Hinging on a metaphysical examination of the concept of newness and Paul Guyer’s notion of the temporally extended self, this article analyzes what it means that we are a temporally extended being that is fashioned in time, which is none other than a transcendental object = newness, and argues that (fashioned) bodies can be things in themselves and mere phenomena simultaneously. Kant’s doctrine of self-positing assists us in decoding how the subject obtains an embodied experience while a thing in itself, (...) as well as how both a non-empirical affection and an empirical affection are at play, casually affecting the subject. This paper addresses the central moral issues regarding the burka ban in a liberal society: the freedoms of religion and expression, women's liberty, gender equality, state neutrality and public safety. The paper argues that the ban is unjustifiable in a liberal society for the following reasons: (1) liberal institutions increase the likelihood of voluntary decisions, (2) a legal measure that promotes a controversial conception of liberty is an undue interference with liberty, (3) the ban overrides women’s judgment regarding their own (...) interest rather than gives effect to it, (4) the principle of moral equality fails to support forced unveiling, and (5) the ban is discriminatory because it imposes a harsh burden on women by preventing religious observance. Peremptory norms of general international law are universally binding prohibitions that override any consideration for non-compliance. The question is how nonconsensual norms emerge from a consensual international legal order. It appears that either the peremptoriness of jus cogens renders consent superfluous to the norm’s binding force or consent divests jus cogens of its peremptory status. The goal of this paper is to resolve the dilemma by explaining why jus cogens is exempt from the general requirement of consent that binds states (...) to the rules of international law. This paper is a critical examination of a widely accepted method of human rights justification. The method defends the universality of human rights by appeal to diverse worldviews that converge on human rights norms. By showing that the norms can be justified from the perspective of diverse worldviews, human rights theorists suggest that there is reason to believe that human rights are universal norms that should govern the institutions of all societies. This paper argues that the evidence of plural foundations (...) of human rights fails to increase our confidence in the universality of human rights. The paper defends the following claims: (1) the convergence on human rights is better explained as an accidental outcome than as an indicator of the universality of human rights, (2) the plurality of human rights justification is superfluous to the explanation of why human rights apply to all societies, (3) the aggregation of justifications decreases rather than increases the reliability of the universality belief, and (4) the reasonable disagreement among conflicting justifications generates an epistemic dilemma. By probing into how desire is involved in fashion phenomena, this article illuminates Willkür in tandem with desire. It first analyzes how the higher and lower faculties of desire, spelled out by Immanuel Kant, play a role in fashion, unveiling how fashion as a form of social relations exists in concert with the higher faculty of desire, which has a close connection with Willkür. This article maintains that the arbitrary choice manifested in and through fashion is illustrative of Willkür, on (...) the grounds that it results from a self-conscious deliberation, demonstrating the ‘reflective distance’ from our incentives. Christine M. Korsgaard’s elucidation of the relationship between ‘reflective distance’ and self-consciousness helps formulate this argument. However, this article also discusses the foibles of Korsgaard’s reading of Kant, in particular in the area of theory of action. By doing so, this article argues that reason is not the only factor with which we make choices and take actions within the bounds of which freedom is secured, and that fashion allows us to comprehend not only how the power of choice, independent from necessitation by sensible impulses, exercises its freedom, but also how personal autonomy is related to Kant’s negative concept of freedom. This essay discusses the relationship between Georg Simmel’s sociological aesthetics and Hegel’s dialectics, demonstrates fashion as a domain in which subject-object relations are operative, and shows how fashion hypostatizes the dialectical relations between mind and body and between (...) the individual and the collective while connecting subject and object. In recent years, there has been an increase in the adoption of Shari’a in Europe and North America as an arbitration protocol for the resolution of potential contractual disputes. In a largely secular Western business environment, this reality raises corporate policy implications for business organizations. In particular, questions are raised about whether Shari’a is by nature too unpredictable—and too dismissive of women’s rights—to be properly and ethically permitted by Western companies as a possible dispute resolution alternative. This article examines the (...) dynamics and factors that are involved as corporate managers decide whether Shari’a arbitration ought to be banned entirely from contractual negotiations. Arguments for and against the inclusion of a Shari’a arbitration clauses in commercial contracts and contract negotiations are presented. The article concludes that while managers should