This article considers the extent to which insights from the philosophy of art can assist copyright law in identifying the author or authors of works to which many have contributed. In doing so, it looks to institutional theories of art, which go beyond a simple bifurcation of ‘author’ and ‘work’, and focus instead on broader determinants of an art work’s production, such as the ‘artworld’. It puts forward a framework focusing on three components of authorship supported by these theories: role, (...) authority and intention. The paper then draws attention to some important challenges that this framework raises for copyright law’s joint authorship doctrine in the UK and USA, and suggests some ways in which copyright law might be reformed, so as to allow copyright to retain its own benchmarks while also bringing conceptions of authorship in law and art closer together. This paper examines the relationship between corporate social responsibility and financial performance for Islamic banks in the Gulf Cooperation Council region over the period 2000–2014 by generating CSR-related data through disclosure analysis of the annual reports of the sampled banks. The findings of this study indicate that there is a significant positive relationship between CSR disclosure and the financial performance of Islamic banks in the GCC countries. The results also show a positive relationship between CSR disclosure and the future financial (...) performance of GCC Islamic banks, potentially indicating that current CSR activities carried out by Islamic banks in the GCC could have a long-term impact on their financial performance. Furthermore, despite demonstrating a significant positive relationship between the composite measure of the CSR disclosure index and financial performance, the findings show no statistically significant relationship between the individual dimensions of the CSR disclosure index and the current financial performance measure except for ‘mission and vision’ and ‘products and services’. Similarly, the empirical results detect a positive significant association only between ‘mission and vision’ dimension and future financial performance of the examined banks. (shrink)

This paper analyses the principles of stable cooperation for stochastic games. Starting from the non-cooperative version of a discounted, non zero-sum stochastic game, we build its cooperative form and find the cooperative solution. We then analyse the conditions under which this solution is stable. Principles of stability include subgame consistency, strategic stability and irrational behaviour proof of the cooperative solution. We finally discuss the existence of a stable cooperative solution, and consider a type of stochastic games for which the cooperative (...) solution is found and the principles of stable cooperation are checked. In this paper I tackle Gadamer’s and Dewey’s conceptions of art, showing a possible dialogue between American Pragmatism and Gadamerian Hermeneutics. Despite the obvious differences, it is possible to show fundamental commonalities between the two philosophies when it comes to the role of art. They share the double goal of critiquing the aestheticism of modern age, the conception of art as a mere “art for art’s sake,” and of recomposing the continuity between aesthetic experience and everyday life. I argue that (...) this common goal entails a reassessment of the relation between the work of art and the public, a reassessment that has fundamental consequences for the role of art in our societies. The present comparison will also help shed new light on Gadamer’s conception, often accused of being a merely conversative theory. For both Gadamer and Dewey art does not consist in a product of the elites that is given to the spectators: rather, the spectators cooperate with the author in the creation and development of the work of art itself. The purpose of the study is to determine the prospects for the export of Russian information technologies and cooperation in the fields of artificial intelligence and cybersecurity with the countries of the Association of Southeast Asian Nations. The article discusses the request of the ASEAN countries in the field of AI and cybersecurity, the level of development of the digital economy in this region and its impact on the prospects for Russian IT-exports; in addition, the structure and dynamics of Russian (...) IT-exports to the world market are presented. The scientific novelty lies in the reassessment of the prospects for cooperation between Russia and the ASEAN countries in the field of IT, AI and cybersecurity. As a result, the factors influencing the competitiveness of Russia in the field of IT were identified and the leading Russian IT-companies and their experience in the global market were analyzed. Based on this, a conclusion was made about the prospects for the export of Russian IT and cooperation in the field of AI and cybersecurity with the ASEAN countries. (shrink)

The Ibero-American Conference is a forum for dialogue, consultation and cooperation in which the observance of human rights is an essential principle. These rights are an area of action of the Ibero-American system. The instruments adopted by the Conference and other Ibero-American instances provide political and legal indications in the field of human rights that must be developed through initiatives, actions, programmes and agendas of cooperation. Social rights deserve special attention at the Ibero-American Summits. All this should have an influence (...) on the positions of the Inter-American Court of Human Rights, particularly when it deals with cases in which are affected economic, social and cultural rights, as it has been done in the wake of recent judgments on the matter. The work of the Ibero-American system in the fields of migration and culture will be of particular interest to the Inter-American Court in determining the content and scope of the rights recognized and protected in the inter-American system. For Aristotle, human cognition has a lot in common both with non-human animal cognition and with divine cognition. With non-human animals, humans share a non-rational part of the soul and non-rational cognitive faculties (DA 427b6–14, NE 1102b29 and EE 1219b24–6). With gods, humans share a rational part of the soul and rational cognitive faculties (NE 1177b17– 1178a8). The rational part and the non-rational part of the soul, however, coexist and cooperate only in human souls (NE 1102b26–9, EE 1219b28–31). At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

