BackgroundMental health professionals (MHP) working in court-mandated treatment settings face ethical dilemmas due to their dual role in assuring their patient’s well-being while guaranteeing the security of the population. Clear practical guidelines to support these MHPs’ decision-making are lacking, amongst others, due to the ethical conflicts within this field. This qualitative interview study contributes to the much-needed empirical research on how MHPs resolve these ethical conflicts in daily clinical practice. Methods31 MHPs working in court-mandated treatment settings were interviewed. The interviews (...) were semi-structured and our in-depth analysis followed the thematic analysis approach.ResultsWe first outline how mental health professionals perceive their dual loyalty conflict and how they describe their affiliations with the medical and the justice system. Our findings indicate that this positioning was influenced by situational factors, drawing the MHPs at times closer to the caring or controlling poles. Second, our results illustrate how participating MHPs solve their dual loyalty conflict. Participants considered central to motivate the patient, to see the benefits of treatment and its goals. Further, transparent communication with patients and representatives of the justice system was highlighted as key to develop a trustful relationship with the patient and to manage the influences from the different players involved. ConclusionsEven though individual positioning and opinions towards dealing with the influences of the justice system varied, the results of our research show that, in spite of varying positions, the underlying practice is not very different across participating MHPs. Several techniques that allow developing a high-quality therapeutic alliance with the patient are key elements of general psychotherapy. Transparency appears as the crucial factor when communicating with the patient and with representatives of the justice system. More specifically, patients need to be informed since the beginning of therapy about the limits of medical confidentiality. It is also recommended to develop guidelines that define the level of detailed information that should be disclosed when communicating with the authorities of the justice system. (shrink)

This book collects texts from three specialists in ancient philosophy which deal with the question of perceptive and intellective knowledge in antiquity. They try to present, in their different analyzes, the complex interrelationship among perception and thought in ancient authors, like Heraclitus, Parmenides, Democritus, Plato and Aristotle. The purpose of the texts is to expose the visible field - the perceptual knowledge domain - interacts with the invisible - the domain of reason and thought. From the early to mid-1970s, Michel Foucault posited that power consists of a relation rather than a substance and that this relation is comprised of unequal forces engaged in a warlike struggle against each other, resulting invariably in the domination of some forces over others. This understanding of power, which he retrospectively dubbed `Nietzsche's hypothesis' and `the model of war', underpinned his well-known analyses of disciplinary power. Yet, Foucault in his Collège de France course from the academic year 1975-6, `Society (...) Must Be Defended', suddenly began to call into question this understanding and his doubts about it did not abate well into the late 1970s. In this article, we suggest that his militant politics in the early 1970s sustained his adherence to the war model and that his more cautious political attitude later in the decade underpinned his suspicions about this model. The main aim of this paper is to introduce the logics of evidence and truth $$LET_{K}^+$$ and $$LET_{F}^+$$ together with sound, complete, and decidable six-valued deterministic semantics for them. These logics extend the logics $$LET_{K}$$ and $$LET_{F}^-$$ with rules of propagation of classicality, which are inferences that express how the classicality operator $${\circ }$$ is transmitted from less complex to more complex sentences, and vice-versa. The six-valued semantics here proposed extends the 4 values of Belnap-Dunn logic with 2 more values (...) that intend to represent (positive and negative) reliable information. A six-valued non-deterministic semantics for $$LET_{K}$$ is obtained by means of Nmatrices based on swap structures, and the six-valued semantics for $$LET_{K}^+$$ is then obtained by imposing restrictions on the semantics of $$LET_{K}$$. These restrictions correspond exactly to the rules of propagation of classicality that extend $$LET_{K}$$. The logic $$LET_{F}^+$$ is obtained as the implication-free fragment of $$LET_{K}^+$$. We also show that the 6 values of $$LET_{K}^+$$ and $$LET_{F}^+$$ define a lattice structure that extends the lattice L4 defined by the Belnap-Dunn four-valued logic with the 2 additional values