The U.S. Food and Drug Administration's rationale for supporting the development and approval of BiDil for heart failure specifically in black patients was based on under-powered, post hoc subgroup analyses of two relatively old trials , which were further complicated by substantial covariate imbalances between racial groups. Indeed, the only statistically significant difference observed between black and white patients was found without any adjustment for potential confounders in samples that were unlikely to have been adequately randomized. Meanwhile, because the accepted (...) baseline therapy for heart failure has substantially improved since these trials took place, their results cannot be combined with data from the more recent trial amongst black patients alone. There is therefore little scientific evidence to support the approval of BiDil only for use in black patients, and the FDA's rationale fails to consider the ethical consequences of recognizing racial categories as valid markers of innate biological difference, and permitting the development of group-specific therapies that are subject to commercial incentives rather than scientific evidence or therapeutic imperatives. This paper reviews the limitations in the scientific evidence used to support the approval of BiDil only for use in black patients; calls for further analysis of the V-HeFT I and II data which might clarify whether responses to H-I vary by race; and evaluates the consequences of commercial incentives to develop racialized medicines. We recommend that the FDA revise the procedures they use to examine applications for race-based therapies to ensure that these are based on robust scientific claims and do not undermine the aims of the 1992 Revitalization Act. In the modern moral luck debate, Kant is standardly taken to be the enemy of moral luck. My goal in this paper is to show that this is mistaken. The paper is divided into six sections. In the first, I show that participants in the moral luck literature take moral luck to be anathema to Kantian ethics. In the second, I explain the kind of luck I am going to focus on here: consequence luck, a species of resultant luck. In (...) the third, I explain why philosophers have taken Kantian ethics to reject moral luck and, in particular, consequence luck. In the fourth, I explain why these philosophers are mistaken, and I set out Kant’s theoretical framework for consequence luck. This article is divided into three sections. In the first and second, I examine Sartorio’s account of the causal structure of the famous Thirsty Traveler thought experiment. I argue that this account does not withstand critical scrutiny. In the third, I turn to a novel kind of moral luck that Sartorio uses the Thirsty Traveler to expose. Meteorology is not one of the most discussed topics in Paracelsus studies, although it is closely linked to both Paracelsus’ medicine and cosmology. Furthermore, it appears to be at the very core of Paracelsus’ famous matter theory of three chymical principles, mercury, sulphur and salt, known as the tria prima. By discussing prominent examples of Paracelsus’ explanations on how the tria prima operate within the stars, this article shows how the Swiss physician conceived meteorology within his own body of knowledge, (...) obviously constructed in opposition to the Aristotelian-scholastic tradition, how he based it on a peculiar interpretation of the Biblical creation story, and made it the proper laboratory of his chymical matter theory, applying it first systematically to the field of natural philosophy, especially to celestial phenomena, even before using it for his medical theory in his later writings. In his discussion of the duty of benevolence in §27 of the Metaphysics of Morals, Kant argues that agents have no obligation to promote their own happiness, for ‘this happens unavoidably’ (MS, AA 6:451). In this paper I argue that Kant should not have said this. I argue that Kant should have conceded that agents do have an obligation to promote their own happiness.

In this paper, I argue that Kant gives a philosophically plausible derivation of the general duty of benevolence and that this derivation can be used to show how to derive other general duties of commission with the universalizability tests. The paper is divided into four sections. In the first, I explain Kant’s notion of a general duty. In the second, I introduce the universalizability tests. In the third, I examine and argue against an account in the secondary literature of how (...) to derive general duties from these tests. In the fourth, I look at Kant’s derivation of the duty of benevolence in the Metaphysics of Morals, and I suggest how this reasoning can be extended to other duties. (shrink)

The very first words of The Expanse appear on a title card: In the twenty‐third century, humans have colonized the solar system. Of course, The Expanse is a work of science fiction, (...) and its success or failure rests primarily on whether it entertains us, not whether it tells us something significant about our own world. In this chapter, I take up the question of whether one of the central principles of jus ad bellum – just cause – is relevant in a world in which cyberattacks occur. I argue that this principle is just as relevant as ever, though it needs modification in light of recent developments. In particular, I argue, contrary to many traditional just war theorists, that just cause should not be limited to physical attacks. In the process, I offer an improved definition (...) of cyberattack and show how some other principles of jus ad bellum constrain this widened notion of just cause. (shrink)

When we dismantle it brick by brick, systematically examining each piece, we find that the self, like the Death Star, lacks any substantial permanent essence, that it is bereft of the sum of self. LEGO enthusiasts recognize the MOC (My Own Creation) as a LEGO creation that monks designed and built. Destruction of a mandala, like dismantling LEGO creations, demonstrates that beauty is only meant for this world for a short time. (shrink)

Nearly one year has passed since the release of the Committee’s final report and recommendations, and it seems an appropriate time to invite discourse and reflection on the influence and impact of the Committee and (...) its efforts. Our intent is to advance understanding of the Committee and its work, its place in the evolution of bioethics and public policy, as well as the broader legacy of restoring trust in the conduct of human subjects research.In 1993, President Clinton and Secretary of Energy Hazel O’Leary initiated an investigation of America’s involvement in radiation experiments on its citizens during the Cold War. The investigation resulted in the appointment of the Committee in January 1994. Some issues raised by these radiation experiments were brought to the attention of the nation by revelations contained in a Pulitzer Prize-winning series of newspaper stories about plutonium injections carried out by the government on allegedly unsuspecting subjects during the Cold War. The Committee faced a broad mandate, which included piecing together the history of Cold War radiation experiments and human subjects research, as well as recommending remedies for past wrongs and mechanisms to ensure that such wrongs could not be repeated in the future.This issue of the Journal consists of articles and accompanying commentaries on historical, philosophical, policy, and political aspects of the Committee’s work that are important to bioethics. This collection of articles, authored by Committee members, staff, and leading scholars, is designed to paint a picture of the breadth and complexity of the Committee’s efforts and to provide context and to stimulate discussion of significant issues.In the first article, Ruth Faden provides her unique perspective as chair of the Committee. Nancy Kass and Jeremy Sugarman discuss the results of the Committee’s attempts to measure the operation and effectiveness of the current system for protection of human subjects. Paul Appelbaum comments on the relevance and value of the Committee’s empirical projects to contemporary human subjects research.The Committee’s work, and the products of any commission’s work, must be viewed partly in light of the place of commissions in bioethics scholarship and policymaking. The philosophical legacy of Antonio Gramsci, co-founder of the Italian Communist Party, represents a significant contribution to Marxist philosophy. Gramsci breathes new life into the Marxist tradition by infusing Marxism with persistent strands of Italian political thought. Not only does Gramsci turn to the Marxist philosophy of Antonio Labriola, but, furthermore, he reaches outside the Marxist tradition to such non-Marxist thinkers as Giambattista Vico, Niccolo Machiavelli, Gaetano Mosca, Giovanni Gentile, and Benedetto Croce. In particular, it is through his encounter with, (...) and reformulation of, Crocean philosophy that Gramsci lays the foundation for his own open-ended critical philosophy which challenges the universalistic pretensions of traditional interpretations of Marxism as a closed system of unalterable scientific laws and immutable truths.
