Über die als Rechtssoziologie bekannt gewordenen Werkstücke von Wirtschaft und Gesellschaft ist bereits vieles gesagt und geschrieben worden. Die mittlerweile vorliegende Edition der Texte im Rahmen der historisch-kritischen Gesamtausgabe sowie die in der Editionsarbeit gewonnenen Einsichten in den Entstehungsprozess, die innere Logik und den Ort dieses Collagenwerkes geben jedoch Anlass, sowohl etablierte Deutungen zu hinterfragen als auch neue Interpretationen dieser vielschichtigen Texte zur Debatte zu stellen. So lassen sich in diesen Texten bereits Ansätze eines Pluralismus normativer Ordnungen finden, und auch (...) die kulturelle Dimension als Differenz der Rechtsordnungen wird von Weber in einer Weise betont, die noch fur Betrachtungen von Gegenwartsgesellschaften und ihrer Identitätsbilder bedeutsam scheint. Feature logics are the logical basis for so-called unification grammars studied in computational linguistics. We investigate the expressivity of feature terms with negation and the functional uncertainty construct needed for the description of long-distance dependencies and obtain the following results: satisfiability of feature terms is undecidable, sort equations can be internalized, consistency of sort equations is decidable if there is at least one atom, and consistency of sort equations is undecidable if there is no atom.

The cost-effectiveness of 24-hour care makes it a major source of support for elderly people in need of home-based care in Austria. Language barriers, feelings of isolation when living with chronically ill people and a lack of adequate training and quality control create stressful working conditions for 24-hour caregivers in Austria, who mainly come from Slovakia, Hungary and Romania. The challenges not only affect the 24-hour caregivers themselves but also their clients, relatives and registered care agency nurses in care settings. (...) The aim of the qualitative study was to assess user needs in order to develop an app to improve working conditions and quality assurance in 24-hour home-care. The study consisted of guided interviews, focus group and cultural probes and 45 interviewees. The collected data were analyzed using Kuckartz’s method of content structuring qualitative content analysis. The main results show that 24-hour caregivers predominantly require information about common geriatric diseases and the law on 24-hour care. Additionally, medical emergencies can cause insecurities, which creates high interest in professional emergency management skills. Clients and relatives are especially interested in 24-hour caregivers having better German language skills. Care agencies and registered nurses would particularly welcome electronic care documentation to ensure traceability of the activities and measures taken. The study points to the need for a digital tool that would meet demand for an appropriate assistance system for 24-hour home-care that complies with the AAL requirements of the aligned project. Therefore, the intended software solution meets challenges in 24-hour home-care for 24-hour caregivers, persons in need of care, their relatives and professionals involved in the 24-hour care setting. The multi-cultural nature of the Austro-Hungarian Empire in the late nineteenth century created much unrest among the many different ethnic groups within the Empire. As each group struggled against the other groups for more rights, dissolution threatened the Empire. The Hapsburg government under Franz Joseph used two different strategies in Austria and Hungary to keep the country united, and these strategies successfully kept the Empire together for half a century. After the Emperor’s death, opposing interests and separatism proved too (...) powerful without Franz Joseph’s uniting influence, and the Austro-Hungarian Empire collapsed. (shrink)

We are all immersed in a sea of social norms, but they are sometimes tricky to observe with any clarity. They are often invisible to us and emerge only when they are not observed. Social norms are important to understand because they are both limiting of our freedom, such as gendered and racialized norms, and at the same time the very conditions of our agency. Social Goodness presents an original, externalist answer to the question of the source or origin of (...) social role normativity. Rather than grounding social normativity in the attitudes of persons, the book argues for an externalism that roots social role normativity in the social world itself: in its positions, institutions, and larger architecture. The core insight of externalism is that the function or structural feature of an enterprise or activity can bring with it normative demands quite independently of the attitudes of those who engage with it. According to the artisanal model, just as a carpenter, ceramicist, or chef is responsive to and evaluable under a set of artisanal norms or techniques, so too is a mother and or an academic or a President. The source of normativity is this technique or expertise, independent of the preferences, endorsements, or recognitive attitudes of individuals. The artisanal model for social role normativity has resources to explain both the "stickiness" or persistence of social norms and our ability to criticize existing norms and to engage in normative self-creation--to create new normative selves. The artisanal model also has resources to capture and express the social situatedness, locality, and materiality of social roles. The relational ontology of social roles, implicit in the artisanal model, provides a useful frame to consider both hierarchical and oppressive social relations. (shrink)

When one thinks—knows, believes, imagines—that something is the case, one’s thought has a topic: it is about something, towards which one’s mind is directed. What is the logic of thought, so understood? This book begins to explore the idea that, to answer the question, we should take topics seriously. It proposes a hyperintensional account of the propositional contents of thought, arguing that these are individuated not only by the set of possible worlds at which they are true, but also by (...) their topic: what they are about. The book then builds epistemic, doxastic, probabilistic, and conditional logics based on this view. It applies them to issues ranging from dogmatism, scepticism, and epistemic fallibilism, to imagination and suppositional reasoning, belief revision, framing effects, and the acceptability of indicative conditionals. Given that individual information processing and memory capacity are severely limited, many institutional and procedural properties of the social communication process can be explained within an individualistic approach as the outcome of a co-evolution of action-inherent knowledge and preferences. This argument is outlined by referring to phenomena such as the competitive release of information (advertising), the role of celebrities and the rent they collect, and some characteristic ‘critical mass’ features.

