The European Union faced high risks from personal data proliferation to individuals’ privacy. Legislation has emerged that seeks to articulate all interests at stake, balancing the need for data flow from EU countries with protecting personal data: the General Data Protection Regulation. One of the mechanisms established by this new law to strengthen the individual’s control over their data is the so-called “right to be forgotten”, the right to obtain from the controller the erasure of records. In gender (...) class='Hi'>transition, this right represents a powerful form of control over personal data, especially health data that may reveal a gender with which they do not identify and reject. Therefore, it is pertinent to discern whether the right to have personal data deleted—in particular, health data—is ethically acceptable in gender transition. Towards addressing the ethical dimensions of the right to be forgotten in this case, this study presents relevant concepts, briefly outlines history, ethics and law of records considering the evolution from paper to electronic format, the main aspects of identity construction and gender identity, and explores the relationship between privacy, data protection/information control and identity projection. Also, it discusses in gender transition the relation between “the right to self-determination”, “the right to delete”, and “the right to identity and individuality”. Conclusions on the ethical admissibility of the ‘right to be forgotten’ to control gender-affirming information are presented. (shrink)

Les Cent nouvelles nouvelles, recueil rédigé en Bourgogne dans les années 1450, présente un cas singulier de dénudation (nouvelle 45) dont il existe une image dans un manuscrit conservé à Glasgow. Une lavandière transgenre, Mme Marguerite, est accusée de relations sexuelles avec une jeune fille et exposée semi-dénudée sur la place du marché de Rome pour dévoiler son pénis. L’article compare ce cas (...) à d’autres occurrences de procès de personnes transgenres ayant trait à des questions de sexualité. Il compare également ce cas à un fabliau et à une nouvelle de Boccace dans lesquels se posent des questions de transition de genre et de sexualité illégitime. Le cas de Mme Marguerite apparaît comme l’un des jalons d’une histoire longue de la dénudation forcée des personnes transgenres. (shrink)

Biological sex should be “acknowledged” and “accepted”—but which responses to gender dysphoria might this preclude? Trans-identified people may factually acknowledge their biological sex and regard transition as purely palliative. While generally some level of self-deception and even a high level of nonlying deception of others are sometimes justified, biological sex is important, and there is a nontrivial onus against even palliative, nonsexually motivated cross-dressing. The onus is higher against co-opting the body, even in a minor and/or reversible way, (...) to make a false communication concerning one’s sex. Hardest to defend is the destruction of sexual–reproductive functions and causally downstream functions such as lactation: due to the transcendent nature of sexual–reproductive functions, an appeal to the “principle of totality” here is misplaced. This is not to say that social, and milder medical, transition is absolutely excluded even for severe unmanageable dysphoria, nor that subsequent to any transition, detransition is necessarily required. Social media plays an important role in forming, maintaining, and reproducing norms and practices (Flanagan et. al 2008). Content shared on social media has the power to reaffirm certain norms and practices merely by being shared (Caldeira et al., 2018; Burns, 2015; Krijnen & Van Bauwel, 2015). When it comes to questions of identity and questions surrounding representation of certain identity groups in the media, social media content is often taken to play a significant role in the constitution of certain (...) identities (Haimson, 2018, 2021; Frissen et al., 2015; Eickers & Rath, 2021). This chapter specifically explores the role social media plays in trans peoples’ transitioning processes. Transitioning, as understood here, can be social – e.g., performing gender differently via clothing or behavior, using a different name or pronouns – and legal – e.g., changing one’s gender category on formal identification documents, official name changes, and medical – e.g., undergoing hormone replacement therapy or other gender-affirming medical care like gender-reassignment surgeries. Transitioning can encompass all or any combination of these aspects (Bettcher, 2009, 2017). The chapter homes in on the impact that the representation of trans people on social media has on the transitioning processes. Here, questions around bodies and their representation through and with technologies and increasing digitization emerge. One might ask, for example, whether representation on social media platforms facilitates someone’s discovery of their gender identity and/or supports their coming to terms with it. This kind of representation may also provide people before or in transitioning processes with different ways to conceive of their future self. There are numerous social media accounts of trans people documenting their transitioning processes (Horak, 2014; Gauthier & Chaudoir, 2004). Displaying one’s own gender transition online may not only be important to some trans people because they feel like it makes a difference for the community, it may also become a vital part of the transitioning process itself, influencing and shaping the way the transition is taking place (Rawson, 2014; McInroy & Craig, 2015). Indeed, the representation of trans people on social media matters to trans communities and trans individuals because, by seeing images and perceiving narratives of trans people, one might, first, conceive of the possibility of one’s existence as a trans person, including the possibility of embodying another gender, and, second, think of the possibility of representing oneself (as a trans person) too (Cavalcante, 2016; Cannon et al., 2017). Accordingly, this chapter argues that social media can be viewed as a form of corporeal technology that is involved in transitioning processes. Social media can help the individual to reconceive their identity by means of representing themselves to themselves and others online. (shrink)

