Droit et morale Sous la direction de Dominique Bureau, France Drummond et Dominique Fenouillet Véritable « pont aux ânes de la pédagogie juridique », la question des relations qu'entretiennent Droit et Morale appelle une réponse doctrinale presque invariable: la séparation de principe n'exclurait pas l'influence réciproque. Le droit contemporain semble pourtant traversé par deux courants a priori antinomiques: ici, la référence morale est invoquée comme une sorte de « tabou » qui justifierait le retrait du droit, alors que, (...) là, elle est appelée en renfort pour justifier telle solution ou fonder telle réforme. C'est de cette étrange coexistence du « retour offensif » et du « tabou » qu'est née l'idée d'organiser un colloque sur le thème « Droit et Morale. Aspects contemporains » en privilégiant une approche interdisciplinaire. Le 4 juin 2010, dans le cadre des journées d'étude qu'il consacre au pluralisme, le Laboratoire de sociologie juridique de l'Université Paris II accueillait donc les réflexions croisées d'Olivier Descamps, Dominique Fenouillet, Michel Germain, Valérie Malabat, Horatia Muir Watt, Cécile Pérès, Marc Pichard, Jean-Emmanuel Ray et Jean-Louis Sourioux. L'ouvrage ici présenté s'est enrichi des contributions supplémentaires d'Éric Martin-Hocquenghem et de Mustapha Mekki. Puisse cette publication contribuer à éclairer les relations singulières qu'entretiennent le Droit et la Morale. This book sets out some of the latest scientific findings around the evolutionary development of religion and faith and then explores their theological implications. This unique combination of perspectives raises fascinating questions about the characteristics that are considered integral for a flourishing social and religious life and allows us to start to ask where in the evolutionary record they first show up in a distinctly human manner. The book builds a case for connecting theology and evolutionary anthropology using both historical (...) and contemporary sources of knowledge to try and understand the origins of wisdom, humility, and grace in 'deep time'. In the section on wisdom, the book examines the origins of complex decision-making in humans through the archaeological record, recent discoveries in evolutionary anthropology, and the philosophical richness of semiotics. The book then moves to an exploration of the origin of characteristics integral to the social life of small-scale communities, which then points in an indirect way to the disposition of humility. Finally, it investigates the theological dimensions of grace and considers how artefacts left behind in the material record by our human ancestors, and the perspective they reflect, might inform contemporary concepts of grace. This is a cutting-edge volume that refuses to commit the errors of either too easy a synthesis or too facile a separation between science and religion. As such, it will be of interest to scholars of religious studies and theology - especially those who interact with scientific fields - as well as academics working in anthropology of religion. This chapter addresses the issues that motivate representationalist accounts, and it describes the different versions of representationalism as responses to these issues. It argues that the representationalist views do not adequately respond to the epistemological problems that motivate them and that they engender some ontological problems. The chapter presents an alternative ‘presentationalist’ account that preserves the straightforward sense of the mind's openness to the world. While representationalism and presentationalism agree that the relation between mental events or states is direct but (...) mediated, they radically differ in their views of the nature of the mediation involved in the mind's intentional directedness to the world. This difference and the preferability of the presentationalist account are explored. (shrink)

The Lowell Institute in Boston, Massachusetts, founded in 1836, supports an annual series of distinguished lectures. Henry Drummond, the influential Scottish scientist, Free Church minister, explorer and evangelist published his Lowell Lectures as The Ascent of Man in 1894. This provocative book examines Darwinism in a Christian context. It describes the rise of man, who is considered the highest purpose of the universe, and his relations with the lower animals. In particular, it addresses the question of altruism and its (...) role in promoting the survival of the fittest, which Drummond argues had been overlooked. Drummond claims, unlike traditional evolutionary theory, that the force of evolution is not only the struggle for life, but also the struggle for the life of others. His book, which aroused great interest in its time, remains of importance for historians and philosophers of science today. (shrink)

