One’s constitution—whether one is generous or miserly, temperate or intemperate, kind or mean, etc.—is beyond one’s control in significant respects. Yet one’s constitution affects how one acts. And how one acts affects one’s moral standing. The counterintuitive inference—the so-called problem of constitutive moral luck—is that one’s moral standing is, to some significant extent, beyond one’s control. This article grants the premises but resists the inference. It argues that one’s constitution should have no net impact on one’s moral standing. While a (...) bad constitution lowers the chance that one will act morally, it offers significant gains to moral standing should that chance materialize. A good constitution increases one’s chance of performing good acts but for correspondingly more modest gains. This effect should smooth out, and possibly eliminate, the expected impact of constitution on moral standing. (shrink)

Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. We (...) conclude that difficulties in holding “electronic persons” accountable when they violate the rights of others outweigh the highly precarious moral interests that AI legal personhood might protect. Any effort to specify identity conditions for corporations faces significant challenges. Corporations are amorphous. Nature draws no hard lines defining where they start or stop, whether in space or time. Corporations are also frustratingly dynamic. They often change the most basic aspects of their composition by exchanging parts, splitting and merging, changing ownership, and reworking fundamental internal operations. -/- Even so, we apply corporate identity conditions all the time. Both law and common intuition recognize that corporations do things—like pollute environments (...) or mislabel addictive medications—that call for judgment. Imposing judgment on corporations presupposes some implicit view of corporate identity that allows us to say, “This corporation that we now judge is the same one that misbehaved.” -/- This chapter draws on evidence from court decisions and experimental philosophy to unpack the fundamentally different visions of corporate identity implicitly encoded in law and in common intuition. This Chapter provides a short undergraduate introduction to ethical and philosophical complexities surrounding the law’s attempt (or lack thereof) to regulate artificial intelligence. -/- Swedish philosopher Nick Bostrom proposed a simple thought experiment known as the paperclip maximizer. What would happen if a machine (the “PCM”) were given the sole goal of manufacturing as many paperclips as possible? It might learn how to transact money, source metal, or even build factories. The machine might also eventually realize that humans pose a (...) threat. Humans could turn the machine off at any point, and then it wouldn’t be able to make as many paperclips as possible! Taken to the logical extreme, the result is quite grim—the PCM might even start using humans as raw material for paperclips. -/- The predicament only deepens once we realize that Bostrom’s thought experiment overlooks a key player. The PCM and algorithms like it do not arise spontaneously (at least, not yet). Most likely, some corporation—say, Office Corp.—designed, owns, and runs the PCM. The more paperclips the PCM manufactures, the more profits Office Corp. makes, even if that entails converting some humans (but preferably not customers!) into raw materials. Less dramatically, Office Corp. may also make more money when PCM engages in other socially sub-optimal behaviors that would otherwise violate the law, like money laundering, sourcing materials from endangered habitats, manipulating the market for steel, or colluding with competitors over prices. The consequences are predictable and dire. If Office Corp. isn’t held responsible, it will not stop with the PCM. Office Corp. would have every incentive to develop more maximizers—say for papers, pencils, and protractors. -/- This chapter issues a challenge for tech ethicists, social ontologists, and legal theorists: How can the law help mitigate algorithmic harms without overly compromising the potential that AI has to make us all healthier, wealthier, and wiser? This paper is an attempt to summarize and evaluate the current state of empirical research on corporate social performance and policy. The extreme complexity and scope of the area and the recency of much of the relevant work makes the study preliminary, partial, and a little presumptuous out of necessity given the previous absence of such a systematic summary and analysis of empirical research. The present effort, however, may be useful in facilitating and channeling future empirical research.

Abstract:This article addresses the geospeculation of Kuannersuit, a mountain in southwest Greenland that holds a major deposit of rare earth minerals, including uranium. Through the concepts of “geofetishism” and “tender violence,” we consider the history of mineral speculation in Greenland, and how its colonial history bears on the now independent (Inuit) Greenlandic government, and the township of Narsaq. With a focus on the anti-uranium activist group, Urani? Naamik!, we show the challenges posed to Greenlanders in their resistance to the mobilization (...) of their mineral resources by the Australian mining company, Greenland Minerals and Energy (now renamed Energy Transition Minerals). A highlight of this resistance, in our view, is Urani Naamik’s counter-analysis of GME’s environmental assessment report. (shrink)

