Drawing from the critical phenomenology of Alia Al-Saji, Christina Sharpe’s notion of “the wake,” and Jan Slaby’s work on affect, this paper offers a critique of George Ciccariello-Maher’s (2017) formulation of Frantz Fanon’s decolonized dialectic. I argue that Ciccariello-Maher’s formulation, while excellent in most respects, nevertheless contains a significant lacuna. While he is correct to point out that Fanon’s critique of universal reconciliation forces his dialectical activity to remain firmly rooted in the present, by failing to fully draw out how (...) the past always already weighs on the present, Ciccariello-Maher runs the risk of obscuring the affective weight of Fanon’s historical critique. This is problematic for the way it obscures the full range of ethical possibilities that stem from this particular affective experience—possibilities that Jan Slaby (2020: 189–95) makes clear via Christina Sharpe’s notion of “the wake.” In other words, while Ciccariello-Maher seems to frame Fanon’s recourse to infinitely deferred reconciliation as a reflection of the “ethical nihilism” (2017: 62) that characterizes the system of oppression he is responding to, a reformulation of Ciccariello-Maher’s observations with respect to affectivity re-frames this infinite deferral as an “embodied ethics of being and knowing” (Slaby 2020: 189). I will ultimately argue that this reformulation helps us understand Fanon’s parting words in Black Skin White Masks—“Oh my body, always make me a man who questions!” (Fanon 2008b: 206; 1952: 188)—as a call for the type of ethics suggested by Sharpe’s notion of “the wake” (2016). This paper highlights ethical dilemmas faced by journalists who participated in a focus group exploring the news media's trauma coverage. Major themes included professional obligations versus ethical responsibilities, journalists' perceived status and roles, permissible harms, and inexperience. Instructional classroom simulations based on experiential learning theory can bridge the gap between the theory of ethical trauma reporting and realities journalists face when covering events that are often (...) chaotic and unpredictable by their very nature. This article examines discursive strategies used by police and politicians to describe and justify the application of penalty notices to minor criminal offences. Critical discourse analysis is used as an analytical tool to show how neoliberal economic thinking has informed the prism through which infringement notices have been rationalised as a legitimate alternative to traditional criminal prosecution, while also highlighting the contradictions inherent in neoliberalism as an ideology through which to view the embrace of legally hybrid powers in the criminal (...) justice system. Discursive strategies identified in the article include the use of ideological keywords ordinarily associated with free market economics and managerial efficiency; the adoption of militaristic vocabulary and metaphors in representations of policing and space; the strategies of assimilation and formulation to represent police views as uniform and coherent; and the use of nominalisations to legitimise the lack of procedural safeguards attached to infringement notices. The logic of—and the language ordinarily associated with—the domain of private business, the ‘free market’, and deregulation has infiltrated the criminal justice sphere. In addition, the naturalisation of neoliberal economic discourse in political and police representations of infringement notices produces and sustains important ideological effects, by disguising the ways in which the expanded use of administrative sanctions in public order policing intensifies state power at the expense of due process of law. Despite a growing literature on identity theory in the last two decades, much of its current use in archaeology is still driven toward locating and dating static categories such as 'Phoenician,' 'Christian' or 'native.' Previous studies have highlighted the various problems and challenges presented by identity, with the overall effect of deconstructing it to insignificance. As the humanities and social sciences turn to material culture, archaeology provides a unique perspective on the interaction between people and things over the long term. (...) This paper clarifies several sources of the epistemological confusion that currently characterize the field of clinical psychology. Using a constructivist framework, it is argued that much of this confusion can be traced to a traditional failure to distinguish among levels of analysis when evaluating and comparing clinical psychology theories. By recognizing certain distinctions among levels of analysis, it becomes clear that efforts to provide epistemological legitimacy for clinical psychology theories have often conflated not only theories with epistemology, but also epistemologies (...) that reside at different levels of analysis. Recognition of these distinctions also permits a more precise definition of the role for which the received view of a natural science epistemology and hermeneutics are competing. How might the rhetoric of the sublime be used to both describe our current situation and help formulate constructive responses to it? The predictable rhythmic structure is important to most ecologically relevant sounds for humans, such as is found in the rhythm of speech or music. This study addressed the question of how rhythmic predictions are maintained in the auditory system when there are multiple perceptual interpretations occurring simultaneously and emanating from the same sound