This paper both welcomes and explores the recent article in Nursing Philosophy by Dave Holmes and Denize Gastaldo. Holmes and Gastaldo's paper introduced us to Deleuze and Guattari's philosophical concepts of ‘arborescent thought’ and ‘rhizomatic thought’, respectively. These concepts were used to illuminate and critique certain aspects of contemporary nursing theory and educational practice. Arborescent thought is held to stifle and constrain the development of the discipline of nursing, while rhizomatic thought is presented as a more fitting way forward across (...) a diversity of knowledges and methods of inquiry. We are thus urged to engage in a metamorphosis from an arborescent way of thinking to a rhizomatic one. The paper below, while applauding the introduction of these concepts into nursing thought, raises some questions as to their proposed utility and relationship as given in the paper by Holmes and Gastaldo. This is done in a spirit of collaboration, motivated by a desire to further explore the philosophy of Gilles Deleuze (and Felix Guattari). (shrink)

The terms “empathy” and “sympathy” are often used interchangeably, and the terms “sympathy” and “compassion” are also often used interchangeably. In other words, empathy sympathy, and compassion seem to be one thing. I shall argue, to the contrary, that there are important differences between three. I shall distinguish empathy from sympathy and compassion on the ground that empathy is not an afective experience; I shall show how empathy underlies sympathy and compassion; and I shall clarify the nature of the three (...) kinds of experience. Raimond Gaita's example of saintly love, in which the visit of a nun to psychiatric patients has profound effects on him, has been criticised for being an odd and unconvincing example of saintliness. I defend Gaita against four specific criticisms; firstly, that the nun achieves nothing spectacular, but merely adopts a certain attitude towards people; secondly, that Gaita must already have certain beliefs for the example to work; thirdly, that to be acclaimed a saint requires a saintly biography, not just (...) an incidence of good behaviour; and finally, that there is something oppressive about saintly behaviour. I consider that Gaita does indeed leave himself open to criticism on this last point by claiming that saints love impartially. I argue that his description of the example suggests rather that the customs and practices of partial love are at the heart of saintliness and not some form of 'life-denying' impartiality. If I am right, then this has the twofold effect of making saintliness appear achievable by ordinary mortals and explaining our feelings of wonder in the face of such saintly behaviour. (shrink)

Many people with religious beliefs, pro or con, are aware that those beliefs are denied by a great number of others who are as reasonable, intelligent, fair-minded, and relatively unbiased as they are. Such a realization often leads people to wonder, “How do I know I’m right and they’re wrong? How do I know that the basis for my belief is right and theirs is misleading?” In spite of that realization, most people stick with their admittedly controversial religious belief. With the advent of CRISPR gene-editing technology, designer babies have become a reality. Françoise Baylis insists that scientists alone cannot decide the terms of this new era in human evolution. Members of the public, with diverse interests and perspectives, must have a role in determining our future as a species.

What happens when something happens? In Thinking the Event, senior continental philosophy scholar François Raffoul undertakes a philosophical inquiry into what constitutes an event as event, its very eventfulness: not what happens or why it happens, but that it happens, and what "happening" means. If, as Leibniz posited, it is true that nothing happens without a reason, does this principle of reason have a reason? For Raffoul, the event always breaks the demands of rational thought. Bringing together philosophical insights from (...) Heidegger, Derrida, Nancy, and Marion, Raffoul shows how the event, in its disruptive unpredictability, always exceeds causality, subjectivity, and reason. It is that "pure event," each time happening outside or without reason, which remains to be thought, and which is the focus of this work. In the final movement of the book, Raffoul takes on questions about the inappropriability of the event and the implications this carries for ethical and political considerations when thinking the event. In the wake of the exhaustion of traditional metaphysics, the notion of the event comes to the fore in an unprecedented way, with key implications for philosophy, ontology, ethics, and theories of selfhood. Among the cognitive capacities of evolved creatures is the capacity to represent. Theories in cognitive neuroscience typically explain our manifest representational capacities by positing internal representations, but there is little agreement about how these representations function, especially with the relatively recent proliferation of connectionist, dynamical, embodied, and enactive approaches to cognition. In this talk I sketch an account of the nature and function of representation in cognitive neuroscience that couples a realist construal of representational vehicles with a pragmatic account of (...) mental content. I call the resulting package a deflationary account of mental representation and I argue that it avoids the problems that afflict competing accounts. (shrink)

