Hobbes says a great deal about the rights of subjects, particularly in Leviathan, and yet, despite his apparent insistence on the importance of the rights of the subject, the prevailing view amongst modern Hobbes scholars has been that rights of Hobbesian subjects are weak. The dominant view of Hobbesian rights as weak and insignificant is the view of modern Hobbes scholarship, which analyses Hobbes's political theory at great distance from his intellectual milieu and from the dramatic political events of the (...) time. Hobbesian absolutism is understood to rule out rights of any strength or significance on the part of Hobbesian subjects and particularly, any rights held against the sovereign. The significance of defining subjects' rights as Hohfeldian liberty rights is that liberty rights lack any correlative duties on the part of others. The sovereign's authority and right to rule are made dependent on his ability and willingness to protect the subjects' aggregate right to self‐preservation. (shrink)

This volume compiles writings by leading moral theologians and ethicists on an important, emerging topic in the field of ethics. As spirituality asserts its broad humanistic interdisciplinarity, and moral theology emerges from its fixation on sin to address broader questions of human formation and Christian discipleship, the need for the two disciplines to be in dialogue is clear.

Two philosophers, Robert Spaemann and Henri Gouhier, have identified a similarity between Fénelon and Kant in the prominence of motive in their thought: disinterestedness in Fénelon's pure love and in Kant's good will. Spaemann emphasizes their common detaching of the ethical in terms of motivation from the context of happiness. In this article I explore further similarities and differences under the topics of perfectionism, pure love, good will, happiness, and disinterestedness, as these are pertinent to their thought. On perfectionism there (...) appears a stark contrast; on pure love over against good will, on happiness, and on disinterestedness, however, there seems a balance between likenesses and differences. In Curran's latest book, Diverse Voices in Modern US Moral Theology, he presents the twelve leading voices of Catholic Moral Theology (CMT) from the early twentieth century to the present. (One could argue that Curran, himself, should be in this book.) The book discusses key individuals, and one movement that included multiple people, in the development of the field to show how it has evolved. The New Wine, New Wineskins movement was included because the movement was led by (...) lay people, showing how dramatically the face of CMT changed. The book provides overviews of the major figures in CMT without offering critique in order to foster a dialogue between liberal and conservative approaches to MT, and demonstrates that one's approach to CMT is very rooted in one's historical circumstances--called Sitz-im-Leben in the field. It is the last aim that provides the main argument for the book; that CMT has changed and each of these theologians have shifted thinking largely because of the historical context in which they wrote. Curran also shows that those on opposing sides of the debates in moral theology have become more divided and urges in his conclusion that they have more conversations with each other and not just discussions within each side. A vivacious biography of the prophetic and sympathetic philosopher who along with Voltaire and Rousseau built the foundations of the modern world, and travelled as far as Russia to enlighten the Tsarina Catherine the Great. Denis Diderot is often associated with the decades-long battle to bring the world's first comprehensive Encyclopédie into existence. But his most compelling and personal writing took place in the shadows. Thrown into prison for his atheism in 1749, Diderot decided to reserve his most daring books (...) for posterity-for us, in fact. In the astonishing cache of unpublished writings that he left behind after his death, Diderot dreamed of natural selection before Darwin, the Oedipus complex before Freud, and genetic manipulation centuries before Dolly the Sheep was born. Lockdown measures in response to the COVID-19 pandemic involve placing huge burdens on some members of society for the sake of benefiting other members of society. How should we decide when these policies are permissible? Many writers propose we should address this question using cost-benefit analysis, a broadly consequentialist approach. We argue for an alternative non-consequentialist approach, grounded in contractualist moral theorising. The first section sets up key issues in the ethics of lockdown, and sketches the apparent appeal of addressing (...) these problems in a CBA frame. The second section argues that CBA fundamentally distorts the normative landscape in two ways: first, in principle, it allows very many morally trivial preferences—say, for a coffee—might outweigh morally weighty life-and-death concerns; second, it is insensitive to the core moral distinction between victims and vectors of disease. The third section sketches our non-consequentialist alternative, grounded in Thomas Scanlon’s contractualist moral theory. On this account, the ethics of self-defence implies a strong default presumption in favour of a highly restrictive, universal lockdown policy: we then ask whether there are alternatives to such a policy which are justifiable to all affected parties, paying particular attention to the complaints of those most burdened by policy. In the fourth section, we defend our contractualist approach against the charge that it is impractical or counterintuitive, noting that actual CBAs face similar, or worse, challenges. (shrink)