source. We recorded the electroencephalogram (EEG) while presenting participants with a tone sequence that had two different tone feature patterns, one based on the sequential rhythmic variation in (...) tone duration and the other on sequential rhythmic variation in tone intensity. Participants were presented with the same sound sequences and were instructed to listen for the intensity pattern (ignore fluctuations in duration) and press a response key to detected pattern deviants (attend intensity pattern task); to listen to the duration pattern (ignore fluctuations in intensity) and make a button press to duration pattern deviants (attend duration pattern task), and to watch a movie and ignore the sounds presented to their ears (attend visual task). Both intensity and duration patterns occurred predictably 85% of the time, thus the key question involved evaluating how the brain treated the irrelevant feature patterns (standards and deviants) while performing an auditory or visual task. We expected that task-based feature patterns would have a more robust brain response to attended standards and deviants than the unattended feature patterns. Instead, we found that the neural entrainment to the rhythm of the standard attended patterns had similar power to the standard of the unattended feature patterns. In addition, the infrequent pattern deviants elicited the event-related brain potential called the mismatch negativity component (MMN). The MMN elicited by task-based feature pattern deviants had a similar amplitude to MMNs elicited by unattended pattern deviants that were unattended because they were not the target pattern or because the participant ignored the sounds and watched a movie. Thus, these results demonstrate that the brain tracks multiple predictions about the complexities in sound streams and can automatically track and detect deviations with respect to these predictions. This capability would be useful for switching attention rapidly among multiple objects in a busy auditory scene. (shrink)

Scientists have long counseled against interpreting animal behavior in terms of human emotions, warning that such anthropomorphizing limits our ability to understand animals as they really are. Yet what are we to make of a female gorilla in a German zoo who spent days mourning the death of her baby? Or a wild female elephant who cared for a younger one after she was injured by a rambunctious teenage male? Or a rat who refused to push a lever for food (...) when he saw that doing so caused another rat to be shocked? Aren’t these clear signs that animals have recognizable emotions and moral intelligence? With _Wild Justice_ Marc Bekoff and Jessica Pierce unequivocally answer yes. Metabolic dysfunction is a ubiquitous underlying feature of many neurological conditions including acute traumatic brain injuries and chronic neurodegenerative conditions. A central problem in neurological patients, in particular those with traumatic brain injuries, is an impairment in the utilization of glucose, which is the predominant metabolic substrate in a normally functioning brain. In such patients, alternative substrates including ketone bodies and lactate become important metabolic candidates for maintaining brain function. While the potential neuroprotective benefits of ketosis have been recognized for (...) up to almost a century, the majority of work has focused on the use of ketogenic diets to induce such a state, which is inappropriate in cases of acute disease due to the prolonged periods of time (i.e., weeks to months) required for the effects of a ketogenic diet to be seen. The following review seeks to explore the neuroprotective effects of exogenous ketone and lactate preparations, which have more recently become commercially available and are able to induce a deep ketogenic response in a fraction of the time. The rapid response of exogenous preparations makes their use as a therapeutic adjunct more feasible from a clinical perspective in both acute and chronic neurological conditions. Potentially, their ability to globally moderate long-term, occult brain dysfunction may also be relevant in reducing lifetime risks of certain neurodegenerative conditions. In particular, this review explores the association between traumatic brain injury and contusion-related dementia, assessing metabolic parallels and highlighting the potential role of exogenous ketone and lactate therapies. This paper offers a qualified defence of physician non-compliance with antiabortion legislation in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. The paper examines two ethically troubling trends of post-Dobbs legislation: narrow and vague maternal health exemption clauses and mandatory reporting of miscarriages in jurisdictions where patients may criminal prosecution for medically induced abortions. It then examines and defends a professional obligation on the part of physicians to comply with the law. This obligation, however, (...) is defeasible. The paper then argues that physicians’ obligations to comply with the law is defeated when the law is illegitimate and following the law would constitute bad medical practice. In this thesis, I defend John Rawls’s assertion that political liberalism does not use the concept of truth. I respond to objections from Joshua Cohen and David Estlund. I argue that Cohen fails to show that public reason needs a minimalist conception of truth, since individuals with a range of conceptions of moral truth can meet the requirements of public reason. I dispute Estlund’s argument that the liberal principle of legitimacy is merely insular. Estlund assumes that the claim that the (...) liberal principle of legitimacy is reasonable is no different than the claim that the principle is acceptable to reasonable persons. I argue that this assumption is incorrect, and that therefore the liberal principle of legitimacy is justifiable on the grounds that it is reasonable. I argue that political liberals need not worry that doing without the concept of truth will undermine the semantic coherence or objectivity of political liberalism. (shrink)