exercise great prudence and consider the moral implications of negotiating arbitration clauses, an organizational ban of the use of faith-informed arbitration generally, or Shari’a in particular, would be neither morally required nor optimally serve the interests of the organization or its stakeholders. The study aimed to examine the influence of personal characteristics on activity preferences using decision tree analysis and examine the effects of the variables using conventional approaches. A descriptive study was conducted with 251 nursing home residents with dementia in Korea to examine the relationship between their personal characteristics and activity preferences. Decision tree analysis was used to classify participants’ activity preferences, and preference levels were examined using logistic regression analysis. Activities were classified as either physical and social activities or (...) cognitive and affective activities. This model showed an accuracy rate of 85.7% for positively predicting physical and social activity preference and 30.3% for positively predicting cognitive and affective activity preference. Gender was the strongest determinant of activity preference. The odds of preferring physical and social activities were 3.179 times higher among women, while the odds for preferring cognitive and affective activities were 0.412 times higher among men. Notably, cognitive and affective activity preference increased to 58.8% for married male participants. This study’s findings can contribute to the development of programs to decrease behavioral and psychological symptoms among older people with dementia residing in nursing homes and provide scientific evidence for integrating these activities into long-term services for this population. This study draws upon interviews with 45 senior citizens to understand this group’s expectations for human-robot interactions and their anticipated needs for robots. Our grounded theory analysis suggests that senior citizens expect robots to meet three types of needs: physical, informational, and interactional. Drawing upon uses and gratifications perspectives and socioemotional selectivity theory, this study examined the differences in the use of Facebook features among younger, middle-aged, and older adults. Furthermore, it explored the association between Facebook activities and users’ perceived enjoyment for different age groups. An online survey was conducted with 647 Facebook users in the United States. An exploratory factor analysis identified four types of Facebook activities: broadcasting, directed communication, content consumption, and information regulation. The results revealed that younger users’ broadcasting, (...) content consumption, and information regulation activities substantially differed from those of older users. In addition, broadcasting and content consumption activities were more popular among younger users and more predictive of their enjoyment. Directed communication was more powerful in predicting middle-aged and older users’ enjoyment. However, younger and middle-aged users’ engagement with information regulation activities was negatively related to their enjoyment of Facebook. The study findings provide more nuanced knowledge regarding user experiences on social media platforms among specified age groups and practical insights into the improvement of social media by addressing their different needs. In Hume's view, no first cause or designer responsible for the ordered universe could possibly have moral attributes; nor could the existence of such a being have any real implications for human practice or conduct. Hume's case for this 'moral atheism' is a central plank of both his naturalistic agenda in metaphysics and his secularizing program in moral theory. (...) Hume regards the ‘absolute’ necessity attending demonstrable truths as simply an expression of our imaginative blocks, and thereby avoids any commitment to a mind-independent and extra-empirical domain of absolute modal properties and facts. I develop this expressivist interpretation of Hume’s metaphysics of absolute modality, situate it against a wider understanding of Hume’s philosophy of language, and defend it against some recent objections.

Hume contrasts two different ways in which we might speak about the attributes of the first cause of all: first, in an attempt to describe the actual nature of this ultimate being or principle; or second, in ascribing attributes to it as so many honorifics, with no intention to describe but merely to express our own reverence. I survey Hume’s skeptical critique of the former, descriptive kind of talk, and also examine his purposes in considering and, through his character Philo, (...) apparently valorizing the latter, reverence-expressing kind of religious speech. Die Studie erarbeitet diese These anhand eines Vergleichs der Phänomenologie des Geistes mit der Archäologie des Wissens. Es wird dargelegt, inwiefern beide Konzeptionen kritisch auf Kants Vernunftkritik bezogen sind und in welchen Hinsichten sich ihre Theorien der Wissensentwicklung annähern.

This study examined influential factors of newspaper corporation social responsibility and evaluated corporate social responsibility using a newspaper corporate social responsibility index. Results of this study, which was conducted by survey, showed that arbitrative, essential, and cultural activities were influential factors comprised of newspaper corporate social responsibility. In addition, the findings indicated that higher corporate social responsibility index was not accompanied by Korean newspaper corporations with larger circulations.

