Which party characteristics contribute to the representation of young legislators? We examine this question quantitatively, focusing on the European Parliament, and gauge the influence of the age of the party leader, the age of the party, the size of its support, party ideology and party nomination procedures on the age of politicians, based on data of all members who have served in the EP. The aim of this paper is to describe the way in which argumentative patterns come into being in plenary debate over legislative issues in the European Parliament. What kind of argumentative patterns are to be expected within this macro context? It is shown that the argumentative patterns that come into being in legislative debate in the European Parliament depend for the most part on the problem-solving argumentation that is put forward in the opening speech by the (...) rapporteur of the parliamentary committee report. This argumentation can be pragmatic problem-solving argumentation or complex problem-solving argumentation. The most important prototypical argumentative patterns are investigated in the argumentation put forward by the Members of parliament. This investigation is based on an inventory of the arguments that can in principle be used to support or attack the initial problem-solving argumentation put forward by the rapporteur. (shrink)

This paper examines the different discourses adopted concerning the climate change-migration nexus within the European Parliament (EP). It uses a critical discourse analysis approach to analyse a specific motion for resolution report, its amendments, and plenary debates, as well as an expert interview with the rapporteur to gain further insights into the political dynamics and challenges involved in the process. An own-initiative report is chosen for the analysis to reveal conflicting discourse-making processes between various political groups within the (...) EP and to better understand the role of the EP in the legislative branch of the European Union. It is found that political ideology plays an influential role. Even though political groups agree on the aims of the report, they constantly debate and use amendments to change content and extent. Therefore, we claimed that political discourses in a parliamentary setting should be analysed by specifically evaluating diagnostic, prognostic, and motivational arguments of discourses. (shrink)

The aim of this paper is to present and analyse legal acts cited in the European Parliament resolution of 20 January 2011 on the situation of Christians in the context of freedom of religion. The author presents the substance of the right to religious freedom and the position of religious freedom among other human rights. The paper also shows the formation of European law on religious freedom and grasps the development trends in this area. Because of the (...) discrepancies that arise when translating the same foreign terms into the Polish language, in order to better explain the content of the cited documents, the texts are also given in English language. The article is the summary of basic legal regulations relevant to reflect on religious freedom at EU level. Compiled materials may be useful to continue the reflection on religious freedom. (shrink)

In September 2019, the European Parliament adopted a resolution that sparked controversy due to its equation of Nazism and Communism. The document made the USSR jointly responsible for the outbreak of the Second World War and accused the Russian government of whitewashing communist crimes and glorifying the Soviet totalitarian regime. This article presents the resolution as the latest expression of a broader discursive process that started with the accession process of the Central and Eastern European countries. To (...) support this hypothesis, I examine the genealogy of the resolution, namely the documents that originally outlined the stances expressed by the latter, as well as the debates at the EU Parliament that preceded its adoption. This analysis highlights in particular two fundamental tendencies, i.e. the entanglement of history and memory characterising the recent discourse on European integration and the frequent identification of the Central and Eastern European member states as victims. In the final paragraphs, I suggest that the construction of a shared ‘historical memory’ may represent a legitimising framework for the implementation of specific sets of political and economic ideas, but I also note that processes such as the one described in the article may ultimately damage the cohesion among the member states and the ability of the EU institutions to address relevant internal and external issues. The Committee on Women’s Rights and Gender Equality of the European Parliament is one of the key actors within the European Union institutional framework for gender equality policies. In the context of this Committee, women’s interests are continuously being defined by discursive and deliberative processes. Civil society actors are being included into these processes of policy-making through institutional funding and public hearings. Through the inclusion of particular organizations and the selection of experts for hearings, existing meanings are (...) being reproduced and/or challenged. The article argues that battlegrounds have been opened in recent years as dominant discourses are questioned by the inclusion and legitimation of new civil society actors. Both the FEMM Committee, as a feminist stronghold, and the established women’s organizations at the EU level are being challenged. It becomes contested who the gender experts are, and diverse understandings of gender equality and women’s interests are being articulated. (shrink)

