This study aims to analyse the pros and cons of imposing penalties or fines in law enforcement regulations for violating health protocols in Indonesia. Some people consider that the norm of the fine sanctions in statutory provisions regulating health protocol violators is unconstitutional, but others say it is constitutional. As a country with the largest Muslim population in the world, a study of the perspective of Islamic law is essential. This article uses a normative legal research methodology using two main (...) approaches: the statutory and conceptual approaches. The results show that fines are found in the criminal law clusters and state administrative law. Penalties in state administrative law in their enforcement do not require intervention from other institutions. Still, they can be carried out directly by government officials whose authority has been determined in the laws and regulations. Meanwhile, from the Islamic perspective, the fine sanctions can be applied, in the context of hifz Al-Insan, in Maslahah Mursalah as part of the maqasid al-Syari’ah. The obligation to obey government regulations is part of a person’s obedience to God’s commands. Contribution: This study’s findings can support the government in enforcing the law to combat the spread of the coronavirus disease 2019 (COVID-19) in Indonesia and other countries because, constitutionally, the law is legal. Then, the legality of fines for violators of the COVID-19 health protocol, from an Islamic perspective, does not contradict maqasid al-shari’ah. So, there should be no doubts for Muslims to obey these regulations. (shrink)

This paper describes an axiomatic theory BT, which is a suitable formal theory for developing constructive mathematics, due to its expressive language with countable number of set types and its constructive properties such as the existence and disjunction properties, and consistency with the formal Church thesis. BT has a predicative comprehension axiom and usual combinatorial operations. BT has intuitionistic logic and is consistent with classical logic. BT is mutually interpretable with a so called theory of arithmetical truth PATr and with (...) a second-order arithmetic SA that contains infinitely many sorts of sets of natural numbers. We compare BT with some standard second-order arithmetics and investigate the proof-theoretical strengths of fragments of BT, PATr and SA. (shrink)

This paper describes axiomatic theories SA and SAR, which are versions of second order arithmetic with countably many sorts for sets of natural numbers. The theories are intended to be applied in reverse mathematics because their multi-sorted language allows to express some mathematical statements in more natural form than in the standard second order arithmetic. We study metamathematical properties of the theories SA, SAR and their fragments. We show that SA is mutually interpretable with the theory of arithmetical truth PATr (...) obtained from the Peano arithmetic by adding infinitely many truth predicates. Corresponding fragments of SA and PATr are also mutually interpretable. We compare the proof-theoretical strengths of the fragments; in particular, we show that each fragment SAs with sorts <=s is weaker than next fragment SAs+1. (shrink)

Affective bonding to radical organizations is one of the most prominent features of a recruit’s personality. To better understand how affective bonding is established during the recruitment of youth for radicalization and how it is maintained afterward, it seems promising to adopt new insights and developments from the field of situated cognition and affectivity, particularly the concepts of Affective Scaffolding, Mind Invasion, and Self-Stimulatory Loops of Affectivity (SSLA). The three notions highlight both the intended structuring of the affective bonding by (...) the recruiting organizations and the immersive influence these settings have on the individuals. We will study the affective bonding between an individual and a radical group from two perspectives: first, from an organizational perspective, and second from a personal perspective. The first aims at understanding how extremist organizations “invade the mind” of young people, by providing carefully designed affective scaffolding: (a) during the recruitment process and (b) while being a full member of the organization. The second aims at identifying some of the affective loops which individuals who have joined the radical organization enter. (shrink)

The article discusses the key stages of the development of ‘disability studies’. Public awareness of the problems of inclusion, as overcoming social inequality, is in the stage of formation in Ukraine and needs a socio-philosophical implementation. he main purpose of the article is to analyze the problem of social space of the city, which is convenient for the life of citizens with different set of opportunities, and the expediency of including disability as a social phenomenon in the broad philosophical context (...) of study. The field of thinking about the city in the study is outlined in the following concepts: the right to the city, the urban space for human development, social communications and the just principles of being. It is important to understand the vector of the development of the socio-cultural field of the city in terms of overcoming the "soulless indifference" (bliss) and for the development of communication between the citizens. The novelty of the work is determined by the rationale for the transformation of traditional disability models in modern conditions of social development. The relevance of the study is associated with the complexity of the