Contemporary health care often lacks generosity of spirit, even when treatment is most efficient. Too many patients are left unhappy with how they are treated, and too many medical professionals feel estranged from the calling that drew them to medicine. Arthur W. Leavitt It is always good to try to make peace, to try to resolve differences between whatsomebelieveare conflictingpoints ofview. Nevertheless, sometimes the points ofview which are believed to be opposed to each other really do oppose one another and so the most ingenious attempts at reconciliation turn out to have been ill-conceived. Wim Klever has brought considerable scholarship to bear in (...) his attempt to show that Hume and Spinoza were not so far apart as we thought.2 It was an especially pleasant surprise to see the comparison of their views on personal identity,3 for example. And he has made a convincing case for doubt that Hume's "sharp anti-Spinözistic utterings"4 in Treatise 1.4.5 were really sincere. In my opinion, however, Klever has gone too farin trying to bring together what should have been left asunder. Some ofhis points ofthe purportedly common ground shared by Hume and Spinoza are based on what I believe to be a blatant misreading ofSpinoza. Other points show a failure to appreciate a fundamental disagreement between Hume and Spinoza on central issues in the old Aristotelian tradition. Hume and Spinoza, like other philosophersofthe seventeenth and eighteenth centuries, can be best understood when one is aware ofthe Aristotelian background against which they were writing and with which they expected their readers to be familiar. Hume shows familiarity with Aristotelianism in his discussion of the "antient philosophy" at Treatise 1.4.3 as well as in his various remarks about scholasticism.6Spinoza'srelationshipto ChristianAristotelianism has been discussed by Wolfson6 and by myself,7 among others. And his relationship to Maimonides, who was his link to Jewish Aristotelianism, has been discussed by Harvey.8 1 shall base my claim that Hume and Spinoza were much further apart than Klever makes them out to be upon an attempt to identify some scholastic and Aristotelian issues and doctrines with respect to which Hume and Spinoza took very different stands. The firstthing which I wanttodraw attention toisKlever'sreading ofthe scholia to 2 Ethics 40, which bears on medieval disputes over the nominalistic, conceptualistic and realistic approaches to Aristotle's treatment of the problem of the universels. Since Spinoza allows that universal notions "are notformed by all men in the same way,"9 Klever Volume XVII Number 2 203 FRANK J. LEAVITT makes him out to be holding the same position which Hume expresses when he adopts Berkeley's opinion that "all general ideas are nothing but particular ones, annexed to a certain term" (T 17). And Klever claims "Hume and Spinoza are both thorough nominalists."10 But Klever misses the point that Hume denies that there are, in addition to particular ideas, universal ones, that is, common notions, while Spinoza clearly admits, in the second scholium to 11 Ethics 40, the difference which Hume denies. According to Spinoza we have (1> confused representations of particular things, and (2) remembered ideas which are "similar to those through which we imagine things." These latter are ideas of the sort which Hume recognized. But in addition tothese two, which Spinoza calls "opinion" and "imagination," Spinoza claims that we have (3) "notions common to all men, and adequate ideas ofthe properties ofthings." These are notions of"those things which are common to all, and which are equallyin a part and in the whole [and which] cannotbe conceived exceptadequately"(2Ethics 38). These notions, which parallel Descartes' "clear and distinct ideas" are the general abstract ideas which Hume denies in Treatise 1.1.7. There Hume denies that ideas can be general "in their nature" but allows that they can be general "in their representation." To the extent to which Hume's position can be called "nominalism," the passages to which I have referred show that Spinoza, who basically accepted the Cartesian doctrine ofclear and distinct ideas, was not a nominalist. Aristotle drew a sharp distinction between imagination and thought in De anima 2.3. Descartes preserved the distinction between imagination and intellection at the beginningofthe fourth Meditation, among other places. Bradley succeeded in conceptualizing biological productivity in terms—monetary investment vs. profit—that could be applied to organisms as different in form and habitat as trees, grapevines, and crayfish.41 This form of measurement was not precise enough to have served as a basis for actual comparisons of production rate. His way of thinking, however, could have been applied with other terms of measurement once the usefulness of such measurements had been realized. The realization that production rate is an important factor is implicit (...) in his discussions, but for his purposes, yearly yields were generally sufficiently precise determinations.Although Bradley drew substantially upon the contributions of others, his writings represent a significant beginning for productivity ecology. All of the kinds of investigations that he reported could have been extended, rendered more precise, and formed the basis of ecological generalizations during the eighteenth century.There