The ongoing global economic and financial crisis has exposed the risks of considering market and business organizations only as instruments for creating economic wealth while paying little heed to their role in ethics and values. Catholic Social Teaching (CST) could provide a useful contribution in rethinking the role of values in business organizations and markets because CST puts forward an anthropological view that involves thinking of the marketplace as a community of persons with the aim of participating in the Common (...) Good (CG) of society. In the light of the CST tradition, and in particular Caritas in Veritate , this article investigates the thinking of some of the historical scholars of the Italian Economia Aziendale ( EA ), by focusing on the concept of azienda , in order to reinterpret in a more humanistic way the role of business organizations in society. By linking CST and EA , the dichotomy between for-profit and not-for-profit organizations and the stereotype of the so-called business amorality that has, for a long time, driven business managers can be transcended. IntroductionStress is associated with disease and reduced leukocyte telomere length. The objective of this research is to determine if self-perceived stress is associated with telomere length in Costa Rican adults and the gender differences in this association. Findings may help explain how some populations in apparent socioeconomic disadvantage and with limited access to specialized medical services have a remarkably high life expectancy.MethodologyData come from the pre-retirement cohort of the Costa Rican Longevity and Healthy Aging Study, a population based (...) survey conducted in the households to 2,327 adults aged 53 to 66 years. The DNA to measure LTL was extracted from blood cells in laboratories of the University of Costa Rica whereas the Blackburn laboratory at the University of California performed the telomere length measurement applying the quantitative polymerase chain reaction. The relationship between telomere length and perceived stress was measured using least-squares multiple regression. Perceived stress was measured by a set of questions about family, job, finances and, health reasons to be stressed. Models included the control variables: age and sex of the participant, whether he or she resides in the Nicoya area, a “blue zone” known for its high longevity, and the aforementioned sociodemographic, health and lifestyles characteristics.ResultsStress perception and LTL are significantly different by sex. Women perceived higher stress levels than men in almost all aspects studied, except work. Women have significantly longer telomeres. Shorter telomeres are significantly associated with caregiving stress in men and with parental health concerns in women. Counter-intuitive telomere lengthenings were observed among women who feel stressed about caring for family members; and among men who feel stressed due to their family relationships as well as concerns about their own health.DiscussionResults confirm that people with self-perceived stress due to caregiving or health issues have shorter telomeres. The relationship between stress and telomere length differs between men and women. Gender relations exert a strong modifier effect on the relationship between stress and LTL: gender is related to perceived stress, telomere length, and apparently also to the way stress and LTL are related. Challenging Situatedness contends that the production of knowledge is just that—a production, and one fraught with intrinsic and often unconscious biases. In fact, to assume that scientific research is inherently objective, neutral, and therefore genderless can, quite literally, be harmful to one's health. Lockdown measures in response to the COVID-19 pandemic involve placing huge burdens on some members of society for the sake of benefiting other members of society. How should we decide when these policies are permissible? Many writers propose we should address this question using cost-benefit analysis, a broadly consequentialist approach. We argue for an alternative non-consequentialist approach, grounded in contractualist moral theorising. The first section sets up key issues in the ethics of lockdown, and sketches the apparent appeal of addressing (...) these problems in a CBA frame. The second section argues that CBA fundamentally distorts the normative landscape in two ways: first, in principle, it allows very many morally trivial preferences—say, for a coffee—might outweigh morally weighty life-and-death concerns; second, it is insensitive to the core moral distinction between victims and vectors of disease. The third section sketches our non-consequentialist alternative, grounded in Thomas Scanlon’s contractualist moral theory. On this account, the ethics of self-defence implies a strong default presumption in favour of a highly restrictive, universal lockdown policy: we then ask whether there are alternatives to such a policy which are justifiable to all affected parties, paying particular attention to the complaints of those most burdened by policy. In the fourth section, we defend our contractualist approach against the charge that it is impractical or counterintuitive, noting that actual CBAs face similar, or worse, challenges. (shrink)

