This article provides the first English translation of Tanabe’s early essay, “The Limit of Logicism in Epistemology: A Critique of the Marburg and Freiburg Schools”. The key notion that the young Tanabe seeks to define in relation to his detailed analyses of contemporary Neo-Kantian epistemology is the notion of “pure experience” presented in Nishida’s philosophy. The general theory of epistemology shared among the thinkers from these two prominent schools of philosophy in early 20 th century Germany aimed to eliminate (...) the empirical residues in Kant’s theory of knowledge while opposing naïve empiricism and the uncritical methodology of positive science. Their “logicistic” approach, according to Tanabe, seems to contradict Nishida’s notion of pure experience, for it cannot allow any vestige of empiricism in its systematic framework, which is specifically designed to ground scientific knowledge. Yet given that the Neo-Kantian configuration of epistemology does not create the object of knowledge, it must face sensation or representational content as its limiting instance. Thus, to ground a Neo-Kantian theory of knowledge while taking account of this limit of logicism involves explaining their understanding of the unity of subject and object in human knowing. For this, Tanabe argues, recourse to Nishida’s notion of pure experience is indispensable. (shrink)

Aesthetic normativity continues to be of interest in contemporary aesthetics, and significant contributions to the topic can be found in neo-Kantianism. This article examines the account of aesthetic normativity presented by Jonas Cohn (1869–1947), a member of the Southwestern school of neo-Kantianism and author of a 1901 book on aesthetics. Cohn's Kantian-Hegelian theory of aesthetic normativity deserves more examination than it has so far received. Even if one does not accept all of its main arguments, Cohn's theory offers an (...) interesting alternative to the third Critique's account of the universal validity of aesthetic judgments, and it reveals how Kant's aesthetic theory was appropriated at the turn of the century. Since a number of objections can be raised against Cohn's account, however, at the end of the paper I raise several of them. (shrink)

This paper challenges the first Gettier counterexample to the tripartite account of knowledge. Noting that 'the man who will get the job' is a description and invoking Donnellan's distinction between their 'referential' and 'attributive' uses, I argue that Smith does not actually believe that the man who will get the job has ten coins in his pocket. Smith's ignorance about who will get the job shows that the belief cannot be understood referentially, his ignorance of the coins in his pocket (...) shows that it cannot be understood attributively. An explanation for why Smith appeared to have justified true belief is given by distinguishing between 'belief' and 'belief in truth'. Smith believes the sentence 'the man who will get the job has ten coins in his pocket' to be true (he mistakenly believes that Jones will get the job, of whom he knows that he has ten coins in his pocket) (hence his 'belief'), the sentence is true (hence 'truth'), and he has sufficient reason to assent to it (hence his 'justification'). But he does not believe the proposition expressed. Hence he does not know it either. (shrink)

Congress's national-security legislation will often require clear and specific congressional authorization before the executive can undertake certain actions. The War Powers Resolution, for example, prohibits any law from authorizing military hostilities unless it "specifically authorizes" them. And the Foreign Intelligence Surveillance Act of 1978 required laws to amend FISA or repeal its "exclusive means" provision before they could authorize warrantless electronic surveillance. But efforts to legislate clear-statement regimes in national-security law have failed to induce compliance. The Clinton Administration inferred congressional (...) "authorization" for the 1999 Kosovo War from an appropriations statute that failed to specifically authorize the conflict. And the Bush Administration inferred congressional "authorization" for the NSA surveillance program from ambiguous language in the post-September 11th Authorization to Use Military Force. In both situations, executive-branch lawyers employed expansive theories of implied repeal and constitutional avoidance to evade the codified clear-statement requirements, and Congress and the courts acquiesced to the President's actions. Recent proposals to strengthen the clear-statement requirements in Congress's national-security framework legislation are unlikely to be effective without institutional mechanisms, such as points of order, that can