This article poses a challenge to contemporary theories in psychology that portray empathy as a negative force in the moral life. Instead, drawing on alternative psychological and philosophical literature, especially Martha Nussbaum, I argue that empathy is related to the virtue of compassion and therefore crucial for moral action. Evidence for evolutionary anthropological accounts of compassion in early hominins provides additional arguments for its positive value in deep human history. I discuss this work alongside Thomistic notions of practical wisdom, compassion, (...) misericordia, and the importance of reason in the moral life. The tension between “bottom up” accounts of empathy and that according to a theological interpretation of “infused” virtues also needs to be addressed. From a secular perspective, infused virtue is a projection of the ideal moral life, but from a theological perspective, it is a way of understanding how human capacities through the action of grace can reach beyond what seem to be the limits of psychological moral identity. Finding a way to come to terms with the disvalues in the evolutionary world is a particular challenge in the light of Neo‐Darwinian theories. In this article I trace the shift in Christopher Southgate's work from a focus on theodicy to a theologian of glory. I am critical of his rejection of the tradition of the Fall, his incorporation of disvalues into the work of divine Glory, and the specific theological weight given to scientific content. I offer a critique of (...) Holmes Rolston III's approach to the valuation of nature that I believe has influenced Southgate's theology. Constructively, I offer an alternative that seeks to recover an understanding of the origin of evil and the Adamic event that draws on the work of Paul Ricoeur. I also draw on the work of anthropologist Tim Ingold for an alternative philosophical approach to evolution which opens up a space for a recovery of the concepts of creaturely Sophia and shadow Sophia in the work of Sergius Bulgakov. The critical edition of Husserl's works will, upon its completion, include three volumes of Husserl's shorter essays, reviews, and lectures. These works--only some of which were published during Husserl's lifetime--have no natural home as supplementary texts to Husserl's major works and lecture-courses, and are therefore collected in separate volumes. Nijhoff published the first of these volumes in 1979; it collects works focused largely around logical issues from the years 1890-1910. The second volume, presently under review, is a more heterogenous collection (...) than the first, and the third is still in preparation. (shrink)

The rift which has long divided the philosophical world into opposed schools-the "Continental" school owing its origins to the phenomenology of Husserl and the "analytic" school derived from Frege-is finally closing.

I discuss controversial claims about the status of non-human animals as moral beings in relation to philosophical claims to the contrary. I address questions about the ontology of animals rather than ethical approaches as to how humans need to treat other animals through notions of, for example, animal rights. I explore the evolutionary origins of behavior that can be considered vices or virtues and suggest that Thomas Aquinas is closer to Darwin's view on nonhuman animals than we might suppose. An (...) appreciation of the complexity of the emotional lives of social animals and their cooperative behaviors in light of the work of animal ethologists such as Frans de Waal and Marc Bekoff suggests that social animals can be considered moral in their own terms. I discuss the charge of anthropomorphism, drawing on the work of archaeologist Steven Mithen, and consider arguments for the evolution of conscience in the work of anthropologist Christopher Boehm. Only the biological basis for the development of conscience and religion has evolved in nonhuman animals, and this should not be confused with sophisticated moral systems of analysis or particular religious beliefs found in the human community. The uncertainties implicit in this debate are particularly acute in the context of disease or population groups for whom multidisciplinary, multipleagency teamworking has become acknowledged as the “best practice” for providing effective and timely care or support. The greying of the population is a demographic phenomenon that will have a profound impact (...) on the health care system, social care agencies, and caregivers, and will require a greater degree of service coordination in order to meet the complex care needs of both care-receiver and caregiver. Abstract This paper argues that a genuine engagement of Christianity with evolution needs to include a discussion of Christology. Further, it develops a particular approach to Christology through a theo-dramatic account of incarnation. The somewhat static post-Chalcedon theological categories of divine and human natures are hard to square with contemporary evolutionary accounts of human origins. Once the divine Logos is portrayed in the active categories of Wisdom it becomes easier to envisage divine and creaturely wisdom coexisting in the person of (...) Christ. I argue, in particular, that a focus on God's agency through a modified version of Hans Urs von Balthasar's account of theo-drama invites participation and affirms human agency in a way that grand narratives do not. More particularly, drawing on examples from hominid evolution, contemporary discussion of paleontology and cooperative evolutionary theories, I suggest that the most convincing accounts of evolutionary biology fit into this theo-dramatic account more readily than alternatives. As such, in the spirit of Robert Boyle, this paper deliberately blurs the categories of revealed and natural theology by arguing that we can make sense of the former through concentration on the latter.
