The purpose of this paper is to show how interdisciplinary studies between the fields of law and literature can contribute to the debate on legal interpretation, and to the role of what legal operators actually do when deciding constitutional issues. First, we will review one of the possible meeting points between law and literature - i. e. law as literature - and we will examine Roland Barthes’ semiological proposal, specifically his theory about “The Death of the Author”; from there on, (...) we will show how the ideas and concepts he coined constitute one of the tools that best describe the mechanics of the current constitutional interpretation in some legal systems. Más adelante, se proponen también dos líneas de investigación adicionales. Se sugiere que los estudios históricos deben iluminar el realismo jurídico como parte de un cambio intelectual a largo plazo del pensamiento social occidental, un cambio precipitado por variaciones socioeconómicas, como la segunda revolución industrial, el desarrollo de la secularización, y la llegada del estado de bienestar regulador, así como por (...) transformaciones intelectuales tales como el avance del materialismo científico y el naturalismo. This paper analyses the details that characterized the negotiation and collection of the servicio de los naturales from the year 1603 onwards, the last time of those three in which moriscos of Granada paid to the Hispanic Monarchy after the Alpujarras War, when they were settled in Castile. The author has analysed documents coming from the Archivo General de Simancas, but also those included in notary’s protocols and in local archives. Its main contributions are three: to publish the content of (...) the actual contract signed by the moriscos and the Crown; to contribute to set up a precise spatial distribution of the communities that paid the tax and, finally, to show the amounts delivered by them. Irregularities, problems, and conflicts lived while the precedent servicios were being paid, are analysed too. There are aspects that we know thanks to other previous works. Nevertheless, if they are considered in relation with the situation of the year 1603, they allow observing that all those difficulties were used in order to improve the servicio itself and the agreement between the minority and the King. En el presente trabajo se sostienen toda una serie de tesis interrelacionadas. En primer lugar, se argumenta que el escepticismo y el pensamiento crítico no gozan de especial buena salud el ámbito de la teoría social. En segundo lugar, se sostiene que esto es también así a nivel social general. En tercer lugar, se discuten algunos mecanismos que pueden permitir explicar por qué el bullshit y el oscurantismo, y no el pensamiento crítico y el escepticismo, proliferan en ambos contextos. En (...) cuarto lugar, se abordan tres ámbitos donde la crisis del pensamiento crítico resulta especialmente grave, tanto a nivel social como académico: a saber, los movimientos ecologista, feminista y antirracista. En este caso, se defiende que no se trata tan solo de que el bullshit y el oscurantismo estén presentes en estos debates tanto en el campo académico como en el político, sino que existe una relación causal entre ambos ámbitos, así como un proceso de falsificación de preferencias que puede ser peligroso tanto para la libertad intelectual, como para la libertad de expresión y la salud de la democracia. A cien años de la publicación de A Treatise on Probability, de J. M. Keynes, este artículo indaga sobre su relevancia en la historia del concepto de “probabilidad”. Tras repasar el surgimiento y evolución del concepto moderno de “probabilidad” hasta principios del siglo XX, se identifica un punto nodal en la publicación del Ars Conjectandi de J. Bernoulli a principios de siglo XVIII, en donde se propuso de forma original tratar el campo completo de las conjeturas probables mediante el herramental (...) matemático de la doctrina de las posibilidades. El artículo busca comprender el Treatise keynesiano como una reacción a dicho proyecto encarnado en el siglo XVIII por la escuela clásica laplaciana y en el XIX por la escuela frecuentista. Tras presentar los principales argumentos de Keynes en contra de la concepción de la probabilidad como una entidad necesariamente medible y, por ende, tratable mediante el herramental matemático de la doctrina de las posibilidades, se extraen reflexiones sobre la relevancia y actualidad del Treatise. Pode definir-se o alcance da tese que está subjacente aos estudos de M. Martins: - a existência du. duma constante no Homem, quando este é considerado globalmente, como ser vivo e senhor de sentimentos e de aspirações em larga medida comuns a todos os tempos. Os termos (...) em que o homem medieval experimentou e desenvolveu tão complexa teia de relações na sua época - de ideias, de gostos, de crenças, de volições e de vivências, e sobre aquela, nos textos quenos legou pôde reflectir em plano. especulativo - tal foi o objecto prioritário da diuturna inquirição do nosso Autor. Tese essa que supõe, para conveniente compreensão e tratamento dos temas, se reconheça a funcionalidade interdisciplinar dos agentes da cultura. É esta noção que leva M. Martins releas, thus, to a comparative methodology, giving special emphasis on interrelationships; diverse philosophical doctrines, historical sources, tradional myths and legends archetypes revealed in arcajc poetry, popular novelas, etc. What we find is avast network of spirituality that brings together East and West, Antiquity and the Middle Ages, the Middle Ages and our oun times. As historica of interrelationships, M. Martins' work can contribute to the need revision of concepts in current Portuguese historical studies. Unpublished letters and bibliography of the author can be found in apendix. These reveal the personality traits and the central themes of this medievalist. (shrink)