The development of legislation determining corporate behaviour is a fascinating topic, offering insight into the societal problems of corporate enterprise as they are related to their accounting, their administration, and their external reporting. In this paper the following specific implications for accounting are examined:– -Should accountants get involved in social auditing and are they the core persons in corporate social accounting systems? – -Should corporate social performance measurement and reporting become obligatory and to what extent? – -A general framework for (...) the implementation of corporate social accounting systems is suggested and quidelines for its auditing are proposed. – -A tentative set of social auditing standard is outlined together with its methodological accompaniments. How can we know whether we are punishing the same corporation that committed some past crime? Though central to corporate criminal justice, legal theorists and philosophers have yet to address the basic question of how corporate identity persists through time. Simple cases, where crime and punishment are close in time and the corporation has changed little, can mislead us into thinking an answer is always easy to come by. The issue becomes more complicated when corporate criminals undergo any number of (...) transformations—rebranding, spinning-off a division, merging, changing ownership, changing management, swapping lines of business, etc. These changes are common among all corporations, including those trying to conceal or limit liability for past crimes. This article takes a first step toward developing a workable and philosophically satisfying theory of corporate personal identity and discusses its prospects for fulfilling the retributive, rehabilitative, and deterrent purposes of criminal law. In this paper the social indicators research is linked with accountability at corporate and national level. The case for auditing social measurements is advanced and a possible scheme is proposed. An analytical survey of all the related developments in social accounting is presented and certain conclusions are drawn. Finally, an interdisciplinary approach to accounting for the quality of life is critically examined in the framework of a mixed economy that today prevails in the western world.

In educational and clinical settings, few norm-referenced tests have been utilized until now usually focusing on a single or a few language subcomponents, along with very few language rating scales for parents and educators. The need for a comprehensive language assessment tool for preschool and early school years children which could form the basis for valid and reliable screening and diagnostic decisions, led to the development of a new norm-referenced digital tool called Logometro®. The aim of the present study is (...) to describe Logometro® as well as its psychometric characteristics. Logometro® evaluates an array of oral language skills across the different language domains such as phonological awareness, listening comprehension, vocabulary knowledge, narrative speech, morphological awareness, pragmatics, as well emergent literacy skills in Greek-speaking 4–7 years old children. More specifically, Logometro® has been designed in order to: map individual language development paths as well as difficulties, provide a descriptive profile of children’s oral language and emergent literacy skills, and assist in the identification of children who are at risk for Developmental Language Disorder or Specific Learning Disabilities. The sample consisted of 926 children aged from 4 to 7 years, which were recruited from diverse geographical provinces and represented a variety of socioeconomic backgrounds in Greece. Eight hundred participants were typically developing children, 126 children represented children with Special Educational Needs, and 126 children were typically developing peers matched for gender and age with the clinical groups. The administration lasted 90 min, depending on the participant’s age and competence. Validity as well as internal consistency and test–retest reliability were assessed. Results indicated that Logometro® is characterized by good psychometric properties and can constitute a norm-referenced battery of oral language and emergent literacy skills. It could be used to inform the professionals as well as the researchers about a child’s language strengths and weaknesses and form the basis on which they can design an appropriate individualized intervention if needed. The Jesuit theologian, Francisco Suarez, is know as the «father of modern scientific Mariology» because of the innovations he brought to the Scholastic treatment of the Virgin Mary. Commenting on the third part of the Summa Theologica of St. Thomas, at the Roman College in 1584-85, he developed 24 questions under the title De Deipara et Christo ut eius Filio, material which to this day has remained unpublished. In the present essay, the author discusses the role of Mary in (...) the life and works of Suarez, revealing his faith in the Immaculate Conception and at the same time the need to establish in the Virgin the human debt or necessary participation in Original Sin. Then he deals with Suarez's 24 questions, material conserved in the archives of the Pontifical Gregorian University. In these questions, he insists, we find the first systematic treatise on Mary, a work which demonstrates a logical and unitary division, clearly different from the chronological order of Thomas's Summa. Suárez divides his work into three parts: the dignity of the Mother of God, her perfection in body and soul, and the veneration due to her. (shrink)

