as knowledge that we can create in the communicative process. The socio-cognitive approach emphasizes that common ground is a dynamic construct that is mutually constructed by interlocutors throughout the communicative process. The core and emergent components join in the construction of common ground in all stages, although they may contribute to the construction process in different ways, to different extents, and in different phases of the communicative process. Proponents of the explanatory indispensability argument for mathematical platonism maintain that claims about mathematical entities play an essential explanatory role in some of our best scientific explanations. They infer that the existence of mathematical entities is supported by way of inference to the best explanation from empirical phenomena and therefore that there are the same sort of empirical grounds for believing in mathematical entities as there are for believing in concrete unobservables such as quarks. I object that this inference depends (...) on a false view of how abductive considerations mediate the transfer of empirical support. More specifically, I argue that even if inference to the best explanation is cogent, and claims about mathematical entities play an essential explanatory role in some of our best scientific explanations, it doesn’t follow that the empirical phenomena that license those explanations also provide empirical support for the claim that mathematical entities exist. The work of general practitioners is infused by norms from several movements, of which evidence based medicine, patient-centredness, and virtue ethics are some of the most influential. Their precepts are not clearly reconcilable, and structural factors may limit their application. In this paper, we develop a conceptual framework that explains how GPs respond, across different fields of interaction in their daily work, to the pressure exerted by divergent norms. Data was generated from unstructured interviews with and observations of sixteen Swedish (...) GPs and family medicine residents between 2015 and 2017. Straussian Grounded Theory was used for analysis. We found that GPs’ maxims of action can be characterised in terms of dichotomous responses to demands from four distinct sets of norms, or “voices”: the situation, the self, the system, and the profession. From the interactions between these voices emerge sixteen clusters of maxims of action. Based on the common features of the maxims in each cluster, we have developed a conceptual framework that appears to be rich enough to capture the meaning of the ethical decisions that GPs make in their daily work, yet has a high enough level of abstraction to be helpful when discussing the factors that influence those decisions. Our four-dimensional model of GPs’ responses to norms is a first step toward a middle-range theory of quality from GPs’ perspective. It brings out the complexity of their practice, reveals tensions that easily remain invisible in more concrete accounts of their actions, and aids the transferability of substantive theories on GPs’ ethical decision making. By explaining the nature of the ethical conflicts that they experience, we provide some clues as to why efforts to improve quality by imposing additional norms on GPs may meet with varying degrees of success. The 1992 Convention on Biological Diversity (CBD) and its 2010 Nagoya Protocol brought about a breakthrough in global policy making. They combined a concern for the environment with a commitment to resolving longstanding human injustices regarding access to, and use of biological resources. In particular, the traditional knowledge of indigenous communities was no longer going to be exploited without fair benefit sharing. Yet, for 25 years after the adoption of the CBD, there were no major benefit sharing agreements that led (...) to significant funding streams for indigenous communities. This changed with the signing of the Rooibos Benefit Sharing Agreement in South Africa, described in this paper. As the authors report, the Rooibos Agreement is a superlative in two respects. It is the biggest benefit sharing agreement between industry and indigenous peoples to date. It is also the first industry-wide agreement to be formed in accordance with biodiversity legislation. This article is a co-production between traditional knowledge holders, the lawyer who represented their interests, the Co-Chair of the Nagoya Protocol negotiations, and an ethicist who analyzed the major challenges of this historic agreement. With no precedent in the benefit sharing world, the agreement stands as a concrete example of the ‘art of the possible.’ Although the rooibos case is unique in a number of aspects, the experience offers many transferable insights, including: patience; incrementalism; honesty; trust; genuine dialogue; strong legal support; a shared recognition that a fair, win-win deal is possible; government leadership; and unity amongst indigenous peoples. Such ingredients of success can apply well beyond southern Africa. (shrink)

Cora Diamond’s discussions of the ethics of our treatment of animals offer a critique of conceptions of morality which regard our ethical responses as founded on reasons which ought to be reasons for anyone. Diamond takes issue with accounts of our treatment of animals based on their possession of capacities which are shared with us. She offers instead a concept of the moral life, as a form of life—inherited, shared and negotiated—only within which can moral reasons count as reasons at (...) all. Our fellow creatures have some share in this life, but one that must be recognized as partial and problematic.In this discussion, we offer an account which is consistent with Diamond’s general perspective. But one which also offers a more generous account of ways in which the discoveries of the ethological sciences dynamically reshape the place of animals in our shared moral life. (shrink)

El que batega al fons del llibre de Ground és una defensa de l’art contemporani quan (...) reivindica la seua intel·ligibilitat com un tret centralment constitutiu d’aquest. Una defensa que passa, necessàriament, per mantenir en peus la vigència de la pregunta que dóna títol al llibre, a pesar dels intents recents per anul·lar-la o per relegar-la a una desautorització ingenuista i/o reaccionària de «tot» l’art contemporani. El text d’Ian Ground la traducció del qual transcrivim a continuació va ser llegit a l’acte de presentación del seu llibre ¿Arte o chorrada? (València, Publicacions de la Universitat de València / Col•lecció Estètica & Crítica, 2008) el dia 9 de juny de 2008 a l’Aula Magna de l’edifici del Carrer La Nau de la Universitat de València, amb la presència, a més d’Ian Ground, de Romà de la Calle (en qualitat de Director de la col•lecció Estètica & Crítica) i (...) de mi mateix, Salvador Rubio (en qualitat de traductor, editor i autor de la introducció del llibre). El text va ser llegit en anglés pel seu autor, alternat, paràgraf per paràgraf, amb la lectura de la traducció castellana. Hem preferit que el text traduit aparega ací en castellà, exactament igual al que va ser llegit a l’esmentat acte de presentació. La reflexió que ens proposa Ian Ground, en cara que específicament concebuda per a aquest acte, no necessita cap presentació i pot ser llegida perfectament com un text autònom. Tanmateix, em permet precedir-la amb unes quantes observacions que no pretenen sustituir les meues paraules a l’acte (on, naturalment, els agraïments eren els protagonistes) ni tampoc la introducció del llibre ja publicada, i a la qual es pot remetre directament el lector d’aquest article. We hypothesise that the sarcolemma of an actively growing myofibre has different properties to the sarcolemma of a mature adult myofibre. Such fundamentally different properties have clinical consequences for the onset, and potential therapeutic targets, of various skeletal muscle diseases that first manifest either during childhood (e.g. Duchenne muscular dystrophy, DMD) or after cessation of the main growth phase (e.g. dysferlinopathies). These characteristics are also relevant to the selection of both tissue culture and in vivo models employed to study such (...) myopathies and the molecular regulation of adult myofibres. During growth, multinucleated myofibres increase enormously in size and volume with dramatic increases in length (up to ∼600 mm). This is in striking contrast with most mononucleated cells such as fibroblasts, that remain at a relatively small size (∼10–20 µm diameter). The consequences of a dynamic, expanding sarcolemma during growth, compared with that of an adult myofibre of a fixed length, are discussed with respect to various aspects of muscle biology.
