Feminism is going to ruin your life--in the best way possible--because society screams numerous messages every moment about how women must look, act, and speak in order to earn their right to be seen and heard. The only thing any human needs to do in order to earn their right to exist, however, is to exist. Break free of the insidious narratives that hold you back from being your most authentic self.

In conversation with Hortense Gallois’ recent essay on the importance of bioethicists participating in public discourse, I suggest that speaking up is as fraught as it is important. Focusing on the anti-trans movement’s misuse of expertise, I highlight the fine line between correcting misinformation and inadvertently causing harm through ill-timed speech. Drawing on the work of Eva Feder Kittay, I suggest that knowing when to speak up and when to stay silent starts with understanding the communities we speak about and (...) the consequences that our words can have on them. Speyr, y el modo en que su actividad médica modeló su lectura de las Escrituras, en particular del capítulo 11 del evangelio de Juan. Although informed consent models for prescribing hormone replacement therapy are becoming increasingly prevalent, many physicians continue to require an assessment and referral letter from a mental health professional prior to prescription. Drawing on personal and communal experience, the author argues that assessment and referral requirements are dehumanising and unethical, foregrounding the ways in which these requirements evidence a mistrust of trans people, suppress the diversity of their experiences and sustain an unjustified double standard in contrast to other forms of clinical (...) care. Physicians should abandon this unethical requirement in favour of an informed consent approach to transgender care. (shrink)

By attending to how people speak about their gender, we can find diverse answers to the question of what it is like to have a gender identity. To some, it is little more than having a body whereas others may report it as more attitudinal or dispositional—seemingly contradictory views. In this paper, I seek to reconcile these disparate answers by developing a theory of how individual gender identity comes about. In the simplest possible terms, I propose that gender identity is (...) how we make sense of our gender subjectivity, the totality of our gendered experiences of ourselves. Gender identity is constituted by gender subjectivity, but this constitutive relationship is underdetermined. While gender subjectivity may narrow the range of inhabitable gender identities, it is always compatible with more than one. To arrive at a gender identity, we arrange gender subjectivity like building materials. My theory helps us understand how different people offer seemingly incompatible accounts of their gender identity without questioning their authenticity or validity. They simply arrange similar building materials differently. (shrink)

Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher level decision-maker, (...) such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

Il est courant de déplorer la perte d’un horizon politique fédérateur apte à mobiliser les membres de nos sociétés dans la poursuite de l’intérêt général. Entre autres responsables de la dissolution du lien politique et de l’affaiblissement du devoir civique, est convoquée la philosophie libérale dont la portée individualiste aurait rendu inconcevable le sacrifice des intérêts particuliers au nom de l’intérêt général. Il s’agit d’éclaircir cette critique en montrant que la reformulation moderne du bien commun par le libéralisme a surtout (...) introduit une indétermination qui rend compte de la difficulté pour ses membres à s’y rapporter. En vertu du droit de chacun à poursuivre ses propres buts, l’intérêt général peut aussi bien désigner la protection des droits que la satisfaction des intérêts particuliers. Or ces deux finalités sont non seulement distinctes mais peuvent également entrer en conflit, comme le révèlent aujourd’hui les débats autour des objectifs de l’Union européenne ou ceux entourant la protection des Biens Publics Mondiaux. Cet ouvrage se propose de montrer que cette tension est déjà présente chez les auteurs fondateurs du libéralisme qui oscillent entre la consécration d’un droit déterminant la sphère des intérêts légitimes et la préservation des intérêts dont découle le régime des droits. L’ambiguïté entre ce qui est d’intérêt général, la garantie des droits, et la poursuite de l’intérêt général sur le principe de composition des intérêts particuliers, contraint alors à redéfinir la nature de la participation politique et citoyenne, en particulier dans le cadre de nos démocraties. Cette thèse de doctorat se propose de reprendre l'ensemble de la philosophie pratique de Kant en aval, c'est-à-dire à partir de l'ouvrage chronologiquement tardif dans le corpus kantien, "La religion dans les limites de la simple raison" (1793), dont la première partie assigne à la volonté un défi : le "mal radical". Le "mal radical" n'est pas le mal absolu ou diabolique, mais il consiste en une inversion (Verkehrtheit) de l'ordre des principes au sein du vouloir, et ne peut être (...) déraciné que par l'entière conversion du coeur. Avec le mal, s'ouvre l'antinomie du judaïsme, considéré par le philosophe comme le contre-modèle de la foi par excellence, et du christianisme, criterium unique et anhistorique de la religion, seul à même de résoudre le problème de l'homme nouveau. Si, selon Kant, le judaïsme est nouménalement nul parce qu'incapable de véhiculer le contenu de la religion rationnelle, le philosophe, qui considère l'interdit biblique de l'idolâtrie comme "le commandement le plus sublime du Livre de loi des Juifs", lui reconnaît néanmoins le mérite de mettre l'accent sur le respect. Le christianisme, quant à lui, met l'accent sur l'amour, dont Kant retient la signification pratique, à savoir qu'il est l'état de perfection de l'intention vers lequel nous devons tendre. (shrink)