phenomenon of disability, insufficient knowledge of the factors and problems of inclusion of people with special needs in society. With the growing number of people with disabilities in society, the problem of developing a culture of disability becomes urgent, the low level of which should be considered a challenge. A culture of disability implies a mutual desire of people with disabilities and society to move towards each other. The practical aspect of the research is related to the need for change of social consciousness, inclusion of persons with disabilities in the social space, development of social competences of people with disabilities and transformation of these people from the object of social assistance into an active subject and participant of the processes taking place in society., implementation of projects based on justice and citizenship. This article presents Epistemic Spatialization as a new framework for investigating the interconnected patterns of biases when identifying objects with convolutional neural networks. It draws upon Foucault’s notion of spatialized knowledge to guide its method of enquiry. We argue that decisions involved in the creation of algorithms, alongside the labeling, ordering, presentation, and commercial prioritization of objects, together create a distorted “nomination of the visible”: they harden the visibility of some objects, make other objects excessively visible, and consign yet others (...) to permanent or haphazard invisibility. Our approach differs from those who focus on high-stakes misidentifications, such as errors tied to structural racism. Examining the far more dominant series of low-stakes mistakes shows the scope of errors, destabilizing the goal of image content identification with considerable societal impact. We explore these issues by closely examining the demonstration video of a popular convnet. This examination reveals an interlocking series of biases undermining the content identification process. The picture we paint is crucial for a better understanding of the errors that result as these convnets become further embedded in everyday products. The framework is valuable for critical work on computer vision, AI studies, and large-scale visual analysis. (shrink)

This study aims at reducing, and even eliminating, the thoughts of small Muslim groups in Indonesia, which state that the replacement of Pancasila as a Khilafah will raise the Indonesian state to become a developed country. This study uses a normative legal research methodology with two approaches: a historical and a conceptual approach. The historical approach was used to review the history of the implementation of the Khilafah system in Islam and the early history of the emergence of Pancasila as (...) a national government system. Meanwhile, the conceptual approach was used as a road map to examine the Khilafah and Pancasila concepts in the constitutional system. The results of this study revealed that Pancasila represents the Indonesian nation's ideology, which is in tune with Islamic law, and can answer all the needs of its people. Through Pancasila, the Indonesian people can live in harmony amidst existing pluralism. Therefore, there is no space for ideology other than Pancasila to fill and become the foundation of the Indonesian nation.CONTRIBUTION: This article attempts to answer Muslim people's doubts with extremist ideology who want to change Pancasila into Khilafah. New technologies provide new forums for the expression and challenging of racism. This article explores the potential of an interactive blog about asylum-seekers to serve as part of the Habermasian ‘public sphere’, facilitating debate between those with opposing views. We offer evidence that pro- and anti-asylum seeker arguments made in blogs construct a binary between those in favour and those against. Arguments are collectively constructed producing relatively coherent discourses, despite being articulated by different individuals. We then explore the ways in (...) which pro-asylum seeker postings utilize strategies which social scientists have identified as effective in challenging racism. As such, the blog is a site where what has come to be called ‘bystander anti-racism’ is being practised, producing a counter-hegemonic discourse. Our evidence suggests that despite arguments to the contrary, blogs are potentially useful sites for the development of communicative consciousness in relation to race issues, particularly the challenging of racism. Abstract -/- Before Descartes, middle age philosophers like Thomas Aquinas (1225-1274), Duns Scotus (1266-1308), and Francisco Suarez (1548-1617) used to discuss the distinction between essence and existence in three ways (of course, Ibn-Sina was the first who made this distinction to rehabilitate Aristotelian philosophy in the Islamic heritage). Descartes was aware of that, but discussed it according to the relation between mind and body. Yet, he told us many times that he was used to separate essence from existence in metaphysical (...) issues. The objective of this paper is first to rephrase his untold opinion about the relation between essence and existence on the basis of his conception of the problem of distinction according to mind and body, and second, to disclose that Descartes's conception of existence is twofold. At the end, it is claimed that his twofold notion of existence and his inability to overcome it, is the principal factor in his failure to explicate everything according to first principles, and so in his failure to defeat skepticism. There is a perplexing transition in Dr. Reza Davari's thought, when he problematizes the relation between Iranian