Increasingly in certain circles the idea is growing up that ‘intellectual property is theft’. With companies being concentrated into multimedia groups, literary works being captured electronically, products being created for a mass-media culture, commercial exchange on a worldwide scale, the legitimacy of the creator's literary and artistic property is being challenged. Originally the ‘droit d'auteur’ or copyright were mainly protective rules laid down by law to regulate the author's status. The legal system of literary and artistic ownership still ensures that (...) creators receive revenue each time their works are reproduced, adapted or communicated to the public. In addition the droit d'auteur has another aspect through the existence of moral right, which establishes a personal link between author and work. It is true that moral right, which is sometimes seen as an obstacle to economic development, is almost non-existent in the systems of law recognizing copyright, which do not incorporate the same balance of interests as between the author and the company. On the other hand, in its formulation the droit d'auteur takes a more human approach and to say that intellectual property is theft would be equivalent to weakening, or even eradicating, a system that protects individual creators facing the reality of the exploitation of their work. This is why this criticism of legitimacy should, in my view, be considered in the context of a debate about the status of the author. This book has been defined around three important issues: the first sheds light on how people, in various philosophical, religious, and political contexts, understand the natural environment, and how the relationship between the environment and the body is perceived; the second focuses on the perceptions that a particular natural environment is good or bad for human health and examines the reasons behind such characterizations ; the third examines the promotion, in history, of specific practices to take advantage of the health (...) benefits, or avoid the harm, caused by certain environments and also efforts made to change environments supposed to be harmful to human health. The feeling and/or the observation that the natural environment can have effects on human health have been, and are still commonly shared throughout the world. This led us to raise the issue of the links observed and believed to exist between human beings and the natural environment in a broad chronological and geographical framework. In this investigation, we bring the reader from ancient and late imperial China to the medieval Arab world up to medieval, modern, and contemporary Europe. This book does not examine these relationships through the prism of the knowledge of our modern contemporary European experience, which, still too often, leads to the feeling of totally different worlds. Rather, it questions protagonists who, in different times and in different places, have reflected, on their own terms, on the links between environment and health and tries to obtain a better understanding of why these links took the form they did in these precise contexts. This book targets an academic readership as well as an “informed audience”, for whom present issues of environment and health can be nourished by the reflections of the past. (shrink)