PierceMuch modern criticism follows a long tradition by attending to the presumed effect of literature on our personal and political lives. Feminists, cultural materialists, new historicists, and postcolonialists frequently remind us that texts are "not innocent," and such analysts seek to make explicit the values and judgments that literary texts encourage in their readers. Whether in the vein of unmasking or of celebrating, we (...) critics often attribute great ethical and political significance to the works we study, but we are inclined to be vague about the mechanisms by which these effects occur. Given that I share this presumption that the texts we love to study matter to our lives, I would like to look more closely at how the process occurs, taking Milton's Paradise Regained as a test case.Does our reading of literary texts affect us ethically, and should it?1 An ancient and powerful critical tradition has taken for granted that the answer to both questions is yes. At the very least, good literature read properly is seen as one among the shaping forces of our education. But, beginning in the late eighteenth century, the theoretical movement to separate esthetics from ethics rendered this assumption problematic. Perhaps the beautiful is a value quite separate from the good. Later the literary school of estheticism brashly proclaimed the triumph of beauty over goodness under the banner of art for art's sake, [End Page 208] and Auden more modestly noted in "In Memory of W. B. Yeats" that "poetry makes nothing happen,"2 presumably including in the denial the moral betterment of its readers. The idea that literature is good for us has been almost embarrassing for the past century or so. On the other hand, many feminists and cultural critics have recently argued in effect that literature is often bad for us, that it is implicated in the ethical and political life of the time when it is produced and also in the time when it is received or consumed, so that it may tend to reinforce the ideology of one period or the other. In their assumption that literature is ethically significant they agree with most ordinary people and with the cultural right, especially in concern about its influence.What does this recent set of contentions entail? The term "implicated" that is characteristically used in such analysis claims at a minimum that the literary text in question has been shaped in production, consumption, or both by larger cultural forces, shaped in such a way as to incorporate certain values. Most such analyses go further to assert or suggest that the text under study helps to reinforce those values in the original audience or in later consumers (sometimes by attacking opposed values).3 The characteristic rhetorical stance in such readings is an implied warning to the reader against the insidious effect of the text lest it instill some fallacious, unethical, or politically harmful attitude or idea. Often the reader is rhetorically invited to share a position of intellectual superiority along with the critic, both of them above the corruption that afflicts an unspecified gullible audience. Thus many modern critics identify a romanticizing of war and the military hero in Shakespeare's Henry V, though they differ among themselves in that some locate both poison and cure in the text itself (suggesting, for example, that Shakespeare subverts the official ideology that he portrays), while some offer a "reading against the text," a cure administered by the critic against the wholly poisonous work.Such critics frequently manifest a reasonable caution about their own ethical and political stance. In an age of widespread pluralism and cultural relativism, we have learned to suspect self-confident proclamations of the ethical and political truth by critics as well as by literary authors, and in particular we are suspicious of official codes of conduct, including our own. Pierce SINCE TERMS ARE THE TOOLS of literary study, it is important to keep these tools in good condition, above all by having clear and functional meanings for them. Notoriously, many critical arguments about texts are in fact differences about terminology, and many confused arguments are built on vague or arbitrarily used terms. Few (...) have been the subject of more critical worrying and infighting than "poetry," 1 and few are more disparately defined. Definitions that are fuzzy or tendentious confuse many a discussion of poetry, and in particular they often narrow our response to the rich variety of the texts in front of us by silently imposing a view of what poetry ought to be. I would like to suggest that a Wittgensteinian approach to meaning can cut through a lot of the difficulty that surrounds the term. The refined understanding of the term "poetry" will result in a certain demystification, but it will dissipate only a false mystery based on confusion, not the real mystery of depth and richness that poetry can offer.What does it mean to approach this issue as a Wittgensteinian? The main principle is that the meaning of a term is its use, the way people deploy it