Gemessen an Bedeutung, Rang und Wirkung steht die Rechtsphilosophie Hegels heute neben den Politiken von Platon und Aristoteles, dem Leviathan von Hobbes und dem Contrat social von Rousseau.Hegels "Grundlinien der Philosophie des Rechts" zählen zu den bedeutendsten Werken der neuzeitlichen Rechts- und Staatsphilosophie. In ihnen entwirft er teils unter Rückgriff auf das frühere ›Naturrecht‹, teils im Blick auf die politische und rechtliche Lage nach der Französischen Revolution und zu Beginn der Restaurationsepoche eine Philosophie des objektiven Geistes. Seit ihrer Erstveröffentlichung im (...) Winter 1820/21 sind die Grundlinien Gegenstand heftiger philosophischer und politischer Auseinandersetzungen gewesen. Unter dem Aspekt der historisch-systematischen Erfassung und Bewertung der Hegelschen Leistung kommt es jedoch zunächst darauf an, den originären Gedanken Hegels klar von der mittelbaren Überlieferung zu trennen, die teils durch die von Eduard Gans für die zweite Ausgabe der Schrift 1833 herangezogenen Vorlesungsnachschriften, teils durch die von ihm vorgenommene Umformung und Umarbeitung dieses Sonderguts zu den sogenannten "Zusätzen" zum Hegelschen Text eigene Wirkung erlangte.Diese Neuausgabe beruht auf dem Text der kritischen Edition G.W.F. Hegel, Gesammelte Werke, Band 14 . Die Studienausgabe der Mitschrift Adolf Heimanns von Hegels letzter Berliner Ästhetikvorlesung im Winter 1828/29 schließt die exemplarische Dokumentation einzelner Quellen aus den Jahren 1820/21, 1823 und 1826 ab. Zudem ist diese Quelle die einzige erhaltene Nachschrift von 1828/29, die H.G. Hotho für die Edition der Ästhetik genutzt hat. Heimanns Mitschrift der letzten Berliner Ästhetikvorlesung informiert über eine Reihe von Neuerungen. Die wohl wichtigste ist die von Hegel eingangs vorgetragene, an der Enzyklopädie von 1827 orientierte, differenzierte Bestimmung der Bedeutung der Kunst (...) für die moderne Welt. An die Stelle einer inhaltlichen Orientierung durch Kunst setzt Hegel die These ihrer Funktion als Stimulans der kritischen Auseinandersetzung mit der abend- und morgenländischen Kultur. American pragmatism, religion, and race form a strange yet generative constellation. Figures like William James, John Dewey, and George Santayana, for instance, famously reimagine religious piety in the aftermath of Darwin’s revolution against traditional metaphysical attachments. For these authors, religiosity does not require a commitment to supernatural powers or agents but can be expressed in gratitude and awe toward the immanent, natural sources of human existence. More recently, pragmatism has been helpful for authors to respond critically to the problem of (...) race within America and modern life more broadly. In response to recent events that demonstrate the persistence of racial trauma, this essay revisits James Baldwin's claim that racism is a symptom of fundamental human tendencies and constraints. For Baldwin, we cannot understand the legacy of racism if we do not take seriously all too human attempts to evade, and deflect, death and its intimations. To flesh out this component of Baldwin's thought, I engage with the thought of Georges Bataille, an author who thinks generally about the fraught relationship (...) between the preservation of life and our responsiveness to suffering. To test the insights that Baldwin provides on racial matters, this essay engages recent discussions in black studies and queer theory around futurity, racial difference, and the category of the human. I maintain that we must think “the human” and racial difference together, as a tension-filled relationship, in order to understand the limits and possibilities regarding our efforts to change the order of things. Many plants are adapted to flower at particular times of year, to ensure optimal pollination and seed maturation. In these plants flowering is controlled by environmental signals that reflect the changing seasons, particularly daylength and temperature. The response to daylength varies, so that plants isolated at higher latitudes tend to flower in response to long daylengths of spring and summer, while plants from lower latitudes avoid the extreme heat of summer by responding to short days. Such responses require a mechanism (...) for measuring time, and the circadian clock that regulates daily rhythms in behaviour also acts as the timer in the measurement of daylength. Plants from high latitudes often also show an extreme response to temperature called vernalisation in which flowering is repressed until the plant is exposed to winter temperatures for an extended time. Genetic approaches in Arabidopsis have identified a number of genes that control vernalisation and daylength responses. These genes are described and models presented for how daylength might regulate flowering by controlling their expression by the circadian clock. In 1839 the working hours of the computers employed on the lunar and planetary reductions of the Royal Observatory, Greenwich were reduced from eleven hours to eight hours. Previous historians have explained this decrease by reference to the generally benevolent nature of the manager of the reductions, George Biddell Airy. By contrast, this article uses the letters and notes exchanged between Airy and the computers to demonstrate that the change in the working hours originated from the computers as a reaction (...) to their poor working conditions. Through the exploration of these archival materials, the article shifts the focus of the analysis to the working experience of the computers, rather than to the administrative history of the project that inevitably tends to highlight Airy's actions. By doing so, the article shows how the computers were treated as a disposable low-skilled workforce, as opposed to aspiring astronomers with considerable mathematical talent. Through this reframing, the article takes a step towards a working history of the observatory. (shrink)

