This article is a theoretical and empirical exploration of the meaning that accompanies contractual agreements, such as the End-User License Agreements (EULAs) that participants of online communities are required to sign as a condition of participation. As our study indicates, clicking “I agree” on the often lengthy conditions presented during the installation and updating process typically permits third parties (including researchers) to monitor the digitally-mediated actions of users. Through our small-scale study in which we asked participants which terms of (...) EULAs they would find agreeable, the majority confirmed that they simply clicked through the terms presented to them without much knowledge about the terms to which they were agreeing. From a research ethics standpoint, we reflect upon whether or not informed consent is achieved in these cases and pose a challenge to the academic research community to attend to the socio-technical shift from informed consent to a more nebulous concept of contractual agreement, online and offline. Advances in prosthetic design should benefit people with limb difference. But empirical evidence demonstrates a lack of uptake of prosthetics among those with limb difference, including of advanced designs. Non-use is often framed as a problem of prosthetic design or a user’s response to prosthetics. Few studies investigate user experience and preferences, and those that do tend to address satisfaction or dissatisfaction with functional aspects of particular designs. This results in limited data to improve designs and, we argue, this is (...) pragmatically and ethically problematic. This paper presents results of a survey we conducted in 2017 with people with upper limb difference in Australia. The survey sought to further knowledge about preferences surrounding prosthetics and understanding of how preferences relate to user experience, perspective, and context. Survey responses demonstrated variety in the uptake, use and type of prosthetic—and that use of, preferences about, and impacts of prosthetics rely not just on design factors but on various contextual factors bearing on identity and social understandings of disability and prosthetic use. From these results, we argue that non-use of prosthetics could be usefully reframed as an issue of understanding how prosthetics can best support users’ autonomy. This supports the claim that there is a need to incorporate user engagement into design processes for prosthetic limbs, though further work is needed on methods for doing so. (shrink)

The free and open source software (Foss) movement deserves to be placed in an historico-ethical perspective that emphasizes the end user. Such an emphasis is able to enhance and support the Foss movement by arguing the ways it is heir to a tradition of professional ethical idealism and potentially related to important issues in the history of science, technology, and society relations. The focus on software from an end-user’s perspective also leads to the concept of program conviviality. From a non-technical (...) perspective, however, software is simply a new example of technology, and the effort to assure that technology is developed in a socially responsible manner has a significant history. The argument thus begins with observations about the history of technology. This leads to critical reflections on the development of professional engineering ethics, and to a discussion of the alternative technology movement. Finally, it concludes by indicating some criteria to consider when imagining the design of convivial software. (shrink)

Invasive neural devices offer novel prospects for motor rehabilitation on different levels of agentive behavior. From a functional perspective, they interact with, support, or enable human intentional actions in such a way that movement capabilities are regained. However, when there is a technical malfunction resulting in an unintended movement, the complexity of the relationship between the end user and the device sometimes makes it difficult to determine who is responsible for the outcome – a circumstance that has been coined as (...) “responsibility gap” in the literature. So far, recent accounts frame this issue around the theme of control but more work is needed to explore the complicated terrain of assigning responsibility for neural device-mediated actions from this control perspective. This paper aims at contributing to this tendency by offering more fine-grained distinctions of how that control capacity is facilitated by the machine and how it can be exercised by the end user. This results in a novel framework that depicts an in-depth exploration of the control aspect of responsibility in a way that incorporates the diversity of relationships between neurotechnologies, the various conditions they treat, and the individual end user’s experience. It is now possible to propagate CSR information through social media platforms. Electronic word of mouth directly impacts image and upcoming portfolios of the organization. Customers, employees, and other stakeholders generate revenue for the company. Our goal was to understand why people were sharing and commenting in response to terrible reports about corporate social responsibility on WeChat. A company’s desire to comment on and share CSR news and its perception of its own social and environmental responsibility were all presumed explanatory (...) variables in our investigation. 315 WeChat users were asked to grade a fictitious news report of the environment. The results were shocking. According to our findings, an individual’s attitude toward actions and the effectiveness of information directly correlates to their social and environmental awareness level. EWOM may be discouraged by a company’s brand name, which has the potential to harm its reputation with its customers. (shrink)