Following the rise in use of online communication in electoral campaigns throughout the world, this article deals with the use of blogs by politicians in Europe. Through the approach of Critical Discourse Analysis, it analyzes blog posts written by the European Parliament incumbents running for the European Parliament elections in 2009, from four different EU states and ideological backgrounds, and at the same time the four largest political groups in the European Parliament. The purpose (...) of the study is to reveal the campaign strategy and dominant discourses through the analysis of the format, style and appeals. In the majority of European Union countries, women are far better represented in the European Parliament than in the lower house of their respective national parliaments. This article examines the political signicance of this imbalance through a case study of French women members of the European Parliament. The marginality of the European Parliament in French politics has meant that women have succeeded in getting elected there and that they have had access to power (...) positions in the European Parliament. Some of these women have occupied positions in traditionally male areas like economics and nance. The European Parliament has been for many women politicians a secondary point of entry into national electoral politics. In French politics, the European Parliament provides a forum for the partial overturning of nationally determined political values, especially those that determine the sexual division of political labour. The European Parliament also creates pressures for changes in the gender composition of other sectors in the French political field. (shrink)

Why do political parties elect so few young deputies? Given that the quantitative literature has at best only partially answered this question, we decided to conduct a qualitative investigation. Taking the European Parliament as a case for study, we examined this question through interview research with some of the young MEPs who served between 2014 and 2019. Our respondents, who answered various open-ended questions, suggest that the young are so few in number both because they lack contacts within (...) the party and are seen as lacking experience. In addition, it appears that few parties have established pro-active measures to promote young candidates. (shrink)

The international #MeToo campaign against sexual harassment constitutes the most prominent contemporary campaign against sexual harassment worldwide. It exposed the issue by undermining the ‘culture of silence’ prevailing in several contexts, including political institutions. This article analyses one specific variant of #MeToo, the campaign MeTooEP that emerged in the European Parliament. MeTooEP is unique in many ways: it was the first collective action against sexual harassment in parliaments emerging in the #MeToo aftermath and it was the first collective (...) action within the EP led by members of the staff, which eventually drove some internal policy changes. Using a unique, large interview dataset, the analysis shows how the actors behind MeTooEP were crucial in shaping the campaign. Their knowledge of institutional rules, practices and daily presence in the EP facilitated their advocacy and transformed the Parliament into an enabling platform for their actions. With the help of Feminist Institutionalism, the analysis demonstrates how the formal and informal institutional EP bodies with their rules and regulations shaped MeTooEP in ways that constrained and empowered it. European legislators must increasingly deal with issues related to fundamental rights. Religion is a frequent topic obliging them to do so. It is not directly part of the EU’s competences but is a source of values underlying policy choices and a tricky political object. Relying on the findings of a survey about what Members of the European Parliament believe and what they do with these beliefs, the article analyzes potential tensions created by religion in the implementation of (...) human rights by the EU. A first part shows how and to what extent European law meets religion, and how it leaves ample room for flexibility but also for divergent interpretations. A second part states that MEPs agree largely on the principle of separation between politics and religion, but may be divided when it comes to drawing boundaries between the two domains. The conclusion points out the limits of the rule of law to prevent conflicts and suggests that human rights may inspire support as well as cause resistance to Europeanization. (shrink)