De l'univers sonore médiéval à l'esthétique de Debussy, de la linguistique populaire à l'étude linguistique des relations entre perception, cognition (...) et syntaxe, de Prévost à Proust en passant par Mark Twain ou Virginia Woolf, de la peinture américaine de Thomas Cole aux oeuvres vidéographiques contemporaines, cet ouvrage, tel un kaléidoscope, offre une myriade de perspectives sur la façon dont de simples locuteurs, des écrivains, des artistes ou des philosophes s'efforcent d'appréhender le monde. Les auteurs mettent en évidence les multiples stratégies rhétoriques, narratives ou esthétiques, entre autres, destinées à combler les failles d'une vision trop empirique ou à briser ou brouiller de façon perverse les écrans qui font obstacle à notre perception. Celle-ci survient parfois au terme d'une longue initiation, ou elle ne survient pas, tant il paraît difficile de jeter un regard surplombant sur un monde labile et opaque. La perception n'en demeure pas moins un catalyseur de la création, et aussi de la réception, voire de la re-création par un lecteur / spectateur perspicace qui aime être surpris de voir plus loin que son horizon d'attente. Taking regular walks when living with Parkinson’s disease has beneficial effects on movement and quality of life. Yet, patients usually show reduced physical activity compared to healthy older adults. Using auditory stimulation such as music can facilitate walking but patients vary significantly in their response. An individualized approach adapting musical tempo to patients’ gait cadence, and capitalizing on these individual differences, is likely to provide a rewarding experience, increasing motivation for walk-in PD. We aim to evaluate the observance, safety, tolerance, (...) usability, and enjoyment of a new smartphone application. It was coupled with wearable sensors and delivered individualized musical stimulation for gait auto-rehabilitation at home. Forty-five patients with PD underwent a 1-month, outdoor, uncontrolled gait rehabilitation program, using the BeatWalk application. The music tempo was being aligned in real-time to patients’ gait cadence in a way that could foster an increase up to +10% of their spontaneous cadence. Open-label evaluation was based on BeatWalk use measures, questionnaires, and a six-minute walk test. Patients used the application 78.8% of the prescribed duration and enjoyed it throughout the program. The application was considered “easy to use” by 75% of the patients. Pain, fatigue, and falls did not increase. Fear of falling decreased and quality of life improved. After the program, patients improved their gait parameters in the six-minute walk test without musical stimulation. BeatWalk is an easy to use, safe, and enjoyable musical application for individualized gait rehabilitation in PD. Sara Mills’ influential Foucauldian study of women’s travel writing, Discourses of Difference, heralded a turn from the consideration of individual female travellers as exceptions towards an analysis of the discursive pressures similarly exerted on all of them, through the awareness of normative expectations regarding the production and the reception of their writings. This article revisits panopticism in the genre by showing how travel writing reveals the intersection between the material plane and the discursive process. Through the parallel analysis of three (...) travel narratives, Anna Jameson’s Winter Studies and Summer Rambles in Canada, Isabella Bird’s A Lady’s Life in the Rocky Mountains, and Mary Kingsley’s Travels in West Africa, I show how their clothing and behaviour are enacted as signs of femininity for the benefit of their contemporaries, in texts whose diaristic form articulates the writing of the self and its exhibition to the public. I thus analyse how these travel narratives illustrate the intersection of the individual and the social in power relations and self-fashioning, and how their authors negotiate surveillance in gender performance. Modern knowledge of the grammarian Consentius’ De barbarismis et metaplasmis, a work valuable for the study of the Latin language, dates back to a relatively recent past: it was only in 1817 that its editio princeps was published by Ph.C. Buttmann, just a few years after the legal scholar A.W. Cramer came across a mention of the then unknown treatise in a ninth-century MS in the Bayerische Staatsbibliothek of Munich, numbered Clm 14666. Based on this solitary manuscript, H. Keil published (...) the short treatise in the fifth volume of his Grammatici Latini. With no little enthusiasm did W.M. Lindsay announce his unearthing of what, in his own words, had ‘long been a “desideratum”, a second authority’ for this text, in the MS F 15 III d at the Universitätsbibliothek Basel; this was followed by E.O. Winstedt's complete collation and M. Niedermann's critical edition. After about a century now there comes to light a third authority, surprisingly enough in a codex which has enjoyed such fame in the past decades that one might wonder how Consentius could have gone unnoticed in it for so long: this is the eleventh-century MS of Venice, Biblioteca Nazionale Marciana Lat. Z. 497, in which the De barbarismis et metaplasmis is contained on fols. 84vb 39 - 90va 39; moreover, a so-far-unnoticed quotation from it, together with one from Consentius’ De nomine et uerbo, is found on fol. 41vb 16–21 of the same manuscript in a famous grammatical florilegium. The codex, written in Romanesque minuscule and probably originating in Rome, is regarded as a handbook of liberal arts designed by Lawrence Archbishop of Amalfi, formerly a monk at Montecassino, thereafter a teacher in Florence and Rome, where he died in about 1049. Based on palaeographical evidence, F.L. Newton rightfully assumed as an exemplar for this codex a MS in Beneventan script, as some features can be detected that betray the scribal imitation of that typical South Italian script, namely the use of the distinctive abbreviation for eius as ‘ei in ligature with stroke through the descender of the i’, the Beneventan ti ligature for the assibilated sound, and the 2-shaped Beneventan interrogation sign, to which I would add the typical abbreviation for in as a long i cut by a horizontal stroke and the confusion of a and t. Interestingly enough, none of these features is found on fols. 66–95, those containing the new Consentius: from a codicological point of view, this is an autonomous section, written by a different scribe from the rest of the MS and preserving some grammatical texts generally attributed to insular authors, such as Smaragdus’ Liber in partibus Donati and part of the compilation entitled Pauca de barbarismo, which precedes the De barbarismis et metaplasmis; not surprisingly, the new text of Consentius displays numerous features of the Insular script, such as the symbols for enim, autem, eius, est, nihil and et. On this basis it is most likely that this whole section was never included in the Beneventan exemplar, but was added at the time and place of copying of our MS in order to enrich the grammatical content. This paper forms part of a wider study examining the history and sociology of nursing education in England between 1860 and 1948. It argues that the question of whether nursing was an art, science and/or social science has been at die ‘heart’ of a wider debate on die occupational status and disciplinary identity of nursing. The view that nursing was essentially an art and a ‘calling’, was championed by Florence Nightingale. Ethel Bedford Fenwick and her allies insisted that nursing, (...) like other professions, was a ‘scientific’ and technical enterprise. Social scientists later came to challenge nursing's claim to professionalism by analysing nursing work first within die context of industrial psychology. But they also advocated a rapprochement between nursing, health services and social science research, a challenge which we are in nursing, still striving to meet This paper argues for a strong coalition of nursing with its former nineteenth century ally, social science, in die continuing struggle for change within nursing and health care policy. Rather than searching for some rarified and purified essence of nursing knowledge, it argues that nurses need to join forces with sociologists and economists in striving to shape die agenda for health services research and provide die evidential basis for health policy transformation more generally. La relation qu’entretient Leonardo Bruni à sa ville d’adoption, Florence, tant comme lettré humaniste que comme personnalité politique, est complexe. Elle constitue une « entrée » pertinente pour s’interroger sur le statut moral de la richesse privée à Florence au début du xve siècle. Peut-on être riche et bon citoyen ? En s’interrogeant sur les motivations qu’avait Leonardo Bruni en offrant une nouvelle traduction du traité pseudo-aristotélicien l’Économique à Cosimo de Médicis, on comprend que ce geste s’inscrit dans (...) un débat vivace, marqué par des prises de position théologiques et séculières initialement favorables à la pauvreté, mais aussi par une évolution de la relation entre l’Église et les marchands à Florence. En rupture avec toute idéalisation morale de la vie à la campagne, Bruni avance que la recherche privée de la richesse n’est pas nécessairement un vice. Il entend en proposer la démonstration à travers la peinture d’un homme qui réalise ses vertus dans la cité, en prônant par l’exemple une vie dans l’aisance et en contribuant à la prospérité et à la puissance de la cité. In conversation with Hortense Gallois’ recent essay on the importance of bioethicists participating in public discourse, I suggest that speaking up is as fraught as it is important. Focusing on the anti-trans movement’s misuse of expertise, I highlight the fine line between correcting misinformation and inadvertently causing harm through ill-timed speech. Drawing on the work of Eva Feder Kittay, I suggest that knowing when to speak up and when to stay silent starts with understanding the communities we speak about and (...) the consequences that our words can have on them. El objetivo de este artículo es presentar esta faceta poco estudiada de la vida de Adrienne von (...) Speyr, y el modo en que su actividad médica modeló su lectura de las Escrituras, en particular del capítulo 11 del evangelio de Juan. Although informed consent models for prescribing hormone replacement therapy are becoming increasingly prevalent, many physicians continue to require an assessment and referral letter from a mental health professional prior to prescription. Drawing on personal and communal experience, the author argues that assessment and referral requirements are dehumanising and unethical, foregrounding the ways in which these requirements evidence a mistrust of trans people, suppress the diversity of their experiences and sustain an unjustified double standard in contrast to other forms of clinical (...) care. Physicians should abandon this unethical requirement in favour of an informed consent approach to transgender care. (shrink)