Multistability—the plurality of meanings of technological artifacts—is an emancipatory phenomenon insofar as it allows the user to freely appropriate the object according to his or her interests, even against the will of the designer. The objective of this article is to show how the trend to connect physical and digital artifacts to the Internet poses a danger to the freedom that there is in multistability. By reducing the traditional separation between the artifact and the designer, the connection of the artifact (...) to the Internet allows the designer to continually modify the software that governs or constitutes it, which involves a relative loss of power for the user to determine its meaning. This change, in favor of the designer in the correlation of power among the actors—designer, artifact, and user—from whose interplay the meaning of artifacts arises, favors concentric stabilities and hinders eccentric ones with respect to the will of the designer. Thus, we should rethink the truth value of the designer fallacy, that is, the claim that the meaning of artifacts is determined only by the designer. From a political point of view, the remote control of artifacts and their multistability is an effective pedagogical tool to educate human beings in a time in which texts, according to Sloterdijk, no longer serve this function. 100 years after creating the Federal Reserve System (FED), whose legality and modus operandi remains questionable, there is time to rethink the national and also international payment system as a whole. The key element of existing economic relationships is the money that makes barter-free exchange possible. But monetary economics is only one aspect of more common political framework designed and established for retention of power. Such egoistic political interest proves its own relevancy and exerts ideological pressure on economic thought that (...) consequently forms economic and political institutions. In an effort to breake a rule, and to end the circuit of capitalistic self-fullfilling prophecy, a different economic model based on joint ownership (userization) is taken into consideration. In this paper, I will share findings from a qualitative study that offers a thematic analysis of 76 interviews with Muslim patients and families as well as doctors, nurses, allied health professionals, chaplains and community faith leaders across the United Kingdom. The data show that for many Muslims, Islam—its texts and lived practice—is of central importance when they are deliberating about death and dying. Central to these deliberations are virtues rooted within Islamic theology and ethics, the traditions of adab (virtue) (...) and aqhlaq (proper conduct). Themes analysed include theological and moral understandings around the virtues of hope and acceptance. The study provides an analysis of these themes in relation to the experiences of Muslim patients and families arriving at meaning making around death and dying and how this interfaces with their interaction with biomedicine and healthcare. The study shows that the juxtaposition of different values and moral frameworks require careful negotiation when Muslim patients and families encounter the healthcare system. The study also describes how healthcare professionals and staff of other faiths and no faith encounter Muslim beliefs and practices, and the challenges they face in interpreting virtues and values rooted in faith, especially when these are perceived to be mutually opposed or inconsistent. This article focuses on the Independent Communication Network as an instance of alternative media in Turkey. Throughout the study we define “alternative” media as non-dominant, counter-hegemonic media that prioritizes its distinct relationship with its audience. We report research based on in-depth interviews with the producers of the network’s online site “BIANET news” combined with focus group studies with communication students and women activists that are identified as the main audience segments of BIANET news by the newsmakers. While often presented as promising assistive technologies for motor-impaired users, electroencephalography (EEG)-based Brain-Computer Interfaces (BCIs) remain barely used outside laboratories due to low reliability in real-life conditions. There is thus a need to design long-term reliable BCIs that can be used outside-of-the-lab by end-users, e.g., severely motor-impaired ones. Therefore, we propose and evaluate the design of a multi-class Mental Task (MT)-based BCI for longitudinal training (20 sessions over 3 months) of a tetraplegic user for the CYBATHLON BCI series (...) 2019. In this BCI championship, tetraplegic pilots are mentally driving a virtual car in a racing video game. We aimed at combining a progressive user MT-BCI training with a newly designed machine learning pipeline based on adaptive Riemannian classifiers shown to be promising for real-life applications. We followed a two step training process: the first 11 sessions served to train the user to control a 2-class MT-BCI by performing either two cognitive tasks (REST and MENTAL SUBTRACTION) or two motor-imagery tasks (LEFT-HAND and RIGHT-HAND). The second training step (9 remaining sessions) applied an adaptive, session-independent Riemannian classifier that combined all 4 MT classes used before. Moreover, as our Riemannian classifier was incrementally updated in an unsupervised way it would capture both within and between-session non-stationarity. Experimental evidences confirm the effectiveness of this approach. Namely, the classification accuracy improved by about 30% at the end of the training compared to initial sessions. We also studied the neural correlates of this performance improvement. Using a newly proposed BCI user learning metric, we could show our user learned to improve his BCI control by producing EEG signals matching increasingly more the BCI classifier training data distribution, rather than by improving his EEG class discrimination. However, the resulting improvement was effective only on synchronous (cue-based) BCI and it did not translate into improved CYBATHLON BCI game performances. For the sake of overcoming this in the future, we unveil possible reasons for these limited gaming performances and identify a number of promising future research directions. Importantly, we also report on the evolution of the user's neurophysiological patterns and user experience throughout the BCI training and competition. (shrink)