Thus they are not of divine appointment and their power, in any case limited by Scriptural precept and natural law, is strictly circumscribed. Since they are placed in their position by men, they can be judged and deposed by men if they misuse their power. Throughout his career Ockham (...) violently repudiated the Avignonese papacy because it "professed errors and manifest heresies" and practiced injustice both in Church and state. He likewise regarded the college of cardinals as a purely human administrative institution and denied that they, along with the pope, were successors of the apostles. Since the Roman Church as well as the general Council could err, Ockham held that on occasion it is necessary to defend the true faith against the Roman Church, the pope, the general Council, and all the bishops and clergy (p. 277). The chief bond of Christians is the true faith. This is found both in the Scriptures and in tradition. This faith is to be maintained in its purity by true popes and general Councils. Their fidelity to the faith is the only guarantee of their authority. Therefore, a denial of, or a deviation from, the orthodox faith is heresy which he regarded as the major crime. De Lagarde severely criticizes Ockham by claiming that he reduced the Church to an aggregate of individuals bound together by common faith alone. This was destructive of the Church considered as a hierarchical and ~cramental institution. He traces Ockham's influence upon the dominant personalities of the subsequent decades all the way to Luther. The outstanding nominalists like Pierre d'Ailly and Jean Gerson, and reformers like Dietrich of Niem, John Wyclif, and John Huss, were either his professed disciples or were deeply influenced by Ockham. It may be remarked that the two last-named thinkers can hardly be included in this category: de Lagarde was either poorly informed or biased. For although he quotes in his support the two-volume works of Dora Paul de Vooght (L'h~rgsle de Jean Huss and Huss/ana), he ignores the general characterizations and the careful distinctions de Vooght makes between the positions of these two men, and repeats the uncritical views against which de Vooght energetically protests. It may also be added that the author omits a bibliography which is essential to a work of this kind. Nevertheless, his work is a massive and enlightening contribution to the hitherto neglected study of the post-Thomistic thinkers of the fourteenth century, among whom William of Ockham occupies a dominant place. While it is true that this parallelism cannot be drawn too closely, the similarity of the cultural forces facing both eras is instructive. This parallel suggests the importance of the resurgence of Hermetic gnosticism during the period from the fifteenth through the seventeenth centuries for an understanding of the religious and scientific developments taking place at this time. It is to this point that Profes~r Yates has written a major work of scholarship in the history of ideas. The importance of the Hermetic tradition in the intellectual framework of Renaissance religion and science is placed in its historical evolution from the time of the recovery of the texts and their translation into Latin by Ficino until its gradual decay in the seventeenth century after the correct dating of the texts by Isaac Casaubon. Obviously with so broad an undertaking it would be impossible to treat adequately in one volume the philosophical import of the ideas of the Hermetic texts and their development. Professor Yates wisely chooses Giordano Bruno as the focal point for her penetrating analysis of the Hermetic tradition as a philosophical movement. She contends that a comparative study of religious ethics—in which (...) students explore the ethical decisions they face every day within the context of a range of religious traditions—will draw them into exploring not only their own moral sensibilities but also those religious traditions. I submit that her textbook accomplishes exactly that.No stranger to textbooks in religious ethics, Christine Gudorf has presented us with a well-organized book. The initial chapter is fairly traditional in its approach to the question of ethical method. She rehearses the same threefold pattern found in most textbooks centering on rules, ends, and virtues. Gudorf does much more with rule-based ethics than with teleological ethics, giving the impression that religious ethics is fundamentally rule-based. While this may be true to some degree, there has been far more attention given to teleology in religious ethics than she acknowledges. Her emphasis on connecting theological and religious frameworks to social analysis is helpful and reflects the orientation of many who teach undergraduates in this area. A weakness of the book is that some chapters connect the religious traditions with ethical issues more directly than others. While I tend to be in agreement with much of Gudorf’s own perspective, I sensed at times that she could have made more direct connections between ethical issues and particular religious tradition’s ethical teachings. I might also note that at points the social analysis was a bit long—especially in discussing the history of certain ideas—which might be boring for some undergraduates.Gudorf covers topics that have more experiential relevance for undergraduates than is usually found in social ethics textbooks. This is a good thing because it enables her to cover issues that have the most interest for undergraduates. By drawing on what they are interested in, this textbook is able to lead them into an analysis of the structural components of these issues (rather than zoning out, as undergraduates are prone to do). For the most part, the chapters treat each issue evenly, although the chapter on clothing is a bit short. While there [End Page 236] might be some topics I would like to see added, no text can adequately address everything.The author has a great deal of expertise with case studies, and for the most part the case studies she includes are helpful primarily because their narrative structure and length lend themselves to more sustained and nuanced discussion. The discussion questions, film suggestions, and web resources at the end of each chapter are helpful pedagogical aids. The addition of a glossary is important, but I am glad that she explains most of the terms in the chapters (most students do not take the time to review the glossary).Undergraduates will be able to understand the material Gudorf covers in this book because it connects well with the issues they face on a daily basis. In bringing in her own perspective and experiences as she deliberates about ethical issues—I especially like the discussion of what to do with the homeless on street corners—Gudorf makes this book a bit more distinctive and personal than some other textbooks that attempt to be more “objective.” In all likelihood, I will use this book in my comparative religious ethics class. While these approaches do, in fact, deal with some of the effects of homelessness, they not only fail to address the structural (...) causes of homelessness and poverty but they also reinforce certain ideological assumptions—such as individualism, a pattern of “blaming the victim,” and idyllic conceptions of home ownership—that keep us from addressing the [End Page 214] causes of homelessness in the first