The problems of contemporary states are in large part “affective disorders”; they are failures of states to properly understand and coordinate the emotions of the individuals within and in some instances outside the state. By excluding, imprisoning, and marginalizing members of their societies, states create internal enemies who ultimately enervate their own power and the possibility of peace and freedom within the state. Spinoza’s political theory, based on the notion that the best forms of state are those that coordinate the (...) power and emotions of those within a state, offers us both a diagnosis of and a cure for these affective disorders. In this paper I will outline Spinoza’s notion of the power of the state as a function of the power and coordination of the emotions of its citizens, and show that when the state contracts an affective disorder, such as excessive crime, rebellion, terrorism, etc. the state has failed to properly empower, include and coordinate the passions of the multitude of its citizens and subjects. In this paper, I show how the phenomenological and hermeneutic traditions and method converge on their treatment of the historical subject. Thinkers from both traditions claim that subjectivity is shaped by a historical worldview. Each tradition provides an account of how these worldviews are shaped, and thus how essentially historical subjective experience is molded. I argue that both traditions, although offering helpful ways of understanding the way history shapes subjectivity, go too far in their epistemic claims for the superiority of (...) subjective over positivist or academic history I propose that although the phenomenological/ hermeneutic approach to historical subjectivity is valuable for understanding both history and human nature, it cannot and ought not replace academic or what I will call ‘critical’ history. By showing the importance of historicity, and the force of historical consciousness on our actions, philosophers of history in these traditions expose the epistemic and perhaps even ethical requirement to engage in a rigorous critical history, one that recognizes the importance of historical consciousness. Such critical history is necessary to move beyond the subjective horizon of history as experienced to understand how events shaped this historical horizon. (shrink)

The concept of fitness, central to population genetics and to the synthetic theory of evolution, is discussed. After a historical introduction on the origin of this concept, the current meaning of it in population genetics is examined: a cause of the selective process and its quantification. Several difficulties arise for its exact definition. Three adequacy criteria for such a definition are formulated. It is shown that it is impossible to formulate an adequate definition of fitness respecting these criteria. The propensity (...) definition of fitness is presented and rejected. Finally it is argued that fitness is a conceptual device, a useful tool, only for descriptive purposes of selective processes, changing from case to case, and thus devoid of any substantial physical counterpart. In the Ethics, Spinoza argues that individual human emotions and imagination shape the social world. This world, he argues, can in turn be shaped by political institutions to be more or less hopeful, more or less rational, or more or less angry and indignant. In his political works, Spinoza offered suggestions for how to shape a political imaginary that is more guided by hope than by fear or anger. In this chapter, using the framework of Spinoza’s theory of emotions, I (...) will investigate how Barack Obama’s promise of ‘hope’ was translated into Donald Trump’s rhetoric of hate. Such a transition, from hope to fear is one that would be unsurprising to Spinoza. Spinoza worried about the political and personal effectiveness of hope. He argued that hope can easily be turned into what he called ‘indignatio’ or indignation—an emotion that he believed eroded trust in political institutions. Spinoza warned about the danger of governance that relies upon the emotions of anger and hatred. I will set out how the Trump administration’s reliance on the motivational forces of hate and anger risk what Spinoza called indignation. Spinoza’s political works were written to show how to turn political indignation and anger into a chastened, and perhaps more rational, hope. Finally, I will propose that we may derive from Spinoza participatory, democratic institutions that can overcome this indignation. (shrink)