were, however, certain conceptual limitations imposed by a lack of relevant knowledge in physiology and in physical science. A good understanding of productivity ultimately depends upon an understanding of metabolism, which in turn depends upon an understanding of photosynthesis, respiration, biochemistry, and the first and second laws of thermodynamics. I attribute an 'intensional reading' of the second incompleteness theorem to its author, Kurt G del. My argument builds partially on an analysis of intensional and extensional conceptions of meta-mathematics and partially on the context in which G del drew two familiar inferences from his theorem. Those inferences, and in particular the way that they appear in G del's writing, are so dubious on the extensional conception that one must doubt that G del could have understood his theorem extensionally. However, (...) on the intensional conception, the inferences are straightforward. For that reason I conclude that G del had an intensional understanding of his theorem. Since this conclusion is in tension with the generally accepted view of G del's understanding of mathematical truth, I explain how to reconcile that view with the intensional reading of the theorem that I attribute to G del. The result is a more detailed account of G del's conception of meta-mathematics than is currently available. (shrink)

This forms the basis for a more encompassing research of Kevelson’s position, work and philosophical background, which the authors call for. A quick and enlightening read, this book interests a wide range of readers with an interest in legal history and the fields which Kevelson both drew on and influenced, including lawyers, students and scholars. Like the Copernican revolution which initiated the Modern project, there has been a thermodynamic revolution in the empirical sciences in the last two centuries. The aim of this paper is to show how we might draw from this revolution to make new and startling metaphysical and ethical claims concerning the nature and value of reality. To this end, this paper employs Aristotle’s account of the relation of the various philosophies and sciences to one another to show how we might assert (...) a new theory of being, moral value, and practical action from the primacy of entropic decay asserted in the contemporary mathematical sciences. This paper proceeds to show how, from what the contemporary sciences have concluded concerning the primacy of entropic decay within reality, unbecoming might be forwarded as a new account of the essence of existence: i.e., the first cause and motivating principle of reality’s formal, material, efficient, and final nature. The paper concludes by arguing that a new and surprising account of universal ethical value and normative duty can be deduced from such a metaphysics of decay. (shrink)

How could ectogestative technology disrupt gender roles, parenting practices, and concepts such as ‘birth’, ‘body’, or ‘parent’? In this chapter, we situate this emerging technology in the context of the history of reproductive technologies and analyse the potential social and conceptual disruptions to which it could contribute. An ectogestative device, better known as ‘artificial womb’, enables the extra-uterine gestation of a human being, or mammal more generally. It is currently developed with the main goal of improving the survival chances of (...) extremely premature neonates. We argue that the intended use of the technology in neonatal intensive care units, as an alternative to current incubators (’partial-ectogestation’), challenges concepts such as ‘birth’, ‘fetus’, and ‘neonate’, and has several ethico-legal implications. We moreover address a more futuristic scenario where the entire embryological and fetal development could happen within an artificial womb (’full-ectogestation’). Such a scenario reveals the disruption of gender roles, parenting practices, and concepts such as ‘mother’, ‘father’, and ‘parent’. Speaking Being: Werner Erhard, Martin Heidegger, and a New Possibility for Being Human provides an unprecedented study of the ideas and methodology originally developed by the thinker Werner Erhard, and presented in a course called The Forum, a course that has since evolved further and is offered today by Landmark Worldwide. The book is a comparative analysis that demonstrates how Erhard's rhetorical project and the philosophical project of Martin Heidegger each illuminate the other. The central claim of the authors is (...) that the dialogue of The Forum--presented here in the form of a transcript of an actual course that took place in San Francisco in December of 1989--functions to generate a language which speaks Being, that is, The Forum is an instance of what is called ontological rhetoric: a technology of communicating the unspoken realm of language that allows its listeners to create a new possibility for being human in the world. The purpose of this book is to show that this is actually accomplished in The Forum, and to demonstrate--with Heidegger's thinking presented in a series of "Sidebars" and "Intervals" alongside The Forum transcript --how Erhard did it in 1989. Philosopher and physician Drew Leder shows how a phenomenology of lived embodiment reveals a series of healing strategies available in the face of the bodily breakdowns and challenges that are a part of the human condition.