This paper aims to identify Performance development and its relationship to demographic variables among users of computerized management information systems in Gaza Electricity Distribution Company. This research used two dimensions. The first dimension is demographic variables among users of computerized management information systems and the second dimension the Development of Performance. The control sample was (360) questioners were distributed and (306) were retrieved back with a percentage of (85%). Several statistical tools were used for data analysis and hypotheses (...) testing, including reliability correlation using Cronbach’s alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggested The results showed that: demographic variables among users of computerized management information systems have a positive relationship on the development of performance in Gaza Electricity Distribution Company, there were no statistically significant differences between the perceptions of respondents about performance development and its relationship to demographic variables among users of computerized management information systems in Gaza Electricity Distribution Company which attributable to gender variable, there exist a significant relationship between perceptions of the respondents for each of the resources (physical, software, and human) for computerized management information systems attributed to variable (age), there are no significant differences in the fields of (organizational resources) for computerized management information systems and (development of performance) attributable to variable (age) and that can be explained by the fact that the senior management deals with job titles not with age, there are significant differences between the perceptions of the respondents for each of the fields of resources (physical, software, and organizational) for computerized management information systems attributed to variable (educational qualification), the presence of a statistically significant differences between the perceptions of the respondents for each of the fields of "organizational resources for demographic variables among users of computerized management information systems " and ”development of performance” due to the variable (years of service), there is no statistically significant differences between respondents' perceptions about the fields of resources (physical, software, and human) for computerized management information systems attributed to variable (years of service). The study recommended the following: The need to strengthen the company's management interest in the use of computerized management information systems in all the systems components and elements as being an important variable which contributes to the development of performance. Strengthening the relationship between the users of information system and personnel systems in the department responsible for the system so that employees understand the technological and technical information needed by all users of information systems. It is essential that the company develop the infrastructure for information technology in general, and computerized management information systems, in particular for the development of performance. Increasing attention to provide material resources of equipment and devices used in the computerized management information system, and the interest in providing technical resources for management information systems keeping pace with technological means and modern techniques and work on the training of personnel to use those systems. Greater attention to human resource computerized management information systems “specialized technicians and end-users" through a variety of disciplines working in the field of computerized management information systems. The current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at Gaza Electricity Distribution Company resources explores the status of demographic variables among users of computerized management information systems and their relationship to the development of performance in Gaza Electricity Distribution Company increasing interest in Computerized management information systems through continuity, keeping pace with technological means and modern techniques. Wearable self-tracking devices capture multidimensional health data and offer several advantages including new ways of facilitating research. However, they also create a conflict between individual interests of avoiding privacy harms, and collective interests of assembling and using large health data sets for public benefits. While some scholars argue for transparency and accountability mechanisms to resolve this conflict, an average user is not adequately equipped to access and process information relating to the consequences of consenting to further uses of her data. As an alternative, this paper argues for fiduciary relationships, which put deliberative demands on digital health data controllers to keep the interests of their data subjects at the forefront as well as cater to the contextual nature of privacy. These deliberative requirements ensure that users can engage in collective