The absence of Islam from recent scholarship on Hegel's account of world religions is puzzling. In the first part of the article, we argue that Hegel's neglect of Islam in his systematic account of religious phenomena is not accidental and that he did not think of Islam as a determinate religion. Its size and believers aside, we suggest that it is not possible to assign any determinacy to Islam as a world-historical phenomenon under Hegel's rubric, because such determinacy that applies (...) to other religions would be in conflict with what Hegel takes to be Islam's emphasis on the negative moment of truth, its revolutionary tendencies, and its lack of any novel conceptual content as a response to Christianity. In the second part of the article, we point out how one could respond to Hegel's characterization of Islam when it is mentioned in relation to other religious traditions. First, we argue that Hegel overemphasizes the significance of Islam qua religion in explaining the history of Muslim peoples. More than that, Hegel does not see that the history of Islamic philosophy and science can be characterized by sublation and that it can be integrated into conceptual developments in the West on these terms. However, our critique of Hegel's Eurocentrism does not remain at this level, for in the third part of the article we argue for the significance of considering the response of Muslim philosophers to Hegel. In particular, we look at the responses by Mohammed al-Khosht and Mahmoud Haider, respectively. We conclude that Hegel's exclusion of Islam from any involvement in the history of the Concept indicates an undialectical commitment on his part and that to this extent being Hegelian today requires that we rectify this oversight. Karl Marx’s “On the Jewish Question” has fueled discussions around his early intellectual development as a Young-Hegelian thinker as well as debates about an allegedly distinct form of anti-Semitism native to Left-Hegelian and later to left-thinkers in general, Jewish and non-Jewish alike. In this article, I argue that Marx’s assessment of contemporary Judaism is motivated by an underappreciated criticism of Hegelian historiography. Surveying the genesis of the Hegelian treatments of Judaism between Hegel and Marx, I distinguish Marx’s intervention as a (...) reaction to non-materialistic teleological historiography. This historiography assumes dialectical movement and demands practical change from those considered foreign to the movement. In contrast, this article suggests that Marx’s primary target is the belief that Judaism has been sublated into Christianity, that the abnormality lies not in Judaism’s historical persistence, but in the Christian pretense that the material contradictions Judaism was a response to have been overcome. Against the teleological nature of all renditions of Hegelian historiography, including Marx’s later historical-materialism, his “On the Jewish Question” weaponizes a hitherto unrecognized anti-teleological argument against the assimilationist views it responds to, of the kind that should evoke Nietzschean genealogy. Nietzsche’s views regarding suicide are usually interpreted as a response to Christian, Kantian, and Schopenhauerian ethics. Here, they are defended on the basis of his notion of life as an aesthetic phenomenon in order to provide extramoral responses to such challenges as the following: a) whether the self can deliver the right kind of judgment regarding her life, b) how suicide can be considered an empowerment of the will, and c) whether suicide can be considered an exercise of freedom by (...) the subject who thereby cancels the very grounds and means for will and action. Reconstructed as a response to Hegel’s argument against suicide on the grounds that one is not the master of oneself and that one therefore lacks the proper means to judge one’s life, Nietzsche’s position provides the epistemic footing to ground an alternate notion of self-mastery as well as the necessary insight regarding one’s life. It is shown that this reading of Nietzsche’s argument is in alignment with his non-dualism and expressivist views regarding agency. Finally, a response is formulated to the socially-grounded arguments prohibiting suicide on the basis of this reading of Nietzsche’s position. (shrink)

Research ethics committees are charged with providing an opinion on whether research proposals are ethical. These committees are overseen by a central office that acts for the Department of Health and hence the State. An advisory group has recently reported back to the Department of Health, recommending that it should deal with inconsistency in the decisions made by different RECs. This article questions the desirability and feasibility of questing for consistent ethical decisions.