Varela (1946-2001) studied biology in Santiago de Chile, obtained his doctorate 1970 at Harvard University with a (...) dissertation on the insect eye, and worked there for some time in the laboratory of Torsten Wiesel, the later Nobel Laureate for medicine. From his scientific beginnings as a researcher in biology, he not only studied and practiced biology but, resisting the dominating mainstream, pursued a research program that ignored and broke down traditional disciplinary boundaries. This research program is best characterized as experimental epistemology, a concept introduced by the neuropsychiatrist and cybernetician Warren S. McCulloch. Francisco J. Varela's great aspiration was to examine and answer the philosophical ur-question of cognition with scientific precision and with the help of the best possible theoretical framework. The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

Worldwide, vulnerable neighbourhoods of large cities are often the scene of collective violent conflicts linked with migration and ethnic minorities’ struggles for social justice. However, urban conflicts of this kind have not taken place in Spanish cities with high immigration rates, even though the country has been deeply affected by two recent socioeconomic crises (2009 and 2020). This article reports findings of a study aimed at understanding what lies behind this apparent social peace. The research methodology was based on an (...) analysis of secondary socio-economic and socio-relational data from the Spanish Institute of Statistics and from key national surveys and reports. Results confirmed that immigrant population living in the country are strongly segregated in the lower strata of the labour and socioeconomic structure and have been disproportionately affected by the crises. However, research findings also pointed to the existence of strong closed support networks where social capital has been effective at palliating members’ disadvantage and unrest. Drawing on the Theory of Rupture Frames, we argue that this is a fragile and unsustainable social peace, rooted in social injustice, and anticipate that unless actively prevented, uncontrolled conflict will eventually emerge in main cities’ neighbourhoods in Spain. This article identifies a double allusion to the tragic characters of Phaedra and Eriphyle in Amm. Marc. 14.1.3 and considers its possible meanings. In combination, these allusions evoke the double nature of the story of Eriphyle, therefore functioning as a reference to the double nature of Caesar Gallus’ depiction in Ammianus. The double allusion consequently forms part of Ammianus’ tragic style throughout Book 14. Having identified the presence of this double allusion, the article illuminates its possible meaning by connecting Ammianus’ (...) passage to the Virgilian rewriting of the description of Eriphyle in Homer. The question whether ethical behavior is biologically determined may refer either to the capacity for ethics (i.e., the proclivity to judge human actions as either right or wrong), or to the moral norms accepted by human beings for guiding their actions. I herein propose: (1) that the capacity for ethics is a necessary attribute of human nature; and (2) that moral norms are products of cultural evolution, not of biological evolution. Humans exhibit ethical behavior by nature because their biological makeup (...) determines the presence of three necessary conditions for ethical behavior: (i) the ability to anticipate the consequences of one’s own actions; (ii) the ability to make value judgments; and (iii) the ability to choose between alternative courses of action. Ethical behavior came about in evolution not because it is adaptive in itself, but as a necessary consequence of man’s eminent intellectual abilities, which are an attribute directly promoted by natural selection. That is, morally evolved as an exaptation, not as an adaptation. Since Darwin’s time there have been evolutionists proposing that the norms of morality are derived from biological evolution. Sociobiologists represent the most recent and most subtle version of that proposal. The sociobiologists' argument is that human ethical norms are sociocultural correlates of behaviors fostered by biological evolution. I argue that such proposals are misguided and do not escape the naturalistic fallacy. The isomorphism between the behaviors promoted by natural selection and those sanctioned by moral norms exist only with respect to the consequences of the behaviors; the underlying causations are completely disparate. _Dialectic and Dialogue_ seeks to define the method and the aims of Plato's dialectic in both the "inconclusive" dialogues and the dialogues that describe and practice a method of hypothesis. Departing from most treatments of Plato, Gonzalez argues that the philosophical knowledge at which dialectic aims is nonpropositional, practical, and reflexive. The result is a reassessment of how Plato understood the nature of philosophy.