The article is devoted to educational opportunities for the formation of social capital. Social capital is manifested in the ability of people to communicate and work together. Analysis of the concept of social capital allows understanding the foundations of social interaction, the need for trust, and the relationship between the formation and distribution of the social trust, norms, and social capital itself. Social capital does not exist outside people. Social capital cannot be characterized as an attribute of a separate individual. (...) Social capital belongs to the group, the community. Learning is a situation of joint activity. In modern pedagogy, the problem is how to teach, organizing effective joint forms of educational activity. In distance learning (e-learning), it is important to organize the educational environment to have properties that make up for the lack of live communication. Today, the subjective nature of the educational process, focused on the formation of a creative personality, is being affirmed. Educational priorities are aimed at comfortable, conflict-free cooperation between the student at all levels of the educational process and the teacher, perhaps even partnership. The teacher and the student jointly develop goals, objectives, problem search field of research, working "cocreatively," a mini-team. This anthropocentric pedagogical technology relates to project and problem technologies in the educational process. (shrink)

In this case-report we describe an experience where alternative places – rather than the classroom – are exploited to implement learning processes. We maintain that this experience is a good example of materiality because it focuses on a project where students had the opportunity to re-design a public space. To this aim, various objects and tools are used to support discussions and exchanges with new stakeholders. Our theoretical vision combines Piaget’s and Vygotsky’s tradition with an innovative framework called the Trialogical (...) Learning Approach (TLA). From such theoretical background an idea of materiality emerges, that refers to material in combination with the social relationships developed around the material. Our case-report concerns a participatory project run by Rete Dialogues, a national school network focusing on global citizenship education. Our research question is: how can this project highlight the connection between the TLA and socio-materiality? Since 2017, around 200 students (age 7-16) and 20 teachers from different schools have been engaged in tackling the degradation of an important square in Rome. The project – “Dialogues in the Square” (DiS) was developed with several stakeholders that contributed to the understanding of critical issues influencing the maintenance of the square, in the perspective of planning, and possibly implementing improvements proposed by students. Crucial is the cooperation with two important urban art projects: i) the pilot-project MACRO-ASILO, run by the MACRO museum in Rome and aimed at connecting the world of art with the city life; ii) the “building sites” of the Rome Rebirth Forum, inspired by the world-known artist Michelangelo Pistoletto’s “third paradise” methodology, that encourages responsibility and action taking on sustainability through art. Drawing on data collected through direct observations and video recordings, we aim to show and make sense of the connection between the TLA and socio-materiality, highlighting three key elements: the flexible use of mediation tools, the overcoming of the dichotomy between individual and collective learning through reflection, and the re-shaping of social practices. El presente estudio muestra la opinión de estudiantes universitarios del Grado en Maestro en Educación Primaria en relación al uso de recursos audiovisuales, concretamente el vídeo, para el aprendizaje del método científico en la etapa de Educación Primaria. Se realiza un cuestionario, antes y después de la actuación y se comparan los datos a través del programa estadístico SPSS v.26. Los datos arrojan que existen diferencias significativas en cuestiones como la utilidad para los docentes, la inclusión o para trabajar la (...) educación medioambiental. Además, se produce un avance de las medias (no significativo) en las demás cuestiones planteadas. (shrink)

