Foreign nationals who marry U.S. citizens have an expedited track to naturalization. U.S. immigration officials require that “green card” petitioning couples demonstrate that their relationships are “valid and subsisting” and not fraudulent. These requirements are ostensibly gender and racially neutral, but migration itself is not; men and women petitioners seek partners in different regions and solicit advice from similar others about the potential obstacles to their petitions’ success. Using an online ethnography and textual analysis of conversation threads on a large (...) online immigration forum where U.S. petitioners exchange such information, I examine how gendered standards of legitimacy are applied to family and sexuality and used discursively among petitioners to achieve genuineness and define red flags indicating potential marriage fraud. I argue that forum members police immigration requests even before cases reach an immigration officer. Petitioners use the formal criteria of U.S. immigration in ways that reveal gender ideologies, expectations for conformity to a gendered hegemonic family ideal, and sexual double standards surrounding sexual agency, fertility, and desirability. These intersectional norms shape members’ online discussions about the suitability of marriages and of the migration of noncitizen partners to the United States. (shrink)

Background: Family members are often required to act as substitute decision-makers when health care or research participation decisions must be made for an incapacitated relative. Yet most families are unable to accurately predict older adult preferences regarding future health care and willingness to engage in research studies. Discussion and documentation of preferences could improve proxies' abilities to decide for their loved ones. This trial assesses the efficacy of an advance planning intervention in improving the accuracy of substitute decision-making and increasing (...) the frequency of documented preferences for health care and research. It also investigates the financial impact on the healthcare system of improving substitute decision-making. Methods/DesignDyads (n = 240) comprising an older adult and his/her self-selected proxy are randomly allocated to the experimental or control group, after stratification for type of designated proxy and self-report of prior documentation of healthcare preferences. At baseline, clinical and research vignettes are used to elicit older adult preferences and assess the ability of their proxy to predict those preferences. Responses are elicited under four health states, ranging from the subject's current health state to severe dementia. For each state, we estimated the public costs of the healthcare services that would typically be provided to a patient under these scenarios. Experimental dyads are visited at home, twice, by a specially trained facilitator who communicates the dyad-specific results of the concordance assessment, helps older adults convey their wishes to their proxies, and offers assistance in completing a guide entitled My Preferences that we designed specifically for that purpose. In between these meetings, experimental dyads attend a group information session about My Preferences. Control dyads attend three monthly workshops aimed at promoting healthy behaviors. Concordance assessments are repeated at the end of the intervention and 6 months later to assess improvement in predictive accuracy and cost savings, if any. Copies of completed guides are made at the time of these assessments. DiscussionThis study will determine whether the tested intervention guides proxies in making decisions that concur with those of older adults, motivates the latter to record their wishes in writing, and yields savings for the healthcare system. The relationships between captive primates and their caregivers are critical ones and can affect animal welfare. This study tested the effect of caregivers using chimpanzee behaviors or not, in daily interactions with captive chimpanzees. In the Chimpanzee Behavior condition the caregiver presented chimpanzee behaviors. In the Human Behavior condition the caregiver avoided using chimpanzee behaviors. The chimpanzees had individual patterns of response and had significant differences in their responses to each condition. These data are compared to a similar study conducted (...) at The Zoo Northwest Florida. Both groups of chimpanzees were sensitive and responsive to the differences in conditions. In an effort to build interest in the two-year old service learning center and to fulfill its mission to integrate academic life with service in thoughtful and relevant ways, a competition was held to award developmental grants to faculty to create innovative courses incorporating service learning. The winning proposal from the business school used a business ethics course as the vehicle for formally introducing service into the business curriculum. Recently, calls have grown louder for more stakeholder democracy that is, letting stakeholders participate in the process of organizing, decision‐making, and governance in corporations, especially in the area of Corporate Social Responsibility (CSR) activities. Despite the relevance of the subject, the impact of customer involvement in CSR on their company‐related attitudes and behaviors still represents a major research void. The paper at hand develops a conceptual framework of consumer involvement in CSR based on the existing literature, theories of stakeholder democracy, (...) and organizational boundaries as well as drawing from the qualitative focus group interviews (N = 24). The framework is tested on a large scale, two‐time point field‐experimental study (N = 3,397). More specifically, consumer reactions to three degrees of customer involvement (i.e., information, feedback, and dialogue) are tested in two different CSR domains (i.e., company‐internal business process vs. company‐external philanthropic CSR). Results indicate that the customer involvement in CSR has a more beneficial effect in terms of strengthening customer outcomes in CSR domains that directly affect external stakeholders of the company (i.e., philanthropic CSR) than in domains that mainly concern company‐internal stakeholders (i.e., business process CSR). Games and simulations--from quantitative modeling to immersive, experiential scenarios--as methods for engagement within futures studies have a substantial history. In recent years, there has been a surge of projects using a wide array of tools. As practitioners and researchers have gravitated toward more playful approaches, there is a need to review and evaluate such approaches. This chapter provides an introduction to gaming and simulations as anticipatory processes. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. The method of metaphysics of scientific practice consists in developing metaphysical claims on the basis of empirical information from and about scientific practice. This method stands in the tradition of naturalistic or scientific metaphysics on the one hand, and philosophy of science in practice on the other. In this chapter we draw on some of our own research to specify the method at work. We argue that the method is typically carried out in four steps: identifying the available empirical information (...) that might be relevant to the metaphysical topic of interest; selecting the relevant empirical information; developing a preliminary metaphysical claim that the relevant empirical information supports; mutually adjusting empirical information and metaphysics. We reveal some major methodological challenges and present ways to overcome them. We conclude that when drawing metaphysical claims from scientific practicewe need to: first, make sure that our previous metaphysical views do not influence the empirical information or its selection in problematic ways; second, explain in what sense we are doing metaphysics, countering for instance the idea that metaphysical claims must be highly general and transdisciplinary. We end the chapter by pointing to the advantages of the method of metaphysics of scientific practice. (shrink)

