The purpose of this paper is to show that the standard notion of informed choice is unacceptable and must be replaced. To do so, I examine Foucault's analysis of people in contemporary society, drawing attention to the ways power relations act upon us, and to the possibility of resistance. I show how feminist moral theory can be enriched by Foucault's analysis. Applying this new understanding of people and moral theory to an analysis of informed choice, I claim that (...) the standard notion of informed choice is unacceptable, in part because it relies on a false conception of people. Its “necessary” features—intention, understanding, and absence of controlling influences—are much more difficult, if not impossible, to obtain than proponents of the standard notion believe. I end by offering direction for creating a new, Foucault-inspired, feminist theory of informed choice. (shrink)

In 1977 Michel Foucault contemplated the idea of punishing rape only as a crime of violence, while in 1978 he argued that non-coercive sex between adults and minors should be decriminalized entirely. Feminists have consistently criticized these suggestions by Foucault. This paper argues that these feminist responses have failed to sufficiently understand the theoretical motivations behind Foucault's statements on sex-crime legislation reform, and will offer a new feminist appraisal of Foucault's suggestions.

Against the backdrop of a longstanding feminist critique that Michel Foucault’s call to anonymity is insensitive to the erasure of marginalized persons, I aim to contribute to a critical account of anonymity as a feminist Foucauldian ideal. I do this in two ways. First, I analyze the tactical role of anonymity in the Prisons Information Group, an organization in which Foucault was involved. Second, I analyze the unique paradoxes of anonymity faced by gender non-conforming prisoners then and now. (...) I conclude that anonymity is ideally a situational and multi-layered tactic. By developing a modality of anonymity accountable to the differential politics involved in the chosen or forced renunciation of a name, I contribute to a critical evaluation of anonymity as a practice of resistance from within and beyond the prison system. This volume presents an exploration of the intersection between the work of Michel Foucault and feminist theory, focusing on Foucault's theories of sex/body, identity/subject, and power/politics. Like the other books in this series, this volume seeks to bring a feminist perspective to bear on the interpretation of a major figure in the philosophical canon. In the case of Michel Foucault, however, this aim is somewhat ironic because Foucault sees his work as disrupting that very canon. Since (...) feminists see their work as similarly disruptive, Foucault and feminism would seem to find much common ground, but, as the contributors to this collection reveal, the matter is not so simple. Foucault, like many feminists, is centrally concerned with questions related to sexuality and the body. This concern has led both Foucault and feminists to challenge the founding concept of the modernist philosophical canon: the disembodied transcendental subject. For both Foucault and feminists, this subject must be deconstructed and a new concept of identity articulated. The exciting possibilities of a Foucaultian approach to issues of the subject and identity, especially as they relate to sex and the body, are detailed in several of the essays collected here. Despite these possibilities, however, Foucault's approach has raised serious questions about an equally crucial area of feminist thought-politics. Some feminist critics of Foucault have argued that his deconstruction of the concept "woman" also deconstructs the possibility of a feminist politics. Several essays explore the implications of this deconstruction for feminist politics and suggest that a Foucaultian feminist politics is not viable. Overall, this collection illustrates the range of interest Foucault's thought has generated among feminist thinkers and both the advantages and liabilities of his approach for the development of feminist theory and politics. This essay is a critical review of two recent collections, Feminism and Foucault: Reflections on Resistance, edited by Irene Diamond and Lee Quinby and Feminism as Critique: On the Politics of Gender, edited by Seyla Benhabib and Drucilla Cornell. While the collections differ in their manner of addressing the critical sources that have inspired them-the former relying upon a single theorist, the latter attempting to move through some of the philosophical history that constitutes our present theoretical terrain-both (...) attempt to think through and thus revisualize some of the categories of difference which we have inherited. Though the best essays from these collections are celebrated for demonstrating how "feminism as critique" can work to move us toward a clearer and more inclusive feminist theory, questions are raised about what the inattention to race in these volumes suggests about our own role in the construction of power and knowledge, and the erasures that help to secure them both. This paper situates Lynne Huffer’s recent queer-feminist Foucaultian critique of reason within the context of earlier feminist debates about reason and critically assesses Huffer’s work from the point of view of its faithfulness to Foucault’s work and its implications for feminism. I argue that Huffer’s characterization of Enlightenment reason as despotic not only departs from Foucault’s account of the relationship between power and reason, it also leaves her stuck in the same double binds that plagued earlier feminist (...) critiques of reason. An appreciation of the profoundly ambivalent nature of Foucault’s critique of reason offers feminists some insights into how to navigate those double binds. What feminists should learn from the early Foucault is precisely his commitment to engage in a rational critique of reason that highlights reason’s dangerous entanglements with power while resisting the temptation to reject or refuse reason altogether. Feminism and the Final Foucault is the first systematic offering of contemporary, international feminist perspectives on the later work of philosopher Michel Foucault. Rather than simply debating the merits or limitations of Foucault's later work, the essays in this collection examine women's historical self-practices, conceive of feminism as a shared ethos, and consider the political significance of this conceptualization in order to elucidate, experiment with, and put into practice the conceptual "tools" that Foucault offers (...) for feminist ethics and politics. The volume illustrates the ways in which Foucault's later thinking on ethics as "care of the self" can reintroduce a number of issues and themes that feminists jettisoned in the wake of postmodernism, including consciousness raising, feminist therapy, the subject woman, identity politics, and feminist agency. Taken as a whole, the diversity of feminist viewpoints presented provide important new insights into "the final Foucault," and thus serve as a productive intervention in current Foucault scholarship. This paper begins with the assumption that the differences among women pose a threat to building a unified feminist theory and practice. Utilizing the work and methods of Michel Foucault, I explore theoretical and practical implications of taking difference seriously. I claim that a politics of difference puts into question the concept of a revolutionary subject and the idea of a social totality. In the final section a brief Foucauldian analysis of the feminist sexuality debates is given.