Ideal theory in social and political philosophy generally works to hide philosophical theories’ complicity in sustaining the structural violence and maintenance of white supremacy that are foundational to settler colonial societies. While non-ideal theory can provide a corrective to some of ideal theory’s intended omissions, it can also work to conceal the same systems of violence that ideal theory does, especially when framed primarily as a response to ideal theory. This article takes a decolonial approach to exploring the limitations of (...) non-ideal theory in its ability to respond to and redress the continuing harms done to Indigenous peoples by settler colonialism, including by outlining non-ideal theory’s relationship to a colonial politics of recognition. One way to track the many critical impacts of women of color feminisms is through the powerful structural analyses of gendered and racialized oppression they offer. This article discusses diverse lineages of women of color feminisms in the global South that tackle systemic structures of power and domination from their situated perspectives. It offers an introduction to structuralist theories in the humanities and differentiates them from women of color feminist theorizing, which begins analyses of structures from embodied and phenomenological st¬¬andpoints--with (...) the day-to-day concerns of our lives. The essay is divided into three sections. In section one, I discuss theories of structure in the humanities and sciences, differentiating them from women of color’s analysis of structure as diagnostic of the ways colonial power relations are functionalized through social structures. In section two, I discuss the diverse contexts of interpretation that background women of color feminisms, outlining key themes and ideas related to theories of structure. I argue against a unified theory of women of color structural feminisms that supplants difference, favoring a rehabilitated concept of structure for the purposes of making targeted interventions in contemporary radical anti-colonial politics. I offer the example of systematic marginalization produced by colonial violence and mythology as one reason to take up this approach. In section three, I outline four provisional characteristics of women of color structural feminisms. I conclude that, when divested from colonial myths that guide mainstream notions of structure, it can be a useful hermeneutic tactic in the fight for liberation from ongoing colonial violence. Gender-based forms of administrative violence, such as reproductive violence, are the result of systems designed to enact population-level harms through the production and forcible imposition of colonial systems of gender. Settler statecraft has long relied on the strategic promotion of sexual and reproductive violence. Patterns of reproductive violence adapt and change to align with the enduring goals and evolving needs of settler colonial occupation, dispossession, and containment. The U.S. Supreme Court’s recent decision to end the constitutional right to abortion in (...) Dobbs v Jackson is but one instance of this larger pattern. We analyze reproductive and obstetric violence and the structural trauma they produce through the lenses of i) historical continuity and ii) the global architectures of neoliberal settler capitalism in order to connect reproductive rights rollbacks in the U.S. with the expansion of reproductive violence across a world connected by colonial globalization. The subject of our article is the identification of cultural codes of Eastern European shtetl towns in the play by Grigory Gorin "Memorial Prayer", the libretto of which was written by the author based on the works of the famous Yiddish writer Sholom Aleichem. The author of the article describes the history and conditions of localization of Jewish culture in Eastern Europe and the Russian Empire, the peculiarities of its transformation, the tragic history of the Jewish theater in the first (...) third of the twentieth century. After the disappearance of the towns and the disuse of the Yiddish language, the preservation of the history of the characteristic everyday and philosophical way of life of the shtetls became the goal of museum figures, historians, writers, playwrights, and artists. In the work, using the example of Tevye the milkman, his family and environment, characteristic images of the inhabitants of small towns, their habitat, types of thinking and actions are revealed. The article uses the methods of historicism in the retrospective of the culture of Shtetl towns, the method of analysis in the identification of Shtetl archetypes, the method of synthesis in the generalization of a set of characteristic cultural codes. The main conclusions of the study are: 1. Eastern European Jewish shtetl towns are small urban-type settlements with a predominantly Jewish population, whose unique culture was determined by the Jewish faith, everyday and religious traditions, the Yiddish language, as well as the localization of residence in a small area. 2. During the period of large-scale social upheavals of the early twentieth century and the subsequent expansion beyond the boundaries of the towns, their unique culture became a mythologeme, the foundation for writers, artists, musicians, and theater figures who emerged from it. One of the milestones in the preservation of this culture was the Jewish theater GOSET, whose existence was tragically cut short in the middle of the twentieth century. 3. The play "Memorial Prayer", written by Grigory Gorin based on the works of Sholem Aleichem and staged at the Lenkom Theater by Mark Zakharov, became the quintessence of the characteristic images of the shtetl, and at the same time the revival of authentic Jewish culture. The author's special contribution is to highlight in the play the images-the archetypes of the Shtetl, which have become cultural markers, or codes of Jewish Yiddish culture. (shrink)

The chapter challenges hyperbolic claims about the centrality of appreciation of beauty to Buddhism. Within the texts, attitudes are more mixed, except for a form of 'inner beauty' - the beauty found in the expression of virtues or wisdom in forms of bodily comportment. Inner beauty is a stable presence throughout Buddhist history, practices, and art.