What are the conditions under which one biological object is a part of another biological object? This paper answers this question by developing a general, systematic account of biological parthood. I specify two criteria for biological parthood. Substantial Spatial Inclusionrequires biological parts to be spatially located inside or in the region that the natural boundary of t he biological whole occupies. Compositional Relevance captures the fact that a biological part engages in a biological process that must make a necessary contribution (...) to a condition that is minimally sufficient to one or more of the characteristic behaviors of the biological whole. Instead of emphasizing the diversity of part-whole relations in the biological world, this paper asks what biological part-whole relations have in common and what constrains their existence, in general. After presenting the two criteria for biological parthood I discuss in how far my account can cope with hard cases (e.g., redundant parts) and I reveal the merits and limits of monism. (shrink)

By attending to how people speak about their gender, we can find diverse answers to the question of what it is like to have a gender identity. To some, it is little more than having a body whereas others may report it as more attitudinal or dispositional—seemingly contradictory views. In this paper, I seek to reconcile these disparate answers by developing a theory of how individual gender identity comes about. In the simplest possible terms, I propose that gender identity is (...) how we make sense of our gender subjectivity, the totality of our gendered experiences of ourselves. Gender identity is constituted by gender subjectivity, but this constitutive relationship is underdetermined. While gender subjectivity may narrow the range of inhabitable gender identities, it is always compatible with more than one. To arrive at a gender identity, we arrange gender subjectivity like building materials. My theory helps us understand how different people offer seemingly incompatible accounts of their gender identity without questioning their authenticity or validity. They simply arrange similar building materials differently. (shrink)

Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher level decision-maker, (...) such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

Il est courant de déplorer la perte d’un horizon politique fédérateur apte à mobiliser les membres de nos sociétés dans la poursuite de l’intérêt général. Entre autres responsables de la dissolution du lien politique et de l’affaiblissement du devoir civique, est convoquée la philosophie libérale dont la portée individualiste aurait rendu inconcevable le sacrifice des intérêts particuliers au nom de l’intérêt général. Il s’agit d’éclaircir cette critique en montrant que la reformulation moderne du bien commun par le libéralisme a surtout (...) introduit une indétermination qui rend compte de la difficulté pour ses membres à s’y rapporter. En vertu du droit de chacun à poursuivre ses propres buts, l’intérêt général peut aussi bien désigner la protection des droits que la satisfaction des intérêts particuliers. Or ces deux finalités sont non seulement distinctes mais peuvent également entrer en conflit, comme le révèlent aujourd’hui les débats autour des objectifs de l’Union européenne ou ceux entourant la protection des Biens Publics Mondiaux. Cet ouvrage se propose de montrer que cette tension est déjà présente chez les auteurs fondateurs du libéralisme qui oscillent entre la consécration d’un droit déterminant la sphère des intérêts légitimes et la préservation des intérêts dont découle le régime des droits. L’ambiguïté entre ce qui est d’intérêt général, la garantie des droits, et la poursuite de l’intérêt général sur le principe de composition des intérêts particuliers, contraint alors à redéfinir la nature de la participation politique et citoyenne, en particulier dans le cadre de nos démocraties.