place. If we are really going to end homelessness, Stivers contends, we have to address the structural issues that keep people homeless, such as the inadequate availability of low-incoming rental housing, unemployment, low wages, and increasing inequality between rich and poor. If Christians and churches want to end homelessness, they must collaborate more fully and develop social movements that will address the full range of factors affecting homelessness, including causes and effects. In other words, they must embody in principle and in practice not only hospitality and compassion but also social justice. The place to begin, Stivers argues, is by listening to the homeless and the poor, allowing their experiential realities to set the agenda, and working in solidarity with them to disrupt the ideologies and to challenge the policies that perpetuate the problem.This requires an education in “disruption” that enables Christians to move beyond the behavioral manifestations of homelessness so that they can see the web of oppressive structures that have generated the bonds experienced by so many poor and homeless. Stivers provides a wealth of data that illustrate and document the full extent and complexity of homelessness in our society. Drawing upon Tracy West’s ethical methodology of “disruption,” Stivers then brings to light what she considers the dominant ideological assumptions that sustain homelessness. These include the assumptions that homeowners are responsible, autonomous citizens while the homeless are deviant, dependent, and criminal; and further that excessive wealth and inequality is justified. Stivers illustrates how these assumptions fail to consider certain factors—such as power, privilege, and racial and class disparities—that underlie and perpetuate the problems of homelessness and promote private over public policies to address them. To address these factors, Stivers argues for a different approach—modeled on such groups as the Industrial Areas Foundation and the PICO (People Improving Communities through Organizing) National Network—that embodies community organizing principles that engage the victims of homelessness in meaningful dialogue about the problems, actively listens to their stories and to their solutions, and works in solidarity with them to address the causes and the policies that perpetuate their homelessness.The audience for this book is Christians and churches seeking to address the issue of homelessness in our nation. Ethicists and Christians of like mind will have few problems with Stivers’s diagnosis of and remedy for homelessness, even if her remedy comes across as a bit utopian at places. Nonetheless, her rhetoric of empowerment, solidarity, social justice, and sustainability might drive away those of a more conservative theological bent. Since many involved in ministry to the homeless today presuppose precisely the assumptions she challenges, I am not sure she has done enough to convince them to change their approach, even though she attempts to ground her approach [End Page 215] biblically in the life and ministry of Jesus. Stivers is correct in asserting that substantive change will only come about as a result of a concerted social movement that involves churches of all theological stripes. While unionization rates have steadily declined in the United States, there has been a renewal of grassroots labor organizing—in many cases connected in some way with religious communities. Attending to such organizing efforts holds the potential to deepen religious-ethical reflection on questions of labor, and these religious-ethical reflections hold the potential to enrich on-the-ground organizing efforts. These opportunities have largely been overlooked. On the one hand, while scholars have recently explored connections between religious ideas and economic ideas, they have often (...) neglected questions of labor. On the other hand, labor studies scholars have often ignored the role of religion, although this is beginning to change. In this introduction we limn the resources available for religious-ethical reflection on questions of labor and we propose a direction that the field could take, bringing together engagement with religious traditions and attunement to grassroots organizing. The development of technologies for gene editing in the wild has the potential to generate tremendous benefit, but also raises important concerns. Using some form of public deliberation to inform decisions about the use of these technologies is appealing, but public deliberation about them will tend to fall back on various forms of heuristics to account for limited personal experience with these technologies. Deliberations are likely to involve narrative reasoning—or reasoning embedded within stories. These are used to help people discuss (...) risks, processes, and fears that are otherwise difficult to convey. In this article, we identify three forms of collective narrative that are particularly relevant to debates about modifying genes in the wild. Our purpose is not to privilege any particular narrative, but to encourage people involved in deliberations to make these narratives transparent. Doing so can help guard against the way some narratives—referred to here as “crafted narratives”—may be manipulated by powerful elites and concentrated economic interests for their own strategic ends. Many popular business strategies, such as re-engineering, core competency, and value engineering, may achieve short-term profits by antagonizing workers and alienating customers. We contend that self-actualized companies must create an ethical business environment grounded in three ethical principles. To suggest these principles, which characterize all "volitionist companies", we first review two typical problems and the questionable ways that some companies resolved them. Then, we discuss these principles and compare "volitionism" to three well- known normative ethical theories. Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers. Documenting capacity assessments and identifying substitute decisionmakers in healthcare facilities is ethically required for optimal patient care. Lack of such documentation has the potential to generate confusion and contention among patients, their family members, and members of the healthcare team. An overview of our research at the Ottawa Hospital and issues that influence the consistency of documentation in the Canadian context are presented here, as well as ideas for the mitigation of these issues and ways to encourage better documentation.