The medical drama and its central character, the doctor-hero have been a mainstay of popular television. House M.D. offers a new (and problematic) iteration of the doctor-hero. House eschews the generic conventions of the “television doctor” by being neither the idealized television doctor of the past, nor the more recent competent but often fallible physicians in entertainment texts. Instead, his character is a fragmented text which privileges the biomedical over the personal or emotional with the ultimate goal of scientifically uncovering (...) and resolving instances of disease. This article examines the implicit and explicit messages in House M.D. and critically analyzes both the show and its lead character in relation to the traditional medical drama genre that highlights the “doctor-hero” as the central character. While at first House seems to completely violate narrative and generic norms, ultimately the program provides a new form that reinforces the presence of the doctor-hero, but highlights House’s character as the central figure who is personally and interpersonally problematic but biomedically effective. The paper is about the connection between logic and discrimination, with special focus on Plumwood’s ideas in her groundbreaking article ‘The Politics of Reason. Towards a Feminist Logic’ (1993). Although Plumwood’s paper is not focused on the notion of discrimination, what she writes is useful for illuminating some basic mechanisms of thought that are at the basis of discriminatory practices. After an introductory section about the concepts of logic and discrimination and their possible interconnections, I present Plumwood’s ideas in 1993 (...) with a special focus on their relevance for understanding the nature of discrimination. More specifically, I use examples of discriminatory practices that make the connection between logical operations and oppression envisaged by Plumwood clear. I focus especially on two questions: Can logic produce discrimination? Can logic contribute to the fight against discrimination? If so, how? (shrink)

This paper investigates Negative Concord, arguing that it results from a systematic lexical ambiguity: the items that participate in Negative Concord ("n-words" in Laka's 1990 terminology) are ambiguous between negative polarity items and their genuinely negative counterparts. I try to show that on empirical grounds the proposed account compares favorably with other analyses that shy away from ambiguity. I furthermore suggest that the ambiguity is not implausible conceptually because it can be viewed as reflecting an intermediate stage of the Jespersen (...) Cycle. Negative Concord can be observed in many languages. The data discussed here are taken from Romance, primarily Spanish. (shrink)

Bare conditionals, I argue, exhibit Conditional Duality in that when they appear in downward entailing environments they differ from bare conditionals elsewhere in having existential rather than universal force. Two recalcitrant phenomena are shown to find a new explanation under this thesis: bare conditionals under only, and bare conditionals in the scope of negative nominal quantifiers, or what has come to be known as Higginbotham’s puzzle. I also consider how bare conditionals behave when embedded under negation, arguing that such conditionals (...) often involve denial negation. One important conclusion that emerges from the discussion is that an account of bare conditionals that validates Conditional Excluded Middle is not warranted. By limiting the scope of the strict analysis Conditional Duality is also a way of maintaining such an account. (shrink)

Anwendbare Zeichen sind Symbole: Sie werden bedeutsam, wenn sie in Zusammenhang mit anderen Zeichen gebracht werden und eine Funktion in der kognitiven oder praktischen Aneignung der Welt erfüllen. Symbole gehören zu Symbolsystemen und können als Vorschriften für symbolische, d.h. semiotische und insbesondere logische, Operationen mit Zeichen aufgefasst werden. Die Veränderung der Wittgensteinschen Auffassung des Verstehens besteht vor allem im Anerkennen der Erfahrung der Sozialisation als einer der wichtigsten (...) What is the nature of time? This new study engages with the philosophy of Henri Bergson on time and proposes a new way of thinking about the effects of future events on the past. According to Bergson, time is an integral feature of real things, just as much as their material or size. When a flower grows, it takes a period of real time for it to flourish, which cannot be quickened or slowed down, nor can it be eliminated from (...) the process of growth. Bergson named this real time 'duration' and argued that everything and everyone exist as duration, and that internal processes flow into one another, with no clear boundaries that separate one phase of duration from another. According to Bergson's philosophy, the past does not disappear but smoothly flows into the present, forming an indivisible dynamic unity. But what if the causal flow of temporal reality is not unidirectional? What if not only past events influence future ones, but future ones in their turn have retrospective effect on past occurrences? The author of this book analyses these key questions, asserts that the changeability of the past follows from Bergson's theory of time and proposes a theory of embodied time that involves the retrospective enrichment of reality. It has been a long-standing puzzle that Negative Polarity Items appear to split into two subvarieties when their effect on the interpretation of questions is taken into account: while questions with any and ever can be used as unbiased requests of information, questions with so-called `minimizers', i.e. idioms like lift a finger and the faintest idea, are always biased towards a negative answer (cf. Ladusaw 1979). Focusing on yes/no questions, this paper presents a solution to this puzzle. Specifically it is (...) shown that in virtue of containing even (cf. Heim 1984), minimizers, unlike any, trigger a presupposition, which reduces the set of the possible answers to a question to the singleton containing the negative answer. (shrink)