After coming into force of the Treaty of Lisbon it is acknowledged that better control and respect of the principle of subsidiarity is one of the most important and innovative goals of the Treaty. To achieve this goal, the Treaty introduces a mechanism which, apart from checking compliance of draft legislative acts with that principle, may eventually lead to a draft act to be deleted from the legislative agenda of the European Union on grounds of violation of subsidiarity. Within (...) this mechanism, crucial role is attributed to the national parliaments of the Member States. In this article, the reasons for overall inclusion of national parliaments in the European Union (hereinafter EU, the Union) activities are analysed. The role of national parliaments in the EU according to the specific provisions of the EU treaties is also discussed and the largest part of the work is devoted to the ex ante subsidiarity principle control mechanism (the Early Warning System), which gives the right for the national parliaments to influence the EU legislative process. In the debate on the European Union’s problems, the concept of “democracy deficit” has been present from its very beginning. This term is applied in a quite vast manner and, apart from the asymmetry of the relation between the European Parliament and the Council, it also concerns the overly limited role of national parliaments in the European Union. In this regard, inadequacy in the national position of individual parliaments is observed. On the other hand, it is (...) necessary to emphasise their uneven activity on their European aspirations. At the time when the European dispute on the rule of law in Poland has polarized attitudes and language in statements on both sides – despite irresponsible trends – it is worth to examine the participation of national parliaments (including the Polish parliament) in the European inter-parliamentary dialogue and, consequently, to determine whether and how its constructive impact on the European Union and its law functions. Human enhancement issues are not merely academic: the technologies and trends involved give rise to new needs and social demands, provide opportunities for individuals and society, and present new risks. They also challenge crucial cultural notions, social concepts and views of the human condition, and may cause new forms of social pressure and social exclusion. This chapter reports on a systematic attempt by the European Technology Assessment Group (ETAG), conducted on behalf of the Science and Technology Options Assessment (STOA) (...) panel of the European Parliament, to suggest policy options on the issue of human enhancement. It outlines and discusses a number of strategies for dealing with the issue in a European policy context, identifying a reasoned pro‐enhancement approach, a reasoned restrictive approach, and a systematic case‐by‐case approach as viable options. Through a study of Gandhian political writings in mid-twentieth-century India, this article explores the neglected question of how the issue of representative democracy shaped anticolonial thought. The rise of a Gandhian perspective on electoral representation was made possible by the account of modern democracy given in Gandhi’s "Hind Swaraj" (1909). From the 1930s, four key Indian thinkers influenced by Gandhi expanded on "Hind Swaraj" to argue that capitalist economics were a threat to democratic equality and produced the kinds of unaccountability (...) and elite capture of legislatures that they identified in Western European parliamentary states. In response, Gandhian thinkers developed proposals for federalist postcolonial constitutions, combining a system of participatory legislative councils with collectivist agrarian socialism. I trace the intellectual origins of Gandhian democratic thought in the 1930s and 1940s and outline how its main proponents articulated ideas of antiparliamentarism and moral economics. Revisiting the Gandhian tradition, I suggest, highlights the importance of economic ethics in participatory theories of democracy and popular sovereignty. (shrink)

This book examines the role of the EU in ensuring privacy and data protection on the internet. It describes and demonstrates the importance of privacy and data protection for our democracies and how the enjoyment of these rights is challenged by, particularly, big data and mass surveillance. The book takes the perspective of the EU mandate under Article 16 TFEU. It analyses the contributions of the specific actors and roles within the EU framework: the judiciary, the EU legislator, the independent (...) supervisory authorities, the cooperation mechanisms of these authorities, as well as the EU as actor in the external domain. Article 16 TFEU enables the Court of the Justice of the EU to play its role as constitutional court and to set high standards for fundamental rights protection. It obliges the European Parliament and the Council to lay down legislation that encompasses all processing of personal data. It confirms control by independent supervisory authorities as an essential element of data protection and it gives the EU a strong mandate to act in the global arena. The analysis shows that EU powers can be successfully used in a legitimate and effective manner and that this subject could be a success story for the EU, in times of widespread euroskepsis. It demonstrates that the Member States remain important players in ensuring privacy and data protection. In order to be a success story, the key stakeholders should be prepared to go the extra mile, so it is argued in the book. The book is based on academic research for which the author received a double doctorate at the University of Amsterdam and the Vrije Universiteit Brussels. It builds on a long inside experience within the European institutions, as well as within the community of data protection and data protection authorities. It is a must read in a time where the setting of EU privacy and data protection is changing dramatically, not only as a result of the rapidly evolving information society, but also because of important legal developments such as the entry into force of the General Data Protection Regulation. This book will appeal to all those who are in some way involved in making this regulation work. When, on December 7, 2000, the European Parliament, the Council and the Commission proclaimed solemnly in Nice the Charter of Fundamental Rights of the European Union, many thought that European integration was practically guaranteed and that the Charter would soon be made into a binding legal text. Since then, the two attempts to enact a European consitution – the Constitutional Treaty for the European Union of 2004 and the arguably less ambitious Treaty of Lisbon (...) of 2007 – both failed. Further efforts at unification have stagnated, in part due to the 2008 economic crisis and the European Union’s inability to coordinate responses to issues as serious as immigration, the refugee crisis, and terrorism. In this paper, I examine a theoretical counterpoint to that bleak perspective for European unification, to wit, Jürgen Habermas’ eurofederalist proposal of the postnational democracy and European constitutional patriotism. The nanotechnologies and nanomaterials sector is a huge and growing industry. The amount of legislation already in place and still to be produced in order to regulate it will be very substantial. What process is used to produce such regulation? The answer is that very diverse regulatory approaches are and will be used. The approach taken by the European Commission diverges from the one taken by the European Parliament. Moreover, at national level, Member States add their own (...) contribution to the process. This article attempts to describe the landscape and various regulatory actions that have been undertaken by all these actors in the European Union. It first describes the role played by the European Commission and Parliament. It then looks at specific regulatory initiatives from a more sectoral perspective: Cosmetics, Food information, Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment, Waste Electrical and Electronic Equipment and Biocides. The third part of the paper describes some major national initiatives, in particular those concerning the establishment of reporting systems for nanomaterials, mixtures, articles and consumer products containing them, as an example of how to improve the current governance in the EU and to prevent the risks to human health and the environment. The fourth part gives the perspective of the European Trade Union Confederation. Finally it presents some conclusions and policy recommendations, taking into consideration the diversity of regulatory approaches. (shrink)