Decisions made so far by the Federal Constitutional Court of Germany have always been characterized by their writing and content, even down to details, precision, accuracy, professional legal style of writing, always clear in the elaboration and adjudication of cases from its competence, but surprisingly, in our country, only a few have paid attention to the German Court in a scientific context, which can be seen from the only few materials we possess in the Albanian language. The purpose of this (...) paper is to provide an overview of this Court, so that the comparative aspects can be made, highlighting its advantages and disadvantages, in case of dictating the state need for reform of the Constitutional Courts. Those who have institutionalized this constitutional institution know its value in the system of constitutional justice, which performs it in terms of protection of constitutions, its principles and value, and most importantly in the protection of freedoms and rights of human beings and citizens. The Federal Constitutional Court of Germany, to this date, has conveyed the efficiency of the protection of the German legal order, the serious approach and law interpretation, for the protection of freedoms and human rights, which ranks this court into a high level among all other powers in the German law system. The author, in the following paper, gives an overview of this Court starting with its history, organization and functioning, which today undoubtedly constitutes one of the most important constitutional courts in the world. In confrontation with the current events of his time, Max Scheler develops his idea of a “new Europe”, which is to emerge from the ruins of the First World War in confrontation with “capitalist England” and through the awakening of a new religiosity. From the 1920s onwards, the idea of unity under Catholicism is overcome and raised to a higher level to a global and cosmopolitan level. Scheler speaks of a “cosmopolitanism” that needs to be learned and will ultimately entail (...) a balancing process (Ausgleichsgeschehen). Scheler understands this Ausgleich and cosmopolitanism as an educational task (Bildungsaufgabe). According to Scheler, only in and through the education (Bildung) of persons towards this idea can national, cultural and religious one-sidedness be overcome. Scheler's new conception of knowledge and Bildung plays an essential role in this, culminating in the concept of the all-man (Allmensch), who, as a relative all-man, is to be both a model and a goal. Temporal perspectives allow us to place ourselves and temporal events on a timeline, making it easier to conceptualize time. This study investigates how we take different temporal perspectives in our temporal gestures. We asked participants (n = 36) to retell temporal scenarios written in the Moving‐Ego, Moving‐Time, and Time‐Reference‐Point perspectives in spontaneous and encouraged gesture conditions. Participants took temporal perspectives mostly in similar ways regardless of the gesture condition. Perspective comparisons showed that temporal gestures of our participants resonated better with (...) the Ego‐ (i.e., Moving‐Ego and Moving‐Time) versus Time‐Reference‐Point distinction instead of the classical Moving‐Ego versus Moving‐Time contrast. Specifically, participants mostly produced more Moving‐Ego and Time‐Reference‐Point gestures for the corresponding scenarios and speech; however, the Moving‐Time perspective was not adopted more than the others in any condition. Similarly, the Moving‐Time gestures did not favor an axis over the others, whereas Moving‐Ego gestures were mostly sagittal and Time‐Reference‐Point gestures were mostly lateral. These findings suggest that we incorporate temporal perspectives into our temporal gestures to a considerable extent; however, the classical Moving‐Ego and Moving‐Time classification may not hold for temporal gestures. Objectives—To study the value of taking an ethics history as a means of assessing patients' preferences for decision making and for their relatives' involvement.Design—Questionnaire administered by six junior doctors to 56 mentally competent patients, admitted into general and geriatric medical beds.Setting—A large district general hospital in the United Kingdom.Main measures—To establish whether patients were adequately informed about their illness and whether they minded the information being communicated to their relatives. To establish their preference regarding truthful disclosure and participation in decision (...) making with risk attached. To establish whether they wished to be involved in CPR decision making, and if not, who should make the decision. To establish whether they knew of living wills and whether they had any advance directives.Results—Twenty-four were inadequately informed of their illness.Forty-six said they would want to know were something serious to be found. Twenty-eight wanted to make their own decision if requiring risky treatment and 11 wanted family members involved. Thirty-one wanted to make a cardiopulmonary resuscitation decision and five of these decisions differed from those made by the doctors. Twenty-five preferred the doctors to decide. Eleven of the patients had heard of living wills but only one had executed such a will. Seven of the patients wished to provide advance directives. Three did not find the history taking helpful but none were discomforted.Conclusion—Taking an ethics history is a simple means of obtaining useful information about patients' preferences. (shrink)

Objectives: To compare non-treatment decision making by general practitioners and geriatricians in response to vignettes. To see whether the doctors’ decisions were informed by ethical or legal reasoning.Design: Qualitative study in which consultant geriatricians and general practitioners randomly selected from a list of local practitioners were interviewed. The doctors were asked whether patients described in five vignettes should be admitted to hospital for further care, and to give supporting reasons. They were asked with whom they would consult, who they believed (...) ought to make such decisions, and whether the relatives’ preferences would influence their decision making.Main measures: To analyse the factors influencing the doctors’ decisions not to admit otherwise terminally ill patients to hospital for life prolonging treatment.Results: Seventeen GPs and 18 geriatricians completed the interview. All vignettes produced strong concordance in decision making between both groups. Ten per cent of the doctors would provide life prolonging treatment to patients with severe brain damage. Most would admit a surgical patient regardless of age or disability. Medical reasons were largely used to explain decision making. The wishes of relatives were influential and resource considerations were not. There was variability regarding decision making responsibility.Conclusions: Little attempt was made to link decision making with ethical or legal concepts and there may have been non-recognition, or denial, of the ethical consequences of failure to admit. The process of decision making may involve deception. This may be conscious, because of the illegality of euthanasia, or unconscious , because of deepseated medical and societal reluctance to accept that intentionally withholding life prolonging treatment may equate with intentionally causing death. The paper by Szasz is about mental illness and its meaning, and like Procrustes, who altered hapless travellers to fit his bed, Szasz changes the meanings of words and concepts to suit his themes.1 Refuting the existence of “mental illness”, he suggests that the term functions in an apotropaic sense. He submits that in this sense it is used to avert danger, protect society, and hence justify preventive detention of “dangerous” people.But his arguments misrepresent the precise meaning of the term (...) “apotropaic”, which is an adjective, defined in Webster’s, Chambers and the New Shorter Oxford dictionaries as averting or turning aside evil. It is possible that amulets and incantations ward off evil, in the same way as garlic repels vampires, but evil and danger are different concepts. Yet Szasz talks of using phrases like ‘“dangerousness to self and others’ as apotropaics to ward off dangers we fear”, and the word “evil” does not appear in his paper.I will argue that “dangerousness to self and others” and “psychiatric treatment” have a prosaic rather than an apotropaic function.The word “danger” is familiar rather than arcane, and includes many risks. A predatory paedophile is usually both dangerous and evil, but many dangerous people are not evil. For example, a child who plays with a box of matches is dangerous, as is a demented person who drives a car, or a schizophrenic who, acting on delusional beliefs, arms herself with a knife and roams the streets believing she is an avenging angel.Suppose …. Advance refusals of life-sustaining treatment involve three potentially conflicting interests: those of the patient; those of the doctor; and those of the law. The state's interest in protecting life can clash with the patient's right to self determination which, in turn, can conflict with the doctor's desire to act in the patient's best interests. Against this background, we present the case of a patient who was treated (arguably) contrary to his advance refusal but in accordance with English law.