Films That Spill is a comprehensive study of the Cinema of Transgression, a hitherto under-examined moment in US underground film culture. Reconsidering the concept of transgressive cinema not only as a description of the intentionally provocative content of the films, but rather as a feature of a cross-disciplinary practice, the book explores how filmmaking in the context of the vibrant and intermingling art, music, performance, and film scenes in 1980s Lower Manhattan spilled over the boundaries of artistic disciplines, media formats, (...) and content concepts. This study not only provides a microhistory of these scenes and insight into their afterlife in archives and exhibitions. It also represents an innovative contribution to debates within film, media, and visual culture about the methodological and historiographical challenges posed by the expansion of film beyond the discursive boundaries of cinema. The task of giving some sort of interpretation of Wittgenstein's Remarks on Colour is an extraordinarily difficult one. The book is exceptionally fragmentary. Many of the remarks seem to raise questions that are then left completely unanswered, or to invite us to imagine various circumstances that are then left without any further comment. Although nearly all the remarks are related in one way or another to the problem of colour, the range of topics that Wittgenstein touches on is extremely wide, (...) and covers areas that are not normally mentioned in contemporary philosophical discussions of colour. For example, apart from the familiar ‘Why can't there be a transparent white?’ and ‘Why can't there be a reddish-green?’, he asks ‘Can a transparent piece of glass have the same colour as an opaque piece of paper?’, ‘Is white always the lightest colour?’, ‘Do I see blond hair in the black and white photograph of a blond youth?’, ‘Does it make sense to point to a colour in the iris of a Rembrandt eye and ask for the walls of my room to be painted the same colour?’, ‘Do the colour-blind have the same concept of colour-blindness as the normally sighted?’, ‘Can normal vision be described?’, and so on. BackgroundCountries are increasingly devoting significant resources to creating or strengthening research ethics committees, but there has been insufficient attention to assessing whether these committees are actually improving the protection of human research participants.DiscussionResearch ethics committees face numerous obstacles to achieving their goal of improving research participant protection. These include the inherently amorphous nature of ethics review, the tendency of regulatory systems to encourage a focus on form over substance, financial and resource constraints, and conflicts of interest. Auditing and accreditation programs (...) can improve the quality of ethics review by encouraging the development of standardized policies and procedures, promoting a common base of knowledge, and enhancing the status of research ethics committees within their own institutions. However, these mechanisms focus largely on questions of structure and process and are therefore incapable of answering many critical questions about ethics committees' actual impact on research practices.The first step in determining whether research ethics committees are achieving their intended function is to identify what prospective research participants and their communities hope to get out of the ethics review process. Answers to this question can help guide the development of effective outcomes assessment measures. It is also important to determine whether research ethics committees' guidance to investigators is actually being followed. Finally, the information developed through outcomes assessment must be disseminated to key decision-makers and incorporated into practice. This article offers concrete suggestions for achieving these goals.ConclusionOutcomes assessment of research ethics committees should address the following questions: First, does research ethics committee review improve participants' understanding of the risks and potential benefits of studies? Second, does the process affect prospective participants' decisions about whether to participate in research? Third, does it change participants' subjective experiences in studies or their attitudes about research? Fourth, does it reduce the riskiness of research? Fifth, does it result in more research responsive to the local community's self-identified needs? Sixth, is research ethics committees' guidance to researchers actually being followed? (shrink)