deter future legislators from enacting vague or ambiguous legislation from which the executive might claim implicit congressional "authorization," and that can induce Congress to confront Presidents that act without specific congressional authorization. Simply enacting more narrow or explicit clear-statement requirements, or adding funding restrictions to Congress's framework legislation, fails to counter the aggressive interpretive doctrines that executives of both political parties have used to concoct congressional "authorization" from vague or ambiguous statutory language. This article considers the possibility of articulating a renewed understanding of the principle of political idealism on the basis of Edmund Husserl’s phenomenology. By taking its point of departure from one of the most interesting political applications of Husserl’s phenomenological method, the ordoliberal tradition of the so-called Freiburg School of Economics, the article raises the question of the normative implications of Husserl’s eidetic method. Contrary to the “static” idealism of the ordoliberal tradition, the article proposes that the phenomenological (...) concept of political idealism ought to be understood as a fundamentally dynamic principle. As opposed to the classical understanding of political idealism as the implementation of a particular normative model—political utopianism—the phenomenological reformulation of this idea denoted a radically critical principle of self-reflection that can only be realized on the basis of perpetual renewal. In order to illustrate this point, the article considers Husserl’s distinction between two types of ideals of perfection, the absolute and the relative, and argues for their relevance for political philosophy. Academic resistance in Nazi-Germany between 1941 and 1944 gives a rare example of an exceptional cooperation between scholars of economics, law, history an Protestant theology. Leading representatives of the ordo-liberal Freiburg school of eceonomics (W. Eucken, F. Böhm and others) joined forces with theologians to develop concepts for political, social and economic life in post-war Germany by ordinance of >Bekennende Kirche< represented by Dietrich Bonhoeffer. This outstanding example of interdisciplinary thinking proved tobe influential in founding Germany's Social Market (...) System. It stands as a successful, yet singular, way of dialogue between theology and economics. (shrink)

The recent crisis of the Eurozone has led scholars and activists to critically consider the ordoliberal tradition of thought, in order to underline the ideological and effective primacy of the German interests within EU’s economic and monetary policies. Starting from this last widespread assertion, the author, after having recalled the differences which exist among the liberalism of the “Freiburg School” and that of the “Vienna School”, analyzes and discusses the principles of Walter Eucken’s economic policy, in particular, (...) the “constitutive principles” and the “regulative principles” of his Wettbewerbsordnung. Nevertheless, if it is true that the ordoliberal concept of competition is based on a Leistungsprinzip which requires a starker Staat, how does the Wettbewerbsordnung coexist with EU’s systems of governance? Actually, says the author, the multilevel European governance seems to be better understood if intended as a “hybrid”, with respect to which not always Ordoliberalism plays a role consistent with its tradition. As recent newspaper headlines show the topic of patents/patent laws is still heavily disputed. In this paper I will approach this topic from a theoretical-historical and history of economic thought-perspective. In this regard I will link the patent controversy of the nineteenth century with Walter Eucken's Ordoliberalism – a German version of neoliberalism. My paper is structured as follows: The second chapter provides the reader with a historical introduction. At the heart of this paragraph are the controversy and discourse on (...) patent laws in nineteenth century Europe as well as the pro and contra arguments presented by the anti-patent/free-trade movement respectively by the advocates of patent protection. The focus of my paper is on the struggle for the protection of inventions and innovations in nineteenth century Germany, since Walter Eucken, main representative of the Freiburg School of Law and Economics, picks up the counter-arguments presented in the national debate and in particular by the Kongress deutscher Volkswirthe. The third chapter deals intensively with the question whether patent laws are just 'nonsense upon stilts' from an ordoliberal perspective. RESUMENEl artículo que se presenta aquí traducido se editó en alemán en un volumen homenaje al