Through an empirical analysis of YouTube videos, blogs, and interviews, this article explores how partners experience intimacy and desire in relation to trans men’s body modifications. Building on Salamon’s conception of trans bodies as emerging within relations of desire, I argue that partners’ experiences of trans men’s bodies are crucially shaped by their intimate bonds with trans men as people, rather than reducible to generic parts. Partners continue to experience trans men as essentially the same people through gender (...) class='Hi'>transition, despite fears that testosterone might alter their personalities. Their intimate bonds with trans men also open up space for new relations of desire to emerge, including attraction to bodily changes they might otherwise find unattractive. These partnerships work to expand ideas about which bodies can be desired as male or masculine, and undercut the literalness of sexual identity labels. Thus, the lived realities of gender transition, as they materialize within this context, challenge hegemonic conceptions of gender, sexuality, and desire. (shrink)

David Albert Jones recently proposed an analogy between adoption and gender transitioning. Jones notes that adoption grants a child a social identity that is distinct from the natal identity and suggests that a similar situation might obtain in the case of gender transitioning. According to this proposal, a biological male who wishes to be called a woman is not assuming a false identity. Adoption and gender transitioning are significantly different, however: adoptive sonship participates in natural sonship in (...) a way that is not true of the relationship between a biological woman and a man who wishes to be called a woman. Attention is given to different forms of analogy, leading to the conclusion that the use of the word woman for a biological male would be either a metaphor or a very weak analogy. In contrast, the term son as applied to an adopted boy fulfills the fundamental signification of that word. (shrink)

This book turns critical feminist scrutiny on national climate policies in India and examines what transition might really mean for marginalized groups in the country. -/- A vision of “just transitions” is increasingly being used by activists and groups to ensure that pathways towards sustainable futures are equitable and inclusive. Exploring this concept, this volume provides a feminist study of what it would take to ensure just transitions in India where gender, in relation to its interesting dimensions of (...) power, is at the centre of analysis. With case studies on climate mitigation and adaptation from different parts of India, the book brings together academics, practitioners and policymakers who provide commentary on sectors including agriculture, forestry and renewables. Stories told about violence, trauma, and loss inform knowledge of post-conflict societies. Stories have a context which is part of the story-teller’s life narrative. Reasons for silences are varied. This article affirms the importance of telling and listening to stories and notes the significance of silences within transitional justice’s narratives. It does this in three ways. First, it outlines a critical narrative theory of transitional justice which confirms the importance of narrative agency in telling or withholding stories. Relatedly, it affirms (...) the importance of story-telling as a way to explain differentiated gender requirements within transitional justice processes. Second, it examines gendered differences in the ways that women are silenced by shame, choose silence to retain self-respect, use silence as a strategy of survival, or an agential act. Third, it argues that compassionate listening requires gender-sensitive responses that recognize the narrator’s sense of self and needs. (shrink)

Feminist transitional justice has greatly contributed to the study of justice in the ruins of war, notably around prosecuting wartime rape. At the same time, scholars have observed limitations to this research agenda such as externally-driven definitions gendered harms and how to address them. This paper explores two novel areas for feminist TJ research: ‘everyday gendered harms’ and customary justice. Based on a three month field study of baraza, a customary justice mechanism in parts of South Kivu, Democratic Republic of (...) Congo, I explore three cases of ‘everyday’ harms against women: domestic violence, polygynous relationships and witchcraft. Through a substantive examination of these baraza cases, I highlight how studying the contextualised functioning of customary justice mechanisms provides new insights into different areas of feminist TJ scholarship, including women’s participation in the transition, justice for harms against women, and advancing gender equality. Additionally, this paper adds to the broader TJ literature by engaging with local TJ needs as they pertain to people’s everyday life in transition. (shrink)