participation and share their health data at a lower risk of privacy harms. This paper also proposes a way to balance the flexible and open-ended nature of fiduciary law with the specific nature and scope of fiduciary duties that digital health data controllers should owe to their data subjects. Technological development and increased international competition have imposed a significant burden on the product development function of many companies. The growing complexity of products demands a larger product development team with people having various competencies. Simultaneously the importance of good quality, usability and customisation of products is growing, and many companies want to involve customers and users directly in the development work. Both the complexity and quality demand new ways of working that support collaboration between people with various competencies, (...) interests and responsibilities both inside and outside the company. This paper reports experiences from using action research to introduce new user-centred work practices in two commercial product development projects. The interventions varied. In the first project it was found rewarding to engage customers and users in workshops based on participatory inquiry and collaborative design. The design process was iterative and the workshops took place several times involving concept through detailed design. In the second project, new design representations are introduced. The experiences highlight the importance of creating and reifying insights in design representations and using these to both support collaboration, and create continuity in the project. The paper ends with a discussion of scientific rigor in action research and what the new work practices imply for the development team. (shrink)

Starting from the observation that data sharing in general and sharing of reusable behavioral data in particular is still scarce in psychology, we set out to develop a curation standard for behavioral psychological research data rendering data reuse more effective and efficient. Specifically, we propose a standard that is oriented toward the requirements of the psychological research process, thus considering the needs of researchers in their role as data providers and data users. To this end, we suggest that researchers (...) should describe their data on three documentation levels reflecting researchers’ central decisions during the research process. In particular, these levels describe researchers’ decisions on the concrete research design that is most suitable to address the corresponding research question, its operationalization as well as a precise description of the subsequent data collection and analysis process. Accordingly, the first documentation level represents, for instance, researchers’ decision on the concrete hypotheses, inclusion/exclusion criteria and the number of measurement points as well as a conceptual presentation of all substantial variables included in the design. On the second level these substantial variables are presented within an extended codebook allowing for the linkage between the conceptual research design and the actually operationalized variables as presented within the data. Finally, the third level includes all materials, data preparation and analyses scripts as well as a detailed procedure graphic that allows the data user to link the information from all three documentation levels at a single glance. After a comprehensive presentation of the standard, we will offer some arguments for its integration into the psychological research process. (shrink)

This paper focuses attention on the ethical issues concerning the involvement of young service users as co-researchers. In particular the article offers an examination of the limitations of the term ?service user?, comments on degrees of participation and explores the ethical issues prior to the start of the research, during the research and after the research has been completed. Particular emphasis is focused on the topics of: the funders of research, ethics committees, valuing contributions, informed consent, confidentiality, authorship and (...) ending the research. The article also suggests that this is a complex area worthy of further exploration and that many of the ethical challenges identified for working with young service users also need to be considered for young service user co-researchers. “Privacy as confidentiality” has been the dominant paradigm in computer science privacy research. Privacy Enhancing Technologies (PETs) that guarantee confidentiality of personal data or anonymous communication have resulted from such research. The objective of this paper is to show that such PETs are indispensable but are short of being the privacy solutions they sometimes claim to be given current day circumstances. Using perspectives from surveillance studies we will argue that the computer scientists’ conception of privacy through data or communication confidentiality (...) is techno-centric and displaces end-user perspectives and needs in surveillance societies. We will further show that the perspectives from surveillance studies also demand a critical review for their human-centric conception of information systems. Last, we rethink the position of PETs in a surveillance society and argue for the necessity of multiple paradigms for addressing privacy concerns in information systems design. (shrink)

