Although American scholars sometimes consider European legal scholarship as old-fashioned and inward-looking and Europeans often perceive American legal scholarship as amateur social science, both traditions share a joint challenge. If legal scholarship becomes too much separated from practice, legal scholars will ultimately make themselves superfluous. If legal scholars, on the other hand, cannot explain to other disciplines what is academic about their research, which methodologies are typical, and what separates proper research from mediocre or poor research, they will probably end (...) up in a similar situation. Therefore we need a debate on what unites legal academics on both sides of the Atlantic. Should legal scholarship aspire to the status of a science and gradually adopt more and more of the methods, (quality) standards, and practices of other (social) sciences? The workshop will discuss new insights in the interaction between logic and law, and more precisely the study of different answers to the question: What role does logic play in legal reasoning? It will present both current challenges and historical perspectives in the relation between logic and law. The perspectives to be discussed involve the interface of the following studies.

This experiment compared the effects of exposure to masked phobic stimuli at a very brief stimulus-onset asynchrony on spider-phobic and non-phobic individuals. Participants were identified through a widely used questionnaire and a Behavioral Avoidance Test with a live, caged tarantula to establish baseline levels of avoidance. One week later, they were individually administered one of two continuous series of masked images: spiders or flowers. Preliminary masking experiments showed that independent samples of participants from the same populations failed to recognize these (...) stimuli. Participants in the main experiment reported ratings of subjective distress immediately before and after the exposure manipulation. Then they engaged in the BAT once again. Very brief exposure to images of spiders reduced phobic participants’ avoidance of the tarantula. No effects were evidenced on subjective distress, or on non-phobic participants. Theoretical implications for the non-conscious basis of fear are discussed. (shrink)

In this far-reaching essay, historian Michael Edward Moore examines modernity as an historical epoch following the end of the medieval period -- and as a "messianic concept of time." In the early twentieth century, a debate over the meaning and origins of modernity unfolded among the philosophers Ernst Cassirer, Hans-Georg Gadamer and Hans Blumenberg. These thinkers tried to resolve the puzzle of the fifteenth-century master Nicholas of Cusa. Was Cusanus the last great medieval thinker, his ideas a summa of (...) medieval tradition? Or was he a mysterious epochal figure, seated at one end of the bridge leading to modern thought? Nicholas of Cusa lived during a time of historical and existential crisis, or kairos, when medieval governments and cherished sources of unity were shaken. Likewise, the debate over his significance took place during a later phase of crisis for Europe, in the decades before and after the Second World War, when the collapse of European civilization was witnessed. Moore argues that modernity, so intently examined as an historical and spiritual problem, has significance for our contemporary sense of crisis. (shrink)

