The use of storytelling in the judgment process is based on the necessary assumption that experience and meaning are universal. In place of recognizing legitimate differences in the interpretation of social experience, jurors more often are compelled to regard unfamiliar story elements or dissonant interpretations as signs of guilt. When key elements in a case are anchored in different social worlds, defendants may be found guilty simply by reason of their social experiences and their communication styles. The important question arising (...) from this state of affairs is whether anything can be done to correct biased judgment of trials.Securing access to justice means, at a minimum, recognition for the legitimacy—if not the validity—of one's grievances and aspirations. The study of memory is witnessing a spirited clash between proponents of traditional laboratory research and those advocating a more naturalistic approach to the study of “real-life” or “everyday” memory. The debate has generally centered on the “what” (content), “where” (context), and “how” (methods) of memory research. In this target article, we argue that the controversy discloses a further, more fundamental breach between two underlying memory metaphors, each having distinct implications for memory theory and assessment: Whereas traditional memory research has (...) been dominated by thestorehousemetaphor, leading to a focus on thenumberof items remaining in store and accessible to memory, the recent wave of everyday memory research has shifted toward acorrespondencemetaphor, focusing on theaccuracyof memory in representing past events. The correspondence metaphor calls for a research approach that differs from the traditional one in important respects: in emphasizing the intentional –representational function of memory, in addressing the wholistic and graded aspects of memory correspondence, in taking an output-bound assessment perspective, and in allowing more room for the operation of subject-controlled metamemory processes and motivational factors. This analysis can help tie together soine of the what, where, and how aspects of the “real-life/laboratory” controversy. More important, however, by explicating the unique metatheoretical foundation of the accuracy-oriented approach to memory we aim to promote a more effective exploitation of the correspondence metaphor inbothnaturalistic and laboratory research contexts. The importance, legitimacy and role of second-order probabilities are discussed. Two descriptive models of the use of second-order probabilities in decisions are presented. The results of two empirical studies of the effects of second-order probabilities upon the rank orderings of bets are summarized briefly. The bets were of three basic types and involved a wide variety of first- and second-order probabilities as subjectively assessed by the subjects. Support was obtained for the assumption that the majority of subjects make use of (...) the one model or the other. It is suggested that greater attention should be paid to second-order probabilities, both from a normative and descriptive standpoint. (shrink)

In what countries and among which individuals in Asia is China's influence seen as least favorable? Drawing upon AsiaBarometer survey data from 12 Asian societies between 2006 and 2008, this study tests a series of hypotheses aimed at identifying those variables that most consistently predict individuals’ perceptions of China. With the exceptions of Japan, South Korea, Taiwan and Vietnam, a clear plurality or a majority of respondents in each polity views China's influence positively. Concerns about domestic economic management were most (...) consistently associated with perceptions of China that are more unfavorable, while greater levels of contact with the Chinese film and television culture were consistently associated with perceptions of China that are more favorable. These results suggest that China is more likely to be seen as an economic rather than military threat by Asian publics, and that Asia may prove responsive to a nuanced soft power campaign by Beijing in the future. It has become common to view Hobbes as a 'liberal', indeed as one of the founders of liberalism. Despite this characterization, there are few works which examine his views on liberty closely. The first part of this paper attempts to explicate what Hobbes says about liberty, mainly in Leviathan, especially in relation to recent philosophical analysis of the subject. In the second part, I examine the relation between Hobbes's views about liberty and other aspects of his political views.

Previous research (e.g., Horiuchi, Goldsmith, and Inoguchi, 2005) has shown some intriguing patterns of effects of several variables on international public opinion about US foreign policy. But results for the theoretically appealing effects of regime type and post-materialist values have been weak or inconsistent. This paper takes a closer look at the relationship between these two variables and international public opinion about US foreign policy. In particular, international reaction to the wars in Afghanistan (2001) and Iraq (2003) are examined using (...) two major multinational surveys. The conclusions of previous research are largely reinforced: neither regime type nor post-materialist values appears to robustly influence global opinion on these events. Rather, some central interests, including levels of trade with the US and NATO membership, and key socialized factors, including a Muslim population, experience with terrorism, and the exceptional experiences of two states (Israel, Albania) emerge as the most important factors in the models. There is also a consistent backlash effect of security cooperation with the US outside of NATO. A discussion of these preliminary results points to their theoretical implications and their significance for further investigation into the transnational dynamics of public opinion and foreign policy. Smith et al. show that monkeys and dolphins can respond adaptively under conditions of uncertainty, suggesting that they monitor subjective uncertainty and control their behavior accordingly. Drawing on our own work with humans on the strategic regulation of memory reporting, we argue that, so far, the distinction between monitoring and control has not been addressed sufficiently in metacognitive animal research.

Despite Australia's increasing economic ties with Asia, little is known about how it is perceived by the typical citizen in the region. This paper seeks to contribute to the Australian discussion on , as well as to a general understanding of the structure of foreign policy beliefs, by examining perceptions of Australia's influence among the mass publics of 14 Asian polities. Despite some anxiety in Australia on national op-ed pages and among political leaders over how the country is perceived, we (...) find that the average person in Asia probably does not have a strong or meaningful opinion about Australia's foreign policy. Using survey data covering the years 2006 through 2008 from the AsiaBarometer project, we find that, on average, far more people view Australia's influence on their country favorably (40.5%) than view it unfavorably (6.1%). A similar percentage (41.5%), however, have neutral views of Australia's influence, and 12% of people in Asian nations express no opinion on the topic. We suggest these high frequencies of neutral perceptions and non-response are evidence of considerable indifference towards Australia. Furthermore, we investigate the correlates of perceptions of Australia's influence and find that in almost all cases citizens general internationalist sentiment or perceptions of major powers. When speaking of the posthistorical, one is also speaking of posthumanism, so that the question becomes “On what basis can one speak in these terms? And what are their main characteristics?” I begin with statements that include these questions, and answer by exploring the theme of negativity put forth by Giorgio Agamben, Emmanuel Levinas, Vladimir Jankélévitch, and Jean-Luc Nancy. Negativity generates negative phenomena and contexts that lead to negative feelings and states of mind. It also includes such phenomena as boredom, (...) solitude, loneliness, and isolation, which I consider in this order to show the similarities and differences among these phenomena and pose the question whether they can influence one another. I conclude by examining whether these phenomena are symptoms of a posthumanist nihilism or if they can bring forth changes in our human, insurmountable finitude. If so, a different ethics arises that sets aside the humanism of the past and puts in its place a posthuman way of being-in-common based on co-existence. (shrink)