The application of artificial intelligence (AI) to judicial decision-making has already begun in many jurisdictions around the world. While AI seems to promise greater fairness, access to justice, and legal certainty, issues of discrimination and transparency have emerged and put liberal democratic principles under pressure, most notably in the context of bail decisions. Despite this, there has been no systematic analysis of the risks to liberal democratic values from implementing AI into judicial decision-making. This article sets out to fill this (...) void by identifying and engaging with challenges arising from artificial judicial decision-making, focusing on three pillars of liberal democracy, namely equal treatment of citizens, transparency, and judicial independence. Methodologically, the work takes a comparative perspective between human and artificial decision-making, using the former as a normative benchmark to evaluate the latter. -/- The chapter first argues that AI that would improve on equal treatment of citizens has already been developed, but not yet adopted. Second, while the lack of transparency in AI decision-making poses severe risks which ought to be addressed, AI can also increase the transparency of options and trade-offs that policy makers face when considering the consequences of artificial judicial decision-making. Such transparency of options offers tremendous benefits from a democratic perspective. Third, the overall shift of power from human intuition to advanced AI may threaten judicial independence, and with it the separation of powers. While improvements regarding discrimination and transparency are available or on the horizon, it remains unclear how judicial independence can be protected, especially with the potential development of advanced artificial judicial intelligence (AAJI). Working out the political and legal infrastructure to reap the fruits of artificial judicial intelligence in a safe and stable manner should become a priority of future research in this area. It is argued that a chief obstacle to a naturalistic explanation of the origins of mind is human exceptionalism, as exemplified in the 17th century by Descartes, and in the 20th century by Noam Chomsky. As an antidote to human exceptionalism we turn to the account of aesthetic judgment in Darwin’s Descent of Man, according to which the mental capacities of humans differ from those of lower animals only in degree, not in kind. Thoroughgoing naturalistic explanation of these capacities is (...) made easier by shifting away from the substance-metaphysical implications of the search for an account of mind, toward a dispositional account of the origins of mindfulness. The idea of ‘relations’ being ‘between’ things pushes one into a ‘this’ and ‘that’ (and maybe ‘and the other’) thinking space. In Jacques Derrida's famous words: ‘Deconstruction is justice’. The responsibility of deconstruction is to disrupt those taken‐for‐granted meanings of curriculum discourses by opening them up and releasing them from their metaphysical assumptions to see what or who may have been overlooked, marginalised and omitted in the process of curriculum‐making. The new model of knowledge formulated in The Schools White Paper for the General Certificate in Secondary Education examinations (GCSE6) is located within a challenging curriculum framework in which grade boundaries are raised, end‐of‐module examinations are replaced with end‐of‐course examinations and opportunities to re‐sit examinations through the course of the programme of study are removed. English summary: The study of the philosophy of history is currently divided into two largely irreconcilable approaches. The methodological and scientific analysis of historical practice stands opposed to an approach based on the reflection on the historicity of human identity. Previous attempts to overcome this discrepancy have been prevented from seeking recourse in Hegel's historical thought, since it is still seen as representing a substantialist and tangible philosophy of history and therefore as being theoretically obsolete. Max Winter shows that Hegel (...) not only possesses a theoretically sophisticated and formal philosophy of history, but one that is also able to bridge gaps within philosophy of history today, in that it combines an epistemology of historical knowledge with a theory of historical identity. Thomas Arne Winter legt erstmals eine systematische Traditionstheorie vor, die das Wesen hinter den vielfältigen Erscheinungsformen von Tradition ergründet. In kritischer Auseinandersetzung mit Heidegger und Gadamer entwickelt er einen neuen Ansatz, der phänomenologische, hermeneutische und strukturanalytische Verfahren zusammenführt.