Famously Ryle imagined a visitor who has seen the colleges, departments, and libraries of a university but still wonders where the university is. The visitor fails to realize that the university consists of these organizational units. In this paper I ask what exactly the relation is between institutional entities such as universities and the entities they are composed of. I argue that the relation is constitution, and that it can be illuminated in terms of constitutive rules. The understanding of the (...) ontology of institutions that constitutive rules provide, however, is incomplete. In order to capture the practical significance of institutions, I introduce the notion of a status rule. Status rules concern the normative powers of institutions. The status account of institutions defended here is used to solve the problem of freestanding status terms: it turns out to be rather difficult to identify the entities of which statuses such as corporations and electronic money are composed. Unable to solve this problem, Searle concludes that they are created out of thin air. I criticize this claim and argue that these statuses are imposed on persons. (shrink)

A provocative and entirely new account of ethical reasoning that reconceives the traditional understanding of ethical action negatively -/- In this radical reconsideration of ethical reasoning in contemporary European philosophy, Drew M. Dalton makes the case for an absolutely grounded account of ethical normativity developed from a scientifically informed and purely materialistic metaphysics. Expanding on speculative realist arguments, Dalton argues that the limits placed on the nature of ethical judgments by Kant’s critique can be overcome through a moral evaluation of (...) the laws of nature—specifically, the entropic principle that undergirds the laws of physics, chemistry, and biology. In order to extract a moral meaning from this simple material fact, Dalton scrutinizes the presumptions of classical accounts and traditional understandings of good and evil within the history of Western philosophy and ultimately asserts that ethical normativity can be reestablished absolutely without reverting to dogmatism. -/- By overturning our assumptions about the nature and value of reality, The Matter of Evil: From Speculative Realism to Ethical Pessimism presents a provocative new model of ethical responsibility that is both logically justifiable and scientifically sound. How should we react to the contention that there is empirical evidence showing that many judge Gettier cases to be cases of knowledge, contrary to the verdict of most analytical philosophers about these cases? I argue that there is no single answer to this question. The discussion is set inside a view about how to view the role and significance of intuitive responses to some of philosophy's famous thought experiments. This paper tries to ‘liberate’ Augustine’s view on time from certain modern prejudices, e.g. that the church father’s theory of time involves the modern dichotomy between subjectivism and objectivism (Ricœur), that his understanding of time can be seen as a precursor of modern phenomenology (Husserl, Heidegger), that Conf. XI lacks a coherent theory of time as such or that, at least, it falls short of the insights of Kant’s enlightened transcendentalism (Flasch). By contrast, the church father circumvents typically modern aporiai (...) by both differentiating between time on the level of physics and time on the level of soul as well as by accounting for the link between these two ‘times’: Whereas the time of physics tends to non–existence, it is the soul that, by cognizing a certain process in its (relative) entirety, establishes actual time; on the level of soul, time persists and is preserved (in contrast to physical time). Neither does Augustine propose nor need the notion of any ‘absolute time’. Maybe Augustine’s theory of time is compatible with certain assumptions of modern physics (e.g. Einstein’s theory of relativity) although the church fathers’ view can in no way be reduced to the level of physics. Why is it that some instances of disagreement appear to be so intractable? And what is the appropriate way to handle such disagreements, especially concerning matters about which there are important practical and political needs for us to come to a consensus? In this paper, I consider an explanation of the apparent intractability of deep disagreement offered by hinge epistemology. According to this explanation, at least some deep disagreements are rationally unresolvable because they concern ‘hinge’ commitments that are unresponsive to (...) rational considerations. This explanation, if correct, seems to have troubling implications for how we should respond to deep disagreement. If my position on a topic is not responsive to rational considerations, then what choice have I but to dogmatically hold to that position, and simply dismiss the views of those with whom I disagree? I address this problem by identifying an attitude of intellectual humility that is appropriate to have towards one's hinge commitments, and suggest that this attitude provides the basis for a non-rational, constructive way to resolve deep disagreement. We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