La relevancia de Vico en cuanto precursor de la noción de "comprensión" y adelantado de la rehabilitación de las "Ciencias del Espíritu" ha sido frecuentemente puesta de manifiesto. Ha sido mucho menos estudiada en España, sin embargo, la contribución seminal de Johann G. Herder, que, independientemente de Vico, desarrolla en el último tercio del siglo XVIII un interesante esbozo de teoría de la "comprensión".Vico's relevance as precursor of the concept of "comprehension" and pioneer of the rehabilitation of the "Geisteswissenschaften" is (...) well known. It's not been studied as much in Spain, however, the founding contribution of Johann G. My purpose in this article is to propose an explicitly naturalized account of the experience of present nowness on the basis of two complementary sources: phenomenological analysis and cognitive neuroscience. What I mean by naturalization, and the role cognitive neuroscience plays will become clear as the paper unfolds, but the main intention is to use the consciousness of present time as a study case for the phenomenological framework presented by Depraz in this Special Issue.

In _Ecological Ethics and the Human Soul: Aquinas, Whitehead, and the Metaphysics of Value_, Francisco J. Benzoni addresses the pervasive and destructive view that there is a moral gulf between human beings and other creatures. Thomas Aquinas, whose metaphysics entails such a moral gulf, holds that human beings are ultimately separate from nature. Alfred North Whitehead, in contrast, maintains that human beings are continuous with the rest of nature. These different metaphysical systems demand different ethical stances toward creation. Benzoni (...) analyzes and challenges Thomas's understanding of the human soul, his primary justification for the moral separation, arguing that it is finally philosophically untenable. The author finds promising the alternative metaphysics of Whitehead, for whom human beings are a part of nature—even if the highest part; all creatures have a degree of subjectivity and creativity, and thus all have intrinsic value and moral worth, independent of subjective human valuation. Further, though there is difference, there is no moral gulf between God and the world. God is truly affected by the experience of creatures. This article attempts to elucidate the Deleuzian philosophy of the event between The Logic of Sense and A Thousand Plateaus, where it acquires clearly political nuances. With regard to The Logic of Sense, I show that (i) it takes up the definition of the event of Difference and Repetition, identifying it with that redistribution of pre-individual singularities or individuating differences at the level of the univocal being which defines the conditions of problems; (ii) the event is henceforth also the instance (...) that makes possible the “communication” of the heterogeneous series of bodies and propositions from which the production of sense in language follows; and (iii) the counter-effectuation should be understood in this book as an ethics of the event. With regard to A Thousand Plateaus, I emphasize (i) the “return” to The Logic of Sense that the concept of assemblage entails, (ii) the reformulation of the notion of event that takes place in the new theoretical framework, and (iii) that of the counter-effectuation, which must henceforth be understood as a politics of the event. Pendant l’ete de 1928 Heidegger a offert un seminaire sur le troisieme livre de la Physique d’Aristote et donc sur l’explication aristotelicienne de la nature du mouvement. La derniere seance de ce cours, qui eut lieu le 25 juillet, est d’une grande importance parce que c’est a cette occasion que Heidegger va au livre neuf de la Metaphysique pour essayer de comprendre la notion ontologique qui est a la base de l’interpretation aristotelicienne du mouvement : l’energeia. Mais dans les protocoles (...) de ce seminaire qui se trouvent parmi les papiers de Heidegger et qui ont ete publies recemment dans le volume 83 de la Gesamtausgabe, la seance du 25 juillet se trouve absente. Ce fait a conduit l’editeur a conclure que le seminaire avait pris fin le 23 juillet, sans s’apercevoir donc que la conclusion du seminaire manquait. Il existe heureusement une transcription preservee parmi les papiers de l’etudiante de Heidegger, Helene Weiss, et accessible aujourd’hui dans les archives de l’universite de Stanford. Cette transcription montre que la derniere session eut bien lieu le 25 juillet et nous offre la lecture heideggerienne de Metaphysique IX qui ne se trouve pas dans la version de la Gesamtausgabe. C’est dans le contexte de cette lecture que Heidegger fait la declaration etonnante qui nous concerne ici : ≪Dans la derniere instance, la Metaphysique Θ revient a Platon ; la priorite de l’energeia est fondamentalement la meme chose que l’epekeina des Idees. ≫La première tâche que je me propose ici sera d’expliquer cette déclaration qui suggère une relation tres etroite, ou meme une identite, entre la notion aristotelicienne de l’energeia comme ayant une priorite vis‑a‑vis de la dunamis et la notion platonicienne de l’Idee du Bien comme etant epekeina de l’ousia. Pour cette explication je ferai appel non seulement au contexte du seminaire de 1928, mais aussi aux textes plus tardifs comme les Beitrage et les cours sur Nietzsche dans lesquels Heidegger semble presupposer et développer sa déclaration de 1928. Ma seconde tâche sera de comparer cette thèse heideggerienne a la tentative de Gadamer de surmonter l’opposition traditionnelle entre les ontologies de Platon et d’Aristote