filósofo Heinrich Rombach, quien se ha sabido unido a la «escuela de Freiburg » (en Briesgau) y determinado por la conexión entre Husserl y Heidegger, que, a pesar de las diferencias, es Fenomenología. Amigos, colegas y discípulos del profesor Rombach, por entonces profesor activo de la Universidad de Würzburg, dejaron en ese volumen huellas de haber oteado brechas y caminos muy distintos, en pos (...) de alcanzar espacios abiertos, libres y diversos, propios de un filosofar que se sabe estructural, intermundano e intercultural. La participación de Franco Volpi, que se concentró en el Welt und Gegenwelt de Rombach, caminó a la par de quienes transitaron el primero de los tres movimientos, que emprendió la filosofía de Rombach y que se llama Hermética filosófica. Inspirado, pues, por la lectura del Welt und Gegenwelt, Volpi defiende que con el proyecto de la hermética el pensar de Rombach aventaja, de modo radical, la Zeitkritik de Heidegger de los fundamentos epocales, en cuyo caso el profesor italiano pone a consideración el aporte de la Hermética en la tradición de la filosofía alemana, que alcanza al fundador de la escuela hermeneútica. Rombach identified himself as a member of the “Freiburg School” in Breisgau, and delimited by the connection between Husserl and Heidegger, which, despite their differences is Phenomenology. Friends, colleagues and disciples of Professor Rombach, who was back then an active Professor at the University of Würzburg, left traces in this volume of having glimpsed very different paths and gaps in the pursuit of reaching free, open and diverse spaces, characteristic of a structural, intermundane, and intercultural way of doing philosophy. Franco Volpi’s contribution moved along others who focused on the Rombach`s Welt und Gegenwelt, following the first of three movements undertaken by Rombach`s philosophy, namely philosophical Hermetics. Inspired by Welt und Gegenwelt, Volpi claims that with the hermetic project, the thought of Rombach surpasses, in a radical way, the Heideggerian Zeitkritik, and so the Italian Professor examines the contribution of the Hermetics in the tradition of German philosophy, that includes the founder of the school of hermeneutics. The letter with Rombach`s reply to Volpi`s claim, on the other hand, denies Rombach`s involvement with the Zeikritik. Instead, Rombach emphasizes the centrality of the hermetic phenomenon, that is, the immediate and inseparable unity of human being and reality, which happens as they respectively move along together or at the same time, understood by Rombach as a special discover for who can grasp it. The everyday realities of educational practices of the Third Reich are reconstructed in the memoires of involved observers of these processes. The most of them can be used as a factual supplement to theoretical reflections on totalitarian transformations in education as their subjective perceiving. Despite of different origin and life attitudes all the authors of translated fragments are concentrated on those features of totalitarian educational innovations which show their completely incompatibility with the humanistic tradition in education. The everyday life of (...) universities’ and school’s communities in the Third Reich was determined by the national-socialist ideology. The recalling on Heidegger’s activities as the rector of the University in Freiburg (H. Gottschalk, H. Jonas, K. Löwith, G. Cesar) expose the ambiguity of his way of thinking and acting, what was also noticeable in his habitus. His nationalism was not combined strong with the anti-Semitism in the university’s management. The race theory as a part of national-socialismideology wasn’t definitive for the everyday life in those educational institutions, where the educational traditions were connected with the humanistic values existing in families (L. Schmidt, G. Cesar). Some attempts to stimulation of the pro-social behavior of pupil and students (helping and solidarity) were not effective in the Third Reich because of their directive nature (G. Cesar). The comparison of the national-socialism model of the school and the Lichtwark School taking by L. Schmidt demonstrates the advantages of non-indoctrinated educational institutions withthe pedagogical and socialfreedom used for the all-side development of pupil personality. The experience of the membership in BMD (League of German girls), connected with the force working is critically analyzed by G. Cesar and L. Schmidt. The social status of women and their educational influence in the family of the Third Reich design is reconstructed by B. Vinken. She shows that the fascist ideology provides only the subordinated role of women in all spheres of the social life including the educational practices. (shrink)