By focusing on the works and intellectual network of the Timurid historian Sharaf al Dīn ʻAlī Yazdī (d.1454), this book presents a holistic view of intellectual life in fifteenth century Iran. İlker Evrim Binbaş argues that the intellectuals in this period formed informal networks which transcended political and linguistic boundaries, and spanned an area from the western fringes of the Ottoman State to bustling late medieval metropolises such as Cairo, Shiraz, and Samarkand. The network included an Ottoman revolutionary, a (...) Mamluk prophet, and a Timurid occultist, as well as physicians, astronomers, devotees of the secret sciences, and those political figures who believed that the network was a force to be taken seriously. Also discussing the formation of an early modern Islamicate republic of letters, this book offers fresh insights on the study of intellectual history beyond the limitations imposed by nationalist methodologies, established genres, and recognized literary traditions. This study explored the perceptions of ethics among long-term care employees (N275) in order to test two hypotheses. A cohort cross-sectional survey examined employees’ perceptions of an ethics environment, racial-ethnic, and position disparities (HO1; ANOVA), and, secondarily, ethics in relationship to select, research-grounded work features measured as manage disagreements, effectiveness, work satisfaction, and opinions of care, the latter including intention to remain (HO2; Pearson Correlations). Established questionnaires with robust psychometrics were employed. Response rate was 51%. Non-significant differences between sample and (...) population on key variables supported extrapolation of results. Statistically significant differences between racial–ethnic (p < 0.03; F 2.42) and work positions (p <0.0001; F 6.24) were revealed on ethics (3.16; HO1). Statistically significant relationships (p <0.0001; r = 0.26–0.68; HO2) between ethics and employees’ work features also were found, confirming both hypotheses. Perceptions of ethics based on racial-ethnic and position disparities, as well as the robust links with employee work features, offered potential avenues for decreasing disparities at work and improving the quality of long-term care. Noted further on ethics item scoring were relatively low scores indicating less involvement in, and access to, ethics discussions and decisions. In contrast, the literature review substantiated the importance of empowerment and retention, which were enhanced by employee involvement in work, notably, discussions and decisions. Thus, implications of ethics committees in long-term care sites as ways to potentially enhance employees’ work and quality of care, especially work satisfaction and retention, were explored; relevant concerns raised by the Covid pandemic were, briefly, discussed. Andrew Sayer undertakes a fundamental critique of social science's difficulties in acknowledging that people's relation to the world is one of concern. As sentient beings, capable of flourishing and suffering, and particularly vulnerable to how others treat us, our view of the world is substantially evaluative. Yet modernist ways of thinking encourage the common but extraordinary belief that values are beyond reason, and merely subjective or matters of convention, with little or nothing to do with the kind of beings people (...) are, the quality of their social relations, their material circumstances or well-being. The author shows how social theory and philosophy need to change to reflect the complexity of everyday ethical concerns and the importance people attach to dignity. He argues for a robustly critical social science that explains and evaluates social life from the standpoint of human flourishing. (shrink)

The management of “wisdom” has been mooted in knowledge management (KM) theory mostly in relation to what is known as the “knowledge hierarchy”. We argue that there are unquestioned assumptions inherent in KM leading to wisdom being included in KM theory because of rhetorical “urges” more than theoretical ones. These rhetorical urges impel a drive towards perfection that excludes more than is included. Our interrogation of the KM literature uncovers some of the questionable implications in understanding knowledge as a resource (...) and an asset and of understanding wisdom as a pinnacle to a knowledge hierarchy. We urge caution regarding theorising of wisdom at the top of a hierarchy, as it should not be mooted as a perfect final solution to Knowledge Management. We suggest the theorising of wisdom be opened out to its fullest “poetic possibilities”, and that attempts to close off its meaning be resisted. (shrink)
