The impact of globalization on human rights has generated substantial debate. On the one hand, those making liberal, free-market arguments assert that globalization has a positive impact on developing countries through the increased generation of wealth (e.g., Garrett 1998; Richards et al. in International Studies Quarterly 45:219–239, 2001; Rodrik in Challenge 41:81–94, 1997). On the other hand, the critical perspective claims that globalization negatively impacts respect for human rights because trading arrangements, while open, are detrimentally uneven (e.g., (...) Carleton 1989; Haggard and Maxfield 1996; Stiglitz and Charlton 2005). However, few have looked at the relationship between globalization and respect for economic and social rights. In order to test this relationship, I examine non-OECD countries utilizing two-stage regression analysis to control for investment-selection factors. I find mixed results for the hypothesis that globalization negatively affects respect for economic and social rights. Consistent with Richards et al. (International Studies Quarterly 45:219–239, 2001), I conclude by arguing for the need to disaggregate globalization in order to determine its true effects. (shrink)

Sovereignty and the sovereign state are often seen as anachronisms; Globalization and Sovereignty challenges this view. Jean L. With growing globalization, the governments of many countries are tending to place a disproportionately large emphasis on economy, which often results in budget cuts in health, education and social welfare. Such a tendency has provoked arguments by many individuals concerned. The neo-conservatism represented by ex-US President Reagan and ex-UK Prime Minister Thatcher in the 1980s, known as Reaganomics and Thatcherism, caused public funds for health care and education to be substantially reduced. The book begins with an overview of globalization, showing how wealth and power are concentrated in the hands of a transnational elite while ever increasing numbers of people are being marginalised. Institutions such as the World Trade Organisation and the International Monetary Fund are intent upon exercising a new hegemony over individuals as the role of the traditional nation state is transformed. At the centre of this power shift is a group of high-tech robber barons who dominate the Information (...) Age and exploit the technologies of globalization for their own narrow interests. The second part of the book explores the rise of the new grass roots oppositional movements around the world. Manifest in such diverse struggles as the uprising of the Zapatistas in Mexico and the battle of Seattle against the World Trade Organisation, this new postmodern politics is "de-centred" and has little interest in the old ideologies that dominated much of the twentieth century. The final section of the book contextualizes postmodern politics by drawing on contemporary examples. The authors discuss the demise of socialist and proto-socialist experiments in Chile, Grenada, Nicaragua and Cuba and the emergence of postmodern movements in Latin America. In this paper, attention will focus primarily on economic and financial aspects of the globalization debate, and on their implications for public policy. Nevertheless, these issues cannot be separated from their historical and political context. The current discussion of globalization can only be understood in relation to the development of economic and political institutions over the past century. Globalization is frequently discussed as a counterpoint to national sovereignty. It is commonly asserted that globalization has eroded national (...) sovereignty or that it has rendered borders obsolete. In particular, it is asserted that, in a globalised world economy, governments have no alternative but to adopt neoliberal economic policies of privatisation, deregulation and reductions in public expenditure. The analysis presented in this paper gives little support to the view of globalization as an exogenous force that has undermined domestic economic sovereignty. On the contrary, financial globalization is best interpreted as the international counterpart of domestic neoliberalism. Both in domestic and international policy, the swing to neoliberalism was a response to the actual and perceived failures of the post-1945 policy framework in which domestic Keynesianism and the welfare state were complemented internationally by the Bretton Woods system. The advocates of neoliberal reform have had only limited success in implementing their policy agenda, even in the English-speaking countries. The choice between continued neoliberal reform and a remodelled social democracy remains open. The direction chosen by democratic governments will ultimately depend on the relative success of competing economic and social models, rather than on an exogenous process of globalization. (shrink)