Coral bleaching has impacted reefs worldwide and the predictions of near‐annual bleaching from over two decades ago have now been realized. While technology currently provides the means to predict large‐scale bleaching, predicting reef‐scale and within‐reef patterns in real‐time for all reef users is limited. In 2020, heat stress across the Great Barrier Reef underpinned the region's third bleaching event in 5 years. Here we review the heterogeneous emergence of bleaching across Heron Island reef habitats and discuss the oceanographic drivers (...) that underpinned variable bleaching emergence. We do so as a case study to highlight how reef end‐user groups who engage with coral reefs in different ways require targeted guidance for how, and when, to alter their use of coral reefs in response to bleaching events. Our case study of coral bleaching emergence demonstrates how within‐reef scale nowcasting of coral bleaching could aid the development of accessible and equitable bleaching response strategies on coral reefs. In this paper, the results of a pilot interview study with 19 subjects participating in an EEG-based non-invasive brain–computer interface (BCI) research study on stroke rehabilitation and assistive technology and of a survey among 17 BCI professionals are presented and discussed in the light of ethical, legal, and social issues in research with human subjects. Most of the users were content with study participation and felt well informed. Negative aspects reported include the long and cumbersome preparation procedure, discomfort with (...) the cap and the wet electrodes, problems concerning BCI control, and strains during the training sessions. In addition, some users reflected on issues concerning system security. When asked for morally problematic issues in this field of non-invasive BCI research, the BCI professionals stressed the need for correct information transfer, the obligation to avoid unrealistic expectations in study participants, the selection of study participants, benefits and strains of participation, BCI illiteracy, the possibility of detrimental brain modifications induced by BCI use, and problems that may arise at the end of the trials. Furthermore, privacy issues were raised. Based on the results obtained, psychosocial and ethical aspects of EEG-based non-invasive BCI research are discussed and possible implications for future research addressed. (shrink)

Providing meaningful and actionable explanations for end-users is a situated problem requiring the intersection of multiple disciplines to address social, operational, and technical challenges. However, the explainable artificial intelligence community has not commonly adopted or created tangible design tools that allow interdisciplinary work to develop reliable AI-powered solutions. This paper proposes a formative architecture that defines the explanation space from a user-inspired perspective. The architecture comprises five intertwined components to outline explanation requirements for a task: (1) the end-users’ (...) mental models, (2) the end-users’ cognitive process, (3) the user interface, (4) the Human-Explainer Agent, and (5) the agent process. We first define each component of the architecture. Then, we present the Abstracted Explanation Space, a modeling tool that aggregates the architecture’s components to support designers in systematically aligning explanations with end-users’ work practices, needs, and goals. It guides the specifications of what needs to be explained (content: end-users’ mental model), why this explanation is necessary (context: end-users’ cognitive process), to delimit how to explain it (format: Human-Explainer Agent and user interface), and when the explanations should be given. We then exemplify the tool’s use in an ongoing case study in the aircraft maintenance domain. Finally, we discuss possible contributions of the tool, known limitations or areas for improvement, and future work to be done. (shrink)

When infrastructural technology is functioning correctly, it is often considered to recede from view and become invisible. According to this perspective, visibility is restored in cases of breakdown and malfunction, which for this reason, are often understood to represent important epistemic opportunities for grasping previously hidden aspects of infrastructure. This article seeks to outline the limitations of the idea that infrastructural failure has a positive epistemic function by distinguishing between two fundamentally different ways in which the nature of technological function (...) can be conceptualised; the first understands function as stemming primarily from the way a technology was designed and produced, the second as a process sustained by constant human activities of maintenance and repair. After illustrating how a number of recent studies of infrastructure build upon insights granted by the latter process perspective, this article aims to demonstrate how the experience of breakdown itself does little to facilitate a shift towards understanding infrastructure in this way. For this reason, this article ends with a suggestion for a shift in emphasis in studies of infrastructure, away from breakdown and towards a sustained examination of everyday practices of maintenance, repair and modification of infrastructural technologies. Writing is frequently analyzed as a mode of communication. But writing can be done for personal reasons, to remind oneself of things to do, of thoughts, of events. The cellphone has revealed this shift, commencing as a communication device and ending up as a memory prosthesis that records what we see, hear, read and think. The recordings are not necessarily for communicating a message to others, but sometimes just for oneself. Today, when machine learning algorithms read, write and transmit, a (...) new mode of communication arises that is not centered on the human. In this chapter the various phases of modern writing are modeled according to postphenomenology. As a branch of philosophy of technology, postphenomenology offers a set of analytical tools to study technologies and our relations to them. One of its central frameworks is the scheme of “I–technology–world.” The author proposes some modifications so that the