The tendency for abstract theorists of democratization to overlook gender dynamics is perhaps exacerbated in the South African case, where racial inequality is obviously key. Yet, attention to the processes through which South African activists inserted gender issues into discussions about how to construct new institutions provides an unusual prism through which to explore the gendered character of citizenship. After providing an explanation for the unusual prominence of gender concerns in South Africa's democratization, the article argues that (...) during the drawn-out democratic transition, South African activists, often influenced by international feminist discussions, developed a collective definition of gender interests and began to build those interests into the structure of democratic institutions, in ways that will affect politics and the definition of “women's interests” in the future. Can work-family policies promote greater gender equity in family roles? Using interviews with couples from upstate New York, we examine the role of work-family policies in the decisions dual-earner married couples make about paid work during the transition to parenthood. During the period immediately around a birth, differences in mothers’ and fathers’ access to paid time off from work interacted with their parenting role ideologies to influence gender differences in paid work arrangements. After the initial transition, (...) employed women used and created more flexibility in their work arrangements than their husbands, often reducing their husbands’ need to use available work-family policies. In this article I analyze both generalized propriety as a boundary marker of Sudanese identity in Cairo, and gendered attitudes toward morality and female genital cutting (FGC) as a fundamental aspect of that boundary. Sudanese have been profoundly affected by the ongoing political crisis in their home country, by the displacement triggered by political and economic collapse, and by their deteriorating legal and social status in Egypt. The dramatic changes in the circumstances of Sudanese residence in Cairo have challenged the (...) cultural norm of gender complementarity as men ‘stay at home’ for want of work while women seek and find new opportunities for themselves. This unstable situation has led Sudanese to place more emphasis on ‘proper’ ways of behaving and being, an assertion that helps define the ethnic boundaries of the Sudanese community in Cairo. I demonstrate the inconsistencies between discourse and reality through ethnographic data while analyzing how Sudanese have found new ways of asserting their identity and resisting the practice of FGC. Rural families must constantly negotiate their livelihoods by obtaining access to natural resources, labor, capital, knowledge, and markets. Successful negotiation leads to enhanced family well-being and sustainable use of natural resources. Unsuccessful negotiation threatens family survival, threatens sustainable use of natural resources, and reduces bio-diversity. These negotiation processes are mediated by gender relations. The ideas of negotiation and of survival strategies outlined here provide a framework within which the articles of this issue can be situated. The articles are the (...) result of research on gender and natural resource management conducted in Latin America, Asia, Africa, and North America. The growing literature on gender in armed conflict and the debates over post-conflict reparations for women, focus on the prevalence and harms of sexual violence. While this focus has recently been critiqued, there are few articulations of other types of gendered injuries. This article decentres the emphasis on sexual violence by examining the intersection between forced displacement and political insecurity. Based on extensive field research in Colombia, and using as an example a case study of an internally displaced women’s (...) grassroots organization in Cartagena, Colombia, this article examines political insecurity as a specifically gendered harm. It reflects on the concrete circumstances of insecurity, on the relevance of traditional gender roles in the constitution of insecurity, and on the challenges for court-ordered remedies. This widening of the scope of attention also invites complex reflection on the possibility of transformative reparations in post-conflict situations. (shrink)

The importance of male dominance in the scientific community is no strange to us all. Science, as a source of respected and influential information is a staunchly guarded male domain for millennia. What is specific for our time and place is the nervousness with which female presence is accepted. It is also the time of great changes in the axis of power, and the struggle for control is very aggressive. What is even more so in Serbia and Montenegro one of (...) the pieces of ruins of the late SFRJ, is that the dysfunction of the war and sanctions brought about more inequality than before. And science is a field of professional achievement with slow and uncertain rewards, vast investment of time, effort and funds, for a career that is beneficial more to vanity than to the bank account. Women are seen as frivolous when they devote a huge amount of work and other resources to self-improvement and personal achievement and not to the comfort of the immediate family. Serious gender-based crimes were committed against women and girls during Sierra Leone’s decade-long armed conflict. This article examines how the Special Court for Sierra Leone has approached these crimes in its first four judgments. The June 20, 2007 trial judgment in the Armed Forces Revolutionary Council case assists international criminal law’s limited understanding of the crime against humanity of forced marriage, but also collapses evidence of that crime into the war crime of outrages upon personal dignity. The February 22, (...) 2008 appeals judgment attempts to correct this misstep. In contrast, the August 2, 2007 trial judgment in the Civil Defence Forces case is virtually silent on crimes committed against women and girls, although the May 28, 2008 appeals judgment attempts to partially redress this silence. This article concludes that the four judgments, considered together, raise the specter that the Special Court could potentially fail to make a significant progressive contribution to gender-sensitive transitional justice. British equality law protections for sex and gender reassignment have grown fraught as activists tussle over legal and social categories of gender, gender transitioning, and sex. This article considers the future of gender-related equality protections in relation to ‘decertification’—an imagined reform that would detach sex and gender from legal personhood. One criticism of decertification is that de-formalising gender membership would undermine equality law protections. This article explores how gender-based equality law could operate in (...) conditions of decertification, drawing on legal thoughtways developed for two other protected characteristics in equality law—religion and belief, and disability—to explore the legal responses and imaginaries that these two grounds make available. Religious equality law focuses on beliefs, communities, and practices, deemed to be stable, multivarious, and subject to deep personal commitment. Disability equality law focuses on embodied disadvantage, approached as social, relational, and fluctuating. While these two equality frameworks have considerable limitations, they offer legal thoughtways for gender oriented to both its hierarchies and its expression, including as disavowal. (shrink)