Frank Cunningham discusses the idea that there is no universal form of democracy, in his contribution on MacPherson, “Globalization and developmental democracy”. Working at a time in which colonial attitudes had not yet been radically questioned, MacPherson analyzed the democratic potential of peoples that were, in Western eyes, still deemed too immature for self-government. MacPherson’s theoretical framework was particularly suited to such an endeavour, because his definition of democracy did not focus on narrow institutional characteristics. The concept of social license to operate was forged in the crucible between globalization—which has radically decentralized the ability of organizations to operate wherever they choose—and the rise of oppositional social movements, newly empowered to confront global actors infringing on their communities. This article reviews the central dilemma posed by social license to operate: whether it is business practice, sociological reality, or emerging form of governance, drawing on the insights and findings of the articles in this special issue. (...) It then suggests three lines of future research for the critical social sciences. The article concludes that the principle shortcomings of the concept of social license to operate is the inevitability of the boundaries it draws between organizations and the communities they inhabit and the failure of the concept to acknowledge that transformation, not just operation, is almost always at stake in these encounters. The flow of capital is $1.5 trillion per day, very little of it productive. Ninety-five percent of it is destructive and speculative. The analysis of this globalization in philosophy and social sciences has an extremely contradictory character which is law-governed in the modern society. Globalization, as a technological and economic phenomenon, asserts specific models for the governance of common resources. In particular, the technological and economic impulses of globalization further the capitalization of nature. This process is evident in the regionalization of bioprospecting efforts in Mesoamerica.

Globalization has led to a redefinition of the functions and roles of the state. Based on data drawn from a cross-national social survey, this article examines the influences of globalization on the public's attitudes towards their state in Australia, China, India, Japan, Russia, and the United States, by focusing on satisfaction with government performance and demands on the government. The six countries differ extensively in their sociopolitical and technological situations, as well as in the experiences of their people (...) with globalization in terms of the following aspects: connectivity with the world through personal ties and digital means, English language capacity, and support for the forces of globalization. There are also huge disparities in the public rankings of government performance and demands for expanding government spending in a wide range of policy areas. Our analysis reveals that, although both intra- and inter-country variations in the influences of globalization on public attitudes towards the state are not particularly prominent, those who support globalization not only are more inclined than others to be satisfied with the government's performance, but also demand more government intervention. This book analyses public sector reform comprehensively in all parts of China's public sector - government bureaucracy, public service units and state-owned enterprises. It argues that reform of the public sector has become an issue of great concern to the Chinese leaders, who realize that efficient public administration is key to securing the regime's governing capacity and its future survival. The book shows how thinking about public sector reform has shifted in recent decades from a quantitative emphasis on 'small government', (...) which involved the reduction in size of what was perceived as a bloated bureaucracy, to an emphasis on the quality of governance, which may result in an increase in public sector personnel. The book shows how, although Western ideas about public sector reform have had an impact, Chinese government continues to be best characterized as 'state capitalism', with the large state-owned enterprises continuing to play an important - and increasing - role in the economy and in business. However, state-owned enterprises no longer provide care for large numbers of people from the cradle to the grave - finding an alternative, efficient way of delivering basic welfare and health care is the big challenge facing China's public sector. The unprecedented economic changes taking place in China over the past three decades have led to significant new fiscal pressures for the central and provincial governments. The relative decline of public ownership and rise of the private sector has forced governments to substitute revenues from new taxes for the funds formerly provided by public enterprises. The shift from profit distribution to tax revenues has led to a realignment of power between local governments and the central government while the growing disparity (...) in wealth between have and have-not provinces has increased the pressure on the central government to further consolidate control over tax revenues and to apply the enhanced revenues to fund fiscal redistribution transfers. At the same time, modernization of the economy and the influx of foreign investment have created pressure to revamp tax laws and tax administration so both resemble more closely western market economy norms. These processes