An examination of the use of medical simulators shows that they contain traces of the one-sex body model found in pre-Enlightenment anatomies. The simulators present the male body as ‘male including female’ rather than ‘male, not female’. Only when female sex organs are relevant to a practice, as in gynaecology, does a simulator need to become ‘female, not male’. The widely held modernist understanding of sex and gender as binary categories is actually masking local practices which allow varied sex and (...) gender paradigms to coexist in simulator use. This analysis applies the discussions of Laqueur, Schiebinger and Faulkner to simulator practice. The consequences of recognizing the presence of the one-sex body are two-fold. Firstly, seeing that the reification of medical knowledge can still be haunted by conceptual paradigms of the past forces a more nuanced understanding of the variety that localized medical practices contain. Secondly, observing the ease with which the reified knowledge of a one-sex body is embraced by subjects who also exist in a world of binary gender points to the complexity our subjectivities can embrace and forces the researcher to acknowledge the implications of the simulations’ context. Human rights have become an important ideal in current times, yet our age has witnessed more violations of human rights than any previous less enlightened one. This book explores the historical and theoretical dimensions of this paradox. Divided into two parts, the first section offers an alternative history of natural law, in which natural rights are represented as the eternal human struggle to resist opression and to fight for a society in which people are no longer degraded or despised. At (...) the time of their birth in the 18th Century and again in the popular uprisings of the last decade, human rights became the dominant critique of law and society. The radical rhetoric of rights and its apparently endless expansive potential has led to its adoption by governments and individuals alike seeking to justify their actions on moral grounds and has undermined its radical edge. Part Two examines the philosophical logic of rights. The classical critiques of Kant, Burke, Hegel and Marx illuminate traditional aproaches to the concept of human rights. The work of Heidegger, Sartre and psychoanalysis is used to deconstruct the metaphisical essentialism of bothe universalists and cultural relativists. Finally, through a consideration of the ethics of otherness, and with reference to recent human rights violations, it is argued that the end of human rights is to judge law and politics from a moral stand point which both transcends the present and is historically relevant. In recent years, the notion of relational autonomy has transformed the old debate about the freedom of the individual in society. For Spinoza, individual humans are embedded in natural, social and political circumstances from which they derive their power and freedom. I take this to mean that Spinoza’s is best described as a constitutive theory of relational autonomy. I will show how by defining freedom in terms of power, Spinoza understands individual freedom as irreducibly relational. I propose that Spinoza develops (...) his theory of power to understand how individual power or freedom is limited and enhanced by the power of those around one. For Spinoza, the power of an individual is a function of that individual’s emotions, imaginative conceptions of itself and the world and its appetites. In this paper (1) I will argue that Spinoza reformulates a concept of freedom in terms of power. (2) His mature theory of freedom as power proposes that individual power is determined through social interaction, and is thus best understood as a relational theory of freedom. (3) I will show that as a consequence of Spinoza’s theory, individual power and empowerment relies on those around the individual, and thus, to achieve individual liberation we must pursue collective empowerment. Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at the bar (...) of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

This article examines the relevance of a theory of the multinational state for the evaluation of claims for self-determination and secession. Considerations of ?ethnocultural justice? imply that the recognition of the multinational character of a state ? or the granting of some of the minority nations' demands ? is a matter of justice. If these requirements are not met, secession could be justified. Indeed, if secession needs a just cause (as it has been argued), a failure to build a truly (...) multinational arrangement can be a valid reason for a minority nation to secede. An approach like the one proposed would also contribute to the resolution of some of the key problems of the three main theories of secession and their appeals to nationalism, choice and remedial rights. This research examines the integration of medical simulators into medical education. Training on a haptic-enabled surgery simulator has been observed with an eye to the context of the medical apprenticeship. Videotape of simulations and ethnographic observations at the simulator center are analyzed using the theoretical tools of legitimate peripheral practice and identity construction. In doing so, it becomes apparent that simulations are much more than just a forum for the transfer of specific medical skills. Although they may be designed to (...) facilitate discrete aspects of surgical practice, when in use, the simulators are surrounded by the rich and varied social interactions that make up the medical apprenticeship. These social aspects contribute to the creation of medical practices out of simulator practices, so that working on the simulator can still be experienced as part of the situated learning otherwise conducted during the internship of medical training. The current crisis is one outcome of the financialisation of contemporary capitalism. It arose in the USA because of the enormous expansion of mortgage-lending, including to the poorest layers of the working class. It became general because of the trading of debt by financial institutions. These phenomena are integral to financialisation. During the last three decades, large enterprises have turned to open markets to obtain finance, forcing banks to seek alternative sources of profit. One avenue has been provision of financial (...) services to individual workers. This trend has been facilitated by the retreat of public provision from housing, pensions, education, and so on. A further avenue has been to adopt investment-banking practices in open financial markets. The extraction of financial profits directly out of personal income constitutes financial expropriation. Combined with investment-banking, it has catalysed the current gigantic crisis. More broadly, financialisation has sustained the emergence of new layers of rentiers, defined primarily through their relation to the financial system rather than ownership of loanable capital. Finally, financialisation has posed important questions regarding finance-capital and imperialism. (shrink)