en faisant appel a l’idee du bien chez les deux. Cette tentative se trouve dans le texte Die Idee des Guten zwischen Plato und Aristoteles. La comparaison que j’entreprends ici va montrer certaines affinites entre les interpretations de l’Idee du Bien chez Heidegger et Gadamer, mais aussi de profondes differences qui vont determiner leurs differents projets philosophiques. What is often identified with Plato’s doctrine of love is greatly complicated, if not even compromised, by the dialogical form in which it is presented. In the first place, this account of love in placed in the mouth of a character, Diotima, who as priestess and woman seeking to initiate Socrates into mysteries he may not be able to follow is sharply distinguished from the philosopher. Furthermore, even the ideal portrait of the philosopher we find in the character of Socrates (...) is rendered suspect by the fanaticism and erotic idolatry of those who narrate the dialogue, Apollodorus and Aristodemus. When these narrative complications are taken into account, what emerges is a tension between the mortal knowledge of the philosopher, continually demanding to be reborn by its continual retreat into oblivion, and that secure knowledge and possession of divine reality that the philosopher can only dream of. This paper sets forth a familiar theme, that science essentially consists of two interdependent episodes, one imaginative, the other critical. Hypotheses and other imaginative conjectures are the initial stage of scientific inquiry because they provide the incentive to seek the truth and a clue as to where to find it. But scientific conjectures must be subject to critical examination and empirical testing. There is a dialogue between the two episodes; observations made to test a hypothesis are the inspiration for new (...) conjectures. Inductive generalizations may also inspire hypotheses, but cannot validate them. A hypothesis is empirically tested by ascertaining whether or not predictions about the world of experience deduced from the hypothesis agree with what is actually observed. This has been appropriately considered the 'criterion of demarcation' that distinguishes science from other knowledge. But scientific hypotheses must satisfy other tests as well, e.g., whether they have explanatory value and further understanding. I briefly explore such issues as verifiability and falsifiability, empirical content and truthfulness, contingency and certainty, fact and theory, error and fraud. Science like any human activity is subject to error and to the foibles and other failings of human beings. But severe attempts of empirical falsification and other trials yield knowledge that stands the test of time and provides a foothold for further knowledge. Moreover, scientists have developed social mechanisms, such as peer review and publication, to evaluate their work. Because the research of scientists depends on the validity of previous knowledge, it is of great consequence that they discern valid from invalid knowledge and thus scientists are inclined to transcend ideology, nationality, friendship, monetary interest and other prejudices when the mettle of scientific knowledge is at stake. I use historical examples to illustrate some relevant aspects of scientific practice: its success (Mendel), misrepresentation (Darwin), ideological abuse (Lysenko), arrogant violation of the requirement of testing (Koch), theory replacement (Priestly and Lavoisier, Newton and Einstein), and the indispensability of context (Oswald Avery and Alfred Wegener). Dans le passé, l’intellectuel était situé à l’avant-garde de la société civile à propos de l’établissement de l’opinion publique, d’après un model « transcendant » qui faisait de lui une sorte de directeur spirituel du peuple. Le présent travail a par objectif approfondir dans la caractérisation de l’intellectuel spécifique qui donne Foucault dans des textes brefs et entretiens de la décade des 70, à partir des études de base historiographique à propos des concepts du gouvernement de soi et des autres, (...) alèthurgie et parrêsia qui l’ont occupé dans des années 80, et aussi de la distinction kantienne parmi les usages public et privé de la raison. En plus, on veut élucider la transition du model de l’intellectuel « universel » à celui de l’intellectuel « spécifique » dans la deuxième moitié du XX e siècle et finalement on veut clarifier la catégorie politique la plus adéquate à l’action parrêsiastique de l’intellectuel spécifique, que plutôt que l’objection de conscience c’est la désobéissance civile. The question whether ethical behavior is biologically determined may refer either to thecapacity for ethics (e.i., the proclivity to judge human actions as either right or wrong), or to the moralnorms accepted by human beings for guiding their actions. My theses are: (1) that the capacity for ethics is a necessary attribute of human nature; and (2) that moral norms are products of cultural evolution, not of biological evolution.Humans exhibits ethical behavior by nature because their biological makeup determines the presence (...) of the three necessary, and jointly sufficient, conditions for ethical behavior: (i) the ability to anticipate the consequences of one's own actions; (ii) the ability to make value judgements; and (iii) the ability to choose between alternative courses of action. Ethical behavior came about in evolution not because it is adaptive in itself, but as a necessary consequece of man's eminent intellectual abilities, which are an attribute directly promoted by natural selection.