and Western history/cultures, on which this paper is focusing. The interperative objective is to clarify this transition on the basis of the implicit relation between the two most fundamental concepts in his earlier and later thought respectively westernization and underdevelopment. Although, by this transition, the level of discussion transits from an ontologico-philosophical to an intellectualist one. So, there are two different levels of problematization (...) in his thought which differ deeply. Therefore, we are not just dealing with the substitution of fundamental concepts, but with different problematizations and different levels of discussion. Obviously, there will be new problems arising which are not just concerning with the justification of the transition but with the problematization of westernization itself. Finally, it's been concluded that in order to clarify these new problems, we should step back to the level of philosophical discussion, and first of all to the clarification of the I-not-I relation which has been neglected thoroughly in the whole project. Descartes' methodical doubt is being criticized by naïve realists and others who don't find doubt as a good starting point for metaphysical thought, however, the philosophical achievements of his method have been absorbed in all later philosophies. The objective of this paper is to demonstrate how an inevitable question concerning the foundation of Descartes' mathesis universalis, which led him to investigate this foundation by applying this very method in Metaphysics, has finally enabled him to discover his most important philosophical principle, (...) i.e., the necessary relation between being and reason in the identity of the "I". To demonstrate this, after summarizing the fundamental ideas of mathesis uneversalis, and showing the inner necessity of introducing the methodical doubt to fortify these ideas, the decisive role of metaphysical doubt as the third step of the methodical doubt, and malicious demon as its second phase would be highighted. It would also become clear that the metaphysical doubt has a great importance as a turning point from different aspects: as a knot that ties mathesis universalis with its underlying Metaphysics; as a bridge from within the psychological "I" to the metaphysical "I". Abstract -/- The objective of this paper is to clarify that the distinction Malkam Khan makes between natural (ordinary) and scientific reason, is crucial to his entire thought, and he makes this distinction because he is aware of the critical status the idea of method has in the formation of the scientific reason. So, I try to prove that the idea of method and the distinction he makes between these two reasons are the same idea which is to be considered (...) as his central idea. According to Malkam Khān, following the principles of this reason is the key to prosperity and progress. So, he believes that in order not to be colonized, we should progress, and in order to become prosperous, we should act according to the principles of scientific reason. On the basis of this analysis I claim that he thinks like a strategist, therefore, whenever we want to interpret his thought as a consistent whole, we should consider this particular approach. My own approach in this paper is in harmony with the main argument of Malkam Khān, trying to interpret his thought not on the basis of his personal character, his concealed intentions, or simple political events in which he was a part, but on the basis of seeing his thought as scientifically (objectively) as possible by focusing on his own writings in different stages of his thought-life, and analyzing them structurally. Disgust seems to play an important role in moral judgment. However, it is unclear whether the role of disgust in moral judgment is limited to certain kinds of moral domains (versus many) and/or certain types of disgust (versus many). To clarify these questions, we conducted a multilevel meta-analysis (k = 512; N = 72,443) on relations between trait disgust sensitivity and moral judgment (disgust-immorality association). Main analyses revealed a significant overall mean disgust-immorality association (r =.23). Additionally, moderator analyses revealed significant (...) specificity in disgust type and moral domain (grounded in Moral Foundations Theory): effects were stronger for (a) sexual disgust compared to pathogen disgust, (b) sanctity moral judgments compared to other domains of moral judgments, and (c) sexual-sanctity associations compared to other disgust type-moral domain pairings. PurposeThe main purpose of this study is to assess the effects of COVID-19 on the restaurant businesses of Bangladesh. It examines the socio-economic impacts of the humanitarian disaster of the COVID-19 pandemic from the perspective of restaurant owners. The study also intends to provide recommendations to mitigate effects on the restaurant business.Design/Methodology/ApproachA qualitative research approach was adopted to explore the effects of the COVID-19 pandemic on the restaurant businesses of Bangladesh. A total of 22 in-depth interviews were conducted with the (...) top-ranked restaurant owners in the Rajshahi City Corporation area of Bangladesh. Thematic analysis technique was applied for analyzing the collected data.FindingsThe study found that the restaurant owners were compelled to reduce their number of employees, and forced to ensure social distancing and proper sanitization which increased the expenses. Although online orders and home delivery services have increased significantly, restaurant business operation is gradually turning critical owing to the lack of financial