Pretendemos analisar alguns trechos da ètica para buscar compreender uma célebre indagação espinosana: o que pode um corpo? Tradicionalmente, é a mente que governa o corpo. Tudo o que surge como criação ou inovação segue-se de uma ação da mente sobre o corpo. Não sendo este mais do que o lugar das relações necessárias, mecânicas ou, ainda pior, o lugar dos pecados, a liberdade não viria senão da sujeição do corpo pela mente. Esta não seria ativa senão na medida em (...) que aquele fosse passivo. Com Espinosa, esse tradicional ponto de vista é inteiramente invertido e é esta inversão que acaba por dar sentido à questão "o que pode um corpo?". Com Espinoza, corpo e mente deverão ser ativos juntos ou passivos juntos. O corpo ocupa um lugar proeminente. Será ele também capaz de criação. Será ele um dos fulcros da liberdade. Eis o trabalho que procuramos empreender neste artigo. E, se muito já se escreveu sobre como, no século XVII, o corpo deixa de ser o lugar das doenças e pecados para tornar-se o lugar das relações necessárias e mecânicas, a inovação espinosana está justamente em ir para além do corpo-máquina. Contudo, o alcance desta empresa está estreitamente vinculado a certa tradição de comentadores que defendem o paralelismo na relação corpo e mente. Using material from the Pfizer sponsored website providing health information on erectile dysfunction to potential Swedish Viagra customers (www.potenslinjen.se), this article explores the public image of masculinity in relation to sexual health and the cultural techniques for creating pharmaceutical appeal. We zoom in on the targeted ideal users of Viagra, and the nationalized, racialized and sexualized identities they are assigned. As part of Pfizer’s marketing strategy of adjustments to fit the local consumer base, the ways in which Viagra is promoted (...) for the Swedish setting is telling of what concepts of masculinity are so stable and unassailable that they can withstand the association with a drug that is, in essence, an acknowledgement of ‘failed’ masculinity and ‘dysfunctional’ sexuality. With comparative national examples, this study presents an interdisciplinary take on the ‘glocalized’ cultural imaginary of Viagra, and the masculine subject positions it engenders. (shrink)

Responding to Alain Badiou’s ‘communist hypothesis’, the leading political philosophers of the Left convened in London in 2009 to take part in a landmark conference to discuss the perpetual, persistent notion that, in a truly emancipated society, all things should be owned in common. This volume brings together their discussions on the philosophical and political import of the communist idea, highlighting both its continuing significance and the need to reconfigure the concept within a world marked by havoc and crisis.

This study integrates corpus-assisted text analysis with frame semantics to study a social problem. Taking a cognitive-linguistic approach to critical discourse studies, in this article I examine the linguistic construction of minors in a corpus of 489 articles from the Uruguayan newspaper El País in the context of the so-called ‘Criminal Imputability Referendum’. Throughout, I focus on the construal operation of framing and identify a host of discursive patterns via which minors and adolescents are recurrently placed within the semantic frame (...) CRIME, and within this, they profile the frame elements of perpetrators of violent crimes rather than victims. I argue that, in the context of the referendum, these discursive strategies run the risk of facilitating the consolidation of a strong conceptual link whereby youth become readily associated with criminality, and are subservient to the political views of groups supporting a lower cut-off age for criminal responsibility and more stringent punishments. The observations arrived at in this instance set the foundations for a future experimental study testing whether the discursive patterns unearthed here have an effect on how readers conceptualize minors outside the texts. Far from his ‘rationalist’ image, Spinoza recognizes that we do not emerge from the ground as fully formed rational agents. We are born and develop in social worlds, where our affects, values and conceptions of the world are formed. For Spinoza, even the ‘free’ individual or sage is affected by the social and emotional worlds in which he argues they ought to live. Yet, Spinoza is ambivalent about the social emotions. These socially conditioned affects and values may be harmful to (...) the individual and to the community. Although they are harmful, these affects may exert a kind of physical force -- an affective force -- that binds individuals to them even when they recognize their harm. If these values and affects are what unify the community, then questioning them may be perilous. Spinoza’s social theory brings light to the question of the ‘dissenter’ in the form of the sage. If the sage seeks ‘reason’, and the norms of the community may be harmful or ‘against reason’, then the sage is in a precarious position. What happens when one can no longer follow the norm of one’s community? What happens when one is at odds with one's culture? What can one do if one recognizes that the norms of one’s community might be bad for one or for all? This question interested Spinoza philosophically and personally. Spinoza advocates reforming harmful and irrational community norms; however, he recognizes the difficulty and danger of reform both for the community and for the reformer. (shrink)

This volume of essays traces the history of jurisprudence from classical times, and examines various interpretations of written laws.