The present study seeks to lay out the most basic elements of the ontology of classical Aš‘arite theology. In several cases this requires a careful examination of the traditional and the formal lexicography of certain key expressions. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Nous essayons ici de presenter les éléments fondamentaux de l'ontologie de l'aš‘arisme classique. Pour quelques expressions, il a fallu examiner la lexicographie et ordinaire et technique pour bien comprendre leur emploi et leur signification. Our intention here is to present the essential character of classical, sunnī kalām within a strictly formal perspective and to set out its basic aspects. It was conceived by the mutakallimīn as a rational, conceptual, and critical science and, although kalām differed in a number of basic concepts and constructs and in its analytic system, the topical organisation of the major compendia parallels that of metaphysics as understood in the contemporary Aristotelian tradition. The debates between kalām and falsafa need to (...) be examined within this context. Kalām, however, is theological in the strict sense of the term and it is as such that its problematic and its procedures are primarily to be understood. Thus seen, the object of kalām is to rationalise the cognitive content presented to Believers in the symbolic language of the koranic revelation. It has, then, four principal tasks, sc, to conceptualise, to order, to explain, and where possible to justify the primary doctrines of the community whose belief is held to be normative. Within this framework the differences that characterise the major schools as such and the various tendencies of individual masters within each school may readily be brought to light. II avait été conçu par les mutakallimin comme une science rationelle, conceptuelle et critique. This is a comprehensive study of the far-reaching changes that led to a re-shaping of the philosophical discourse in Islam during the sixth/twelfth century. Whereas earlier Western scholars thought that Islam's engagement with the tradition of Greek philosophy ended during that century, more recent analyses suggest its integration into the genre of rationalist Muslim theology (kalam). This book proposes a third view about the fate of philosophy in Islam. It argues that in addition to this integration, Muslim theologians picked up (...) the discourse of philosophy in Islam (falsafa) and began to produce books on philosophy. Written by the same authors, books in these two genres, kalām and philosophy, argue for opposing teachings on the nature of God, the world's creation, and on the afterlife. This study explains the emergence of a new genre of philosophical books called "hikma" that stand opposed to Islamic theology and at the same wishes to complement it. Offering a detailed history of philosophy in Iraq, Iran, and Central Asia during the sixth/twelfth century together with an analysis of the circumstances of practicing philosophy during this time, this study can show how reports of falsafa, written by major Muslim theologians such as al-Ghazali (d. 505/1111), developed step-by-step into critical assessments of philosophy that try to improve philosophical teachings, and eventually become fully fledged philosophical summas in the work of Fakhr al-Din al-Razi (d. 606/1210). The book ends in a discussion of the different methods of kalam and hikma and the coherence and ambiguity of a Muslim post-classical philosopher's œuvre. (shrink)

Sohn-Rethel’s great idea was to ‘socialise’ Kant’s transcendental subject by combining it with Marx’s commodity-form. In so doing, he took on three challenges simultaneously: a) the timeless validity of modern natural science; b) the social genesis of empirically pure forms of cognition; and c) socialisation occurring through a purely social synthesis. However, Sohn-Rethel construed Marx’s value-form analysis as an empirical exchange of commodities and held that such exchange performs a real abstraction – in this way, he laboured under the very (...) semblance that money engenders at the surface of society by virtue of its function qua means of exchange. This semblance can be rendered transparent by, on the one hand, explaining value in terms of capitalist valorisation rather than as a product of abstraction, and, on the other, developing money as the measure and form of this valorisation.