Up Against Foucault offers both a feminist critique of Foucauldian theories as well as an attempt to reconcile these seemingly irreconcilable perspectives. Feminists are often "up against Foucault" because he questions key conclusions in feminism regarding the nature of gender relations, and men's possession of power. This book, however, fills the gap in literature about Foucault by showing how his theories of sexuality and power relations are often applicable to the everyday realities of women's lives. Drawing (...) upon their diverse backgrounds in social theory and philosophy, the contributors discuss the ways in which Foucault provokes feminists into questioning their grasp of power relations, and examines the implications of his decision to overlook categories of gender in his discussion of sexuality and power relations. They also show that in spite of his lack of interest in gender, Foucault's ways of understanding the control of women and female sexuality ultimately have much to offer feminism. (shrink)

Shelley Tremain's book, Foucault and Feminist Philosophy of Disability, considers how disability has been incorrectly contained by medical ethics or ignored entirely by mainstream philosophy. She argues for an antifoundational approach to disability that accounts for the historical and material conditions of people while also attending to the conditions of disabled philosophers themselves. This important contribution to the fields of philosophy, gender studies, and disability studies explicitly addresses how ableism has impacted academic discourses in philosophy, harming disabled philosophers, disabled (...) people, and the production of knowledge in these areas. This essay asks about the return to nature and “life itself” in contemporary feminist philosophy and theory, from the new materialisms to feminist science studies to environmental ethics and critical animal studies. Unlike traditional naturalisms, the contemporary turn to nature is explicitly posthumanist. Shifting their focus away from anti-essentialist critiques of woman-as-nature, these new feminist philosophies of nature have turned toward nonhuman animals, the cosmos, the climate, and life itself as objects of ethical concern. Drawing on Foucault, the essay (...) probes the ethical meanings of the term “life itself” invoked in many of these renaturalizing projects. Focusing especially on the archival matter that guides Foucault’s thinking, I suggest that we rethink “life itself” not as a transhistorical substance but as the unstable materiality of history. I then reframe Foucault’s archival, genealogical perspective through the lens of the Anthropocene and geological time. Reconceiving our archive as a fossil record, I suggest that Foucault has much to contribute to environmental challenges to human exceptionalism and the anthropogenic destruction of other species and ourselves. This paper explicates Foucault's conception of experience and defends it as an important theoretical resource for feminist theory. It analyzes Linda Alcoff's devastating critique of Foucault's account of sexuality and her reasons for advocating phenomenology as a more viable alternative. I agree with her that a philosophically sophisticated understanding of experience must remain central for feminist theory, but I demonstrate that her critique of Foucault is based on a mistaken view of his philosophical position as well as (...) on a problematic understanding of phenomenology. The experiential body can become a locus of resistance because it is the possibility of an unpredictable event.

While the varied theoretical frameworks of second wave feminism made possible critical interrogation of societal patterns of domination and oppression in view of the transformative goal of liberation, Michel Foucault’s conceptualization of power shifts contemporary feminist thought away from this binary field of relations towards more fundamental questions about gender constitution. Indeed, from the perspective of popular culture it would seem that challenges to rigid gender roles were a thing of the past, to which freedom and certain kinds (...) of gender malleability were intrinsically tied. In fact gender roles continue to be defined in strict opposition to each other and sexist attitudes and practices continue, although increasingly disguised and unacknowledged. If liberation from the strictures of patriarchy is nothing but a lost illusion from the second wave, is there nonetheless a need for a resurgent feminist consciousness today? In this paper, I argue that this is the case, and attempt to show that “the work of the intellect” described by Foucault, must first be catalyzed by an experiential disruption, leading to recognition of what pragmatist philosopher John Dewey described as the “problematic situation.” While both Foucault and Dewey emphasize the necessity of problematization, Dewey’s methodology includes focus on envisioning desired outcomes. Here, my aim is not to resurrect an old idea of unconditioned liberation, but merely to reconsider whether and how experiential disruption and subsequent consideration of the problem might lead to a shift in social and self-consciousness, and create the possibility for change. In his 1979 lecture series now translated as The Birth of Biopolitics, Michel Foucault suggests that there is an important relationship between neoliberalism and the cluster of phenomena he had previously named “biopower.” The relationship between these two apparently very different forms of governmentality is not obvious, however, and Foucault does not explicate it. The question has become a pressing one for feminists because it underlies a set of issues surrounding the emerging field of “reprogenetics.” Feminists have been (...) highly critical of invasive reproductive technologies for decades, viewing them as demeaning to and dangerous for women's bodies and as staunchly traditional in their reinforcement of gender roles and of maternity as female desire and destiny. Reprogeneticists accuse feminists of hypocrisy in seeking to curtail the widest technically possible range of “procreative choice.” This essay traces some ways in which reprogenetics may be interpreted as a biopolitical formation as well as a neoliberal formation and suggests how the two seemingly antithetical types of phenomena might actually be overlapping and mutually reinforcing—perhaps opening the way for a more effective feminist critique.