mentioned above, intuitively interpreted as positive and negative reliable information. Finally, we also show that $$LET_{K}^+$$ is Blok-Pigozzi algebraizable and that its implication-free fragment $$LET_{F}^+$$ coincides with the degree-preserving logic of the involutive Stone algebras. The relationship between q-spaces (c.f. [9]) and quantum spaces (c.f. [5]) is studied, proving that both models coincide in the case of Spec A, the spectrum of a non-commutative C*-algebra A. It is shown that a sober T 1 quantum space is a classical topological space. This difficulty is circumvented through a new definition of point in a quantale. With this new definition, it is proved that Lid A has enough points. A notion of orthogonality in quantum spaces is introduced, (...) which permits us to express the usual topological properties of separation. The notion of stalks of sheaves over quantales is introduced, and some results in categorial model theory are obtained. (shrink)

In 1996, W. Veldman and F. Waaldijk present a constructive (intuitionistic) proof for the homogeneity of the ordered structure of the Cauchy real numbers, and so this result holds in any topos with natural number object. However, it is well known that the real numbers objects obtained by the traditional constructions of Cauchy sequences and Dedekind cuts are not necessarily isomorphic in an arbitrary topos with natural numbers object. Consequently, Veldman and Waaldijk's result does not apply to the ordered structure (...) of Dedekind real numbers in toposes. The main result to be proved in the present paper is that the ordered structure of the Dedekind real numbers object is homogeneous, in any topos with natural numbers object. This notion involves three theses that show the unconditional vindication of immanence and the critique of all transcendence: affirmation of the body over consciousness; appealing to the good things and the bad things rather than to good and evil; and the defense of the joy and innocence of becoming. The article argues that this naturalistic and pluralistic ethics is grounded in assessment criteria linked to life as the focal point of appreciation, and suggests the creation of new ways of being as a means to tackle the system of moral judgment on which nihilism is based. En el siguiente estudio se evalúa un panorama con respecto al comportamiento sociológico en un preámbulo tanto antes durante y después de esta crisis social que se está viviendo debido a la pandemia de hoy en día. Por ello para sustentar dicha investigación se realizó un censo en el cuál, mediante el uso de herramientas estadísticas, se pudo realizar una comparación entre un antes y un durante de la pandemia, lo cual facilitaría intrínsicamente a la predicción de una denominada post (...) pandemia. En este texto se pretende detallar el proceso y forma de la encuesta, al igual que los resultados obtenidos de la misma. Se proveen, además, posibles explicaciones para estos resultados, guiándose por las restricciones de salud nacionales como posibles razones para el cambio de comportamiento actual. Do all questions have answers? How much can we know about the world? Is there such a thing as an ultimate truth? To be human is to want to know, to understand our origins and the meaning of our lives. Gianni Vattimo associates “mystic” and metaphysics. The “forgetting of the being” would be coextensive to the abandonment (Gelassenheit) or to the mystic “losing oneself” (Versenkung) in the absolute. Based on this, the article analyzes the relevance and the possibility of the vattimiana hermeneutics referring to (Verwindung) “the mystic” to surpass it. The perspective of the hermeneutic ethics of Vattimo defends that the history of modernity, in its nihilism and secularization, keeps traces of the history of the salvation inaugurated by the (...) Jewish-Christian perspective. The “mystical losing oneself” contradicts the Pauline experience of the preparation of parusía. Based on Heidegger, the Italian philosopher defends that, considering the imminent parusía, the authenticity of the temporal experience to the Pauline Christian, meant going through, with faith, the present tribulation in the caducity of the historical contingency, hindering the mystical Versenkung and its respective evasion in the daily efforts. In favor of this persistence/effort, it is glimpsed cáritas, inaugurated by the kénosis in the East, as the optimum authenticity criterion for a contemporary spirituality; because cáritas would imply, in its opposition to the implicit violence of the absolute fundamentals, the recognition of the bond between the spiritual and the nihilist and secularized East. O artigo preconiza a relevância pedagógica da filosofia da não-significação de Albert Camus, especialmente em O Mito de Sísifo. O eixo argumentativo segue a última frase deste livro: “É preciso imaginar Sísifo feliz”. A certeza da existência e a estranheza de se inserir num cenário de