We investigate the higher-order modal logic , which is a variant of the system presented in our previous work. A semantics for that system, founded on the theory of quasi sets, is outlined. We show how such a semantics, motivated by the very intuitive base of Schrödinger logics, provides an alternative way to formalize some intensional concepts and features which have been used in recent discussions on the logical foundations of quantum mechanics; for example, that some terms like 'electron' have (...) no precise reference and that 'identical' particles cannot be named unambiguously. Team reasoning is the idea that we can think as a ‘we’ and this can solve some coordination dilemmas, such as Hi-Lo. However, team reasoning can only solve the dilemmas it is intended to solve if the conditions for team reasoning warrant the belief that others will also perform team reasoning and these conditions cannot render team reasoning otiose. In this paper, I will supplement the theory of team reasoning by explaining how agency transformation also involves a change in the (...) normative attitude. To do this, I will use the theory of affordances, which is the idea that the environment provides ways to interact with it. I will argue that when a person perceives as a group member, she associates herself and the other members with the group’s mosaic of affordances. This triggers a feeling of joint ownership of the agency. It is the feeling that it is up to us to deal with the situation, so we feel entitled to demand each other to cooperate. It warrants the belief that others are team-reasoners without rendering team reasoning otiose. This means that the agency transformation (from I to we) involves a change in the normative attitude. In the Ethics, Spinoza painstakingly reconstructs the way in which individual emotions, ideas and motivations are shaped within social worlds. He argued that emotions based on pain, including hatred and indignation, diminish the power of the individuals who experience them and the political collective in which those individuals reside. Anger, fear and indignation weaken the state. In the second section of the paper, I will set out how the Trump administration’s reliance on the motivational forces of hate and anger risk what Spinoza called indignation. Trump's reliance on exclusionary conceptions of American identity have fanned the flames of racial, ethnic and religious hatred to motivate his base have had widespread social and political effects. I will offer arguments and examples which bear out the Spinozan worries about the effects of anger and indignation on the political and the social. Spinoza’s political works were written not just to explain the worries about an angry and indignant multitude, but also to show how to turn political indignation and anger into a chastened, and perhaps more rational, hope. Finally, I will propose that we may derive from Spinoza participatory, democratic institutions and collective identities that can overcome this indignation. (shrink)

While to political theorists in the United States ‘community radio’ may seem a quaint holdover of the democratization movements of the 1960s, community radio has been an important tool in development contexts for decades. In this paper I investigate how community radio is conceptualized within and outside of the development frame, as a solution to development problems, as part of development projects communication strategy, and as a tool for increasing democratic political participation in development projects. I want to show that (...) community radio is an essential tool of democratization and democracy outside of the development frame. To do so, I will bring out the conceptual and structural dimensions of community radio through examples of existing community radios, both those which are independently created and those which have been created as development projects. These structural and conceptual elements provide community radio the potential to realize the goals of development practice while avoiding characteristic pitfalls. These ‘pitfalls’ of development are also pitfalls of democratization and democracy in existing democratic states, and include: depoliticization, limited participation, particularly of marginalized groups. In the pre-history of the concept of recognition Spinoza’s social philosophy deserves a special place. Although we rarely think of Spinoza as a social philosopher, Spinoza understood well the ways in which individual subjectivity is shaped by the social forces. I will argue that Spinoza offers a mechanism to understand the way in which recognition works, in order to untangle the web of affect, desire and ideas, which support the recognitions and misrecognitions at the foundation of social life. Spinoza sets (...) out this mechanism in Book Three of the Ethics, but his extended example of the first Hebrew Kingdom in the Theological-Political Treatise, shows how he applied his theory of social recognition to the great problem of his times – the debate between faith and reason, and the need to unify a commonwealth. Social unity based on shared religion, for Spinoza, could be powerful, though not so powerful as democracy. Only through understanding Spinoza’s views of social subjectivization can we understand why. (shrink)

The issue of what consequences to draw from the existence of non-classical logical systems has been the subject of an interesting debate across a diversity of fields. In this paper the matter of alternative logics is considered with reference to a specific belief system and its propositions :the Azande are said to maintain beliefs about witchcraft which, when expressed propositionally, appear to be inconsistent. When the Azande have been presented with such inconsistencies, they either fail to see them as such (...) or else accept them as non-problematical. Is our knowledge of logical truths a relative and culturally determined phenomenon, or is there some (transcendent) criterion that allows us to adjudicate between alternative logical systems? The authors propose an approach for resolving disputes about the status of Azande reasoning which assumes a paraconsistent framework, thus providing a new perspective on this debate. (shrink)

We do not generally take the Hobbesian project to be one that encourages human flourishing. I will argue that it is; indeed, I will propose that Hobbes attempts the first modern project to provide for the possibility of the diversity of human flourishing in the civil state. To do so, I will draw on the recent work of Donald Rutherford, who takes Hobbes to be a eudaimonist in the Aristotelian tradition.