Gender transition may be figured as part of a broader creaturely process of being partners in our own becoming. Gender transition is explored through the lenses of transformation (including comparisons with theosis and with religious conversion) and neurodiversity. Humans are transformative creatures; trans and gender-variant people, like others, have the power to curate their own identities and are on a journey toward perfection. Our nature as humans, including our sexed and gendered nature, is not over-and-done-with. (...) In this sense, our active building and shaping of our identities and body-stories is not a rejection of a divine blueprint for human existence, nor an exercise of illegitimate human hubris, but rather a licit creaturely form of generativity. Gender roles are changing with the change of priorities and spheres of social influence in great historical upheavals. Transitional societies have undergone significant changes in social structure and gender roles have been influenced accordingly. Retraditionalization and globalization play important roles in that process.

Gender differences in children’s and adults’ time use are well documented, but few have examined the intervening period—young adulthood. Because many Americans navigate higher education in young adulthood, college time use provides insight into how gendered behaviors evolve during this critical life stage. Using three years of time use data from the National Longitudinal Survey of Freshmen and latent transition analysis, I examine gender differences in time use within and across the college years for those in selective (...) institutions. Among students whose time use is consistent throughout college, I find that women exhibit academically-oriented time use more often, and men exhibit socially oriented time use more often. However, many men transition from social time use at the beginning of college to academic time use toward the end—to the extent that gender gaps in academic time use converge by the third year. I argue that men and women construct distinct college pathways, and that men, in particular, must reroute their time use to accommodate gendered expectations for the transition to adulthood. There has been little considered reflection by Catholic theologians on the concepts of gender identity, gender dysphoria and gender transition. Seeking inspiration in the Scriptures, some Catholic thinkers have interpreted the first three chapters of Genesis and especially the text ‘male and female he created them’ (Gen. 1:27) as requiring all human beings to live in the gender role congruent with their biological sex, and have viewed the biology of sex as self-evident. This article argues (...) that these chapters constitute an appropriate locus for reflection on theological anthropology but that they need to be taken together with other texts and especially with the explicit teaching of Jesus Christ. In the Gospel according to Matthew, the one occasion in which Jesus invokes this passage from Genesis is when he draws attention to exceptional examples in nature and, in a striking phrase, states that some ‘have made themselves eunuchs for the sake of the kingdom of heaven’ (Matt. 19:12). If the Genesis text is interpreted in the light of the words of Christ, the binary division of the sexes, while ordained by God and the basis for a vocation to marry and procreate, admits of exceptions both natural and supernatural. In this article, we examine the continuity of harms and traumas experienced by women before, during and after war and other mass violence. We focus on women because of the particular challenges they face in accessing justice due to patriarchal structures and ongoing discrimination in the political, economic and social, as well as legal spheres, and because of the gendered nature of the crimes and harms they experience. We use the four key pillars of transitional justice identified by the United (...) Nations as a framework to analyse how these harms are addressed in the context of criminal prosecutions, truth commissions, reparations and institutional reform. We conclude that a gender-transformative approach to transitional justice that focuses on transforming psychosocial, socioeconomic and political power relations in society is needed in order to attain human rights for women and build a sustainable peace. This article draws on data from a study of the transition to motherhood to contribute to feminist theorizing of embodiment. Three bodily aspects of women's gendered sense of self are identified as undergoing possible change during this period—sensuality, shape, and space. The work of Arthur Frank is drawn on to theorize shifts in women's experience of these dimensions, and the author shows how the white, middle-class women studied could use such discourses around the body as resources in renegotiating their (...) social positioning. This empirical analysis demonstrates how physical changes may facilitate challenging the dominant body norms, although the work of Robert Connell indicates that social control may also be a consequence of such bodily conceptualizations. This article therefore uses its empirical analysis to contribute to theorizing the connections between bodily practices and gendered identity. (shrink)