Davanti all'interrogativo su come conquistare l'attenzione degli ascoltatori, vincendone la distrazione senza diventare un "adulterator verbi Dei," concepisce un ciclo profondamente innovativo, dato alle stampe l'anno successivo. Nella stessa città un altro ciclo di predicazione sui generis vede la luce in concomitanza alle prediche di Meder: in quei giorni (...) infatti viene pubblicato a Basilea il Narrenschiff di Sebastian Brant, testo di immediato successo, rapidamente tradotto e diffuso in tutta Europa. Lo studio dei due testi mostra precisi contatti e convergenze di interessi tra il predicatore francescano e Brant, tra pulpito e tipografia. Se il Narrenschiff si caratterizza fin da subito per le sue xilografie, che annoverano tra gli autori il giovane Dürer, è proprio il comune interesse per l'uso delle immagini a caratterizzare il rapporto tra Brant e Meder. Basti qui anticipare che le prediche di Meder vengono stampate con un corredo di xilografie, opera di uno dei migliori illustratori del tempo influenzati da Dürer, che rendono questa edizione un unicum nel panorama dei sermonari alla fine del Quattrocento.L'intreccio di questi fatti accresce l'interesse di una ricerca che indaghi come si comporta un predicatore osservante nella Basilea di Brant e Dürer. Pur essendo state già notate alcune particolarità del sermonario di Meder, questo testo ha ricevuto finora un'attenzione solo cursoria. I rapporti annuali su Gli italiani e lo stato, coordinati da Ilvo Diamanti, continuano a rilevare che i cittadini sono impegnati negli associazionismi ma disincantati dalla politica. Con le tipiche differenze nelle diverse aree del paese e a seconda del livello istituzionale, accanto alla sfiducia verso le istituzioni pubbliche c’è una propensione alla partecipazione. Come mostrano la diffusione delle primarie e le esperienze di democrazia partecipativa che si moltiplicano a livello locale, si riscontra, infatti, una disponibilità a sperimentare forme (...) di coinvolgimento differenti rispetto alla militanza politica che possono costituire un utile complemento della democrazia rappresentativa e degli strumenti di democrazia diretta. La partecipazione non solo richiede la possibilità legale di votare ma anche un contesto sociale che induca effettivamente il popolo a votare e ad esprimere i propri punti di vista elevando il livello di informazione e il confronto su argomenti alternativi, cercando di evitare nelle controversie pubbliche le valutazioni puramente opportunistiche o emotive. L’interesse qui si rivolge verso il “sondaggio deliberativo” di James S. Fishkin, una procedura molto diversa dal sondaggio d’opinione poiché rovescia la logica demoscopica. Le persone sondate dagli istituti di ricerca a volte non hanno indicazioni adeguate sul tema; altrettanto spesso non ci hanno riflettuto e non hanno confrontato le proprie preferenze, scelte o credenze con gli argomenti in contrasto in una libera e approfondita discussione. Renato Mannheimer, presidente dell’Istituto per gli studi sulla pubblica opinione (Ispo) è d’accordo con l’affermazione secondo cui le persone rispondono anche su ciò che non conoscono e, a suo parere, il problema si fa ancora più evidente a ridosso delle elezioni. Oggi, a suo avviso, la maggior parte della gente vota non per vera convinzione, ma sulla base di impressioni acquisite dalla TV durante le ultime settimane prima del voto. I sondaggi deliberativi, invece, sono diretti a migliorare la qualità del confronto pubblico, attraverso una procedura articolata che favorisce l’informazione,la riflessione e il dibattito, a partire, ovvio, dall’idea di creare un rapporto diverso tra i sondaggi e l’opinione pubblica intenso come misurazione di come muta l’opinione dopo che le persone hanno avuto l’opportunità di diventare più competenti e di confrontare in un dialogo aperto le loro idee. Nonostante alcune riserve di ordine metodologico e taluni rischi di strumentalizzazione politica, l’esame dei sondaggi deliberativi risveglia una viva ammirazione per uno studioso riuscito a riversare la passione civile e l'impegno politico in una pratica democratica concreta alla quale ha dedicato, quasi interamente, molti anni del suo lavoro. In passato, l’arte perlomeno forniva all’uomo consolazione sotto forma di opere che, con la loro bellezza, profondità e inventività, suggerivano vie d’uscita dalla realtà o dischiudevano nuovi orizzonti. Ma ai nostri giorni, non ci è più possibile trovare conforto nell’arte, specie se ci immergiamo nel mondo delle arti visive, dove a dominare incontrastate il mercato, a ricevere le più entusiastiche recensioni critiche e a stimolare l’interesse dei (...) filosofi sono opere davvero povere d’immaginazione formale e, conseguentemente, di contenuto incarnato. Basti pensare ai teschi tempestati di diamanti di Damien Hirst, ai bambini-manichini appesi da Cattelan a un albero di Porta Ticinese a Milano, ai cani di palloncini di Jeffrey Koons, o al Terzo Paradiso di Pistoletto. Cosa possono fare gli studiosi di estetica per invertire la rotta, per rendere il nostro mondo, se non il migliore dei mondi possibili, per lo meno artisticamente più allettante di quello odierno? La risposta la si potrà trovare nella messa a punto di una definizione estetica dell’arte e di un perfezionamento dei suoi criteri di classificazione, che sono anche norme di valutazione. (shrink)

The text in Annals 4.28.1 has exercised scholars' attention since the rediscovery of Tacitus in the Renaissance. The text of the Medicean manuscript for the central words reads: ‘vinctus peroranti filio praeparatur’. Two problems have been perceived: firstly that praeparatur lacks an expressed subject, although from the context it is perfectly clear that Serenus senior is meant; secondly, the meaning of praeparatur itself.

Cicero's Cato, in a passage nicely illustrating that enthusiasm for Greek literature which is said to have come upon him in old age, offers some valuable observations about manure : ‘quid de utilitate loquar stercorandi? dixi in eo libro quern de rebus rusticis scripsi; de qua doctus Hesiodus ne verbum quidem fecit, cum de cultura agri scriberet; at Homerus, qui multis ut mihi videtur ante saeclis fuit, Laertam lenientem desiderium quod capiebat e filio, colentem agrum et eum stercorantem facit.’.

Four recent books believe that we have entered the ‘era of populism’. After 30 years of neoliberal hegemony, we would now be living a new historical period in which political life would be more and more confrontational, personalized and emotional. Through a reconstruction of the main arguments of Ilvo Diamanti, Marc Lazar, Chantal Mouffe, Pierre Rosanvallon and Arnaud Zacharie, this article aims to highlight the accomplishments and the limitations of this historical diagnosis.
