Whereas, in preindustrial society, the family was mainly a community of need held together by an obligation of solidarity, the logic of individually designed lives has come increasingly to the fore in the contemporary world. The family is becoming more of an elective relationship, an association of individuals who each brings to it their own interests, experiences and plans, and who are each subjected to different controls, risks and constraints. It is therefore necessary to devote much more effort than in (...) the past to the holding together of these different biographies. Whereas people could once fall back on rules and rituals, the prospect now is of a staging of everyday life, an acrobatics of balancing and coordinating. This does not mean that the traditional family is simply disappearing. But it is losing the monopoly it had for so long. Its quantitative significance is declining as new lifestyles appear and spread. These in all their intermediary and secondary forms represent the future of families, or what I call the contours of the `post-familial family'. (shrink)

Individualization and globalization are recent trends that bring fundamental transformations of modern society. In this Article, I will first outline what individualization and globalization imply on a general level, and how in particular they affect families. I will then argue that individualization and globalization also imply some major consequences in the field of family law: Today, norms and beliefs in respect of what is right and proper in regard to personal lives multiply and compete with one another, new family models (...) challenging older ones and opening up numerous questions regarding which model should be given priority. The effect is that the issue of rights and obligations turns into an arena of controversies, an issue of contested rights and obligations. (shrink)

In seiner Einladung zur Mitwirkung hatte der Herausgeber als Arbeitstitel für diesen Band formuliert: "Erziehungswissenschaft am Ausgang der Moderne"; von dieser Vorgabe sind meine Überlegungen an geregt worden. 2 Dahmer I Klafkis (1968) "Ausgangs' -Diagnose war fast noch druckfrisch als die Renaissance der geistes wissenschaftlichen Pädagogik einsetzte. 3 Auf die sich die Postmoderne-Debatte aber nicht reduzieren läßt. 4 Weitere Varianten sind im Kontext evolutionstheoretischer Entwürfe der Pädagogik oder im Anschluß an new-wave-philosophies entstanden, vgl. z.B. Treml 1987 sowie Huschke-Rhein 1988. Auf (...) diese Arbeiten will ich im folgenden nicht eingehen, weil dadurch eine immanente Diskussion von,System' -Denken not wendig würde, die nicht nur von erziehungswissenschaftlichen Problemen, sondern gelegentlich über haupt von Theorieproblemen wegführen würde. 5 Die Rezeptionsgeschichte bei Oelkers/Tenorth 1987 b; Seiler I Meyer 1987 können im übrigen durch den Bezug auf die Herbart-Rezeption zeigen, daß solche eigentümlich verzerrenden Formen der Aneignung von Theorie in der wissenschaftlichen Pädagogik keineswegs singulär sind. 6 Mit,Systemtheorie' sei im folgenden die Form bezeichnet, zu der sich die Systemtheorie modo Luh mann I Schorr in der Rezeption der Pädagogen gewandelt hat. Meine Bemerkungen gelten beiden Modi der Systemtheorie. 7 Ich nutze einen Begriff, mit dem Th.
