Endeavours of politicians, representatives of law enforcement institutions and courts to create simplified, accelerated and less human and time resources requiring legal procedures in criminal cases prompted the authors of this article to assess the possibilities to develop the written form of procedure in Lithuania. The goal of the authors of this article is to assess the origin and goals of the written form of procedure, as well as to define the main rules and points for discussions on the possibilities (...) to develop the written form of procedure in the Lithuanian criminal procedural law. The conclusion is drawn in this article to the effect that written form of procedure is seen as a condition for simplifying and accelerating the legal process, and choosing this form of procedure is not considered as denying or restraining the expectations of participants of criminal procedure towards a fair trial. The analysis provides the basis for the authors to make a conclusion on the appropriate limits of applying written or oral procedures for hearing criminal cases: Oral procedure must be guaranteed in cases where questions of criminal liability and personal guilt are solved at the first instance court hearings; Oral procedure usually has to be guaranteed in cases where during the procedure at the first instance court hearing the questions of criminal liability and personal guilt are solved, although oral procedure may be limited and the procedure may be conducted in written form if new evidence are not investigated and there is no doubt for deciding whether oral procedure is better for understanding the case; Oral procedure need not be guaranteed only in cases where questions of application of the law are solved and if oral procedure was guaranteed during the procedure at the court of first instance; Written procedure may guarantee the right to a fair trial, where the participants of the procedure are allowed to provide various explanations and written documents or a person is allowed to ask for an oral court hearing. This article, while disclosing the conception of rights, their relation to law and their nature, presents the constructive criticism and motivated support of legal personalism, i. e. the original theory presented by prof. A. Vaišvila. This article presents the criticism of terms “positive law” and “natural law”. It emphasizes that the term “natural rights,” while historically very important and common, is rarely used of late. The primary reason for its fall from favor seems to be that it was used in (...) too many different ways and therefore ceased to be useful. So, the author, while defending the indispensable relation between law and morals, offers the term “good morals” instead of “natural law” and also offers to refuse the usage of terms “positive law” and “natural law”. This article represents the view that morality is the source of law. The author accepts a position asserting that the terms “human rights”, “natural rights” and “fundamental moral rights” are synonymous. However, some institutional rights (for example, social rights) flow from statutes, but not morals. (shrink)

In recent years, the issue of corporate social responsibility has become particularly relevant. Accelerating technological advances and increasing consumption are increasingly causing negative impacts on the environment and society that is why the organizations’ social responsibility is becoming more and more relevant every year. The experience of foreign countries shows that social responsibility is useful not only for business but also for its environment, determines the increasing number of socially responsible organizations in Lithuania and a more favorable attitude of consumers (...) towards the activities of organizations [36]. According to Mauriciene and Pauzuoliene, the priority of socially responsible organizations is the expectations and needs of consumers. Socially responsible organizations emphasize in their activity reports the importance of socially responsible activities to the organization, its employees, society and consumers. Consumers are more likely to appreciate such an organization, prefer to choose its products, encourage others to do the same, and believe more in what it does. Analysis of the literature. The issues of corporate social responsibility are investigated by both Lithuanian and foreign scientists and others). It is noticed that foreign scientists Henderson, 2007; Rodriguez, Cruz, 2007; Grosbois, 2012; Dolores, Vargas-Sanchez, 2014; Joon-Ho, Bong-Ihn, Ki-Tai, Jong-Pil, 2017, Ponnapureddy et al. Robin et al, Mensah, Lee and Heo et al sufficiently widely analyze hotel social responsibility. The aim of the work is to investigate the social responsibility of the organization from the point of view of consumers. The objectives raised in the work: To discuss the concept of corporate social responsibility and the peculiarities of implementing in the activities; To describe the models of corporate social responsibility; To assess the social responsibility of accommodation providers in terms of consumers. The following research methods were used to achieve the aim and objectives: analysis of scientific literature, questionnaire survey and statistical analysis of the obtained data. The result of the study. Taking into account the social responsibility of accommodation companies from the point of view of consumers, as an interested party and one of the most important market participants, according to the ethical, legal and economic responsibility components it is stated that the social responsibility of accommodation companies is of medium level and should be improved according to all criteria. Populizmus dnes predstavuje často skloňovaný pojem tak na akademickej pôde, ako i na samotnej politickej scéne, v médiách a medzi laickou verejnosťou. Skutočnosťou je, že hoci v našej spoločnosti tento pojem používa takmer každý, len málokto vie, čo vlastne znamená. V tomto článku sa preto budeme zaoberať otázkou, ktorá sa stala predmetom analýz mnohých teoretikov, otázkou, čo je to populizmus. Jedným z tých teoretikov je Ernesto Laclau (1935–2014), ktorý populizmus nechápe ako ideológiu, ale ako istú stratégiu resp. spôsob komunikácie. V (...) prvej časti nášho článku vymedzíme pojem „populizmus“, pričom upozorníme na jeho viaceré rozličné interpretácie ako aj na to, aké je jeho spoločné základné analytické jad­ro. V nasledujúcich častiach článku sa už zameriame na analýzu populizmu podľa Ernesta Laclaua. Cieľom nášho článku je teda analýza teórie populizmu podľa E. Nadzieja radykalna to nadzieja obecna dotąd w dyskursie religijnym. Począwszy od Nietzschego tematyka ta zaczęła się również pojawiać w dyskursie filozoficznym. Punktem wyjścia artykułu jest myśl Ernesta Blocha, który uczynił z nadziei centralną kwestię rozważań filozoficznych, choć nie udało mu się rozwinięcie tej idei. W tym względzie pierwszeństwo przypada Nietzschemu, który dążył do złączenia filozofii z problematyką nadziei. Ostatnim filozofem, którego poglądy zostaną wzięte pod uwagę jest Quentin Meillassoux, dążący w ostatnich latach do filozoficznego podtrzymania nadziej dotąd kojarzącej się z (...) religią. Punktem docelowym rozważań, oprócz próby oceny propozycji każdego ze wspomnianych filozofów, jest sformułowanie wniosków odnoszących się do konsekwencji pojawienia się problematyki nadziei radykalnej na gruncie filozofii. Wskażę na sposób współczesnego filozofowania, który zdaje się otwierać szanse na powiązanie tej problematyki z filozofią. Can Philosophy substitute for religion? Philosophies of Radical Hope from Nietzsche to Meillassoux Radical hope is hope that could be found in religious discourse. Starting from Nietzsche, the concept entered also philosophical discourse. The article takes as its starting point the thought of Ernest Bloch, who placed hope at the center of philosophical thought, although, he was not able to develop the idea. In this respect, priority should be given to Nietzsche, whose views were taken up by Quentin Meillasoux, who has been aiming to philosophically uphold hope that has been usually associated with religion. The end point of the present deliberation, in addition to an attempt at evaluating the abovementioned philosophers’ propositions, is formulation conclusions concerning the consequences of the appearance of the problematics of radical hope in the field of philosophy. I will point to a way of contemporary practice of philosophy, which appears to open up opportunities to tie in this problematics with philosophy. (shrink)