This paper explores the role of ideology in attempts to influence public policy and in business representation in the EU–China solar panel anti-dumping dispute. It exposes the dynamics of international activity by emerging-economy multinationals, in this case from China, and their interactions in a developed-country context. Theoretically, the study also sheds light on the recent notion of ‘liability of origin’, in addition to the traditional concept of ‘liability of foreignness’ explored in international business research, in relation to firms’ market and (...) political strategies and their institutional embeddedness in home and host countries. Through a qualitative analysis of primary and secondary materials and interview data with key protagonists, we provide a detailed evolution of the case, the key actors involved and their positions, arguments and strategies. This illustrates the complexities involved in the interaction between markets and ideologies in the midst of debates regarding different forms of subsidy regimes for renewable energy, free trade versus protectionist tendencies by governments, and the economic and sustainability objectives of firms and societies. The case shows how relative newcomers to the EU market responded to overcome a direct threat to their business and became, with support from their home government, active participants in the public debate through interactions with local commercial partners and non-governmental organisations. Firms adopted relatively sophisticated strategies to reduce their liabilities vis-à-vis host-country institutions and local stakeholders, including collective action, to increase their legitimacy and reputation, and counter ideologically based attacks. Ethics consultation services provide support to staff, patients, and family members who find themselves in morally difficult situations in healthcare settings. Not unlike other clinical consultation services, ethics consultation activities should be well documented. Good documentation allows for evaluation of the consultation process and the ability to refer back to consults when needed, and provides data for future research in healthcare ethics (HCE).In our exploration of existing HCE documentation systems, we identified two main points of interest. First, HCE information documentation (...) systems are powerful tools for providing information on ethics consultation services. These documentation systems can be used to produce detailed reports on various HCE activities both institutionally and cross-institutionally. Second, our findings indicate greater agreement in the language and terminology of HCE needs to be established. Cultivation of such common language is needed in order to develop a standard healthcare ethicists can use to document and categorize consults. Standardization of language would allow data to be readily comparable and lead to more consistency in documentation of ethics consultations. Ultimately, standardization of documentation can also constitute a standard of practice for HCE in general. The development of such standards is essential for any developing profession, and will be required for HCE as it moves in towards professionalization in Canada. (shrink)

In this article, we aim to map out the complexities which characterise debates about the ethics of vaccine distribution, particularly those surrounding the distribution of the COVID-19 vaccine. In doing so, we distinguish three general principles which might be used to distribute goods and two ambiguities in how one might wish to spell them out. We then argue that we can understand actual debates around the COVID-19 vaccine – including those over prioritising vaccinating the most vulnerable – as reflecting disagreements (...) over these principles. Finally, we shift our attention away from traditional discussions of distributive justice, highlighting the importance of concerns about risk imposition, special duties, and social roles in explaining debates over the COVID-19 vaccine. We conclude that the normative complexity this article highlights deepens the need for decision-making bodies to be sensitive to public input. (shrink)

This article addresses gender differences in laughter and smiling from an evolutionary perspective. Laughter and smiling can be responses to successful display behavior or signals of affiliation amongst conversational partners—differing social and evolutionary agendas mean there are different motivations when interpreting these signals. Two experiments assess perceptions of genuine and simulated male and female laughter and amusement social signals. Results show male simulation can always be distinguished. Female simulation is more complicated as males seem to distinguish cues of simulation yet (...) judge simulated signals to be genuine. Females judge other female’s genuine signals to have higher levels of simulation. Results highlight the importance of laughter and smiling in human interactions, use of dynamic stimuli, and using multiple methodologies to assess perception. (shrink)