Jury theorems are mathematical theorems about the ability of collectives to make correct decisions. Several jury theorems carry the optimistic message that, in suitable circumstances, ‘crowds are wise’: many individuals together (using, for instance, majority voting) tend to make good decisions, outperforming fewer or just one individual. Jury theorems form the technical core of epistemic arguments for democracy, and provide probabilistic tools for reasoning about the epistemic quality of collective decisions. The popularity of jury theorems spans across various disciplines such (...) as economics, political science, philosophy, and computer science. This entry reviews and critically assesses a variety of jury theorems. It first discusses Condorcet's initial jury theorem, and then progressively introduces jury theorems with more appropriate premises and conclusions. We need to understand the impossible. Francesco Berto and Mark Jago start by considering what the concepts of meaning, information, knowledge, belief, fiction, conditionality, and counterfactual supposition have in common. They are all concepts which divide the world up more finely than logic does. Logically equivalent sentences may carry different meanings and information and may differ in how they're believed. Big data biology—bioinformatics, computational biology, systems biology (including ‘omics’), and synthetic biology—raises a number of issues for the philosophy of science. This article deals with several such: Is data-intensive biology a new kind of science, presumably post-reductionistic? To what extent is big data biology data-driven? Can data ‘speak for themselves?’ I discuss these issues by way of a reflection on Carl Woese’s worry that “a society that permits biology to become an engineering discipline, that allows that science to slip into (...) the role of changing the living world without trying to understand it, is a danger to itself.” And I argue that scientific perspectivism, a philosophical stance represented prominently by Giere, Van Fraassen, and Wimsatt, according to which science cannot as a matter of principle transcend our human perspective, provides the best resources currently at our disposal to tackle many of the philosophical issues implied in the modeling of complex, multilevel/multiscale phenomena. Heute dominieren vereinseitigende Selbstbeschreibungen des Menschen, die ihn gentechnologisch, radikalkonstruktivistisch oder hirnphysiologisch auf sein biologisches Substrat reduzieren. Die Polyphonie, die man noch um 1800 in der Beschreibung des Menschen als das Zugleich von Körper und Geist hören konnte, weicht einer Einstimmig- und Einsinnigkeit kraft einer nur noch naturwissenschaftlichen Selbstthematisierung. Hieran ist zu erinnern, wenn man für die Zeit um 1800 festhält, dass sich die Denker zwar um solch disziplinäre Grenzen zwischen Naturgeschichte, Philosophie und Literatur nicht kümmerten, aber gerade dadurch der (...) Vielstimmigkeit einen Raum eröffneten. Die Verwendung des „Bildungstriebes“ in unterschiedlichen Zusammenhängen ist hierfür ein beredtes Zeugnis. Die vorliegende Arbeit zum „Bildungstrieb“ will und kann bisherige Rekonstruktionen des Bildungsbegriffs keineswegs ersetzen, sondern bestenfalls ergänzen. Damit aber werden im „Bildungstrieb“ Wurzeln des Bildungsbegriffs wieder in Erinnerung gerufen, die jenseits einer rein kognitiven, mentalen, subjektivistischen Zurichtung von „Bildung“ liegen. ***** Today, the dominant feature of the self-description of humans is one that confines them to their biological substrate. Genetic engineering, radical constructivism or brain physiology are among those disciplines which advocate such a perspective. The polyphonic descriptions of human beings around 1800, pointing out the simultaneity of body and mind, fall silent in favour of a one-sided and limited purely scientific self-thematization. Around 1800, due to their non-compliance regarding disciplinary boundaries between natural history, philosophy and literature, thinkers opened up a space for polyphony. The use of the “Bildungstrieb” (nisus formativus) in various contexts is eloquent evidence for this. The present volume on the “Bildungstrieb” does not and cannot replace previous reconstructions of the concept of “Bildung”, but at best complements them by drawing the reader’s attention once again to the roots of the concept of “Bildung” in the “Bildungstrieb” that lie beyond a purely cognitive, mental, subjectivist understanding of “Bildung”. According to an optimistic view, affective empathy is a route to knowledge of what it is like to be in the target person’s state (“phenomenal knowledge”). Roughly, the idea is that the empathizer gains this knowledge by means of empathically experiencing the target’s emotional state. The literature on affective empathy, however, often draws a simplified picture according to which the target feels only a single emotion at a time. Co-occurring emotions (“concurrent emotions”) are rarely considered. This is problematic, because concurring (...) emotions seem to support a sceptical view according to which we cannot gain phenomenal knowledge of the target person’s state by means of affective empathy. The sceptic concludes that attaining the epistemic goal of affective empathy is difficult, in practice often impossible. I accept the sceptic’s premises, but reject the conclusion, because of the argument’s unjustified, hidden premise: that the epistemic goal of affective empathy is phenomenal knowledge. I argue that the epistemic goal of affective empathy is phenomenal understanding, not knowledge. Attention to the under-explored phenomenon of concurring emotions clarifies why this is important. I argue that this is the decisive epistemic progress in everyday cases of phenomenal understanding of another person. (shrink)