This paper assesses the work of Robert Brenner alongside the insights developed within social-reproduction feminism to reassess discussions on the origins of capitalism. The focus on the internal relation between social production and social reproduction allows social-reproduction feminism to theorise the construction of gendered capitalist social relations that previous accounts of the transition to capitalism have thus far been unable to provide. It argues that a revised political Marxism has the potential to set up a non-teleological and historically specific (...) account of the origins of capitalism. This paper seeks to redress the theoretical shortcomings of political Marxism that allow it to fail to account for the differentiated yet internally related process involved in the constitution and reconstitution of gendered capitalist social relations. This critique contributes to a social-reproduction feminism project of exploring processes of social production and social reproduction in their historical development and contemporary particularities. To better understand the gender gap in science, technology, engineering and math aspiration, the article examines the critical role of domain-specific motivation. Using longitudinal data from 5th and 6th grade students, person-oriented analyses was applied to understand the gendered motivational profiles and their longitudinal influence on achievement and STEM aspiration. Specifically, we aimed to derive motivational belief profiles regarding science, mathematics, and language, analyze the stability and change in the profiles between the 5th and 6th grade, assess the relationship (...) between motivational profiles and achievement and STEM aspiration, and test for gender differences. We derived four motivational profiles for both years: high motivation in all subjects, high mathematics motivation, low mathematics motivation, and low motivation in all subjects. Latent transition analysis revealed that most students remained in the same profile throughout the 2 years. We found evidence of gendered differences in the motivational profiles and the chance of transitioning between profiles. More girls are characterized by low math motivation, while boys are more likely to transition to higher math motivation in 6th grade. The motivational difference is reflected in their achievement, although not strongly coupled with their STEM aspiration. The findings suggest that at this developmental stage, Finnish students have not developed a strong association between STEM aspiration and their domain-specific motivation, although their motivation may have influenced their achievement. This paper offers a case study based on qualitative research in the burley tobacco region of central Kentucky, where farmers are urged to diversify away from tobacco production. “Replacing” tobacco is difficult for economic and material reasons, but also because raising tobacco is commensurate with a locally valued way of doing masculinity. The focus is on these two questions: How can the doing of work associated with tobacco production and marketing be understood as also doing a particular masculinity? What does (...) an understanding of farm work as a simultaneous doing of gender illuminate about the challenges of diversification away from tobacco? Asking tobacco farmers to “grow something else” is also asking them to do gender differently, suggesting that the transition away from tobacco must be understood as a gendered transition. This research, focused primarily on male farmers who continue to raise tobacco, suggests the need for gendered research with women and men who have moved away from tobacco to other crops. (shrink)

This article traces the gendered consequences of changes in the problem of combining work and family caused by the collapse of state socialism in former East Germany. The transition to capitalism made the trade-offs between work and family more extreme, amplified the experiential distance between work and family, and increased the perceived social value of work relative to family activities. These processes highlighted gender stratification: Women's labor power was devalued just as the value of paid employment increased, and (...) women were increasingly excluded from work just as women's family roles seemed to lose value for society. This study suggests that feminists should conceptualize postsocialist transitions not only as changing labor market conditions and state policies but also as shaping gender relations through changing the meanings and experiences of work and family activities. From a radical feminist perspective, gender is a cage. Or to be more precise, it’s two cages. If genders are cages, then surely we want to let people out. Being less constrained in our choices is something we all have reason to want: theorists in recent years have emphasized the importance of the capability to do and be many different things. At the very least, we should want an end to sex-based oppression. But what does this entail, when it (...) comes to gender? In this paper, I’ll compare four ‘transitional pathways’, with a view to considering how each relates to the ultimate end of ending sex-based oppression. Should we open the doors to the cages, so that people can move freely between them, but leave the cages themselves in place?. Should we add more cages?. Should we make the cages bigger, so that people have a lot more room to move around inside them? Or should we dismantle the cages, so there are no more genders at all?. Some of these options are ‘gender revisionist’, others are gender abolitionist. I’ll argue in favour of a gender abolitionist pathway. (shrink)