The purpose of this article is to analyse the main provisions of the European private company not limited by the provisions as presented by the European Commission in its Proposal for a Council Regulation on the statute for European private company, but also including amendments introduced by the European Parliament and taking into account the negotiations in the Council of the European Union. This article analyses the development of the European private company and (...) explains why such legal form of a company is needed. It provides the analysis of the main provisions of the proposal for the Regulation, the assessment of advantages and drawbacks of the alternatives introduced by the European Parliament and considered in the Council of the European Union, evaluation of the response of these provisions to the specific needs of small and medium-sized enterprises. Most refugees residing in the European Union (EU) do not retain their voting rights in states of origin or lack the means to exercise them effectively. Most member states of the EU do not extend voting rights to refugees. This leaves a large population of refugees residing within the borders of the EU in a unique state of disenfranchisement. In this article, I consider this problem from a democratic perspective. Should refugees in the EU have voting rights? My answer (...) turns on three aspects characterizing the circumstances of refugees: First, refugees reside in member states for an indeterminate, and typically protracted, amount of time without any exit options. Second, the political governance of the EU and its member states significantly shapes the lives of refugees. And third, refugees lack effective voting rights, and consequently, a meaningful political membership, in any political community across the world. In turn, based on an all-subjected principle of democratic inclusion, I argue that refugees should be secured state-level voting rights in member states, albeit with a condition of the period of residency. Moreover, they should have immediate voting rights at the supranational institutions of the EU such as the European Parliament. (shrink)

The Eurozone Crisis is not just a monetary and economic challenge. It is as well the first tremendous challenge of the European Community and as well the national institutions and constitutions of the member states not only within the Eurozone. On one side the European Commission, the European Parliament and the ECB with its endeavours to safeguard and stabilize the single currency EURO within the Eurozone, to support the suffering countries in the south with its struggle (...) against speculative hedge funds, to render financial relief measures to those countries and its financial industry. Irrespective the fact governments and citizens within that countries, less appear to appreciate or honor that measures as efficient help to stabilize but condemn as form of European paternalism and patronage. On the other hand the countries and its citizenship especially in the north of the Eurozone to set a stop sign to the EU and the ECB. Therefore they stress the Maastricht criteria and cite the Art 125 of the TEU, which prohibits one nation to stand for or to be liable for the Government debts of another nation. Especially in the German perspective the demarcation line appears to run along between the European Commission, European Central Bank and European Court on the European side and the Bundesverfassungsgericht, the Bundesbank on the national German side. Each of the institutions feels to be bound to its origin functions and principles and save the respective constitution and the task rendered by that constitution. For a better understanding it is essential to get aware of and to reinforce the constitutional role which the Grundgesetz awarded to the Bundesverfassungsgericht and the Bundesbank and the German citizenship placing their confidence in these institutions. Es soll konkret das Verhältnis zur Nichtbeistandsklausel No-Bail-out Klausel Art 125 AEUVertrag, den Europäischen Fiskalpakt / dem ESFS, ESM / dem OMT-Programm der EZB, möglichen Entwicklung des EU zur Haftungs- und Transferunion mit einem zukünftigen Haftungsautomatismus der Mitglieder, der Unterscheidung von gemeinsamer Währungspolitik und nationaler Wirtschaftspolitik, der drohenden Vergemeinschaftung von Staatsschulden einzelner EU-Länder, die Budgethoheit des nationalen Parlaments als freie Entscheidung über die Verwendung des nationalen Haushaltes untersucht werden. The paper explores the process of the Czech journalists setting the EU agenda in the media during the ‘hot phase’ of the Czech national parliament election campaigns in 2002, 2006, and 2010. Unlike most studies that concentrated on the media agenda in the European Parliament election campaigns, we focused on periods that were neither strictly key events nor routine, but that were more intensively covered by the media and simultaneously generated more influential political representation defining national political (...) attitudes towards the EU. Articles that referred to the EU during the ‘hot phase’ were content analyzed. The results suggest that in the Czech press, the EU agenda is less and less visible, and, moreover, that it is increasingly negatively framed and reduced to an economic agenda. (shrink)