support. Thus, restaurant owners urge the govenrment for financial assistance.Research Limitations/ImplicationsSince this research only focused on one city in Bangladesh, the outcomes of study may have a dearth of generalizability. Hence, the investigators are encouraged to extend the study area.Practical ImplicationsThis study will help restaurant owners and policymakers in formulating contemporary business policies and strategies. Thus, it will be supportive of improving the present condition of the restaurant businesses in developing countries like Bangladesh.Originality/ValueThis paper identified the truculent scenario of the restaurant business during the COVID-19 pandemic. In 2008, Dutch anti-Islam Member of Parliament Geert Wilders produced a short video called Fitna to visualize his argument that Islam is a dangerous religion. Thousands of men and women across the globe uploaded their own videos to YouTube to criticize or support the film. In this article, we look at these alternative videos from a feminist perspective, contrasting the gender portrayal and narratives in Fitna with those in the alternative videos. We contend that Fitna expressed an extremist Orientalist discourse, (...) in which women are presented as the current and future victims of the oppression of Muslim men and Islam. In contrast, the YouTube videos give voice to women themselves who come from across the globe, are relatively young and often active Muslims. Second, they express different view points in generically new ways, criticizing and ridiculing Wilders or producing serious and committed explanations of their own understanding of Islam. Third, although relatively few women appeared in the videos, those that did speak for themselves, not only take on Wilders, but also claim their right to speak within Islam. We propose to understand these videos as acts of citizenships through which women constitute themselves as global citizens, in some cases by engaging in ‘deliberation’ as it is understood in feminist political theory, in other cases by taking a ‘voice’ that can be responded to. ART and, in particular, IVF and ICSI, are essentially a laboratory experiment, but which, due to its specificity, goes beyond the disciplinary boundaries, explicitly acquiring an ethical-axiological dimension in the interaction zone of the members of a particular community involved in child-bearing. At the same time, it is noted that the activity and choice of a way to solve problems with childbirth has a characteristic severity, due to the traditions and level of civil and social maturity of a country, due, (...) among other things, to the level and achievements of technical equipment in this industry of knowledge and practice. According to foreign studies, about half of all subfertile people in developed countries are trying to overcome their infertility with the help of medicine, and research data indicate that the proportion of such individuals is growing. The most difficult problems of reproduction are associated with low quality of oocytes or low ovarian reserve ; aspermia and deep teratozoospermia, can not give hope to a couple to have genetically related offspring. However, donor programs create additional opportunities for social motherhood / paternity. Donation of oocytes is found in ART programs at least 3 times more often than donation of spermatozoa. At the moment, donation of gametes and embryos raises a number of ethical, legal, medical and socio-psychological issues that require competent support from experts of a wide range of specialists, as well as competent, non-commercial, primarily due to the interaction between donors and recipients. The analysis of possible modifications of family and kinship ties is based on the idea of transforming social relations, in which assisted reproductive technologies play a fundamental role, building a system of “new kinship and new family.” By entering into the intimate process of the birth of life and acting as a regulator of the composition of participants in this process through the stimulation of responsibility to present and future relatives, reproductive technologies affect the initial moral requirements in the community, redefining universal values based on the specific situation. Scenarios of childbearing through ART with the involvement of additional participants are possible in the context of the legal field, but legally fixed anonymity of the donor leaves many unresolved issues related to the problems of hereditary diseases, genetic abnormalities and epigenetic changes; in addition, there is a problem associated with the possibility of unintentional incest, as well as the difficulties of the child’s self-identification and the closeness of his genealogy. Solutions to these issues are postponed until later, thereby initiating future dramatic situations, ethical conflicts and dilemmas with a poorly predictable positive outcome. (shrink)

El artículo ofrece un análisis en profundidad de los fragmentos dedicados a Pedro I, al que Ibn Ḫaldūn conoció personalmente, y muestra que su muerte a manos de su medio hermano Enrique II (g. (...) 1366-1367 y 1369-1379) recibió gran atención en Kitāb al-ʿIbar de Ibn Ḫaldūn y Durar al-ʿuqūd al-farīda de al-Maqrīzī. Pone de relieve asimismo que la información sobre el reino de Castilla que proporcionan ambos autores, aunque alterada, guarda relación con fuentes castellanas contemporáneas, y que parte de esa información relativa a la dār al-ḥarb en el otro extremo del Mediterráneo llegó de alguna manera al Egipto mameluco, donde Ibn Ḫaldūn y al-Maqrīzī (y su coetáneo al-Qalqašandī a través de Ibn Ḫaldūn) la incorporaron a sus respectivas obras.