Ovaj tekst ima za svoj cilj teoretski uvod u rad dvoje postmarksističkih teoretičara politike, Ernesta Laclaua i Chantal Mouffe. Fokus je na njihovu zajedničkom radu Hegemonija i socijalistička strategija, pomoću čije se teze o temeljnoj »nemogućnosti društva« stvaraju epistemološke mogućnosti za lakanovsko promišljanje pojmova ideologije, kao i samog pojma ‘Političkog’ ili pojma i definicije ‘Društva’. Autori pokušavaju kroz koncept hegemonije Antonia Gramscija definirati ključno polje za konstrukciju političke zajednice. Njihova se teorija tako stavlja u kontekst i psihoanalitičkog diskursa, no i (...) diskursa koji je u društvenim znanostima poznat pod nazivom »društveni konstruktivizam«.This paper has for it’s purpose theoretical introduction into the work of two postmarxist theoreticians of politics, Ernesto Lacalau and Chantal Mouffe. We will focus on their collaboratory work, Hegemony and Socialist Strategy, whose theses about the basic “impossibility of society” creates the foundations for the possibility of Lacanian theorizing of ideology, as well the notion of ‘Politics’, or the very notion of ‘Society’. Using Antonio Gramsci’s notion of hegemony, authors try to define the key field for the construction of political community. Their theory is contextualized as a psychoanalitical discourse, as well as discourse known in social sciences by the name of “social constructionism”. (shrink)

Filozofija danas, kao i posljednjih desetljeća, u različitim varijantama raspravlja o utemeljenju i širini pojma pluralizma, multikulturalizma/transkulturalizma, mogućeg prihvaćanja drugačijeg i uopće o načinima posredovanja. Tim se povodom u tekstu želi skrenuti pažnja na tek djelomično recipirano djelo Ernesta Grassija. Prije svega riječ je o njegovom drugačijem tumačenju povijesti novovjekovne filozofije, raspravljanju o odnosu filozofije i kulture i trajnom naporu u premošćivanju i međusobnom upućivanju talijanske i njemačke filozofije, te otvorenosti prema drugim kulturama.Grassi je zastupao stajalište da susret sa stranim (...) i drugačijim traži situaciji primjerene teorijske i praktičke odgovore, otvaranje izvornosti onoga što nam pridolazi kao novo. Teorijska otvorenost iskustvu drugačijih svjetova, provlačenje kroz doživljaj drugačijeg što posebno iskazuje u svojim «južnoameričkim meditacijama», ujedno je za njega propitivanje samorazumljivosti europskog iskustva i europskog tumačenja prostora, vremena, umjetnosti…Pitanje je stoga koliko Grassi, koji je kao metodu spoznaje zastupao znanstvene razgovore što uključuju individualnu, historijsku situaciju i interakciju sudionika u aktualnoj govornoj situaciji, i danas može biti zanimljiv sugovornik. Takav njegov pristup utemeljen je na tumačenju zbiljnosti polazeći od jezika, što uključuje kritiku metafizike.For several decades now, philosophy has and is attempting various approaches to the foundationand scope of pluralism, multiculturalism/transculturalism, possible ways to accepting the different,and general means of mediation. In response, this article deals with the partially received work ofErnesto Grassi – in particular, his singular interpretation of the history of modern age philosophy,his discussion on relations between philosophy and culture, his ongoing effort to bridge the differencesand refer to each other the German and the Italian philosophy, his receptiveness to othercultures.Ernesto Grassi supported the view that encounters with the strange and the different call for appropriatetheoretical and practical responses, a receptiveness to genuineness of what one approaches asnew. For him, the theoretical receptiveness to experiencing different worlds, the involvement in thedifferent that he particularly expresses in his »South American meditations«, is also the means ofquestioning the taking for granted of the European experience and its interpretation of essentialssuch as space, time, and art.It remains a question to what extend is Grassi, who viewed a scientific exchange – with its individual,historical context and the interaction of the participants in the current conversational act – asa cognitive method, still an interesting conversationalist today. He builds this approach upon interpretationof reality from the point of language, which includes a criticism of metaphysics. (shrink)