This article argues that parliamentary institutions have increasing difficulty in addressing and dealing with the growing complexity, highly technical character and rapidity of many developments in modern societies. Deficits in representation, in knowledge and competence, and in engagement or commitment effectively erode the authority and status of parliamentary government. Major rule- and policy-making activities are being substantially displaced from parliamentary bodies and central governments to global, regional and local agents as well as agents operating in the many sectors of a (...) highly differentiated, modern society. Governance - and sovereignty - are increasingly diffused upward, downward and outward beyond parliament and its government. The author identifies problems, practical as well as normative, with this general development and discusses the possibilities and limitations of reform. (shrink)

In 2000, the Netherlands became the first European country to legalize prostitution, a policy supported by Dutch feminists. It distinguishes forced from voluntary prostitution, defining the latter as ‘sex work’, in contrast to feminist positions viewing it as ‘sexual domination’. This article examines the discourses used by parliamentarians in the debates since the 1980s and charts the shift from a traditional moral view to the sex-work frame, creating new meanings of ‘ prostitutes’, ‘clients’ and ‘brothel keepers’ in the process. (...) The new discourse allows for an active female sex worker but desexualizes the nature of the prostitution exchange. Neither does it offer an account of why it is mainly men buying sex from women. The analysis also highlights the contradictions created by the forced/voluntary distinction when speaking of the trafficking of women from poor countries and current anti-migration discourse, as well as the near obliteration of the racial differences between ‘clients’ and ‘workers’ in parliamentary discourse. In this paper I shed light on the multi-purposive nature of debates in the European Parliament. As a case in point, I examine a debate on immigration in the wake of a migratory crisis in the Italian island of Lampedusa in early 2011. I analyze the points of view argued for by MEPs, aiming at identifying the different institutional goals that are typically pursued and characterizing the ways in which these goals shape the argumentative exchanges. The link between (...) the multiple goals communicators have and the discourse choices they make can be assumed on the basis of previous research. In line with the pragma-dialectical view of argumentative discourse taking place in the context of more or less institutionalized argumentative activity types, institutional goals are understood as those goals that can be attributed to arguers on the basis of the type of activity in which they are engaged. In identifying the institutional goals, I follow Craig and consider not only goals which are intentional, formal, and directly responsible for a certain discourse choice, but also goals which are functional, strategic, and only indirectly responsible for discourse choices. The analysis shows that the MEPs pursued three kinds of goals: goals that are 1) assigned to them by the occasion of the debate; 2) related to the powers of Parliament; and 3) associated with the different identities they assume in Parliament. While the pursuit of the occasion-related and powers-related goals gave rise to multiple simultaneous discussions, the pursuit of the identity-related goals guided the MEPs’ choices and formulations in these discussions. This paper focuses on argumentation the institutional context of debate in the European Parliament. A parliamentary debate is a distinct argumentative activity type. In the pragma-dialectical approach, argumentative activity types are defined as conventionalized argumentative practices in which the possibilities for strategic maneuvering are predetermined. What are the characteristics of the activity type of a debate in European Parliament that predetermine the possibilities for strategic maneuvering?