may lead to an irreversible shift of fiscal power from provincial governments to the central government and a consequent consolidation of political power, changing forever the political economy of modern China. For over half a century in more than a dozen books and 600 philosophical articles Kai Nielsen has developed and defended a radically egalitarian theory of social justice as well as a political vision demanding a democratic, humane form of socialism and, on an international level, a federative world socialist government embodying these values. In Globalization and Justice Nielsen applies his acute analytical abilities and his substantive theories and views to the present ongoing reality of corporate, capitalist globalization, (...) arguing that this sort of globalization is unjust in that it further disadvantages the developing world. He then argues for an alternative sort of globalization, a process that he believes could and should have, as its end goal, a democratic and humane socialist government and society on a world-wide scale. In response to globalization, is there to be a single, homogeneous set of aesthetic values governing the production and consumption of art? I focus on a newcomer to globalized contemporary art, China, and argue that artworld art is far from the only art currently being produced. I describe four connected kinds of art currently made in China: Modernist, traditional, and avant-garde, which are artworld art, and mass commercial, which is not. Practices in all four conform to expectations globally that (...) Chinese art of all kinds should exemplify imitation, emulation, and copying. Such conformity entails what Winnie Wong has termed ‘staging Chineseness’. I conclude with an examination of this process in two recent exhibitions before proposing that a proliferation of a variety of values is unavoidable while contemporary artworld practitioners continue to introduce local concerns, and while the self-claimed high status of artworld art is progressively challenged by the vitality worldwide of non-artworld art. While some of these values are resistant to Western globalizing homogenization, others conform to it. (shrink)

ABSTRACT:This article examines the presuppositions and theoretical frameworks of the “new-wave” “Post-Westphalian” approach to international business ethics and compares it to the more philosophically oriented moral theory approach that has predominated in the field. I contrast one author’s Post-Westphalian political approach to the human rights responsibilities of transnational corporations (TNCs) with my own “Fair Share” theory of moral responsibility for human rights. I suggest how the debate about the meaning of corporate human rights “complicity” might be informed by the fair (...) share theory. While I point out that Post-Westphalians and moral philosophers may have fundamental disagreements about basic concepts such as legitimacy, justice, and democratic deliberation, I conclude that the Post-Westphalians have made a major contribution to the expansion of the field by presenting business ethicists with an opportunity to inform and guide debates about the potential future course of transnational governance. China does not have a federalist system of government. Nevertheless, with deepening reform and openness, China's political system in terms of central–local relations is functioning more and more like federalism. Federalism as a functioning system in China has been understudied. This paper defines the political system existing in China as defacto federalism, and attempts to explore the sources and dynamics of this defacto federalism. China's defacto federalism was mainly driven by two related factors, i.e. decentralization and globalization. This paper (...) argues that while economic decentralization in the 1980s led to the formation of defacto federalism, globalization since the 1990s has accelerated this process and generated increasingly high pressure on the Chinese leadership to institutionalize existing defacto federalism. The rapid development and diffusion of scientific and technological developments across national borders are creating new realms of international health concern, such as aspects of biomedical science, including human reproductive cloning, (...) germ-line therapy, and xenotransplantation, as well as environmental health problems, including climate change, biodiversity loss, and depletion of the ozone layer. Growth in international trade and travel, in combination with population growth, has served to increase the frequency and intensity of health concerns bypassing or spilling over sovereign boundaries.Although health has traditionally been seen an area of limited multilateral cooperation, there is growing awareness that contemporary globalization has led to the proliferation of cross border determinants of health status and is undermining the capacity of nation states to protect health through domestic action alone. For at least the past several decades, judges around the world have been looking beyond their own states' jurisprudence to international law and the decisions of foreign courts in order to apply domestic law, part of a phenomenon Anne-Marie Slaughter calls "judicial globalization.".