This Handbook contains forty essays by an international team of experts on the antecedents, the content, and the reception of the Dionysian corpus, a body of writings falsely ascribed to Dionysius the Areopagite, a convert of St Paul, but actually written about 500 AD. The first section contains discussions of the genesis of the corpus, its Christian antecedents, and its Neoplatonic influences. In the second section, studies on the Syriac reception, the relation of the Syriac to the original Greek, and (...) the editing of the Greek by John of Scythopolis are followed by contributions on the use of the corpus in such Byzantine authors as Maximus the Confessor, John of Damascus, Theodore the Studite, Niketas Stethatos, Gregory Palamas, and Gemistus Pletho. In the third section attention turns to the Western tradition, represented first by the translators John Scotus Eriugena, John Sarracenus, and Robert Grosseteste and then by such readers as the Victorines, the early Franciscans, Albert the Great, Aquinas, Bonaventure, Dante, the English mystics, Nicholas of Cusa, and Marsilio Ficino. The contributors to the final section survey the effect on Western readers of Lorenzo Valla's proof of the inauthenticity of the corpus and the subsequent exposure of its dependence on Proclus by Koch and Stiglmayr. The authors studied in this section include Erasmus, Luther and his followers, Vladimir Lossky, Hans Urs von Balthasar, and Jacques Derrida, as well as modern thinkers of the Greek Church. Ovo je uporedivo sa humanistima u Evropi koji su od 14. veka smatrali grcku i latinsku knjizevnost osnovom duhovnog i moralnog obrazovanja. Mora se postaviti pitanje, da li je u islamskoj kulturoloskoj sferi razvijan slican ideal edukacije koji je u skladu sa islamskom religijom. Opazena tenzija izmedju humanista antickog razdoblja i hriscanstva poseduje paralelu u tenzijama izmedju islamske religioznosti i racionalnog (...) islamskog svetonazora. Ipak, postoje prosli i sadasnji pristupi koji ce razvijati obrazovni ideal, koji se moze uporediti sa evropskim konceptom moralnog oblikovanja pojedinca. In the present volume, Abe’s expanded essay serves as the first part (...) of a four-part book. The second part includes responses by six Jewish, Christian, and Buddhist thinkers. The third part is Abe’s responses to questions and criticisms raised in Part Two. The fourth part consists of critiques by Hans Küng and Wolfhart Pannenberg and Abe’s separate responses to each.Part One consists of Abe’s well-known essay, “Kenotic God and Dynamic Sunyata.” There are many issues that Abe raises in this essay, of which only two—his understanding of a self-emptying God and his interpretation of the Holocaust—raise any serious concerns among his responders. Abe begins his theological reflection on the self-emptying of God by focusing on the kenosis hymn of Philippians 2:5–11. Abe raises the issue of the kenosis of Christ from a moral to ontological level, asking whether the self-emptying of Christ in either the Incarnation or the Crucifixion can be understood apart from the self-emptying “nature” of the Logos itself. And then, upping the ante, he asks whether one can speak of the kenosis of Christ without also speaking of the kenosis of the God whom Christ reveals.Abe then turns his attention to the Buddhist idea of Sunyata and proposes that Sunyata, far from being either a static or merely negative term, is dynamic and positive. This, he believes, will help to distinguish the Buddhist notion of Sunyata from Nietzschean nihilism. Abe also writes of the place of human reason, free will, the concept of evil, and time and history in Buddhism. It is in this context that he addresses the question of the Holocaust, speaking of his own responsibility not in the sense of having been directly involved, but in light of “collective karma.” At the same time, he does not want to suggest joint responsibility of the victims in the ethical dimension, but rather that such solidarity is realized in what he terms “the most fundamental religious dimension,” this dimension being identical with dynamic Sunyata. Next, Rubenstein turns to his primary concern, which is Abe’s treatment of the Holocaust. He begins by outlining various Jewish responses to the Holocaust and rejecting each of them. Like Abe, Rubenstein denies the continuity of the ethical and ultimate dimensions, and accepts ultimate reality as ultimate nothingness.Sandra B. Lubarsky also appreciates Abe’s concept of Sunyata, but for different reasons than Rubenstein. Lubarsky sees it as a healthy antidote to Jewish tendencies to absolutize the Jewish community, which has led to an idolization of the community. On the other hand, she questions the Zen assumptions that lie behind Abe’s treatment of history and justice. While there is a higher vantage point than the level of human understanding from which to understand historical events, this level is reserved for God alone and to pretend to that level is arrogant. Likewise, from a Jewish perspective, it is impossible to remove God from ethical considerations.Christian responses begin with those of Heinrich Ott, who argues that the proper locus of interreligious dialogue lies not in the discussion of doctrinal or philosophical similarities, but rather in similar psychological experiences. __Theory of Objective Mind__ is the first book of the important German social philosopher Hans Freyer to appear in English. The work of the neo-Hegelian Freyer, especially the much admired __Theory of Objective Mind__, had a notable influence on German thinkers to follow and on America's two greatest social theorists, Talcott Parsons and Edward Shils._ Freyer took what remained valid in G. F. Hegel's work and drew upon the subsequent insights of the early work of Edmund Husserl in an (...) effort to understand the nature of culture by clarifying methodologically the process of Verstehen, the relation between life and objectivated form and the formation of the historical world as described by Wilhelm Dilthey and especially Georg Simmel. _Theory of Objective Mind__ remains a thought-provoking source of insight into the nature of human cognition and action, and necessarily of culture itself. Indeed, its pressing relevance for social philosophy today is clear from its analysis of nationality as a form of objective mind. No less relevant are its valuable analyses of creativity, tradition, and revolution as philosophical problems. The COVID-19 pandemic has laid bare many of the inadequacies of our capitalist systems, as Žižek extols in Pandemic! COVID-19 Shakes the World. This essay explores how the capabilities approach, as outlined by Amartya Sen and Martha Nussbaum, may be re-examined in the light of this new viral reality by the contributions of Slavoj Žižek and Byung-Chul Han. The capability approach, as it stands, suffers from two missing pieces: that of an acknowledgement of the necessity of negativity as a foil (...) to positivity within the capabilities as articulated by Nussbaum, and the existence of the material root of all capabilities, namely the need to have the capacity to be capable. A “capability for boredom,” and a “zeroth capability” are discussed as solutions, means by which to fill these gaps. Finally, an universal basic income is discussed as a means by which to support the functioning of a “zeroth capability,” the goal being to avoid a descent into bare life during this time of pandemic capitalism. Much of the recent philosophy literature on the topic of alternative conceptual schemes responds to Donald Davidson. Davidson makes an argument by applying his system to the question, “Could others have an alternative system of concepts, an alternative conceptual scheme?” But he also remarks on the metaphor of organizing. A number of others have joined in. Why? This material may seem unimportant, but I present some reasons for why, and respond to other remarks, by P.M.S Hacker and Hans-Johann Glock.

This art inclines those who follow it to desire to know the secrets of this world. 1Although Columbus was certainly not unlearned, there is an artlessness and directness about his remark that suggest that whatever Columbus may have meant by "the secrets of the world" and the desire of navigators to know them, he was probably not speaking reconditely or mystically. 2 [End Page 593]Nor was Columbus the only early sixteenth-century practical man who spoke this way. The letters of Hernán Cortés, hardly a philosopher or a navigator, pointed out to correspondents that it was "a universal condition of man to want to know," and that he was first of all desirous of knowledge "of the secrets of these parts"; that "many new secrets" had been learned from the discoveries; of a volcano, "I wished to know the secret of this, which seemed something of a miracle." 3If practical folk could speak thus at the turn of the sixteenth century, it is not surprising that in the course of that century their rulers should appropriate the language of secrets, including the secrets of distant places, and the desire to know them and in doing so to transform their realms into information-gathering states, using detailed questionaires to assemble and organize new data just as they assembled cabinets of curiosities, libraries, zoos, observatories, and botanical gardens. This assumption, that all knowledge was subordinated to a higher purpose and fitted into a providential design, was crucial for the assimilation of the New World of America by sixteenth-century Christendom. 4Elliott's characterization of an honorific Christian intellectual curiosity represented a very small part of a very complex semantic universe that centered on the Latin term curiositas and its vernacular cognates, not all of whose meanings were neutral or honorific.