Was macht das Besondere der menschlichen Lebensform aus? Wie können wir es verstehen, dass unsere Art wie alle anderen natürlich evolviert ist und dennoch als einzige Art die Fähigkeit entwickelt hat, unter dem Anspruch der Freiheit und in reflexiver Distanz zu handeln, damit aber die Umwelt auf eine Welt hin zu transzendieren? Jung argumentiert, dass sich diese Fragen nur beantworten lassen, wenn man philosophische, evolutionstheoretische und kognitionswissenschaftliche Ansätze aufeinander bezieht. Der Schlüssel hierfür ist der Begriff der Bedeutung. Alle Lebewesen (...) erfassen ihre Umwelt im praktischen Umgang mit ihr als bedeutsam. Auch der Geist des Menschen ist essentiell verkörpert und basiert auf erlebten Bedeutsamkeiten. Die Fähigkeit zur symbolischen Artikulation und kulturellen Weiterentwicklung solcher Lebensbedeutungen erlaubt es ihm aber auch, die lokale Umwelt zu transzendieren und dabei Werte, Normen und objektive Geltungsansprüche zu entwickeln. Eine zeitgemäße Anthropologie muss in der Lage sein, diese qualitativen Besonderheiten des menschlichen Geistes als Resultate von Naturprozessen verständlich zu machen. Sie verbindet methodischen Naturalismus mit Offenheit für die Transzendenz des Geistes über die Umwelt. Damit leistet der Autor einen wichtigen Beitrag zu einem nichtreduktionistischen Verständnis des Menschen, das Leib und Geist nicht dualistisch trennt, sondern ihre spannungsvolle Einheit sichtbar macht. The study reviewed 20 currently-available structured ethical decision-making models and developed an integrated model consisting of six steps with useful questions and tools that help better performance each step: (1) the identification of an ethical problem; (2) the collection of additional information to identify the problem and develop solutions; (3) the development of alternatives for analysis and comparison; (4) the selection of the best alternatives and justification; (5) the development of diverse, practical ways to implement ethical decisions and actions; and (...) (6) the evaluation of effects and development of strategies to prevent a similar occurrence. From a pilot-test of the model, nursing students reported positive experiences, including being satisfied with having access to a comprehensive review process of the ethical aspects of decision making and becoming more confident in their decisions. There is a need for the model to be further tested and refined in both the educational and practical environments. (shrink)

There is no greater testament to Emmanuel Levinas' reputation as an enigmatic thinker than in his meditations on eschatology and its relevance for contemporary thought. Levinas has come to be seen as a principal representative in Continental philosophy - alongside the likes of Heidegger, Benjamin, Adorno and Zizek - of a certain philosophical messianism, differing from its religious counterpart in being formulated apparently without appeal to any dogmatic content. To date, however, Levinas' messianism has not received the same detailed attention (...) as other aspects of his wide ranging ethical vision. Terence Holden attempts to redress this imbalance, tracing the evolution of the messianic idea across Levinas' career, emphasising the transformations or indeed displacements which this idea undergoes in taking on philosophical intelligibility. He suggests that, in order to crack the enigma which this idea represents, we must consider not only the Jewish tradition from which Levinas draws inspiration, but also Nietzsche, who ostensibly would represent the greatest rival to the messianic idea in the history of philosophy, with his notion of the ‘parody' of messianism. >. The zone of proximal development is defined as an overarching concept that integrates the main tenets of Vygotsky’s theory of human development. The conceptualization of the ZPD begins with its social, cultural, and historical context and traces its development as a spatial and temporal metaphor that reflects the sociogenetic root of all human mental functioning. Beyond the explication of sociogenesis, the ZPD is reconceptualized to include the notions of voice and dialogicality. The insights gained from the fields of semiotics and (...) discourse studies allow a broader understanding of the ZPD by bringing to light participant structures and institutional and historical forces that may not have been included in the dominant interpretations of the ZPD. With the advancement of medical technology, various life-sustaining treatments are available at the end of life. Older adults should be encouraged to establish their end-of-life treatment preferences (ELTP) while they are physically and mentally able to do so. The purpose of this study was to explore ELTP among older adults and to compare those preferences in a subset of individuals who had reported their ELTP in a survey completed the previous year. This was a descriptive study of 191 older adults (...) living in a continuing care retirement community. Approximately half of the participants did not want cardiopulmonary resuscitation, to be put on a respirator, or to receive dialysis. The findings in this study suggest that many older adults do not want aggressive interventions at the end of life, but choose rather those measures that will keep them comfortable. Moreover, treatment choices may change over time. Health care providers should initiate discussions about ELTP at regular intervals (yearly) to assist older adults in dictating their end-of-life care. (shrink)