This article discusses the manipulation and measurement of levels of situational self-focus, which is generally labeled ''self-awareness.'' A new scale was developed to quantify levels of public and private self-awareness. Five studies were conducted to assess the psychometric properties, reliability, and validity of the Situational Self-Awareness Scale (SSAS). The SSAS was found to have a reliable factor structure, to detect differences in public and private self-awareness produced by laboratory manipulations, and to be sensitive to changes in self-awareness within individuals over (...) time and across situations. The SSAS can be used as a manipulation check of laboratory self-awareness manipulations and as a means of assessing naturally occurring fluctuations in public and private self-awareness in order to clarify the relation between self-awareness and other variables (e.g., mood and memory). 35 million people die annually of non-communicable diseases (NCDs), 80% of them in low- and middle-income countries — representing a marked epidemiological transition from infectious to chronic diseases and from richer to poorer countries. The total number of NCDs is projected to rise by 17% over the coming decade, absent significant interventions. The NCD epidemic poses unique governance challenges: the causes are multifactorial, the affected populations diffuse, and effective responses require sustained multi-sectorial cooperation. The authors propose a range of (...) regulatory options available at the domestic level, including stricter food labeling laws, regulation of food advertisements, tax incentives for healthy lifestyle choices, changes to the built environment, and direct regulation of food and drink producers. Given the realities of globalization, such interventions require global cooperation. In 2011, the UN General Assembly held a High-level meeting on NCDs, setting a global target of a 25% reduction in premature mortality from NCDs by 2025. Yet concrete plans and resource commitments for reaching this goal are not yet in the offing, and the window is rapidly closing for achieving these targets through prevention — as opposed to treatment, which is more costly. Innovative global governance for health is urgently needed to engage private industry and civil society in the global response to the NCD crisis. (shrink)

From climate change, debt, and refugee crises, to energy security, environmental disasters, and terrorism, the events that lead nightly newscasts and drive public policy demand a global perspective. In the twentieth century the world sought solutions through formal institutions of international governance such as like the United Nations, the International Criminal Court, and the World Bank, but present-day our responses to global realities are often more provisional, improvisational, and contingent. Tracing this uneven history in order to identify principal actors, (...) contesting ideologies, and competing rhetoric, Negative Cosmopolitanism challenges the Kantian ideal of cosmopolitanism as the precondition for a perpetual global peace. After experiments with various economic systems, we appear to have conceded, to misquote Winston Churchill that "free enterprise is the worst economic system, except all the others that have been tried." Affirming that conclusion, I shall argue that in today's expanding global economy, we need to revisit our mind-sets about corporate governance and leadership to fit what will be new kinds of free enterprise. The aim is to develop a values-based model for corporate governance in this age of (...) globalization that will be appropriate in a variety of challenging cultural and economic settings. I shall present an analysis of mental models from a social constructivist perspective. I shall then develop the notion of moral imagination as one way to revisit traditional mind-sets about values-based corporate governance and outline what I mean by systems thinking. I shall conclude with examples for modeling corporate governance in multi-cultural settings and draw tentative conclusions about globalization. (shrink)

This paper considers the impact that globalization and the knowledge economy have on the protection and promotion of indigenous knowledge. It is asserted that globalization and the knowledge economy have opened up the world and facilitated the flow of information and knowledge. However, the flow of knowledge has been governed by uneven economic and political power between the developed countries and the devel-oping countries. This has a number of ramifications for IK. The dilemma faced is that whichever method (...) is taken to protect IK exposes IK to some misappropriation. Protecting it through IPR is also fraught with problems. Documenting IK exposes IK to the public domain and makes it that much easier to be misused. However, not protecting IK runs the danger of having it disappear as the custodians holding it die off, or as communities become swamped by the effects of globalization. The conclu-sion therefore is that governments have to take more interest in protecting, promoting and using IK than they have been doing. (shrink)