scheme can systematically model the changes in the humans users, in machine learning algorithms imbued with non-human cognition and in the environments of readers, interlocutors and contexts. The authors ill-receivedexample, involving the disconnection ofventilation in a patient with ALS (Lou Gherig'sDisease) was critiqued by audience members withlong-term experience as ventilation users. The lessons of thisstory, and the conflict that resulted, speakcritically to the limits of simple teachingcases as well as the strengths of narrativeanalysis as a tool for the exploration ofbioethical case histories. Theodor W. Adorno was one of the twentieth century’s most important thinkers. In light of two pivotal developments—the rise of fascism, which culminated in the Holocaust, and the standardization of popular culture as a commodity indispensable to contemporary capitalism—Adorno sought to evaluate and synthesize the essential insights of Western philosophy by revisiting the ethical and sociological arguments of his predecessors: Kant, Nietzsche, Hegel, and Marx. This book, first published in Germany in 1996, provides a succinct introduction to Adorno’s challenging and (...) far-reaching thought. Gerhard Schweppenhäuser, a leading authority on the Frankfurt School of critical theory, explains Adorno’s epistemology, social and political philosophy, aesthetics, and theory of culture. After providing a brief overview of Adorno’s life, Schweppenhäuser turns to the theorist’s core philosophical concepts, including post-Kantian critique, determinate negation, and the primacy of the object, as well as his view of the Enlightenment as a code for world domination, his diagnosis of modern mass culture as a program of social control, and his understanding of modernist aesthetics as a challenge to conceive an alternative politics. Along the way, Schweppenhäuser illuminates the works widely considered Adorno’s most important achievements: _Minima Moralia_, _Dialectic of Enlightenment_, and _Negative Dialectics_. Adorno wrote much of the first two of these during his years in California, where he lived near Arnold Schoenberg and Thomas Mann, whom he assisted with the musical aesthetics at the center of Mann’s novel _Doctor Faustus_. One of the most relevant issues of a social robot is its capability of catching the attention of a new acquaintance and empathize with her. The first steps towards a system which can be used by a social robot in order to be empathetic are illustrated in this paper. The system can analyze the Twitter ID of the new acquaintance, trying to detect the IAB Tier 1 categories that possibly can let arise in him/her a joyful feeling. Furthermore, it can (...) retrieve news about that category and report them to the user, hopefully increasing his/her curiosity towards the system, improving the naturalness of the interaction. Moreover, the system is capable of querying Wikipedia in order to clarify any doubts that may arise in the user. A sample of a possible interaction is reported at the end of the paper. (shrink)

This Master’s thesis explores the relationship between Brain-Computer Interfaces (BCIs) and their human users from a functional, epistemological and phenomenological perspective. The analysis has four steps. I start out with a technical description of BCI systems in which I conceptually analyze different types of BCI applications. This results in the development of a taxonomy of applications which is the point of departure for further philosophical analysis. Thereafter, I explore the functional relationship between BCI applications and their users. That (...) is to say, I analyze functions of BCI applications, relate them to abilities of their users and explore how they extend these abilities. After that, the epistemological relation between BCI systems and their users is conceptualized by analyzing how they contribute to cognitive processes of their users, which is done by using the distributed cognition framework. And lastly, a postphenomenological framework is adapted to investigate how BCIs mediate the experiences of their users. This thesis ends with a reflection in which (1) possible developments in BCI research are placed in a broader historical-anthropological perspective, and (2) a moral consideration is given on the desirability of BCIs. A subset of people with severe mental health conditions feels they are on the verge of losing control, even in the absence of external threats or triggers. Some go to extreme ends to avoid affective arousal and associated expectations of a possible, impending catastrophe. We have learned about such phenomenological, emotional challenges in a group of individuals with severe, composite mental health problems and psychosocial disabilities. These individuals have had long treatment histories in the mental health care system. They have (...) been encountered at a specialized inpatient ward offering exposure-based therapy that aims at restoring self-regulation and recovery. We describe the phenomenology of anxiety and fear presented by these service users, a fear we have coined existential catastrophe anxiety. We also suggest a set of underlying, interacting, psychological mechanisms that may give rise to ECa, before comparing ECa with three other constructs previously described in the literature—annihilation anxiety, ontological insecurity, and affect phobia. These comparisons show several similarities, but also unique qualities with ECa and its suggested underlying mechanisms. The conceptualization of ECa may aid clinicians in addressing extreme experiential turmoil and engage service users in empowering therapeutic projects. (shrink)