catástrofe, sem esperança, suscita em estudantes, especialmente da rede pública, um “sentimento da absurdidade”, mas esse estado não há de ser visto como maldição. A liberdade paradoxalmente advém quando se assume o absurdo como meio (...) de se afirmar a vida, contra os suicídios físico e filosófico, tornando Sísifo o “herói absurdo”. Camus atribui ao pensamento de Søren Kierkegaard a proposta do suicídio filosófico como sacrifício do intelecto pelo salto kiekegaardiano da fé porque ele entende a felicidade encontrada na vida eterna como uma superação e cura da doença mortal do desespero. O esforço dialético de autorreflexão da consciência entre o finito e o infinito faz da resignação infinita uma preparação para o salto da fé. Para nosso autor, porém, o pior mal é não ter sofrido desespero, pois é a partir dele que imaginativamente o absurdo, como potência existencial, transfigura-se numa “revolta metafísica” — uma posição a ser desenvolvida no processo de ensino-aprendizagem em Filosofia. O livro almeja ser representativo nos principais debates contemporâneos, oferecendo uma visão panorâmica sobre o campo na atualidade e permitindo-se aprofundar em algumas discussões selecionadas.O ambiente não pode ser reduzido ao “meio ambiente”, à natureza não humana. Ele não é meramente algo que “nos envolve”, um envoltório: o ambiente somos também nós, seres humanos, histórica e culturalmente situados. Quanto aos territórios, eles se estabelecem em íntima conexão com os ambientes em suas dimensões paisagística e material, quer sejam os processos geoecológicos, (...) quer sejam as formas e as dinâmicas socialmente produzidas. Analisar os territórios significa examinar como, a cada momento, os ambientes, seus recursos e significados são disputados e viram objeto de conflitos.O público-alvo principal são os estudantes dos últimos anos da graduação, além daqueles em nível de pós-graduação, de todas as áreas que lidam com problemas e conflitos ambientais. Afora os pesquisadores iniciantes e os jovens universitários em geral, porém, podemos presumir que profissionais experientes também poderão tirar proveito do material de diversos capítulos. É razoável, por fim, nutrir a expectativa de que muito do que este livro contém possa (retro)alimentar o ativismo ambiental crítico e a prática de combater as iniquidades e as distorções que se acumulam em nossas sociedades, principalmente as muitas situações de flagrante injustiça ambiental. The purpose of this exercise is to help establish a practical access to Deleuze's philosophies, and to offer a clinical account of the Israeli occupation of the (...) Palestinian territories. Michel Foucault is one of the most preeminent theorists of power, yet the relationship between his militant activities and his analysis of power remains unclear. The book explores this relationship to explain the development of Foucault's thinking about power. Using newly translated and unpublished materials, it examines what led Foucault to take on the question of power in the early 1970s and subsequently refine his thinking, working through different models (war and government) and modalities (sovereign, disciplinary, biopolitical, pastoral and governmental). Looking at Foucault's political trajectory, from his involvement with the prisoner support movement and Solidarity to his controversial engagement with the Iranian revolution, the book shows the militant underpinning of his interest in the question of power and its various shifts and mutations. This thorough account, which includes the first translation of a report edited by Foucault on prison conditions, will provide students in contemporary political theory with a better understanding of Foucault's thinking about power and of the interplay between political activities and theoretical productions. The subject of this book is the social and political meaning of constitutional texts to the detriment of their legal concretization. Focusing on the discrepancy between the hypertrophically symbolic function of constitutions and their insufficient legal concretization, it offers a critical counterpoint to constitutional theory that treats constitutional texts as a panacea to solving political, legal, and social problems. In contrast to the premises of Niklas Luhmann's systems theory regarding law and constitution in world's society, symbolic constitutionalization is approached here (...) in both a comprehensive and far-reaching perspective. Chapter 1 sets out the debate about symbolic legislation. Chapter 2 explains the notion of symbolic constitutionalization as a problem embracing the whole legal system. Chapter 3 approaches the issue in terms of allopoiesis of law, characterizing it primarily as a problem in peripheral modernity and referring to the Brazilian experience. The final chapter discusses the tendency to a symbolic constitutionalization of world society in the scope of a paradoxical peripheralization of the centre. (shrink)