in their speaking and writing, the work that it does. 2 A word does not have an essential core of meaning of which the various social uses are approximations; rather those social uses are the meaning. Thus meaning is a social phenomenon, and the way to determine it is to [End Page 151] look outward at how people use a term, not inward for some presumed mental essence that the term designates. Meaning is conventionally divided into reference and sense. What the term "poetry" refers to is a group of publicly visible things in the social world that we call poems, but there is no distillation in the mind that is the essence of poetry, the sense of the term. Of course we have a sense of the term that controls its range of reference. That sense is made up of our bases for calling one thing poetry and not another: the qualities that incline us to see a text as a poem. Wittgenstein would call these defining qualities criteria. The crucial fact is that they are determined by social processes and so are available to public inspection, not hidden away to be discovered only by introspection.Another observation about what it is to assign meaning to a term is important here. If someone asserts that "poetry" means X, he or she can appropriately be asserting that in fact the offered definition describes how people use the term, or else he or she can be suggesting how the term should or will be used in a specific discourse, that is, offering a definition proposal or stipulative definition. In the latter case the proposer needs to show the utility of the change from ordinary speech for his or her purposes. That is of course what literary critics do when they specify meanings for a term like "tragedy" or "irony" that are different from common usage. During the AIDS crisis, natural law arguments have turned up again not only in relation to anti-sodomy arguments, but even as parts of important claims about AIDS prevention made by the medical and scientific community. Such arguments were invoked by the state of Georgia in the 1986 Supreme Court case, Bowers v. Hardwick, in which the Court held that the Constitution does not confer a fundamental right upon homosexuals to engage in sodomy. As we shall see, the Court accepted a (...) version of legal moralism ignoring both the relevance of a right to privacy and two friend-of-the-Court briefs urging them to consider the public health implications of prohibiting homosexual sodomy. I want to argue against legal moralism both in its standard form and in a more sophisticated version that permits natural law arguments a place in legal reasoning. A quick tour through an average U.S. hospital gives pause to anyone with even a rudimentary concern for environmental issues. To a careful observer, the typical U.S. hospital presents an array of challenges to the health of ecosystems. For example, hospitals consume vast quantities of natural resources. The most obvious of these are fossil fuels, which form the basic building blocks of the industrialized medical care industry. Aside from the worry that our healthcare systems are technologically and functionally dependent upon (...) nonrenewable, relatively scarce, and politically volatile resources, our heavy reliance on fossil fuels has important ill effects, including unfavorable health outcomes for humans. For example, the combustion of fossil fuels is the driving force behind global warming, which will likely result in increasing heat-related mortality and morbidity and may contribute to the spread and resurgence of infectious diseases around the world. Also, the combustion of coal and oil releases pollutants such as sulfur oxides, nitrogen oxides, and ground-level ozone that contribute to various respiratory ailments. In addition to being energy intensive, the modern hospital uses a great deal of water, wood, paper, metals, minerals, plastics, chemicals, food, and land. (shrink)

The use of social media as a recruitment tool for research with humans is increasing, and likely to continue to grow. Despite this, to date there has been no specific regulatory guidance and there has been little in the bioethics literature to guide investigators and institutional review boards faced with navigating the ethical issues such use raises. We begin to fill this gap by first defending a nonexceptionalist methodology for assessing social media recruitment; second, examining respect for privacy and investigator (...) transparency as key norms governing social media recruitment; and, finally, analyzing three relatively novel aspects of social media recruitment: the ethical significance of compliance with website “terms of use”; the ethics of recruiting from the online networks of research participants; and the ethical implications of online communication from and between participants. This study examined the impact of perceived ethical culture of the firm and selected demographic variables on auditors' ethical evaluation of, and intention to engage in, various time pressure-induced dysfunctional behaviours. Four audit cases and questionnaires were distributed to experienced pre-manager level auditors in Ireland and the U. S. The findings revealed that while perceived unethical pressure to engage in dysfunctional behaviours and unethical tone at the top were significant in forming an ethical evaluation, only perceived unethical pressure had an (...) impact on intention to engage in the behaviours. Country was also found to have a significant impact, with U. S. respondents reporting higher ethical evaluations and lower intentions to engage in unethical acts than Irish respondents.