Computerized relaxation training has been suggested as an effective and easily accessible intervention for individuals with psychological distress. To better elucidate the neural mechanism that underpins the effects of relaxation training, we investigated whether a 10-session computerized relaxation training program changed prefrontal gamma-aminobutyric acid levels and cerebral blood flow in women with psychological distress. We specifically focused on women since they were reported to be more vulnerable to develop stress-related disorders than men. Nineteen women with psychological distress but without a (...) diagnosis of psychiatric disorders received the 10-day computerized relaxation training program that consisted of 30-min cognitive-relaxation training and 10-min breathing-relaxation training per day. At baseline and post-intervention, perceived stress levels, anxiety, fatigue, and sleep quality were assessed by self-report questionnaires. Brain magnetic resonance spectroscopy and arterial spin labeling scans were also performed before and after the intervention to evaluate GABA levels and relative CBF in the prefrontal region. Levels of perceived stress, anxiety, fatigue, and sleep quality improved following 10 sessions of computerized relaxation training, resulting in a significant relief in composite scores of stress-related symptoms. The prefrontal GABA levels decreased, while relative CBF increased after the intervention. In addition, a greater increase in relative prefrontal CBF was associated with better composite scores of stress-related symptoms following the intervention. The current findings suggest that computerized relaxation training may improve stress-related symptoms through modulating the prefrontal GABA levels and CBF in women with psychological distress. Many clinical and psychological constructs are conceptualized to have multivariate higher-order constructs that give rise to multidimensional lower-order traits. Although recent measurement models and computing algorithms can accommodate item response data with a higher-order structure, there are few measurement models and computing techniques that can be employed in the context of complex research synthesis, such as meta-analysis of individual participant data or integrative data analysis. The current study was aimed at modeling complex item responses that can arise when underlying domain-specific, (...) lower-order traits are hierarchically related to multiple higher-order traits for individual participant data from multiple studies. We formulated a multi-group, multivariate higher-order item response theory (HO-IRT) model from a Bayesian perspective and developed a new Markov chain Monte Carlo (MCMC) algorithm to simultaneously estimate the (a) structural parameters of the first- and second-order latent traits across multiple groups and (b) item parameters of the model. Results from a simulation study support the feasibility of the MCMC algorithm. From the analysis of real data, we found that a bivariate HO-IRT model with different correlation/covariance structures for different studies fit the data best, compared to a univariate HO-IRT model or other alternate models with unreasonable assumptions (i.e., the same means and covariances across studies). Although more work is needed to further develop the method and to disseminate it, the multi-group multivariate HO-IRT model holds promise to derive a common metric for individual participant data from multiple studies in research synthesis studies for robust inference and for new discoveries. In empiricism, there are only two answers for a question: black or white. Yet, subjective meanings of human behaviours and responses toward health and illness cannot be simply explained with black and white. Gray zones are needed because they are characterized by complexity and require a contextual understanding. In this paper, we present and suggest fuzzy logic as an example of theoretical bases that help transcend the conflicts between objectivity and subjectivity, respect gray zones between black and white answers for (...) questions, and provide a contextual understanding of complex nursing phenomenon. A historical review of fuzzy logic is followed by a definition of fuzzy logic. Then, fuzzy logic is discussed in terms of its compatibility with nursing epistemological views and philosophical thoughts. Fuzzy logic agrees with three categories of epistemological views of nursing, including correspondence, coherence and pragmatism. Fuzzy logic also agrees with four major philosophical thoughts in nursing, including postempiricism, pragmatism, feminism, and postmodernism. Based on the discussion, we propose that fuzzy logic be further explored, used and developed in research and practice in the nursing areas/situations/phenomena that are characterized by complexity, ambiguousness, and vagueness.