Philosophers have studied mechanisms in many fields in biology. The focus has often been on molecular mechanisms in disciplines such as neuroscience, genetics and molecular biology, with some work on population-level mechanisms in ecology and evolution. We present a novel philosophical case study of individual-level mechanisms, mechanisms in ecology and evolution that concern the interactions between an individual and its environment. The mechanisms we analyze are called Niche Choice, Niche Conformance and Niche Construction (NC3) mechanisms. Based on a detailed analysis (...) of biologists’ research practices, we develop metaphysical claims about the components and organization of NC3 mechanisms, the phenomena they bring about and how these phenomena relate to individual differences, a major explanatory target in the field. We provide reasons for why processes of niche choice, conformance and construction are mechanisms and how they differ from molecular mechanisms underlying individual differences. Finally, we demonstrate that a general representation of NC3 mechanisms is highly abstract, with more specific types of NC3 mechanisms in particular study systems exhibiting more complex components organized in more complex ways. Our case study highlights some distinctive features of individual-level mechanisms in ecology and evolution, such as complex and heterogeneous organization and multiple phenomena. (shrink)

Tichý’s Transparent Intensional Logic (TIL) is an overarching logical framework apt for the analysis of all sorts of discourse, whether colloquial, scientific, mathematical or logical. The theory is a procedural (as opposed to denotational) one, according to which the meaning of an expression is an abstract, extra-linguistic procedure detailing what operations to apply to what procedural constituents to arrive at the product (if any) of the procedure that is the object denoted by the expression. Such procedures are rigorously defined as (...) TIL constructions. Though TIL analytical potential is very large, deduction in TIL has been rather neglected. Tichý defined a sequent calculus for pre-1988 TIL, that is TIL based on the simple theory of types. Since then no other attempt to define a proof calculus for TIL has been presented. The goal of this paper is to propose a generalization and adjustment of Tichý’s calculus to TIL 2010. First, I briefly recapitulate the rules of simple-typed calculus as presented by Tichý. Then, I propose the adjustments of the calculus so that it be applicable to hyperintensions within the ramified hierarchy of types. TIL operates with a single procedural semantics for all kinds of logical-semantic context, be it extensional, intensional or hyperintensional. I show that operating in a hyperintensional context is far from being technically trivial. Yet, it is feasible. To this end, we introduce a substitution method that operates on hyperintensions. It makes use of a four-place substitution function (called Sub) defined over hyperintensions. (shrink)

René Descartes’ conception of the human will has important implications for his conception of human beings as rational and moral agents. Specifically, the will plays a significant role in his views on what control we have over our beliefs; what kind of freedom we enjoy; how our emotions affect our actions, and how we can moderate our emotions. I explore these issues in three contexts that arise throughout Descartes’ corpus, from his earliest significant work, Rules for the Direction of the (...) Mind (the Regulae, 1619-1628), to his last published work, The Passions of the Soul (1649). I begin with the question of why Descartes construes judgment as an operation of the will in the Meditations. This is a change in view from the Regulae. I argue that to understand this change, we need to consider his conceptions of error and activity in the Regulae. I trace the development in his philosophical views about error and activity from the Regulae to the Meditations and show that these commitments underpin his mature theory of judgment. I then turn to Descartes’ conception of freedom in the Fourth Meditation. Descartes’ conception of the will, I argue, figures centrally in his conception of freedom. I show that Descartes holds that freedom is compatible with determination and consists in the power of the will to determine itself. I show, further, that Descartes’ later correspondence helps to clarify and unify his characterization of freedom in the Fourth Meditation: freedom is proportional to the ease of self-determination. Lastly, I consider Descartes’ conception of the relationship between the will and the passions of the soul (the passions). I begin by addressing how the passions affect the will, and I argue for a “bifurcated” approach to the function of the passions. This interpretation holds that the passions affect the will differently depending on what kind of volition results—volitions involved in action or volitions involved in judgment. I then discuss several ways in which Descartes conceives of the passions as problematic. I conclude by exploring three means Descartes prescribes for controlling them: habituation, indirect control, and the regulation of desire. (shrink)

The Kantian idea that some judgments are synthetic even in the area of a priori judgments cannot be accepted in its original version, but a modification of the notions analytic' and 'synthetic' discovers a rational core of that idea. The new definition of 'analytic' concerns concepts and makes it possible to distinguish between analytic concepts, which are effective ways of computing recursive functions, and synthetic concepts, which either define non-recursive functions, or define recursive functions in an ineffective way.