This article provides a study of the legal regulations of the European enforcement order and the uniform enforcement of judgments without the exequatur procedure, which have been in place between the member states of the European Union for five years already. In the Lithuanian civil procedure law it details the implementation of Regulation (EC) No. 805/2004 of the European Parliament and of the Council of 21 April 2004 for creating a European Enforcement Order for uncontested (...) claims in the national law of Lithuania. The aforementioned legal act of the European Union has been implemented in Lithuania with the adoption of the Republic of Lithuania Law on the Implementation of the European Union and International Legal Acts regulating civil procedure of 13 November 2008. The aim of this paper is to conduct an analysis of the application of the specific rules of nanotechnology incorporated in Regulation No. 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products. It has been ten years since the European Commission had issued its proposal to start the co-decision procedure to create Regulation 1223 of 2009. Although it has been praised for noting the regulatory difference of nanomaterials over the rest (...) of the chemicals, what has been the efficacy of the standard? It is concluded that despite what it meant, the regulation has encountered technical obstacles, thus rendering the objectives relating to nanotechnology that were proposed from the European Commission unfulfilled. This finding is inferred through legal dogmatic methodologies and the identification of nanomaterials that have not been expressly approved. Nevertheless, products incorporating nanomaterials still circulate in the European market. The precepts about nanotechnology in the regulation should be reviewed because technical inconsistencies should be avoided in future regulations or applicable regulations in contexts other than Europe. Such inconsistencies exist with respect to the high level of protection of human health that should be ensured and the provisions intended to protect consumer safety. For instance, the catalog of nanomaterials in circulation does not indicate the materials that have been approved or their toxicological profiles. To date, no comparison studies have been presented between the expectations and legislative objectives set as embodied in the regulation and debated in the European Parliament involving the actual efficacy of this regulation. The first part of the paper is mainly descriptive. Starting from a short historical sketch of the European construction process, from the initial Treaty of Rome to the actual Treaty of the European Union, the changing trade-offs between the environmental and the economic domain will be overviewed. We will focus on a pragmatic examination of the texts, in their dynamic historical evolution.The second part is evaluative. I think probably Cortona is an excellent place to ask such a speculative question, because we are not far away from Assisi, where a successful Interfaith Meeting on the Environment was organised by the W.W.F. in 1986. Following the 1980 US Supreme Court decision to allow a patent on a living organism, debate has continued on the moral issues involved in biotechnology patents of many kinds and remains a contentious issue for those opposed to the use of biotechnology in industry and agriculture. Attitudes to patenting in the life sciences, including those of the research scientists themselves, are analysed. The relevance of morality to patent law is discussed here in an international context with particular reference to the (...) law of the European Patent Convention administered by the European Patent Office (EPO). The EPO has been the principal forum for opposition to such patents and the few cases under dispute in the EPO are reviewed, including patents for the onco-mouse, human relaxin gene, and the PGS herbicidally resistant plant (gmo). Representation in the Anglo-American tradition has often been conceived in terms of the “refine and filter” model commonly associated with The Federalist. Gregory Conti challenges this concept of representation by bringing to light an alternative tradition of “mirroring” that preoccupied nineteenth-century British thinkers who were intent on parliamentary reforms. While Conti’s recovery of this “mirroring” tradition offers potentially useful insights for contemporary theorists of descriptive representation, it nonetheless hinges on an assumption that representative government is a qualitative matter of deliberation (...) rather than the purely quantitative voting that has come to the forefront with the rise of mass democracy. In contemporary democracies, the image that political leaders project is of central importance to their electoral appeal, however, studies of image projection have mainly been based on textual messages, undermining often visual content such as photos, memes and postcards. This study explores populist leaders image projection through visuals on Facebook in a cross-national context, with the aim of verifying if politicians use images to promote their political action or if they instead implement more complex strategies of self-branding and personalisation. The (...) analysis focuses on the election campaign period for the 2019 European elections and proposes a comparison between four leaders that joined the European Parliament’s Group of Identity and Democracy, namely Matteo Salvini for Italy, Heinz-Christian Strache for Austria, Marine Le Pen for France and Alice Weidel for Germany. According to our analysis, important differences emerge in the use that leaders make of the images disseminated on Facebook. Some of them, in fact, disseminate almost exclusively images that are strictly related to their electoral campaign, while others seek a true identification with their voters, following the pattern of intimization.