IntroductionThe various special concerns and commitments that individuals ordinarily have, for example towards family members, friends, and possibly compatriots, present an interesting challenge for justice. Justice, after all, is said to be blind and imposes demands on persons that ought to be impartial, at least in some respects, to personal ties and relationships. Yet individual special concerns are obviously of moral importance and are deeply valued by participants in these relationships. Thus any conception of justice to be plausible has to (...) be able to accommodate to some extent the various types of valuable and valued special concern characteristic of ordinary social life. In particular, it is important to see how the impartial demands of justice can be maintained while accommodating special concern. (shrink)

Although it has been recognized that employees regularly engage in non-green behaviors, little research has been conducted to explain how these behaviors may be avoided. Using data from a three-wave study, this study tested a moderated-mediation model in which trust in the immediate manager was expected to increase the indirect effect of supervisory support for the environment on non-green behaviors through employee environmental commitment. While the findings showed, as predicted, that exchange relationships with the immediate manager reduce the tendency of (...) employees to engage in non-green behaviors, the indirect effect of supervisory support on non-green behaviors through employee environmental commitment was moderated at a low level of trust in the manager, contrary to predictions. Though unexpected, this result seems less surprising when discussed in the light of negotiated exchange, suggesting that employee efforts to avoid non-green behaviors need to be seen as the result of a deal between managers and subordinates. The findings of this study contribute to the emerging literature on social exchange in an environmental context and have implications for organizations seeking to achieve environmental sustainability. Handbook for Buddhist ethical aspects for Bhutanese youngsters.

During the last two decades there has been an enormous development in treatment possibilities in the field of neonatology, particularly for (extremely) premature infants. Although there are cross-cultural differences in treatment strategy, an overview of the literature suggests that every country is confronted with moral dilemmas in this area. These concern decisions to initiate or withhold treatment directly at birth and, later on, decisions to withdraw treatment with the possible consequence that the child will die. Given that the neonate cannot (...) express his or her own will, who will decide? And on the basis of what information, values and norms? We explored some of these issues in daily practice by interviewing a small sample of health care practitioners in a Dutch university Neonatal Intensive Care Unit (NICU). It turned out that experiencing moral dilemmas is part of their daily functioning. Nurses underline the suffering of the newborn, whereas physicians stress uncertainty in treatment outcome. To make the best of it, nurses focus on their caring task, whereas physicians hope that future follow-up research will lead to more predictable outcomes. As for their own offspring, part of these professionals would hesitate to bring their own extremely premature newborn to a NICU. For the most oppressing dilemma reported – terminating an already initiated treatment – we propose the concept of ‘evidence shift’ to clarify the ambiguous position of uncertainty in decision making. As global warming continues to attract growing levels of attention, various stakeholders have put climate change on corporate agendas and expect firms to disclose relevant greenhouse gas information. In this paper, we investigate the consistency of the GHG information voluntarily disclosed by French listed firms through two different communication channels: corporate reports and the Carbon Disclosure Project. More precisely, we contrast the amounts of GHG emissions reported and the methodological explanations provided in each channel. Consistent with a stakeholder theory perspective, (...) we find that GHG amounts are significantly lower in the CR than in the CDP. We also find that firms increase the CR figures’ traceability when there is a discrepancy between disclosures in the two channels. We suggest that the aim of this greater traceability is to enhance information credibility across the different channels used. (shrink)

