This article examines the main aspects of Husserl's phenomenology, which are analyzed in "Appearance and Sense" by Gustav Shpet: the relation between sense and comprehension and between noesis and noema. Shpet emphasizes the hermeneutical theme of "comprehension" as a resolutive dimension to solve aspects not clarified by Husserl. Shpet's critical enquiry, in the course of his subsequent observation, converge into an hermeneutical logic. Shpet identifies the centrality of language as a form of thinking, through the recovery of Humbodt's meaning of (...) the "inner form". (shrink)

MATERIALISTS claim that in principle mentality could be accounted for entirely by properties of matter. They must, of course, clarify, as far as possible, the precise scope of the concept "properties of matter." According to materialists there exists only one type of "substance" in the universe, namely matter. Sophisticated experimental and theoretical analyses have led contemporary physicists to interpret known material entities as being composed of two classes of elementary particles, namely quarks and leptons and constituents of interaction fields that (...) mediate interactions between some or all of the elementary particles and which comprise photons, gluons, intermediate bosons and gravitons. For instance, protons and neutrons are composed--by hypothesis--of quarks, while electrons are probably the most familiar leptons. Whether any analyzed and postulated elementary particles and constituents of interaction fields are "ultimate" components of matter can never be known. It remains always possible that more basic subcomponents of known components will be discovered. This has happened repeatedly throughout the history of physics. Hence, what physicists understand by the "physical properties" of the basic components of matter must always remain expressed in terms of usually intricate hypothetico-deductive theories which are tentative and fallible. Contemporary relativistic quantum mechanics of elementary particles and of interaction fields provide typical examples of such hypothetico-deductive theories relating to present known basic components of matter. This essay explores a major ethical variable in personal sales: trust. By analyzing data drawn from life insurance sales, the essay supports the thesis that the role of the agent and the exigencies of personal sales create certain antinomies of trust that compromise the sales process. As a result, trust occupies a problematic and apparently paradoxical position in the sales process. On the one hand, success in personal sales is held to depend upon trust. On the other hand, because the (...) techniques required to form trust in personal sales nullify the conditions under which trust is possible, these instruments of trust formation are self-defeating. In this paper I shall venture into an area with which I am not very familiar and in which I feel far from confident; namely into phenomenology. My main motive is not to get away from standard, boring, methodological questions like those of induction and demarcation; but the conviction that a phenomenological account of the empirical basis forms a necessary complement to Popper's falsificationism. According to the latter, a scientific theory is a synthetic and universal, hence unverifiable proposition. In fact, (...) in order to be technologically useful, a scientific hypothesis must refer to future states-of-affairs; it ought therefore to remain unverified. But in order to be empirical, a theory must bear some kind of relation to factual statements. According to Popper, such a relation can only be one of potential conflict. Thus a theory T will be termed scientific if and only if T is logically incompatible with a so-called basic statement b, where b is both empirically verifiable and empirically falsifiable. In other words: T is scientific if it entails ¬b; where b, hence also ¬b, is an empirically decidable proposition. (shrink)

The principle of “equivalence of care” in prison medicine is a principle by which prison health services are obliged to provide prisoners with care of a quality equivalent to that provided for the general public in the same country. It is cited in numerous national and international directives and recommendations.The principle of equivalence is extremely relevant from the point of view of normative ethics but requires adaptation from the point of view of applied ethics. From a clinical point of view, (...) the principle of equivalence is often insufficient to take account of the adaptations necessary for the organization of care in a correctional setting. The principle of equivalence is cost-effective in general, but has to be overstepped to ensure the humane management of certain special cases. (shrink)

The current Ebola epidemic has presented challenges both medical and ethical. Although we have known epidemics of untreatable diseases in the past, this particular one may be unique in the intensity and rapidity of its spread, as well as ethical challenges that it has created, exacerbated by its geographic location. We will look at the infectious agent and the epidemic it is causing, in order to understand the ethical problems that have arisen.

Changes in healthcare financing increasingly rely upon patient cost-sharing to control escalating healthcare expenditures. These changes raise new challenges for physicians that are different from those that arose either under managed care or traditional indemnity insurance. Historically, there have been two distinct bases for arguing that physicians should not consider costs in their clinical decisions—an “aspirational ethic” that exhorts physicians to treat all patients the same regardless of their ability to pay, and an “agency ethic” that calls on physicians to (...) be trustworthy advisors to their patients. In the setting of greater patient cost-sharing, physicians' aspiration and agency roles increasingly conflict. Satisfactorily navigating the new terrain of consumer-driven healthcare requires physicians to consider these two roles and how they can best be reconciled so as to maximize quality of care while respecting the heterogeneity of patients' financial resources and willingness to pay. The UNESCO Universal Declaration on Bioethics and Human Rights of 2005 purports to articulate universal norms for bioethics. However, this document has met with mixed reviews. Some deny that the elaboration of universal bioethics norms is needed; some deny that UNESCO has the expertise or authority to articulate such norms; some regard the content of the UNESCO document as too vague or general to be useful; and some regard the document as a cog in the effort of like-minded cosmopolitans to (...) codify their particular moral intuitions in international law. Zermelo once wrote that he had anticipated Russell's contradiction of the set of all sets that are not members of themselves. Is this sufficient for having anticipated Russell's Paradox — the paradox that revealed the untenability of the logical notion of a set as an extension? This paper argues that it is not sufficient and offers criteria that are necessary and sufficient for having discovered Russell's Paradox. It is shown that there is ample evidence that Russell satisfied the criteria and (...) that Zermelo did not. (shrink)