Purpose– There are two claims made by the web marketing/advertising industry. By collecting, managing, and mining data, companies serve consumer's best interests, and by adopting sophisticated analytics, web marketers avoid discriminations that disserve individuals. Although the paper shares an interest in ending social discrimination, the paper is more circumspect about pronounced individualism and technological fixes. Despite its appeal, or perhaps because of it, the paper should not accept the claim at face value. The paper argues that social discrimination may not (...) disappear under smarter marketing; more overt forms may wane only to be replaced by more subtle forms. The paper aims to discuss these issues.Design/methodology/approach– The paper compares the two most important techniques of “smarter” marketing – predictive analytics and Facebook's social graph – with current discriminatory practices of weblining and e-scoring. While noting advances against overt discrimination, the paper describes how smarter marketing allows for covert forms.Findings– Innovative strategies to record and mine users' tastes and social connectivity for marketing purposes open the way for covert social discrimination.Originality/value– The paper provides a critical assessment of two claims made by the web marketing/advertising industry: by monitoring consumer web activity and collecting, managing, and mining data, companies serve consumer's best interests, and by adopting sophisticated analytics, web marketers avoid discriminations that disserve individuals. The ubiquity of the Internet has given rise to new hybrid types of online users such as hybrid consumers and prosumers. This paper looks at some of the new legal challenges raised by the exciting opportunities for active participation and co-creation by such users in electronic commerce transactions. The method employed, in homage to Jon Bing, is to look back in time to understand how users in sales transactions have been progressively regarded—alternatively exposed to risk, alternatively protected—and (...) how contract law has adapted to such new developments. The paper shows that, even following the emergence of the hybrid consumer and the prosumer, there are strong arguments for the consumer’s continued protection, not least because of the increase in technological sophistication and complexity. The paper seeks to test somewhat the limits where consumer protection ends and where general contract law—with its attendant doctrines like caveat emptor—would apply again with respect to the aforementioned new users. This is also in the context of the service user looking for help during a time when they are experiencing levels of distress and difficulty.Important as this is, evident by the substantial clinical and philosophical literature in this area, what has been overlooked is the perspective of the mental health and social care worker responsible for the care of individuals whose sense of self is disturbed. The significance of this omission has been brought home to me through my experiences in running training workshops for workers working with service users with a diagnosis of personality disorder. (From here on, in this paper, the terms worker and trainee are used interchangeably to refer to the mental health and social care worker).During these workshops challenges to the worker's sense of self have been revealed emotionally ("this doesn't feel like me"), ideologically ("I am not a bad person"), and/or practically ("I don't usually behave like this") when discussing their work with service users. This paper draws from the workshop experiences to explore and consider the workers perspective in relation to the self in more detail.There follows a descriptive account of three workshop sessions which include the trainees responses. With each activity the responses are considered within the context of the self, particularly from the worker's perspective. In the conclusion the argument is made, as evidenced by these illustrations, for the importance of including the workers' perspective when attempting to understand the self. The Trainees and Service Users Workers from various professional and nonprofessional backgrounds attend the workshops. They include psychiatrists, nurses, social workers, support workers, and occupational therapists who work in both in-patient and community settings. They usually have several years of clinical experience working with people with a [End Page 373] diagnosis of personality disorder, but rarely have they had any formal education or training in the area. Discussing their experiences of working with this service user group generates strong and highly emotionally charged personal responses during training.It is their experiences of the relationships with service users whose sense of self is absent, inconsistent, or unstable, that make a substantial contribution to the content of the workshops.Often service users are struggling with fragmented, distorted, or threatening perceptions of the world, themselves, and others. The worker, while embedded within their own sense of self, is engaged in a relationship with the service user. The issues that arise as a part of this relationship can be challenging and distressing for the workers. There are two main areas:The impact the service user's chaotic, fragmented, and unstable sense of self has on the worker's own sense of self.The response of the workers when their sense of self is challenged, and the impact that response has on the service user. These can be seen in more detail in the examples taken from the training sessions presented later in this paper. The Training Sessions The training sessions are either run alone or form part of a 1- or 2-day workshop. As mentioned, the groups are composed of a variety of professionally and nonprofessionally qualified staff. The experiences they share mainly relate to people with a diagnosis of Borderline Personality Disorder, although other subcategories are mentioned occasionally.