This paper posits that differences in corporate governance structure partly result from differences in institutional arrangements linked to business systems. We developed a new international triad of business systems: the Anglo-American, the Communitarian and the Emerging system, building on the frameworks of Choi et al. (British Academy of Management (Kynoch Birmingham) 1996, Management International Review 39, 257–279, 1999). A common factor determining the success of a corporate governance structure is the extent to which it is transparent to market (...) forces. Such transparency is more than pure financial transparency; as it can also be based on factors such as governmental, banking and other types of institutional transparency mechanism. There may also be a choice for firms to adopt voluntary corporate disclosure in situations where mandatory disclosure is not established. The Asian financial crisis of 1997–1999 and the more recent corporate governance scandals such as Enron, Andersen and Worldcom in the United States and Ahold and Parmalat in Europe show that corporate governance and business ethics issues exist throughout the world. As an illustration we focus on Asia’s emerging1 markets, as, both in view of the pressure of globalization and taking into account the institutional arrangements peculiar to the emerging business system, these issues are important there. Particularly for those who have to find an accommodation between the corporate governance structures and disclosure standards of the Emerging system and those of the Anglo-American and Communitarian systems. Does globalization undermine the fiscal basis of the welfare state? Some observers are not convinced. They claim that aggregate data on Organization for Economic Cooperation and Development countries show no drop in tax levels and conclude from this that tax competition is not a serious challenge for the welfare state. This conclusion is unwarranted. The article shows that tax competition systematically constrains national tax autonomy in a serious way. This paper focuses on how African national leaders can make global democracy relevant to sustainable development in Africa. Seeing the problem of sustainable development in Africa from the structural and functional angles, this paper begins with an introduction and a clarification of terms such as ‘democracy’, ‘globalization’ and ‘development’. It then analyzes the underlying foundations of global democracy and its implications to cultures of the African peoples. This paper tries to place the impact of global democracy on Africa in (...) perspectives by weighing the pros and cons of global democracy. Tracing the genesis of functional and developmental problems in the post-colonial Africa to structural problems occasioned by Africa’s colonial experience, this paper however strongly contends that the main problem militating against sustainable development in the post-colonial Africa is bad politics and mismanagement of national resources. African peoples need to be taught that some of the African national leaders are responsible for the bad condition of underdevelopment in the global period because of bad political governance ranging from the inability of African leaders to calculate all the relevant factors in the making of their policies as well as failing to provide effective technologies and competent staff to deal with rigging of elections and other electoral problems in addition to corruption and mismanagement of public funds. There is no way for the African nations to survive without production of goods and services in terms of farming, agriculture and diversification of their revenue base. National leaders of the various African nations cannot avoid policies that enable the industrialization of African nations through the provision of the basic infrastructures and viable amenities for social, economic, and political development. They should however be wary of debt traps of International Monetary Fund and World Bank because borrowing nations are often given difficult conditions that often make it difficult for them to obtain the desired benefits in terms of sustainable development. The study recommends that for sustainable development to take place in Africa there is need for national leaders to embrace good political governance that places the people at the centre of development to be manifested in guileless electoral process and effective management of the resources. This paper contends that the realization of sustainable development in African nations requires moral, political, and economic integration. This is called opportunism. Williamson (1985) defined opportunism as “self-interest seeking with guile.” It can wreak havoc with companies, customers, stock markets and economies and is demonstrated regularly in press accounts of misstatements on financial reports and other ways senior managers use their positions to enhance their personal wealth and influence.This paper will focus on the ethical issues surrounding business relationships and how Confucianism, with its focus on trust, reciprocity and mutual benefit in relationships, can offer a moral foundation to the inter-firm arrangements that are so much a part of the contemporary business landscape. Globalization arguably generated a governance gap that is being filled by transnational rule-making involving private actors among others. The democratic legitimacy of such new forms of governance beyond nation states is sometimes questioned. Apart from nation-centered democracies, such governance cannot build, for example, on representation and voting procedures to convey legitimacy to the generated rules. Instead, alternative elements of democracy such as deliberation and inclusion require discussion to assess new instruments of governance. The recently published (...) standard ISO 26000 is an interesting example of transnational governance. ISO 26000 was developed in a lengthy multiorganizational process for the purpose of giving guidance on the social responsibility of organizations. By assessing the specific case of ISO 26000, this study sheds light on the question of how legitimacy beyond nation-state democracy is ensured or constricted. Centering on the idea of deliberate democracy and democratic legitimacy, the study offers in-depth insights on the normative legitimacy of the development process of ISO 26000. Positioned on the interface of business studies and public policy, this article contributes to the academic literature on transnational governance and on the role of multistakeholder processes in shaping the role of business in society.