Most people would not associate Confucian philosophy with contemporary education. After all, the former is an ancient Chinese tradition and the latter is a modern phenomenon. A well-established narrative in the history of science has it that the years around 1800 saw the end of a purely descriptive, classificatory and static natural history. The emergence of a temporal understanding of nature and the new developmental-history approach, it is thought, permitted the formation of modern biology. This paper questions that historical narrative by closely analysing the concepts of development, history and time set out in Karl Ernst von Baer’s study of the mammalian egg (1827). I show that (...) Baer’s research on embryogenesis aimed not simply to explain temporal changes, but to inscribe the formation of new individual organisms into a continuous, unending organic process. I confront Baer’s views with other explanations of embryogenesis arising in the 1820s and 1830s, especially those of Jean-Baptiste Dumas and Jean-Louis Prévost and of Theodor Schwann. By highlighting divergences between these scientists, especially as to their view of the role of gender differences in reproduction, I argue that biology evolved not from a homogeneous concept of developmental history but out of various, even opposing, views and research programmes. Thus, the birth of biology did not imply the end of all natural history’s thought models. (shrink)

In two recent papers, Mr Robert Young maintains that all attempts by philosophers to bolster the-violation-of-law concept of miracles are bound to fail and propounds what he claims to be a novel non-reductivist concept of miracles which avoids the conceptual difficulties of the violation-model. His view of miracles is of god being ‘an active agent-factor in the set of factors which actually was causally operative’ [p. 123] in an event dubbed a miracle. God is put in among ‘the plurality of (...) causes’ [p. 122, S p. 33] that could determine the event, but if he acts in a miracle, then ‘his presence…alters the outcome from what it would have been if, contrary to fact , he had not been present’ [p. 122]. Young claims that his concept ‘is neither a violation of … laws nor is it a coincidental occurrence religiously interpreted’ [p. 122, S p. 33], and so it avoids the difficulties, which he thinks are faced by the violation-model, of having an intelligible notion of an occurrence of the physically impossible, and also the reductivism inherent in taking mere coincidences as miracles. He also suggests a procedure of settling the epistemological issue regarding particular alleged miracles, an inquiry he thinks he has made possible by having first given a sense to miracles. This paper analyzes resource utilization of the Sundarbans in terms of the contradictory issues and pressures generated by foreign assistance and commercial interests in Bangladesh. In the paper, the historical legacy of resource definition and use that shaped the development of forest policy under the British is considered. In addition, the critical role of the state and the interests and pressures on the Government are explored as these shape the larger context in which current natural resource policy is generated and (...) maintained. Three areas of potential conflict between current devlopment policy and resource management control are noted. They are 1) the privatization of production and resource exploitation in contrast to common property resource use, 2) the need to meet foreign exchange requirements versus local user interests, and 3) commercial versus local user interests.The paper argues that national and international fiscal and economic constraints operate to favor commercial interests and natural resource exports at the cost of policies that emphasize an active approach to the generation and preservation of renewable resources such as the Sundarbans. This paper explores the ethical and conceptual implications of the findings from an empirical study (reported elsewhere) of decision-making capacity in anorexia nervosa. In the study, ten female patients aged thirteen to twenty-one years with a diagnosis of anorexia nervosa, and eight sets of parents, took part in semistructured interviews. The purpose of the interviews was to identify aspects of thinking that might be relevant to the issue of competence to refuse treatment. All the patient-participants were also tested using the (...) MacArthur Competence Assessment Tool—Treatment test of competence. This is a formalized, structured, interviewer-administered test of competence, which is a widely accepted clinical tool for determining capacity. The young women also completed five brief, self-administered questionnaires to assess their levels of psychopathology. The issues identified from the interviews are described under two headings: difficulties with thought processing and changes in values. The results suggest that competence to refuse treatment may be compromised in people with anorexia nervosa in ways that are not captured by traditional legal approaches. (shrink)
